The party is to push for a major revamp of Enterprise Ireland and other government agencies with a view to “keeping it local”. And their candidate for Dublin Mid West, Eoin Ó Broin, told Local News that his idea would be to focus such agencies on Clondalkin and what he called the “old villages” of the Dublin southside: “Here in Clondalkin, as in Crumlin and Inchicore, you have very much the same profile and therefore similar needs. Then again, in the Inner City you have yet other needs and different challenges again.” He said that the party plans to take up where the old County Enterprise Boards (now abolished) left off — but that he would push for even smaller divisions than in the old county-by-county system: “There should be, if not a one-stop shop for micro enterprise in Clondalkin alone, then a single office for Clondalkin, Bluebell, Crumlin and the ‘old village’ areas of the southside.” He would take a similar approach to challenges like housing and overcrowding in schools: “Clondalkin parents are being turned away at the school gates every day,” Cllr Ó Broin said. “That’s what I’m hearing on the doorsteps. Frank Delaney, celebrated his 100th Birthday at the Ballyfermot United Sports and Social Club lastweek. He was surrounded by friends relations and many well wishers. Frank who still lives in his homeon Claddagh Road was once described as "the Best Bricklayer in the Corporation" and "the man withthe golden trowel". Ó Broin insiststhat his party is readyto govern, and issurprised to hear thatsome senior SFpeople privatelyprefer to talk aboutthe next electoralcycle rather than thisone:

“I’m ready thistime. The thing is, it’salways difficult for anew party or groupingto take over. It’salways going to be achallenge.”

As we joke aboutthe levers of powerbeing permanently —and, as we bothsuspect, deliberately— jammed by seniorcivil servants, heinsists that they canbe unjammed. Andwhat about themedia, nationally andlocally, talking aboutEoin Ó Broin as anemerging front-benchfigure?

“Let me say, first,of all, that for any ofthat to happen, I haveto be elected first.”

That brings us tothe formidable Sinn

Féin electionmachine, in DublinMid West andelsewhere.

“We have actuallybeen canvassing sincethe local elections of2014. We would havehad several canvassesa week and we onlystopped in earlyDecember.”

He resumed in themiddle of last week(i.e., around January6), and had an hour-and-a-half done bythe time Local Newsmet him at 2:30pm inthe freezing cold carpark of Boomer’s Pubin Clondalkin’s DutchVillage.

That kind ofcanvas commitmentis admirable — andfrightening.

Don’t all thesehelpers (and the SFones are famouslynumerous and hard-working) need to berecognised? Wouldn’tthe PublicAdministrationYearbook of the Bertieera — with its pagesand pages of quangosstuffed with Aherncronies — look like aslim volumecompared to what wewill see in Sinn Féin’s

Ireland?“No, for the very

simple reason thatthese people aredoing it for the samereason I am: not forpower, but to makeIreland better, tobring in policies thatwill provide decentjobs, good schoolsand betterhealthcare.”

So there’s no SinnFéin priesthood, no

Hopeful because,with even half of the ÓBroin camp’s energy,flood courses couldbe built and theShannon drained ifnecessary; everyhairdresser wouldhave a new-and-improved website;every local butcher amarketing plan; everyClondalkin schoolextended andimproved to copewith an expandingintake.

One thing iscertain: Eoin Ó Broinhimself is too much ofa policy person tohave any interest indriving an old-style,Tammany Hall partymachine. And heseems too pragmaticto run policy ondogma — left or right— that omits theopinion of theshopkeeper or theschool-gate parent.

“A lot of what’s inthe party’s policydocuments has beensuggested by thepeople we meet, upand down theconstituency, up anddown the country.”

There’s a goodchance he’ll get in:Dublin Mid West, stilla four-seater, has areputation for beingvolatile. In 2011 ÓBroin was a scant 2percentage pointsbehind fourth-seatedDerek Keating (FG).

So should we beworried or hopeful?

