Wow, can you believe summer is already here?

Today, the sun is shining, the weather is warm and

summer is in full bloom, which means for many PHCC Contractors that business is in full swing. More leads, more work, more money. I have heard from quite a few contractors that they have not been this busy at this time of the year since 2007. I hope every member is experiencing the same, but if not, keep your head up and stay positive, aggressive and embrace change.

Track your results and affect a positive attitude. Times are getting better, albeit slowly and remember our PHCC Association can help you along the road to recovery. Take full advantage of the many benefits PHCC has to offer as well as the knowledge and experience that our members are willing to share. Rocco Fana reminded everyone at a local chapter meeting that the definition of association is “a group of individuals working together for one common goal.” With that said, let us all achieve our goals.

Legislative Day in Columbus, as usual, was a big success. Over 25 members from both the PHCC and ACCA attended to express their views about Residential Licensing, Workers Compensation, the Dig Law and utility competition. I feel each year we continue to do this we get a better response and a little more of

their ear. A few of our members were invited to a luncheon by one of Ohio‘s Representatives to hear more about how the utilities are affecting our businesses. Nice job everyone.

I am proud to say the PHCC has taken an aggressive lead in the “Lead Safe Renovation, Repair and Painting Rule.” Two classes for certification were held and one of our members volunteered their facility for use. Both classes were well attended and actually sold out. A BIG thank you to Greg Faustina for putting it all together.

Don’t forget to contribute to our Media Campaign. Another news release has recently been put out and currently we are working on releasing a short video. If anyone can contribute documentation or additional information, please call Rocco Fana at our association offices. Remember, the more money we pledge to the campaign, the more we can do. I thank all who have made contributions as well.

I know many of us have Health Care Reform on our minds, as well as many other issues. Keep in mind PHCC is always here for you. Often, some of the simplest things can make a significant difference. This is true when it comes to helping the environment. If fact, every business with a fleet of vehicles can help the environment

just by performing regular vehicle maintenance, practicing sensible driving habits, and replacing vehicles at appropriate intervals to take advantage of more fuel efficient technologies.

For example, simply reexamining and changing routes could save a few gallons of gasoline every week. This can add up to a substantial savings at the end of the year when multiplied by the number of vehicles in a company’s fleet.

Paying more attention to proper vehicle maintenance also can help reduce fuel consumption. This not only means performing preventative maintenance at the recommended intervals and using the correct fluids but also maintaining your vehicles’ recommended tire pressure, checking wheel alignment and keeping the air and fuel filters clean. It also means avoiding the temptation to overload a truck, which can result in poor performance and decreased fuel efficiency along with the possibility of expensive repairs and frequent downtime.

Maintenance issues that can have a significant effect on fuel consumption include the following:

• Keep tires properly inflated. Under-inflated tires create more rolling resistance on the road, which decreases fuel mileage and shortens tire life due to accelerated wear. Since tire pressure changes with temperature, you should check and adjust pressure when the tire is cold and when the vehicle has been sitting for a couple

hours. Because information printed on the tire’s sidewall may not be the optimum pressure for your vehicle or driving situation, the most accurate place to find out about proper tire pressure is on a label inside the driver’s door or in your vehicle’s owner manual.

• Check wheel alignment periodically. Misalignment can be caused by hitting potholes, curbs and bumps, worn steering or suspension components and deterioration from aging of suspension parts. Not only does misalignment increase rolling resistance and reduce fuel efficiency, it also causes additional wear and tear on tires. Wheel alignment should be checked every 12,000 miles or once a year, whichever comes first or if you notice unusual tire wear.

• Select the right oil for your engine. Using the correct viscosity oil is important because higher viscosity oils create greater resistance to the moving parts of the engine and can actually reduce fuel efficiency. Manufacturers have, in some cases, increased the service intervals for their vehicles to help reduce their carbon footprint. This not only decreases the cost of maintaining them but reduces the amount of crude oil needed and the amount of waste oil produced. Changing your vehicles’ engine oil at the manufacturers recommended intervals is not only a good maintenance policy, but it is also good for fuel efficiency.

