1.5 Construction works? Yes Necessary civil works and foundations for equipment, fabrication, and erection of equipment for

establishment of 4 x 300 MW coal based power plant have been

completed for units 1 & 2. BOP and Common infrastructure for

Unit 3 & 4 (2X300MW) have been completed. Currently the Phase II of

the project is on hold due to the issues mentioned in the Note on Delay enclosed as Annexure – 2.

All the statutory clearances and financial closure for the project have

been obtained.

1.13 Production and manufacturing Process?

Yes The power generation facility uses the most commonly encountered Rankine based Thermodynamic Cycle. This

facility generates electricity by producing steam in a steam generator

and expanding the steam through a turbine that is coupled to a generator. The steam is then

condensed in a condenser, and the condensate is returned to the steam

generator. The steam turbine converts the thermal energy of steam to rotating mechanical energy, and

rotates the generator, which is coupled to the steam turbine. Thus the mechanical energy is converted to

electrical energy.

project, facilities for storage of the shipments are kept. The same will be

converted to permanent stores during the plant operation phase.

Sir,The undersigned is directed to refer to your letter dated 12.07.2010

along with copies of ElA I EMP and public hearing reports on the subjectmentioned above seeking environmental clearance under the provisions ofthe ElA Notification. 2006.

2. The Ministry of Environment & Forests has examined the application.It has been noted that the proposal is for setting up of 4,,300 MW CoalBased TPP at Binjkot & Darrarnura. in Kharsia Taluk, in Raigarh District. inChhattisgarh. Land requirement will be 874 acres, which comprises of 664acres agricultural land; 24.67 double crop agnculturallands; and 149 acreswasteland. No diversion of forest land is involved. The co-ordinates of thesite will be at Latitude 22001'57" N to 22000'01" N and Longitude 830 12'55"E to 830 12'03" E. Coal requirement will be 60.2 MTPA, for which coallinkage and Fatehpur Coal Block allocation has been obtained. Ash andsulphur contents in coal will be 41 % and 0.4 % respectively. Quantity of flyash to be generated will be 1.98 MTPA. Induced draft cooling system will beadopted. Water requirement of about 34.20 MCM/annum will be obtainedfrom Mahanadi River, for which allocation DC water requirement has beenobtained. The source of intake will be at 30 km from the site and water willbe conveyed through pipeline. There are no national parks, wildlifesanctuaries, heritage sites, tiger/biosphere reserves etc. within 10 km of thesite. However, the.re are several reserve forests in the study area viz. RaboR.F at 0.2 Km in the NE; Burha Pahar R.F at 4.6 Km in SW; Bargah R.F at5.5 Km in NW and P.F near Bendajhariya village at 3.8 Km SW etc. MandRiver Dows at a distance of 0.5 Km SW of the site. River Kurket flows at 3.6Km in the north. Public hearing was conducted on 17.05.2010. Cost of theproject will be Rs 5100.0 Crores.

3. The proj~ct h~s ~en considered in accordance with lhe provisionsof the ElA notification ISSUed by the Mmistry of Environment & Forestsvide 5.0. 1533 (EI, dated September 14,2006 and its amendment.

4. Based on the information submitted by you and presentation made byyou and the consultant MIs Vimta Labs, Hyderabad, the Ministry ofEnvironment and Forests hereby accords enVlTonmentaI clearance to theabove project under the provisions of EtA Notification dated September 142006, subject to the compliance of the following Specific and Generaiconditions:

A. Speciflc Conditions:

(i) Prospective plan for the site showing the future expansion shall beformulated and submitted to the Ministry within .Ix months.

(ii) Sulphur and ash contents in the fuel to be used in the project shallnot exceed 0.6 % and 34 % respectively at any given time. In case ofvariation of coal quality at any point of time fresh reference shall bemade to MOEF for suitable amendments to environmental clearancecondition wherever necessary.

(w) A stack of 275 m heIght shall be provided WIth continuous onlinemorutonng equipments for SO., NO. and Particulate Maner (PM:2.5 &PMIO). Exit velocity of Due gases shall not be less than 22 ml sec.Mercury emissions from stack may also moniwred on periodic basis.