Worried if theworst of the mediastereotyping of SinnFéin turn out to betrue. You’ve heard itall before: “fairy-taleeconomics;dangerous history...”Etc, etc.

Hopeful if the ÓBroin energy, and hisappetite for ideas,represent the party of2016.

Which is the truerpicture? And will theelectorate shun both,preferring theCoalition carrots of“stability” and“continuity”? Or is ittime for new facesand voices? And can ÓBroin’s brand ofpractical politicsinfluence the party?

The last seems themost obviousquestion but it is also,on reflection, themost wrong-headed.These days, peoplelike Eoin Ó Broin andPearse Doherty arethe party. They arewhat you, the elector,will see in the Dáil ifyou mark “1” besidetheir names. And ÓBroin’s particularflavour of locally-engaged economicpragmatism is onoffer to the people ofDublin Mid West.

closed shop? Iconfessed that I knewof many brilliantpolicy ideas (somepushed by thisnewspaper) cold-shouldered by FF, FGand, alas, SF:

“Send it into me,whatever it is! Wealways welcome newideas!”

Even fromoutsiders?

“Especially fromoutsiders! I workedfor Pearse Doherty foryears. Then, and morerecently, when wewere devising ourhousing policy andour jobs policy, nearlyall the people weconsulted wereoutside the party.”

As we leave him,his canvassers return,shivering, toBoomer’s car park,again raisingworrying and hopefulnotes.

Worrying becausethese people arehard-working andhard core. Will theylisten to outsiders?Will they need to be“taken care of”,Fianna Fáil–style,with jobs or at leastperks?

LEGAL ADVICEFROM JOHNSTONSOLICITORS

HAVING AN Enduring Power of Attorney is as important as having a Will.An Enduring Power of Attorney allows a person or persons known as anattorney, to manage the donors, the person creating the Enduring Powerof Attorney affairs if the donor becomes incapable of managing their af-fairs by becoming mentally incapacitated (for example, because of ill-ness, disability or a progressive degenerative illness)

The Enduring Power of Attorney only takes effect when a doctor gives amedical certificate confirming that the donor is incapable of managingtheir affairs.

The Enduring power of attorney may give general authority to the attor-ney to do anything that the attorney might lawfully do or it may merelygive authority to do specific acts on your behalf. The general power givento the Attorney gives total power over all property including Bank ac-counts and property. It is possible to include restrictions i.e. that yourhouse is not be sold. In addition the Attorney is normally authorised totake personal care decisions.

A personal care decision is one or more of the following:

• Where and with whom you should live• Whom you should see and not see• What training and rehabilitation you should get• Your diet and dress• Inspection of your personal papers• Housing, social welfare and other benefits

Creating an enduring power of attorneyAn enduring power of attorney involves the transfer of considerable pow-ers from the donor to another person. The enduring power of attorneycan only come into effect when certain procedures have been gonethrough.

The document creating the power must be in a particular format andmust include the following:

1. A statement by a doctor verifying that in their opinion the donorhad the mental capacity at the time that the document was executedto understand the effect of creating the power of attorney;

2. A statement from the donor that they understood the effect of cre-ating the power;

3. A statement from a solicitor that they are satisfied that you under-stood the effect of creating the power of attorney and you were notacting under undue influence;

One person may be appointed the Attorney, but you may have more thanone. At least two people must be notified of the making of an EPA, noneof whom can be the attorney. One of the notice parties must be yourspouse or civil partner (unless they are the attorney) if living with you. Ifthis does not apply, one of your notice parties must be your child. If nei-ther is applicable, one of the notice parties must be any relative (that isparent, sibling, grandchild, widow/widower/surviving civil partner ofchild, nephew or niece).

Persons who cannot be appointed as an attorneyAn enduring power of attorney may be granted to individuals or trustcorporations but may not be granted to the following people: There area number of restrictions and who must and can be appointed an attor-ney.