• Adjust driving style to save gas. Smooth, steady acceleration from a stoplight or stop sign uses fuel more efficiently than quick “jackrabbit” starts. Drivers also can increase fuel efficiency by shifting to higher gears at the lowest practical speed for standard transmission and accelerating gently with an automatic transmission. If vehicles are equipped with overdrive and/or cruise control, these should be used when appropriate. Also, making sudden starts and stops, revving the engine and excessive idling significantly lower gas mileage. And, according to a United States government Web site, www.fueleconomy.gov, “each 5 mph you drive over 60 mph is like paying an additional $0.15 per gallon for gas.”

• Remove excess weight. Using roof-mounted racks and keeping unnecessary items in your vehicle, especially heavy ones, increases rolling resistance. The U.S. government estimates that an extra 100 pounds in your vehicle can reduce your mpg by as much as 2 percent, based on the percentage of extra weight relative to the vehicle’s weight, which affects smaller vehicles more than larger ones. A good rule of thumb is, when possible, to carry large items inside the trunk or vehicle, and remove items when you don’t need to carry them.

Replacing older, less fuel efficient vehicles at appropriate intervals also can impact the environment. Knowing when to dispose of older vehicles, a systematic process known in the fleet management industry as “cycling,” depends on many factors, such as the time of year, mileage, vehicle type, age and maintenance issues. A cycling program not only ensures vehicles are always in the best possible condition, it helps a company achieve optimum performance and the best resale value, which also directly affects cost savings.

Legislation Enacted By Congress

Health Care Reform

Back in March, the House of Representatives passed the Patient Protection & Affordable Care Act. Within days, a reconciliation bill was passed by both the U.S. House and Senate amending the act. The President

promptly signed the bills into law. Federated Insurance has been closely following the health

care reform debate and its implications. The law is lengthy and extremely complex. There were many last-minute changes to the legislation. There are currently legal challenges in the courts that may further change the legislation. It will take time before we know exactly how the interaction between Federal and State regulations will affect your members and our group health clients.

We will get more comprehensive information out to you as soon as we can but expect this to take a while. You may be hearing news reports that some things take effect “immediately”. What “immediate” really means is “for plan years starting 6 months after the law’s enactment on March 23, 2010.” This means that nothing is in effect now or will be in effect prior to September 23, 2010 (6 months from enactment). In addition, the dates may change depending on the outcome of legal challenges to the law. Even if the dates do not change, the effective date of the change is tied to the beginning of the plan year for the specific employee benefit plan. Many of the more significant health reform provisions will not be effective until 2013, 2014 and even 2018!

Rest assured, we are watching all developments closely, reading all helpful material carefully to stay attuned to the impact, and planning the adjustments we may need to make to compete and be successful in the changing marketplace.

WHAT IMPACT WILL THE LEGISLATION HAVE ON FEDERATED AND OUR CLIENTS?

While the impact will be significant and far reaching for the country, the information needed to evaluate the direct impact on Federated and our clients is not available at this time. As with most legislation, this new law is “enabling legislation”. This means that the law sets out a broad outline of what Congress wants done and leaves the detail to various federal agencies. In this case, the Secretary of Health and Human Services (and other agencies) will be writing regulations over the next months and years that set forth what will actually happen. As with all things, the devil is in the details and the regulations are the details. Until those regulations are written, we have a limited ability to foresee

the impact this legislation will have. It is important, however, to recognize a few things:• The most significant changes don’t start until 2014.

Many things can, and likely will, change during that time period.

• The most far reaching impact will be in the individual insurance market. Employer markets will be impacted too, but not as dramatically.

• The role of the employer in providing health insurance for their employees will not end… it will expand and for certain size employers, will be mandated.

Federated has several advantages we believe will position us to operate in a changing insurance market:

• Our administrative expenses are low. While others will struggle, we should have little difficulty operating within the prescribed minimum loss ratio requirements. We operate efficiently today.

• Our direct, multi-line distribution system is a more expense efficient marketing approach than our competitors who utilize independent agents and brokers. Businesses value a personal relationship with someone that helps them design and implement a benefit plan and premium contribution approach that best meets their needs. We will continue to provide this valuable service to our clients.

We believe the answer is “Yes” to both questions. The much discussed “government option” or “single payor option” did not pass. While insurance may function differently in the future, it will still be provided by insurance companies. Federated is well positioned and intends to be a viable insurer in the reformed market.

Will employers be fined if they don’t provide insurance to their employees?

If the employer has fifty or more employees the answer is likely yes. If they have less than fifty employees the answer is likely no. However, we don’t know how employees will be counted, i.e., full, part-time, seasonal, etc. We have to wait for more details.