(iv) Provision fOT insla.11ation of FOD shall be provided for future use.

(v) High Efficiency Electrostatic Precipitators (ESPs) shall be Installed toensure that particulate emission does not exceed 50 mgl Nm3.

Adequate dust extraction system such 8S cyclones/ bag filters andwater spray system 11\ dusty areas such as in coal handling and ashhandling points, transfer areas and other vulnerable dusty areas shallbe provided.

(vi) Regional Office of the Ministry of Environment & Forests shall monitorthe implementation of the stipulated conditions. A complete set ofdocuments including Environmental Impact Assessment Report andEnvironment Management Plan along with the additional informationsubmitted from time to time shall be forwarded to the Regional Officefor their use during monitoring. Project proponent will up-load thecompliance status in their website and up-date the same from time totime at least six monthly basis. Criteria pollutants levels includingNOx (from stack & ambient airl shall be displayed at the main gate ofthe power plant.

Source sustainability study of water requirement shall be carried outby an institute of repute. The study shall also specify the source ofwater for meeting the requirement during lean season. The reportshall be submitted to the Regional Olliee of the Ministry within .Ixmonths.

No ground water shall be extracted (or use in operation of the powerplant even in lean season. Hydro geological study of the area shall bereviewed annually and report submitted to the Ministry.

No water bodies including natural drainage system in the area shallbe disturbed due to activities associated with the setting up Ioperation of the power plant.

COC of 6.0 shall be adopted. The treated effiuents conforming to theprescribed standards only shall be re-circulated and reused within theplant. There shall be no discharge outside the plant boundary exceptduring monsoon. Arrangements shall be made that effluents andstorm water do not do not get mixed. A sewage treatment plant shallbe provided (as applicable) and the treated sewage shall be used forraising greenbelt/plantation.

Rainwater harvesting should be adopted. Central GroundwaterAuthorityI Board shall be consulted for fmalization of appropriaterainwater harvesting technology within a period of three monthsfrom the date of clearance and details shall be furnished.

Minimum required environmental (Jow suggested by the CompetentAuthority of the State Govt. shall be maintained in the Channel/Rivers (as applicable) even in lean season.

Additional soil for leveling of the proposed site shall be generatedwithin the sites (to the extent possible) so that natural drainagesystem of the area is protected and improved.

Ash pond shall be moved away from side facing river and a thick threetier green belt shall be developed on the westem side of the ash pond.Area of reservoir shall be restricted to 75 acres.

Utilisation of 100% Fly Ash generated shall be made from 4 th year ofoperation of the plant. Status of implementation shall be reported tothe Regional Office of the Ministry from time to time.

Fly ashshall be co.Uected in dry form and storage facility (silos) shallbe proVlded. Unutilized fly ash shall be disposed off in the ash pondin the .form of sJ.urry. ~ercury and other heavy metals (As,Hg, Cr, Pbetc.) will be monttored m the bottom ash as also in the effluents

emanating from the existing ash pond. No ash shall be disposed off inlow lying area.

(XVli) Ash pond shall be lined with HOPE/LOPE lining or any oth.. suitableimpermeable media such that no leachate takes place at any point oftime. Adequate safc'cy measures shall also be implemented to protectthe ash dyke from getting breached.

(xviii) For disposal of Bottom Ash in abandoned mines (if proposed to beundertaken) it shall be ensured that the bottom and sides of themined out areas are adequately lined with clay before Bottom Ash isfilled up. The project proponent shall inform the State PollutionControl Board wen in advance before undertaking the activity.

(xix) Green Belt consisting of 3 tiers of plantations of native species aroundplant and at least 100 m width shall be raised Wherever 100 m widthis not feasible adequate justification shall be submJtted to the Mirustryand Green belt shall be raised all around the plant comprising ofatleast 33% of total area. Tree density shall not less than 2500 per hawith survival Tate not less than 75 %.

(xx) Two nearest village shall be adopted and basic ameruUes likedevelopment of roads, drinking water supply. primary health centre,primary school etc shall be developed in co-ordmation with the districtadministration.

(xxi) The project proponent shall also adequately contribute in thedevelopment of the neighbouring villages. Special package withimplementation schedule for free potable drinking water supply in thenearby villages and schools shall be undertaken in a time boundmanner.