RegistrationIn order to register an EPA, the attorney or attorneys make an applicationfor registration to the Wards of Courts Office of the High Court once thereis reason to believe that the donor is or is becoming mentally incapable.The attorney must have a medical certificate confirming that the donoris incapable of managing their affairs.

Revocation of an enduring power of attorneyThe donor can revoke an EPA at any time before an application is madeto register it. Once the EPA has been registered you cannot revoke it evenif you are, for the time being, mentally capable. To revoke it, you wouldhave to apply to the court.

Termination of an enduring power of attorneyAn EPA ceases on the death of the donor. However, there are variousother circumstances in which an EPA may become terminated.

An Enduring Power of Attorney is a serious document and you must seeklegal advice before creating one.

Crowds walk their way to Operation Transformation 2016ONCE again, therewas a great turnout forthe annual OperationTransformation walkorganised by SouthDublin County SportsPartnership (SDCSP),which took place lastSaturday, January 9th,in Tymon Park.

Supporting the nurses standing upfor the safety of their patientsOVERCROWDING inhospitals around thecountry such as St.James and Tallaghthave reached emer-gency status. Cllr BridSmith who is the Peo-ple Before Profit can-didate in DublinSouth Central hasgiven her full backingto nurses who havebeen fighting the cri-sis in A&E services.

Last week nursesannounced that theyhad rejected a pack-age presented tothem by the govern-ment. They voted58% to 42% againstthe proposals sup-posedly aimed at ad-dressing theovercrowding andunder-staffing ofemergency depart-ments. They took thisdecision becausethey felt that thispackage of measureswould not be fol-lowed through by theHSE.

Seven hospitalsnationwide were tocommence strike ac-tion on Thursday 14January, includingTallaght Hospital.

For now thatstrike action has beenaverted but the issueremains one of themajor political chal-lenges for this Gov-ernment in the runup to a general elec-tion. After all FineGael did promise inthe 2011 general elec-tion that they would'end the trolley crisis'.

Cllr Bríd Smith,said:

“Cuts in thehealth service haveput the safety of pa-tients at majorrisk. Last November,the HSE set a targetthat there would beno more than 50 pa-tients waiting on trol-leys throughout thecountry. Yet last week,according to theINMO trolley watch,

nearly 500 peoplewere waiting on trol-leys”.

Overcrowding isup 4% when compar-ing November 2014and November 2015.This represents a cu-mulative increase of24% in patients ontrolleys from Novem-ber 2014 to Novem-ber 2015.

Cllr Smith contin-ued “Leo Varadkarhas said that over-crowding puts patientsafety at risk. What wecan see now is thatthe trolley crisis andovercrowding is get-ting worse not better,under the watch ofFine Gael. This gov-ernment have bailedout the bankers andleft the health systemto rot. We have paid€28.5 billion servic-ing the national debtsince 2010. Thatmoney could havebeen used to help somany people in this

state.“Last year the

HSE appointed 55new managers. Whatwe need are morenurses not more over-paid managers.Young nurses havebeen treated so dis-gracefully that manyhave fled the countryonce they graduate.Student nurses are re-quired to undertake36 weeks clinicalplacement in theirfinal year. But theyare paid below theminimum wage andthis period is notcounted for incre-mental pay. All ofthese factors havemeant that wholeclasses of undergrad-uate nurse are nowleaving to workabroad – leaving be-hind a massive re-cruitment crisis inIreland".

Cllr Smith wenton to speak about thecuts to home helphours under the cur-rent government.

“Another issuecontributing to theovercrowding is thecutting of one million

home help care hoursby this governmentsince they wereelected to office. In2010, there were 11.7million home helphours available but by2014 this haddropped to an esti-mated 10.4 millionhours. These cutsmean that elderly pa-tients are more likelyto stay in hospitalsbecause they have noguarantee of after-care treatment other-wise. A cheque for anextra €100 millionwould help reversethe cuts to home helphours.