Does the law include a mandate for all Americans to have health insurance? Will people be fined if they choose not to buy it?

The short answer is yes in both cases, however, the details are sketchy at this time and this part of the law is being challenged in court. Many Americans will get access to coverage they were previously ineligible for, like Medicaid or individual health insurance. For those who resist buying coverage, they may be fined.

Will subsidies be available to employers and how will they be determined?

Yes, it appears tax credits may be available to some employers if average employee wages are below a certain limit and if the employer contributes a sufficient amount toward the premium. The IRS has recently published information on their website regarding eligibility for the credit.

What should an employer do now in response to this legislation?

While employers may understandably be anxious, many of the proposed changes will not have much impact on them for several years. For those employers who qualify for tax credits, they should consider taking advantage of that opportunity. The potential for this legislation to lower costs is uncertain, so implementing a plan design and premium contribution approach that makes employees more aware of what is driving increased health care costs makes sense.

Where can clients obtain more information about the law change?

Many media outlets are providing information, yet not all is reliable or unbiased. Be cautious who you listen to and who you believe. As the impact of this legislation becomes clearer, we will provide additional information.

How many times have you heard about a family business ending up with a son-in-law or daughter-in-law, instead of the children or grandchildren, due to a death or divorce? Unless the business is going

to be sold on death, most people need a plan to ensure that their children inherit the business and other assets and not the in-laws. Instead, most business owners tend to focus on the estate tax. With the federal estate tax exemption at $3.5 million, most business owners do not need to focus as much on taxes.

How can John Smith Plumbing Company stay in the family?Let’s say that John Smith owns a plumbing business, is

married, and has two children—a son and a daughter. The daughter works in the business and the parents want their daughter to inherit it.

What happens when Mr. Smith dies? What are the options to guarantee Mr. Smith’s wishes?

MARITAL TRUSTScenario 1

Let’s assume that Mrs. Smith works in the business. If Mrs. Smith inherits the business and remarries, she could leave the business to her new husband under her will. Even if she provides in her will that the business goes to her daughter, under Ohio law, the new husband can still demand up to one-third of the business and other assets. Or, Mrs. Smith could divorce her new husband and possibly lose a portion of the business in a settlement. Even if Mrs. Smith enters into a prenuptial agreement prior to her new marriage, that document can always be ignored by Mrs. Smith or potentially disputed by the new husband.

What should Mr. Smith have done? Mr. Smith should have used a Marital Trust. Under a marital trust, on Mr. Smith’s death, the family business goes into trust for the benefit of Mrs. Smith. However, if Mrs. Smith remarries, her new husband will have no rights to the business during life, on Mrs. Smith’s death, or even if new husband later divorces Mrs. Smith. The marital trust will then provide that, on Mrs. Smith’s death, the assets in the trust, including the family business, pass on to the children.

Scenario 2If Mrs. Smith does not work in the business, I would

usually recommend that, on Mr. Smith’s death, the business be purchased by the child in the business. Because the daughter

may not have enough money to purchase the business, she could purchase a life insurance policy on her dad’s life to fund the buyout on Mr. Smith’s death. Assume the business is worth $500,000 and a policy in that amount is purchased on Mr. Smith’s life. The daughter receives $500,000 of the insurance proceeds free of income tax (because life insurance is income tax free) and uses that money to buy the business from the estate for $500,000. The sale proceeds are received income tax free because capital gains are eliminated on death. Mrs. Smith receives the money free of tax and the daughter owns the business free and clear. The son who did not get the business could receive some or all of any remaining life insurance proceeds on Mrs. Smith’s death.

BLOODLINE TRUST™

If the daughter inherits the business directly from Mr. Smith, what happens if the daughter divorces or dies? Under Ohio law, if the daughter divorces, a portion of the business (or value of the business) could end up with the son-in-law. If the daughter dies, her estate plan probably provides that her assets go to her husband rather than her children. The business could end up being owned by the son-in-law, and the grandchildren may never inherit anything. The son-in-law could remarry and give the assets to his new wife.

On Mr. and Mrs. Smith’s deaths, with a Bloodline Trust™, the assets are inherited in a trust for the benefit of their daughter. The daughter can be the trustee of the trust. However, under the new Ohio Trust Code, the assets in the trust are protected from (i) all claims on divorce (the assets are not subject to alimony or property settlement claims) and (ii) all creditor claims except the IRS, state claims, or child support. Also, the bloodline trust will ensure that on the death of the daughter, the business or the assets in the trust go to the grandchildren, not the son-in-law.