(xxii) An action plan for R&R (as applicable) WIth package for the projectaffected persons be submItted and implemented as per prevalent R&Rpolicy within three montha form the date of issue of this letter.

(xxiii) An amount of Rs 5.0 Crares shall be earmarked as one time capilalcost for CSR programme. Subsequently a recurring expenditure of Rs1.0 CraTes per annum shall be earmarked as recurring expenditurefor CSR activuies. Details of the aCt1vities to be undertaken shall besubmitted within onc month along Wlth road map forimplementation~

(xxiv) While identifying CSR programme the company shall conduct needbased assessment for the nearby villages to study economic measureswith action plan which can help in upliftment of poor section ofsociety. Income generating projects consistent with the traditionalskills of the people besides development of fodder farm, fruit bearing

orchards, vocational training etc. can form a part of such programme.Company shall provide separate budget for community developmentactivities and income generating programmes. This will be in additionto vocational training for individuals imparted to take up selfemployment and jobs.

It shall be ensured that in-built monitoring mechanism for theschemes identified is in place and annual social audit shall be gotdone from the nearest government institute of repute in the region.The project proponent shall also submit the status of implementationof the scheme from time to time

General Conditions:

Adequate safety measures shall be provided in the plant area tocheck/minimize spontaneous fIres in coal yard, especially duringsummer season. Copy of these measures with full details along withlocation plant layout shall be submitted to the Ministry as well as tothe Regional Office of the Ministry.

Storage facilities for auxiliary liquid fuel such as LDO and/HFO/LSHS shall be made in the plant area in consultation withDepartment of Explosives, Nagpur. Sulphur content in the liquid fuelwill not exceed 0.5%. Disaster Management Plan shall be prepared tomeet any eventuality in case of an accident taking place due to storageof oil.

Regular monitoting of ground water level shall be carried out byestablishing a network of existing wells and constructing newpiezometers. Monitoring arou nd the ash pond area shall be carriedout particularly for heavy metals (Hg,Cr,As,Pb) and recordsmaintalned and submitted to the Regional Office of this Ministry. Thedata so obtained should be compared with the baseline data so as toensure that the ground water quality is not adversely affected due tothe project.

Monitoring surface water quantity and quality shall also be regularlyconducted and records maintained. The monitored data shall besubmitted to the Ministry regularly. Further, monitoring points shallbe located between the plant and drainage in the direction of flow ofground water and records maintained. Monitoring for heavy metals inground water shall be undertaken.

First Aid and sanitation arrangements shall be made for the driversand other contract workers during construction phase.

Noise levels emanating from turbines shall be so controlled such thatthe noise in the work zone shall be limited to 75 dBA. For people

working in the high noise area, requisite personal protective

equipment like earplugs/ear muffs etc. shall be provided. Workers

engaged in noisy areas such as turbine area, air compressors etc shall

be periodically examined to maintain audiometric record and for

treatment for any hearing loss including shifting to non noisy/less

noisy areas.

(vii) Regular monitoring of ground level concentration of 802, NOx, PM25 &.

PM10 and Hg shall be carried out U1 the impact zone and records

mamwned. If at any stage these levels are found to exceed the

prescribed limits, necessary control measures shall be provided

immediately. The location of the mOnitoring stations and frequency of

monitoring shall be decided in consultation WIth SPeS. Periodic

reports shall be submitted to the Regional Office of this Ministry. The

data shall also be put on the website of the company.

(viii) Provision shall be made for the housing of construction labour (as

applicable) within the site with all necessary infrastructure and

facilities such as fuel for cooking, mobile toilets, mobile STP, safe

drinking water, medical health care, creche etc. The housing may be

in the form of temporary structures to be removed after the

completion of the project.

(ix) The project proponent shall adveruse m at least two Jocal newspapers

widely circulated in the region around the project, one of which shall

be in the vernacular language of the locality concerned WIthin seven

days from the date of this clearance letter, informing that the project

has been accorded environmental clearance and copies of clearance

letter are avaJlable with the State PoUution Control Board/COmmittee

and may also be seen at Website of the Ministry of Environment and

Forests at htto:llcnvfor.nic.in.