“At the momentwe have people pay-ing three times forhealthcare throughtaxes, private insur-ance and hospitalcharges. This is outra-geous consideringour health service isbroken and not work-ing”.

Cllr Smith saidthat “People BeforeProfit believe we needa total overhaul of theHSE. We need ahealth service that isfree at the point of

use and is available topeople based on theirhealth needs and notthe size of their wal-lets. We need to investto create a high qual-ity health service andpay for it throughprogressive taxationwhere the verywealthy and the cor-porations pay theirfair share”.

She concluded bysaying “People BeforeProfit support thenurses who are con-sistently taking astand against govern-ment cuts. Thesenurses are fighting fortheir patients. We allshould stand with thenurses in Tallaght,James, Beaumontand throughout theHealth Service. Untilnurses, studentnurses and patientsare treated with therespect and recogni-tion they deserve, weshould continue tooppose the policies ofthe rotten establish-ment parties that putthe interests of corpo-rate and private profitbefore the healthneeds of the people."

Catherine Byrne TD stated“I was delighted to visit the IrishBlue Cross this week with the Minister for Agriculture,Simon Coveney, on the announcement that their grant forthis year is €180,000. This is an increase of over 150%on last year’s grant, which was €70,000.

“The Irish Blue Cross undertakes tremendous work for an-imal welfare in our community. They look after the petsowned by people who perhaps cannot afford expensivetreatments, surgeries and general pet care.

Ms Warren re-ported that soonafter the problembegan on the after-noon of Sunday Jan-uary 3, residentsbegan phoning theMaintenance Sec-tion of Dublin CityCouncil. After deny-ing responsibility forthe issue, Mainte-nance directed resi-dents to theWaterworks Division— who also deniedresponsibility.

“The kids wereback in school thatweek and a lot ofpeople could not usethe heating becauseit was hooked up tothe water pipes,” MsWarren recalled.

“There are oldfolks living here, andthe weather was re-ally bad those fewdays. After two daysof no response, a fewpeople contactedKay Noone, Head ofthe Liberties Area forDublin City Council.She came out with afew guys who justmessed around withthe pipes but hadn’ta clue what waswrong.”

NEW YEAR’S RESOLUTIONSHappy New Year! Another fresh start. A time toleave the past behind and to look forward to thefuture. A time to remember that the past is over,but the future is a blank canvas. Today, just likeany day, can be your new start, a time to makea change…if you want it to be!

This is the time of year when we hear a lotabout “New Year’s Resolutions”. Sometimes theterm is almost a joke. A failure before it starts.Did you know that gyms and evening classes gethuge enrolments at this time of year and verysoon the enthusiasm has died away? Manygyms depend on this fact to function. If every-one who joined a gym came all year aroundthere’d be no room for them!

Some people have given up already. Haveyou?

If there is a change that you want to makein your life. If there is a goal that you would liketo achieve. Then, let’s take the “New Year’s Res-olution” jinx off it!

First, instead of attaching your goal to theone calendar date of the first day, or the firstmonth of the year, let’s attach it to the positiveongoing, natural changes which are occurring,the green shoots and the days becoming longer.

That, straightaway, gives you five moremonths of active attention to achieving yourgoal. As the days get longer, our form improvesand we feel more energetic and we have moredaylight during which to do things. So, insteadof your determination and enthusiasm fadingout, let it grow and increase with the lengthen-ing days.

If you have a “New Year’s Resolution” inmind, the first thing to do is to remember that ayear is 12 months long! In order to make any-thing happen, you have to be able to see it hap-pening in your mind’s eye. So, when youvisualise it and imagine it in your mind, imag-ine it happening in Spring, Summer and Au-tumn too.

By doing this you are giving yourself a rea-sonable timescale for achieving your goal. Ifyou want to lose weight for example, it is easierto believe that you can be at your desiredweight by the Summer. This gives you more mo-tivation, as opposed to the demotivation of set-ting yourself an impossible task.

