    So youve signed the lease onthe new place, the rst o yourown. Youre boxing up dishes anddogs-playing-poker pictures andit occurs to you upon glancingaround the room that most o theurniture in here belongs to yourroommate. Youre renting and

    not buying because, well, yourcredit history isnt quite in linewith home-ownership qualica-tions. How are you going to ur-nish the new pad? You dont havea coee can buried in the yard ora benevolent uncle to take altru-istic pity on you.

    My suggestion would be topay a visit to Roberts Furnitureand Mattress on Valley Avenuein Winchester. Teyre oeringa program known as RAC Ac-ceptance, a purchasing plan thatoers opportunities to individu-als who might not (or know theywont) qualiy or the traditional

    nancing options. Tough theAcceptance program isnt a prod-uct o our recessional times, nowis as ortuitous a time as any orsuch an option and its nice toknow that its there or consum-ers who want to rebuild or im-prove their credit while simulta-neously acquiring some nice newurniture.

    I spoke with the gentlemen atRoberts about the RAC Accep-

    tance program. Cli Wainwrightexplains that it operates like a caror house payment. A customergets the merchandise they wantand we set up a monthly paymentplan. Te really nice part is thati they make their payments ontime each month, we report it tothe credit bureaus so that theycan establish or re-establish theirgood standing. And since there

    are no up-ront credit checks(they dont even run a credit checkat the store) no one is going to beturned down. Its a good optionor, say, people just starting outin their rst house or apartment,whatever the case may be, or ora young couple beginning theirlie together, Cli points out. Sois it working here in Winchester?Absolutely, says Cli. Fromabout last Tanksgiving throughMarch o this year, we had overone hundred deals go throughthat simply wouldnt have i notor RAC Acceptance.

    be sure the customer has a resi-

    dency. Ater that, the Acceptanceprogram does require that weobtain our personal reerencesrom the customer.

    Matt says that an advantage oRAC Acceptance is the productthat the program allows a con-sumer to purchase. A customermight not have had new urniturebeore. With the Acceptance pro-gram, were oering people theopportunity to have brand-newurniture in their home as op-posed to buying used or gettingsomething that has been previ-ously rented. Its just a good eel-ing to have, knowing that youre

    the rst owner o something likethat. Also, the Acceptance pro-gram can oster loyalty rom acustomer to a store. Someonecan come in the store, Matt says,and instead o being intimi-dated or disappointed becausethey dont qualiy on a traditionalcredit system, theyll get whatthey came or and think, Tosepeople really helped me. It cre-ates repeat customers.

    The Frederick County Sheris Oce is seeking inormation reerence

    the disappearance o Daniel Eye on October 10, 1992. Mr. Eye was last

    seen at his home on Papermill Road on that date and has never been seenalive since. His vehicle was recovered on October 14, 1992 at the Luray

    Avenue Boat Landing in Front Royal, Virginia. This boat landing is on the

    Shenandoah River.

    Ater a long, agonizing win-ter and early spring the Repub-lican primary voters appear tohave nally aligned themselvesbehind embattled rontrunnerMitt Romney. Romney s victo-ries in the Maryland and D.Cprimaries uesday were expectedgiven those states demographicsand voting patterns. His victoryin Wisconsin, particularly atervictories in Michigan and Ohio,was much more hard-ought and

    severely undercut the argumentso his main rivals that he cannotwin over the base o the party.At this point in the primary pro-cess it seems Romney has in-deed won over that base, except

    in the South where he continuesto struggle. Tere is little doubtthat despite a lack o enthusiasmsouthern GOP voters will pickRomney over President Obamaevery time, making Romneys re-gional problem less problematic.

    Romney now leads in the na-tional polls, has a seeminglyinsurmountable lead in the del-egate count that ultimately de-cides the nomination, and theRepublican Establishment is nowto a large degree lining up behindRomney. Heavyweight endorse-ments have also helped Romneys

    image as the inevitable nominee.Tese endorsements are a signthat even some very conserva-tive GOP leaders are ready towrap up the primary process andturn their sights on the President.

    Meanwhile the Obama campaignis more than prepared, as theyhave quietly assumed or the pastyear that Romney would be thenominee.

    As the attention o the mediaand public shit rom the primaryto the general election, Virginiawill be ground zero or politi-cal organizing and eventually anavalanche o outside spending.Te battle between Romney andObama has already turned bit-terly negative and given the tenoro the political environment it

    is likely to only get more nega-tive. Te Presidents campaignsees Virginia as key and the OldDominion is central to several otheir paths to the 270 electoralvotes needed to win the Presiden-cy. Te President can win with-out Virginia, particularly withwins in Ohio or Florida, but i theturnout among Democrats in thebooming suburbs o NorthernVirginia is high enough the statecould remain in the Democraticcolumn.

    electoral victory in 1964, and thatObamas margin o victory was 7points. Tat margin o victorycame when Obamas popularitywas much higher and in an en-vironment where a deeply dis-

    liked Republican President madeDemocratic victories more likely

    everywhere. Whether a nowsomewhat battered Presidentcan win Virginia in this toxic andpessimistic political environmentis a difcult question to answer.Mitt Romney will surely be ready

    to spend a great deal o time andmoney to put Virginia back in the

    Republican column and he willhave many advantages in doingso.

    Just when we thought things were getting betterDid new council appointments violate state open meeting laws?

