Mr. Milne presented this case stating Mr. Ryan filed a petition for a Declaratory Statement on March 23, 2020. The petition was not noticed in the Florida Administrative Register. Mr. Milne noted the petitioner asked the Board if an unlicensed contractor can operate as an owner/builder by obtaining an owner/builder permit and presenting a power of attorney to the building authority to perform the work on a pool. After discussion, the board voted to decline to answer the petition, as the petition concerned retroactive conduct, concerned the conduct of others, and because there is pending litigation regarding this matter. NEW BUSINESS Discussion took place to develop an approval process to allow for applications for certain license types to fall within the scope of Rule 61G4-15.035, Florida Administrative Code, specifically relating to NASCLA endorsement. After discussion, a motion was made and seconded to allow the Department to develop an in-house approval process for these types of applications. With no further business the meeting was adjourned at 9:59am.