Employers beware! The Department of Labor (DOL) is changing dramatically. Through its rule-making efforts and enhanced enforcement activities, employers face a much greater risk of being found in

violation of federal wage-hour laws. In late spring, the DOL announced an enhanced regulatory

and enforcement strategy called “Plan, Prevent, Protect.” This program will require employers to take affirmative efforts to ensure compliance with federal wage and hour laws, as well as other laws such as the Occupational Safety and Health Act. To ensure regulatory compliance, the DOL is reallocating its resources and hiring 177 new investigators to perform employer audits. In fact, in order to have more funds for regulatory enforcement, the DOL has stopped issuing opinion letters. For many years, these administrative interpretations had been provided by the DOL for the purpose of giving guidance to employers who wished to better comply with the law. But, now, employers will be left on their own to interpret the law as the DOL shifts its funds to field enforcement. DOL’s current budget is $116.5 billion.

The new Plan/Prevent/Protect Program will place new requirements on employers to create compliance action plans and to identify and remediate violations of wage-hour laws. The DOL will require your employees to have participation in the plan and the plan will have to be made available to all of the employees so that they can monitor compliance. The plan must be vigorously implemented to prevent violations and a component of prevention will be the auditing of wage-hour practices by the employer. Finally, the plan must protect employees from violations of their workplace rights. The program soon will be presented through the DOL rule-making process.

Many federal agencies are expanding their powers, broadening the obligations of employers, and creating new rights for employees through the rule-making process and the unsuspecting public is unaware of the impact to our nation’s

businesses. For example, employers already are concerned about the efforts taken by the DOL to attack the independent contractor status of various individuals doing business with employers. Reclassifying independent contractors to true employees represents a tax revenue-raising tactic for the federal government and attacks a longstanding problem of misclassification. Under the new program, an employer may be required to prepare a written explanation of why workers should be considered contractors rather than employees and provide the contractors with that explanation. Any employer that seeks to exclude workers from the Fair Labor Standards Act coverage of minimum wage and overtime would be required to perform a classification analysis, disclose that analysis to the worker and retain that analysis to give the DOL investigators a head start on any investigation.

Currently pending in Washington is the Employee Misclassification Prevention Act, as well. Sherrod Brown (D)-Ohio has introduced legislation to amend the wage-hour laws to prevent misclassification of workers as independent contractors without regard to the DOL initiative. This proposed law would require that each worker be advised of his classification as an independent contractor, direct the employee to the DOL website which addresses employee rights, provide contact information for the local DOL office and the proposed law creates a rebuttable presumption that these individuals are employees and not independent contractors if the requirements of the Act are not met. Congressional hearings have just occurred on this bill.

Other initiatives by the DOL include reversing opinions on exempt status of employees so that they now become subject to minimum wage and overtime provisions. Recently, a DOL interpretation overturned the position it had adopted for ten years with respect to mortgage loan officers, which were considered exempt from minimum wage and overtime. The DOL now claims that mortgage loan officers are production workers as opposed to administrative workers and not exempt under the white collar exemptions covering executives,

administrative and professionals. Then, on June 16, the DOL issued an opinion that the donning and doffing of protective equipment before and after the start of work is a compensable activity. In prior opinions, protective equipment worn by employees performing such things as meatpacking and poultry processing were not eligible for compensation as they put on and took off their protective equipment. Protective equipment includes such things as safety glasses, aprons, guards, sleeves, boots and gloves. This, too, is a departure from prior opinions of the DOL. These types of opinions are some of the subtle ways the laws are being changed and businesses are incurring additional expenses in their operations by such.

In Ohio, employees are protected by state laws as well as the federal laws. Seldom discussed but often used is Ohio Revised Code § 4111.14(G), which permits third parties such as claimant attorneys to gain information about the pay practices of employers. Ohio voters caused this enactment through voting for a constitutional amendment. In addition, Ohio’s Prompt Pay Act, Ohio Revised Code § 4113.15 imposes penalties on employers for failing to properly pay employees. There has been a tremendous surge in class action wage-hour litigation in the recent past and these state and federal laws have been used as effective tools for claimants.