(x) A copy of the clearance letter shall be sent by the proponent to

concerned Panchayat, Zita Parisad / Mumcipal Corporation, urban

local Body and the Local NGO. if any, from whom

suggestions/representations, if any, received while processing the

proposal. The clearance letter shall also be put on the websitc of the

Company by the proponent.

(xi) An Environmcntal Cell shall be created at the project site itself and

shall be beaded by an officer of appropriate seniority and qualification.

It shall be ensured that the bead of the CeU shall directly report to the

bead of the organization.

(xii) The proponent shall upload the starus of compliance of the stipulated

EC conditions, including results of monitored data on their website

and shall update the same periodically. It shall simultaneously be

sent to the Regional Office of MOEF, the respective Zonal Office of

CPCB and the SPCB. The criteria pollutant levels namely; SPM. RSPM(PM:I.5 & PM10), 80:1, NOx (ambient levels as well as stack emissions)shall be displayed at a convenient location near the main gate of thecompany in the public domain.

(xiii) The environment statement for each fmancial year ending 31 fl MarchlD Form-Vas is mandated to be submitted by the project proponent tothe concerned State PoUuoon Control Board as prescribed under theEnvironment (Protectionl Rules. 1986. as amended subsequently,shall also be put on the website of the company along with the statusof compliance of environmental clearance conditions and shall also besent to the respective Regional Offices of the Mirustry by e~mail.

(xiv) The project proponent shall submit six monthly reports on the statusof the lIDplementation of the stipulated environmental safeguards tothe Ministry of Environment and Forests. its RegIonal Office. centralPollution Control Board and State Pollution Control Board. The projectproponent shall upload the status of compliance of the environment ofthe environmental clearance conditions on their website and updatethe same periodically and simultaneously send the same bye-mail tothe Regional Office, Ministry of Environment and Forests.

(xv) Separate funds shall be allocated for implementation of environmentalprotection measures along with item-wise break-up. These cost shallbe included as part of the project cost. The funds earmarked for theenvironment protection measures shall not be diverted for otherpurposes and year-wise expenditure should be reported to theMinistry.

(xvi) The project authorities shall inform the Regional Office as well as theMinistry regarding the date of fmanciaJ closure and final approval ofthe project by the concerned authorities and the dates of start of landdevelopment work and commissioning of plant.

(xvii) Full cooperation shall be extended to the Scientists/Officers from theMinistry / RegIonal Office of the Ministry at BangaJore / CPCB/ SPCBwho would be monitoring the compliance of environmental status.

S. The Ministry of Environment and Forests reserves the right to revokethe clearance if conditions stipulated are not implemented to the satisfactionof the Ministry. The Ministry may also impose additional environmentalconditions or modify the existing ones, if necessary.

6. The environmental clearance accorded sha1.1 be valid for a period of 5years to start operations by the power plant.

withdrawal of this clearance and attract acLion under the provisions ofEnvironment [Protection) Act, 1986.

8. In case of any deviation or alteration m the project proposed includingcoal transportation system from those submitted to this Ministry (orclearance, a fresh reference should be made to the Mmlstry to assess theadequacy of the condition(s) imposed and to add additional environmentalprotection measures required, if any.

9. The above stipulations would be enforced among others under theWater (Prevention and Control of Pollution) Act, 1974, the Air (Preventionand Control of Pollution) Act, 1981, the Envunnment (Protection) Act, 1986and rules there under. Hazardous Wastes (Management, Handling andTransboundary Movement) Rules, 1989 and its amendments, the PublicLiability lnsurance Act, 1991 and its amendments.

10. Any appeal agamst this environmental clearance shall lie with theNational Environment Appellate Authority, if preferred, within 30 days asprescribed under Section 11 of the National Envrronment Appellate Act.1997.

NOTE ON DELAY OF THE PROJECT

1. Brief Summary

SKS POWER GENERATION (CHATTISGARH) LTD (SPGCL) implementing the project in two Phases, Phase – I (2 x 300 MW) and Phase II (2 x 300 MW).