    At its committee meeting twoweeks ago, what remained o the

    Middletown own Council ater theresignation o ormer mayor MarkBrown and ormer councilors JohnBlaisdell and Gil Barrington, voted toappoint two councilors and a mayor.Six candidates applied or the twoopen council seats. Tree candidatesapplied or the mayoral position.

    In order to decide whom to ap-point, the council conducted a bal-loting process, whereby each candi-

    date was ranked by each councilor,and the person or persons with thehighest vote totals was appointed.However, at issue with a 1985 Vir-ginia Attorney Generals opinion is

    the act the paper-ballot rankingsdone in open meeting to choose thenominees to be voted on or approv-al did not include the councilorsnames attached to their votes.

    At the end o the voting, Clarencerip Chewning and Tomas Si-mon were appointed to the council,by a motion, a second, and a vote.Council then conducted the samevoting procedure to decide to ap-

    point Charles H. Harbaugh IV may-or. All three appointees then went tothe Frederick County Courthouse tobe sworn in.

    At this weeks work session, which

    ran smoothly even though there weredierences o opinions on varioustopics, ormer Councilor Barringtonquestioned whether the earlier voteto ll the council and mayoral vacan-cies was public as required by law.

    Councilor Mark Davis stated atthe meeting that it was a legal pub-lic vote, since everything was donein public, including the nal voicevotes to approve the selections. He

    also noted the ranking ballots areavailable or review. However, thereare no names on the ballots, so noone knows which ballot belongs towhich councilor. Tat is what ledBarrigan to question whether the se-lection process was technically se-cret rather than open.

    In the case o the six candidatesor the two open council seats, thecouncilors were given a ballot with

    all six names on it. Te councilorsranked each candidate, with six be-ing their top pick and one being theirlast. Ater the rst vote, the ballotswere passed to the town managerand town clerk to tabulate. Te twocandidates with the lowest voteswere dropped rom contention.

    On the second ballot, the council-ors ranked the remaining our candi-dates with our being the highest and

    You ask whether a city council vio-lated the Virginia Freedom o Inor-mation Act, 2.1-340 through 2.1-346.1 o the Code o Virginia (theAct), by voting on the member-ship o the city planning and zoning

    commission by secret ballot. Te le t-ter enclosed with your request statesthat during a June meeting o coun-cil, three persons were nominated toll two vacancies on the commission.Te councils vote, however, was bysecret ballot. Ater the vote, the clerkcounted the ballots and the winnerswere announced.

    Te Act requires that all meetingso public bodies shall be public meet-ings, unless otherwise specicallyprovided or by law. Section 2.1-343.Meetings o municipal councils arebrought expressly within the pur-view o the Act. Section 2.1-341(a).

    Prior Opinions o this Ofce haveconsistently ound that secret ballot

    voting by members o a public bodyconstitutes a violation o the openmeeting requirements o the Act.See Reports o the Attorney Gen-

    eral: 1982-1983 at 723, 82-83 Va. AG

    723; 1977-1978 at 492, 77-78 Va. AG492; 1974-1975 at 578, 74-75 Va. AG578.

    Accordingly, in accordance withthis long-standing interpretation, itis my opinion that the council violat-

    ed the Act by voting on the commis-sion membership by secret ballot.

    While the attorney generals opin-ions cited above do not carry theorce o law, they do set precedenceor the interpretation o the act. Iound to have violated the act, coun-cil may be subject to liability. Inter-estingly, the council properly moved,seconded, and voted on the appoin-tees at the meeting, so the actual ap-pointments are most likely legal.

    Other business

    Te second legal issue still hover-ing over the council is its dec ision toappoint Councilor Harbaugh mayor,

    leaving only three elected members

    on the council. Pursuant to the towncode, our elected council membersare needed to appropriate undsover $100. Te council believes it isin gray territory, because they be-lieve they can run the town as need

    be, and most items are already in thebudget. So hope or no not-in-the-budget crises between now and No-vember, because, i there is one, thetown may be stuck.

    There are more than 2,700 different types of earthworms residing on the planet. Earthworms are often known to be workhothe garden, helping to aerate and fertilize the soil while filling it with nutrients. Earthworms recycle materials like dead decaying animals and feces so new plant seedlings can grow and have the process begin anew. Worms have been around

    million years -- one of the few species of insects that have stood the test of time. In just one acre of soil, there may be a or more earthworms turning over the soil and chewing on organic matter. Without earthworms, most plants would notEarthworms have mucous covering their bodies in order to stay moist. This helps them to breathe through their skin. Yohave noticed that after it rains worms appear on sidewalks and outside of their underground burrows. This is not becausare drowning underground, but because the environment is moist after it rains, making it moreconducive for worms to band move around to find mates. Normally the dry conditions above ground make them dry out and die. Earthworms can be rable creatures to watch. Contrary to popular belief, worms do have a mouth and an opposite end for waste removal thatinterchangeable.

    Te Frederick County School Board has voted to amend the2011-12 school calendar and move the last day o the school

    year rom June 12 to June 6. Te decision comes as a result o theschool system not using all ve o the inclement weather daysthat were built into the original 2011-12 school calendar.Assistant Superintendent or Administration Al Orndorf says,

    Te Code o Virginia requires students to attend school or at

    least 180 days. Te School Board adopts a calendar each yearwhich includes 180 instructional days, plus ve additional daysto account or possible school closings due to inclement weather.Tis winter, we only used one o the ve inclement weather daysthat were built into the calendar. Tat allowed us to recommend