With Washington’s current campaign to enhance employees’ rights and impose additional obligations on employers through agency rule-making and legislation, it is obvious that employers must do their very best to comply with state and federal wage-hour laws. Understand your obligations under the Fair Labor Standards Act and perform an audit as to your company’s pay practices. Remember, generally, that time and one-half must be paid for hours worked in excess of 40 in any seven consecutive calendar day period. In addition, merely paying an employee a salary does not exempt that employee from the minimum wage and overtime provisions. Also, short term rest breaks are compensable. You cannot afford to sit back and wait to be caught by the DOL because the consequences will be too severe. Employers must take affirmative efforts to ensure compliance now!

UPDATES FROM THE OHIO CONSTRUCTION INDUSTRY LICENSING BOARD (OCILB)

1. OCILB has been receiving calls lately inquiring about a new law that maintenance men cannot perform the five specialty trades, i.e., city buildings, manufacturing plants, apartment complex’s, etc.

The licensing law passed December, 2000. This is hardly a new law. The licensing law mirrors the building code. If the work being performed requires obtaining a building permit (covered under ORC 3781.06), then it requires a licensed contractor to oversee the work. Maintenance people are just that. They may perform service and maintenance. When an install and permitting are required, a licensed contractor must oversee the project. 2. OCILB received a formal opinion from the Attorney General’s Office stating that contractors paid by a 1099 are classified as independent contractors, and therefore, must be licensed.

3. Hearings were recently held for electrical contractors performing work on the Cleveland Metropolitan Housing who were compensated by a 1099 and not on the company payroll.

• Thomas Eichele, owner of the company, Eichco International, agreed to a settlement in lieu of a hearing. Mr. Eichelle agreed to pay a fine of $5,000 for paying contractors by a 1099.

• Jerry Owca held the OCILB electrical contractor license. He claimed he was employed by Eichco International, assigned his license to Eichco, and presented their liability insurance. When, in fact, he was paid by a 1099 and never an employee of Eichco. Mr. Owca was suspended for 1 ½ years for submitting fraudulent paperwork to OCILB.

• More contractors may be disciplined in the case after

the Electrical Section meets June 1, 2010.

PHCC INSTRUMENTAL IN GAINING ADDITIONAL TIME FOR MANDATORY LEAD

CERTIFICATION, TRAINING

NEW DEADLINE IS OCTOBER 1, 2010

Because of pressure from Capitol Hill and PHCC, along with industry partners, the Environmental Protection Agency is granting contractors and workers additional time to obtain necessary training and certifications to comply with the Renovation, Repair and Painting Rule.

Acknowledging the difficulties experienced in obtaining the required certification and renovation worker training by the previous deadline of April 23, 2010, the new guidelines are:

• Until Oct. 1, 2010, EPA will not take enforcement action for violations of the RRP Rules certification requirement.

• EPA will not enforce against individual renovation

workers if the person has applied to, or has enrolled in, a certified renovator class by Sept. 30, 2010. Renovators must complete the training by Dec. 31, 2010.

Welcome to summer in Ohio! The temperature is climbing, the grass is growing very fast thanks to the overabundance of rain we’ve received and the “Boys of Summer” have returned to the

diamond! As Cleveland and Cincinnati are on opposite ends of the state, so are the Indians and Reds on opposite ends of the standings! Currently, the Reds are at the top of their division while the Indians have sunk to the bottom of theirs. The Reds are a much better team than the Indians. How do we know this?

Well, a lot of things tell us this. These “things” are statistics (data). When you compare a team’s performance to previous years or to other teams, that is called performance benchmarking. In business, benchmarking is the process of comparing one company’s performance to both internal and external data. Internal comparisons include: prior year results and budgeted figures. External comparisons include: other companies, industry associations and even other industries.

There’s an old sports saying that says “to be the best, you have to beat the best.” While that has some merit in business, it’s more that “to be the best, you have to match the financial performance of the best companies.” In the breakeven and pricing seminars that I teach, I mention profit performance results for some companies within our industry as well as some that have nothing to do with our industry but are considered top performing businesses when it comes to profitability.

In the most recent year end data I could find, companies like Moen, AO Smith, Home Depot and Lowes have profit margins around 4 percent. While companies outside our industry like McDonald’s, Microsoft, Proctor & Gamble and Disney have profit margins of 20, 25, 17 and 9 percent respectively. If your profit margin is 3 percent, it might look pretty good compared to some companies in the industry but how does it stack up against companies like McDonald’s and Microsoft? Not so good huh!