The other motivational help of this is thateverything looks better in Spring and Summerand all things take time and usually more timethan we expect. So we can reduce the pressureon ourselves and save ourselves the usual dis-appointment by aiming at an achievabletimescale with reasonable effort required, es-pecially during the final dark cold days of win-ter when our energy and mood is at its lowest.Then, we can ramp up our efforts as the dayslengthen and the weather gets better.

If I am spoiling some of your best excusesfor not achieving this year’s “New Year’s Reso-lution”….I’m not a bit sorry! If you don’t haveone yet, let me remove another excuse…. it isNEVER too late. Let this be the start of YOURnew year.

If I am making you feel a little uncomfort-able, great. You’re close, shake yourself up, lifebegins at the edge of your comfort zone!

John Humphrey Memorial Football Blitz 2015ONCE again the yearclosed with the An-nual John Humphreymemorial blitz forUnder 10 footballersorganised by StJames Gaels GAAClub in their impres-sive facilities in theIveagh Grounds.

The weather wasreasonably kind andthe football was su-perb.

On 28 and 29 De-cember the Gaels’home on the Crum-lin Road paraded anarray of under 10 tal-ents from Dublinfootball.

The Gaels organ-ised over 25 Gaelicfootball fixtures intheir annual Christ-mas event.

Under 10 foot-ballers from White-hall, Crumlin,C a s t l e k n o c k ,Coolock, Clondalkin,Templeogue, andKiltipper Roadgraced the IveaghGrounds with theirskills in Gaelic foot-ball and help prepareall of the children fora great season offootball in 2016.

DOOLAN PUSHES FOR SOCIALHOUSING NEAR BULFIN ROADNEARLY five hundred social houses, over 140 of themin Bulfin Road, may be built following a proposal fromCllr Daithí Doolan (SF, Ballyfermot–Drimnagh).

Last Monday (January 11), Dulbin City Council passedCllr Doolan’s amendment to an existing plan for 1,343homes. The scheme includes units for St Michael’s Es-tate just off Bulfin Road, Inchicore; O’Devaney Gar-dens near Smithfield; and Oscar Traynor Road inCoolock.

Following his motion, the Councillor for Ballyfermot–Drimnagh hopes that 30 per cent of the total, amount-ing to 448 homes, will be marked for social housing.About 140 of these are planned for the St Michael’sEstate site.

Some would be below-market rental units, others af-fordable homes for first-time buyers.

Cllr Doolan said that the Council were doing what theycould to make social housing a priority, despite the bestefforts of the government to “starve” the sector offunds.

The 2015 Annual Kevin Kenny Memorial Match was held in the Markievicz Park on the 28th of De-cember. A Landen United FC team competed against a Kevin Kenny Select team for the Kevin KennyMemorial Cup this year. There was a great turn out of players and supporters as there is every year.It was a great day and a great game of football refereed by Wayne Grehan. The final result was 3-1 toLanden United. The result could have gone either way had the Kevin Kenny Select team not missedtwo penalties in the game. Goals on the day were scored by Paul Mooney, Sean Finlan,  Lee Cronin (OG)and Robert Bayly with the Man of the Match awarded to Graham Griffiths. A great evening followedwith refreshments and music from the Weafer Brothers. A big thanks to all involved on the day.

17 convictions inmeter tampering cases

DURING 2015, twenty-six people appeared incourt to face charges relating to meter tam-pering. Their trials followed the conviction ofan individual who provided tampering serv-ices to electricity and gas customers in Dublinand Meath.

Seventeen of those charged were con-victed following pleas of guilty. The tamperingis alleged to have occurred in those countiesduring 2014.

Those convicted were ordered to pay theamounts due, plus fines imposed. The Energy(Miscellaneous Provisions) Act, 2012 provides

Taking prosecutions for unlawful interfer-ence served the dual purpose of managing therisk to public safety and acting as a deterrentto potential offenders.