The Environment Clearance for the project (4X300MW) was received on 05-10-2010 and was extended further upto 04-10-2017. The Consent To Establish (CTE) for the project (4X300MW) was received on 24-01-2011 from CECB. The Consent To Operate (CTO) for Unit I (1X300MW) from CECB was received 12-06-2017 and extended upto 01-04-2018. The CTO for Unit II (1X300MW) on oil from CECB was received on 06-07-2017. All other Statutory Clearances including water, coal, railway siding, boiler certificate, power evacuation, transmission line, etc. are in place. Financial closure was achieved on 19.12.2011 for Phase I while financial closure for Phase II has lapsed. The Original Scheduled Commercial Operation Date (COD) was September 2013 for Phase I and December 2013 for Phase II respectively.

2. Reasons for delay in Implementation of the project

a) Land related issues

SPGCL requires 874 acres of land for setting up 1200 MW out of which 568 acres in already under possession. There was a delay in land acquisition by Chhattisgarh State Industrial Corporation leading to delay in project execution. About 348 acres of balance land is still under litigation pending in the Hon’ble Supreme Court for adjudication due to stay proceedings put up by local villagers.

b) Cancellation of coal block

SPGCL was allocated 73.85 MT of coal through Fatehpur coal block

along with M/s Prakash Industries on 06.02.2008. However, the coal

block was cancelled vide ruling of Hon’ble Supreme Court vide its

order dated 24th Sep’ 2014.

c) Delays in FSA LOA for 1200 MW was assigned to the Company by SECL in 2009 but

LOA was converted to FSA for 600 MW only in 2013 after a delay of 4

years. LOA for Phase II is available.

d) Poor financial condition of EPC Contractor: SPGCL’s EPC contractor Cethar Ltd. could not perform due to

financial stress leading to delay in project execution.

SPGCL was constrained to take over the control of site management

from Cethar Ltd. with effect from Jan’ 2014 to expedite the project

execution including payment to many suppliers for Cethar, which

delayed the supply contract for SPGCL. Active Site management by

SPGCL has helped in bringing back the project on track.

e) Lack of PPAs

PPA was signed between SPGCL and Govt. of Chhattisgarh (“GOCG”)

on 05.11.2011 for supply of 35% (30%+5%) power from the Project

capacity out of which, 30% aggregate capacity was to be at CERC

Tariff and 5% Net power was to be supplied at variable charges.

However, GOCG vide its letter dated 25th Sep’ 2013 has refused to

take 30% aggregate power at CERC Tariff but would like to continue

with 5% net power at variable charges.

Discoms have not come up with significant number of long term PPAs

owing to their poor financial health. Many long term bids have been

withdrawn or cancelled. For example, Telangana State’s 2000 MW

long term bid was withdrawn, UP 3800 MW bid was withdrawn, UP

6000 MW was restricted to ~2,000 MW and Rajasthan 1000 MW was

restricted to 500 MW. Thus, additional ready capacity of 15,000-

20,000 MW is lying idle for want of long term bids.

f) Financial Issues

Sithe Global (subsidiary of Blackstone), our Joint Venture investor,

had committed to invest equity of Rs. 965 Cr. for both the phases

against which, they invested Rs. 493 Cr. and stopped investment after

Dec’ 2013 leading to delay in project execution and cost overrun due

to lack of PPAs, lack of secured fuel, constraints in transmitting power

to various regions and uncertainty in Indian power sector.

SBI had underwritten entire debt requirement for both the phases for

an amount of Rs. 5,170 Cr. (Rs. 2,840 Cr. for Phase I and Rs. 2,330

Cr. for Phase II) subject to down selling of non-hold portion of debt

underwritten for Phase I, vide its sanction letter dated 11th Oct’ 2011.

Currently the underwriting for Phase II has lapsed due to inability in

down selling of non-hold portion of Phase I.

Conclusion

As mentioned above, due to various factors like delay in land acquisition,

cancellation of coal block, delay in signing FSA, lack of case-1 bids,

financial stress of the EPC contractor, investor’s exit from the project,

etc., the project has been delayed significantly.

Hence, SPGCL requests MOEF to extend the validity of Environmental

Clearance for a further period of 5 years with effect from 04-10-2017.
