FOURTH DIRECTIVE ON EMERGENCY MEASURES - EMERGENCY ORDER REGARDING ELECTRONIC PARTICIPATION AT MEETINGS TO BE IMPLEMENTED BY THE COUNTY OF VOLUSIA Effective April 3, 2020, at 5:00 Pm To reduce the spread of COVID 19, the United States Centers for Disease Control and Prevention ("CDC") and the Florida Department of Health recommended implementation of community mitigation strategies to increase containment of the virus, including cancellation of large gatherings and social distancing of at least six (6') feet between persons in smaller gatherings. Additionally, federal and state health officials expect additional cases of COVID-19 to be identified in the coming days and, based on the highly contagious nature of COVID-19, additional person- to-person transmission is likely. As a result, on April 1, 2020, Governor Desantis issued Executive Order 20-91, ordering senior citizens and individuals with a significant underlying medical condition to stay home and take all measures to limit the risk of exposure to COVID-19 and ordered all persons in Florida to limit their movements and personal interactions outside of their home to only those necessary to obtain or provide essential services or conduct essential activities. The order further provided that social gatherings in a public space are not considered essential activities. On March 20, 2020, Governor Desantis issued Executive Order 20-69, which suspended any Florida Statute that requires a quorum to be present in person or requires a local government body to meet at a specific public place, and provided that local government governing bodies may utilize communications media technology for attendance at public meetings, such as telephonic and video conferencing, as provided in Section 120.54(5)(b)(2), Florida Statutes. Executive Order 20-69 did not waive any other requirement under the Florida Constitution and Florida's Government in the Sunshine Laws, including Chapter 286, Florida Statutes. Page 1 of 2

FOURTH DIRECTIVE ON EMERGENCY MEASURES -EMERGENCY ORDER REGARDING ELECTRONIC

Therefore, as County Manager for the County of Volusia , Florida, and pursuant to the authority in

Section 256.46, Florida Statues; that certain County of Volusia Declaration of Local Emergency

for Coronavirus Disease (COVID-19), dated March 13, 2020, as subsequently extended; and all

other legal authority set forth in the Florida Constitution, the County Charter, Florida Statutes,

rules , regulations , Executive Orders, and the Volusia County Code of County Ordinances, I

HEREBY ORDER and PROMULGATE this Fourth Directive on Emergency Measures is

necessary to protect the health , welfare and safety of public, and which will be reasonably and

necessarily implemented in response to this State of Emergency:

1. Any law, ordinance, rule or other regulation that requires a quorum to be physically present in a particular location for a meeting of the County Council or any other board or committee is suspended as authorized by the Governor.

2. The County Council and other County boards and committees may utilize communications media technology, such as telephonic and video conferencing , as provided in Section 120.54(5)(b)(2), Florida Statutes in accordance with the procedures and via those technologies as directed and implemented by the County.

3. Public participation at County Council meetings and all meetings of any of its advisory boards, councils or committees which operate under the Government in the Sunshine Laws set forth in Section 286.011 , shall be by remote access only. In-person public gatherings for the purpose of public participation in any such meeting is prohibited unless authorized by the County Manager. Special arrangements will be made for interested parties in quasi-judicial hearings. Instructions on how to participate by electronic means will be posted on the County's website at https://www.volusia.org and will be provided on all published or posted meeting notices.

4. This Order does not waive any other requirement of the Florida Constitution and Florida's Government in the Sunshine Laws, including but not limited to procedural due process and right of public participation as required by law.

This Emergency Order is promulgated in conformity with the requirements of Section 120.54,

Florida Statues and shall be effective for the duration, without lapse, of the Declaration of Local

Emergency for Coronavirus Disease (COVID-19).