Why should you consider benchmarking? It is an effective tool to see how you are progressing towards financial goals. It also helps identify areas of strength and weakness in your company. If you find a statistic that is way off from the comparisons, it gives you a starting point to investigate what the problem is and how it might be corrected. In order

for the benchmarking to be valuable to you, it must include accurate data from the participants. The participants must also be comparable to your company. While a $1 million service company can compare its’ results with a $25 million mechanical contracting company, the service company would get a much better idea of how it stacks up if its’ results were compared with other companies of similar size. In some cases, it’s even possible to benchmark on a geographic basis. For example, show the average financial data for contractors in the State of Ohio with yearly sales of $1 million or less.

What things should you be benchmarking? It can be easy to get caught up in the minutia of benchmarked data. However, some of the items I think are relevant are:- Gross profit margin- Net profit margin- Material cost %- Direct labor cost %- The basic banking ratios (current ratio, quick ratio, debt-to-

equity, etc.)- Sales per technician- Sales per truck- Company’s billable efficiency %- Average sale per call- Average hours sold per call…..just to name a few.

If you’re interested in benchmarking your financial performance, here’s an easy way to start. Get your most recently completed fiscal year financial statements as well as those from the last few years. This is a good starting point to see how you are performing compared to the last few years. Are the numbers looking better? Worse? Additionally, if you sit down and do an annual budget for the company (which should be done but often isn’t), you can compare your actual results to your budgets to see how accurate they were. If the results varied from the budget, why did they vary? What factors contributed to the variances? Were these factors things that were within or outside your control?

There are not a lot of external data options readily available to contractors to compare themselves against other businesses. There are services like Dun & Bradstreet, who compile financial statements from many companies across many industries available, but they only provide limited data comparisons (sales, cost of sales, gross profit, overhead, operating profit, etc). Some industry associations have

The Internal Revenue Service is encouraging small businesses to take advantage of tax-saving opportunities included in recently enacted federal legislation.

A variety of business tax deductions and credits were created, extended and expanded by the American Recovery and Reinvestment Act of 2009 (ARRA), this year’s Hiring Incentives to Restore Employment (HIRE) Act and the Affordable Care Act. Because some of these changes are only available this year, eligible businesses only have a few months to take action and save on their taxes. Here is a rundown of some of the key provisions.

New Health Care Tax Credit Helps Small Employers

The small business health care tax credit, created under the Affordable Care Act, is designed to encourage small employers to offer health insurance coverage for the first time or maintain coverage they already have.

The credit takes effect this year and is generally available to small employers that pay at least half the cost of single coverage for their employees in 2010. The credit is specifically targeted to help small employers that primarily employ low- and moderate-income workers.

For tax years 2010 to 2013, the maximum credit is 35 percent of premiums paid by eligible small business employers. The maximum credit goes to smaller employers –– those with 10 or fewer full-time equivalent (FTE) employees –– paying annual average wages of $25,000 or less. The credit is completely phased out for employers with more than 25 FTEs or with average wages of more than $50,000.

Because the eligibility rules are based in part on the number of FTEs, not the number of employees, businesses that use part-time help may qualify even if they employ more than

25 individuals. More information about the credit, including a step-by-step guide and answers to frequently asked questions, is available on the IRS website (www.IRS.gov).

Two New Benefits for Employers that Hire and Retain Recently Unemployed

Employers who hire unemployed workers this year (after Feb. 3, 2010, and before Jan. 1, 2011) may qualify for a 6.2-percent payroll tax incentive, in effect exempting them from the employer’s share of Social Security tax on wages paid to these workers after March 18. In addition, for each qualified employee retained for at least a year whose wages did not significantly decrease in the second half of the year, businesses may claim a new hire retention credit of up to $1,000 per worker on their income tax return.

These tax benefits are especially helpful to employers who are adding positions to their payrolls. New hires filling existing positions also qualify but only if the workers they are replacing left voluntarily or for cause. Family members and other relatives generally do not qualify.

Employers must get a signed statement from each eligible new hire, certifying under penalties of perjury, that he or she was not employed for more than 40 hours during the 60 days before beginning employment with that employer. IRS Form W-11 can be used to meet this requirement. Further details, including answers to frequently asked questions, are posted at www.IRS.gov.

