PROSECUTING ATTORNEY’S REPORT- Ian Brown Mr. Brown thanked the board, and updated the board on the number of cases for the previous month and where OGC stands currently with processing cases. With nothing further to report the board voted unanimously to approve this report. HEARINGS AND PETITIONS CHIRINOS, HENRY – REQUEST FOR INFORMAL HEARING Mr. Chirinos was present via phone. Mr. Milne presented this case stating Mr. Chirinos’ application for a Certified Plumbing Contractor’s license was denied at the March 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule

61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in April of 2020. Mr. Chirinos timely requested an informal hearing. After discussion, the board voted to vacate the denial and allow the applicant to withdraw. FERNANDEZ, FRANK – PETITION FOR DECLARATORY STATEMENT Mr. Fernandez withdrew his petition. JOHNSON, ROGER – PETITION FOR DECLARATORY STATEMENT Mr. Johnson was not present. Mr. Milne presented this case stating Mr. Johnson filed a petition for a Declaratory Statement on March 25, 2020. The petition was noticed in the Florida Administrative Register on April 1, 2020. Mr. Milne noted the petitioner asked the Board if a certified plumbing and a licensed swimming pool contractor can plumb a pool on the same contracted job site, as it pertains to statute. After discussion, the board voted to deny the petition due to the petitioner asked questions related to the scope of practice of a license. LAMONACO, JOSE RAUL – REQUEST FOR FORMAL HEARING Pulled. MCLAUGHLIN, MARY KATE – PETITION FOR VARIANCE AND WAIVER Ms. McLaughlin withdrew her petition. MILO, BIANCA – REQUEST FOR INFORMAL HEARING Ms. Milo was present via phone. Mr. Milne presented this case stating Ms. Milo’s application for a Certified Roofing Contractor’s license was denied at the March 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in April of 2020. Mr. Chirinos timely requested an informal hearing. After discussion, the board voted to uphold the previous denial.

PAYA, OSWALDO – REQUEST FOR INFORMAL HEARING Mr. Paya was present via phone. Mr. Milne presented this case stating Mr. Paya’s application to qualify H & L Glassworks, LLC, as an additional business entity was denied at the March 2020 meeting of the Board for failure to appear as required by Rule 61G4-15.0021, Florida Administrative Code, and for failure to demonstrate the qualifying agent would have the ability to supervise the construction work and business activities of the business organization, as required by section 489.119, Florida Statutes, and Rule 61G4-15.0024, Florida Administrative Code. The Notice of Intent to Deny was filed in April of 2020. Mr. Paya timely requested an informal hearing. After discussion, the board voted to uphold previous denial. PFNEISEL, RYAN – REQUEST FOR INFORMAL HEARING Mr. Pfneisel was present via phone with counsel. Mr. Milne presented this case stating Mr. Pfneisel’s application for a Certified Roofing Contractor’s license was denied at the January 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in February of 2020. Mr. Pfneisel timely requested an informal hearing. After discussion, the board voted to vacate the previous denial and to approve the application. RASSI, DENVER – REQUEST FOR INFORMAL HEARING Mr. Rassi was present. Mr. Milne presented this case stating Mr. Rassi’s application for a Certified Residential Contractor’s license was denied at the March 2020 meeting of the Board for failure to demonstrate the required experience, pursuant to section 489.111, Florida Statutes, and Rule 61G4-15.001, Florida Administrative Code. The Notice of Intent to Deny was filed in April of 2020. Mr. Rassi timely requested an informal hearing. After discussion, the board voted to vacate previous denial and approved the application. RYAN, JERALD – PETITION FOR DECLARATORY STATEMENT Mr. Ryan was present.

Mr. Milne presented this case stating Mr. Ryan filed a petition for a Declaratory Statement on March 23, 2020. The petition was not noticed in the Florida Administrative Register. Mr. Milne noted the petitioner asked the Board if an unlicensed contractor can operate as an owner/builder by obtaining an owner/builder permit and presenting a power of attorney to the building authority to perform the work on a pool. After discussion, the board voted to decline to answer the petition, as the petition concerned retroactive conduct, concerned the conduct of others, and because there is pending litigation regarding this matter. VAN HOEVEN, DAVID – REQUEST FOR INFORMAL HEARING Pulled. WALL, THOMAS – REQUEST FOR INFORMAL HEARING Mr. Wall was present. Mr. Milne presented this case stating Mr. Wall’s application for a change of status of his Certified Plumbing Contractor’s license was denied at the December 2019 meeting of the Board because the applicant, at the time the Board originally reviewed the application, was under investigation or prosecution, pursuant to section 455.213 (4), Florida Statutes. The Notice of Intent to Deny was filed in January of 2020. Mr. Walls timely requested an informal hearing. After discussion, the board voted to vacate previous denial and approve the application. NEW BUSINESS Discussion took place to develop an approval process to allow for applications for certain license types to fall within the scope of Rule 61G4-15.035, Florida Administrative Code, specifically relating to NASCLA endorsement. After discussion, a motion was made and seconded to allow the Department to develop an in-house approval process for these types of applications.