The Bureau of Workers’ Compensation (BWC) Board of Directors passed a rule that requires that all employers in the July 1, 2010 Group Rating Program or Group Retrospective Rating Program, who had a claim within the two preceding calendar years are required to attend two hours of safety training between July 1, 2010 and June 30, 2011.

If your company had one or more claims during calendar years 2008 or 2009, and your company is participating in the July 1, 2010 Group Rating or Group Retrospective Rating Program, the BWC has indicated that you must meet the safety training requirement. Therefore, impacted companies must attend and document two hours of safety training to meet the requirement by June 30, 2011.

License•Your license can only be assigned to one company.

•If you do not submit your renewal form and renewal fee by your expiration date, a late fee will be applied. If you have not completed your continuing education by your renewal date, you must submit a letter to the appropriate section of the board requesting additional time.

•If your license has been expired more than one year, you must start over and apply to the appropriate section to take the test.

•Proof of liability insurance MUST be submitted with your renewal notice. DO NOT have your insurance company mail it or fax it to this office. Your liability insurance must be in the same name assigned to your license. There can be only one company name per license on your insurance. For example, it cannot read John’s Heating and Plumbing DBA Rader Heating and Plumbing. That is clearly two company names and your license will not be processed.

•Be sure to complete BOTH sides of your renewal each year and attach a copy of your liability insurance. If any part of the renewal is missing, it will be returned to you and may cause a delay in your license.

•This license is for commercial contractors in the 5 specialty trades (Electrical, HVAC, Refrigeration, Plumbing and Hydronics). H.B. 434 also allows local building departments to require this license for residential at their level.

•This is a License. It is non-transferable to someone else. You obtained this license based on your qualifications.

•You cannot use your license to pull permits for your unlicensed competitors.

•If you use your license to pull a permit, you must be the contractor in charge of the project and be readily available to speak with OCILB investigators if necessary.

•If you pay your help who perform any of the 5 specialty trades by a 1099, then they are designated as independent contractors and they must be licensed.

•Always keep us informed of an address change to make sure renewal notices and licenses are sent to the proper address. When possible, provide us with an email address. That is a quick and easy way for us to contact you if there is a problem with your license.

•Your license is processed and mailed within two days of receipt of your renewal notice. If you do not receive your license within a few days, please contact us.

•Your license number must be displayed on all advertisements, i.e., vehicle, business cards, letterhead, telephone directory ad, internet ads, newspaper ads, etc. (If your company name is not on your vehicle, then it is not an advertisement and does not have to be displayed). If you leave the company your license is assigned to, you must wait 90 days to reassign your license to another company. Or, if you obtain a letter from the previous company releasing you of the 90 days, you may reassign your license immediately.

•You may place your license in “Inactive Status” (Escrow) if you are still current and within your renewal period. You may remain in escrow indefinitely. While in escrow, you do not need to take 10 hours continuing education every year or show proof of liability insurance. However, you must pay the $60 renewal fee each year.

•To come out of escrow and be active, you must take up to 30 hours continuing education and show proof of liability insurance.

•Ohio contractors now have reciprocity with the following states. Reciprocity is only offered to those who have taken the state recognized test. If you grandfathered in, you are not eligible to reciprocate.

MEDIA CAMPAIGN - The Plumbing-Heating-Cooling Contractors Association of Ohio (PHCC) continues to face competition from Ohio gas companies as a result of a 2008 decision made by the Public Utilities Commission of Ohio (PUCO). The decision gives gas companies responsibility for consumer gas service lines typically maintained and repaired by plumbing and heating contractors. If the decision stands, small contracting firms in Ohio face continued profit and job loss. Beginning in 2010, the PHCC, along with ACCA and the Cleveland Plumbing Industry launched a media campaign in order to fight the decision and hopefully recover residential and commercial gas line work.

A few of our objectives include distributing a series of news releases to media outlets in Ohio. We also plan to regularly update public officials through quarterly newsletters. We are encouraging participation of PHCC and non-PHCC contractors through outreach to state legislators, educating them on this issue. Everyone’s support will push us closer to our goal of recovering gas line work.

Documentation is very important and we are asking contractors to share their stories or encounters with the utility companies or out-of state contractors, so we can communicate the implications to our elected officials.
