The Minutes of the 208th Meeting of the NRC held from December 13th to 15th, 2012

The 208th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from December 13th to 15th, 2012 at NRC, NCTE, Jaipur.

The following were present:

The Regional Director, NRC apprised the Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

The respondent has stated that two trusts with same name existed. He acted as chairman of Angoori Devi Educatioal Trust in one address. In another address he acted as Secretary of Angoori Devi Educatioal Trust. This is misleading. The respondent has admitted that two different institution maps located in different village panchayat have been approved by one sarpanch. This is illegal.

The respondent has not responded to the queries made concerning trusts that processing of the society regarding its decision to open institution. This not clear which trust own Sri Krishna college of Education at Singhawali Ahir?

The audited accounts of Angoori Devi Educational Trust (Dolcha and Singhawali Ahir) for past five years as submitted to the Registrar society have not been submitted by the respondent.

Hon’ble High Court order. The matter was again carefully

considered by NRC and NRC observed that, the Hon’ble

High Court has directed the NRC to issue an appropriate

In view of the instructions of NCTE dated 21.09.2012

which is a policy decision as also the detailed legal opinion

obtained on the matter from the counsels, it was

considered appropriate to decide the matter in consonance

with the instruction of NCTE, New Delhi dated 21.09.2012

which unequivocally status that in view of Hon’ble

Supreme Court judgement rendered in NCTE Vs. Shri

Shyam Shikshak Prashikshan the recognition granted

subsequent to 31st August, 2012 must be granted from the

academic session 2013-2014.

Further it was observed by the NRC that as per sub clause

5 of clause of National Council for Teacher Education

( Recognition Norms and Procedure) Regulations, 2009

amended vide National Council for Teacher Education

(Recognition Norms and Procedure) Amendment

Regulations, 2012 provides for a cut of date off 31st August,

2012 for grant of recognition for the academic session

2012-2013. It is to be also noted that Hon’ble Supreme

Court of India in the matter of National Council for Teacher

Education Vs. Sh. Shyam Prasarak Shikshan Sanstha has

upheld the cut off dates prescribed under the NCTE

Regulations and directed the NCTE to ensure that in future

no institution is granted recognition unless it fulfils the

conditions laid down in the Act and the Regulations and

the time schedule fixed for processing the application by

the Regional Committee and communication of the

decision on the issue of recognition is strictly adhered to.

Therefore, NRC decides to maintain its previous order

dated 27.11.2012 to grant of recognition from the session

2013-2014.

226. 208.20.2 RJ-1246 TAGORE B.ED. COLLEGE, SAMBHARIYA ROAD, VILLAGE & P.O.-GONER, DISTT. JAIPUR-303905, RAJASTHAN.

B.Ed. The Northern Regional Committee in its 208th meeting held from 13th – 15th December 2012 considered the case of the Tagore B.Ed. College, Sambhariya Road, Village & P.O. Goner, Distt. Jaipur 303905, Rajasthan in accordance with the direction passed by the Hon’ble High Court in S.B. Civil Writ Petition No. 11940/2012.

The Committee after going through all relevant records, Visiting Team Report under section 17 of the NCTE Act, 1993 viz-a-viz provisions of the NCTE Act, Rules & Regulations observed that the NRC in compliance of the order of the Hon’ble High Court has already started process of restoration of recognition. In light of the inspection report of the institution dated 18.4.2012 in its 207th meeting decided to issue SCN on the following points:-

(i) Although the institution has submitted the details of the faculty but the same is not approved by the affiliating University as per the NCTE norms.

(ii) The institution has also not submitted details of salary component and salary paid to teachers as per clause 4(v)(d) of NCTE norms.

However, the reply of the institution is still awaited.

Further appropriate decision will be taken by the NRC after receiving the suitable reply/compliance of the Show Cause Notice from the institution.

In view of the above, NRC, NCTE has already started process of restoration of recognition of the institution and the same is going on. Therefore, the NRC decided that a reply be filed before the Hon’ble High Court on the above said lines mentioning that the above is in compliance of the directions of the Hon’ble High Court and the NRC by way of issuing show cause notice itself started process of grant of recognition to the institution.

The inspection of the institution was conducted under Section 17 of the NCTE Act, 1993 on 13.8.2012.

After considering the Visiting Team Report in 206th

meeting of the NRC, a Show Cause Notice was issued to the institution vide letter No. NRC/NCTE/PB-339/206th

Meeting/34223-24 dated 6.11.2012. However, a reply to the Show Cause Notice has not been received in the office till date. Further appropriate decision will be taken by the NRC after receiving the suitable reply/compliance of the Show Cause Notice form the institution.

Further the NRC noted that as per para 2 of the order of the Hon’ble High Court of Punjab and Haryana at Chandigarh in CWP NO. 6437 of 2012 dated 30.4.2012, the 4th respondent “Naib Singh was the Chairman of the Society and in an election for the General House held on 1.1.2011, he lost the post of the Chairman and a new Chairman Sh. Rimple Midha son of Shri Raj Kumar was elected, the Chairman of the Society. The Hon’ble High Court vide para 6 also directed both the NCTE and the Punjab University to inspect the petitioner-college, grant hearing to the petitioners through the new management and after such effective hearing and consideration to pass final order.

Therefore, the NRC come to the conclusion that, as of now, Shri Naib Singh the petitioner in writ contempt petition no. 3295 of 2012 has no locus standby in the governing body of the society.

Therefore, the NRC decided that a reply be filed before the Hon’ble High Court on the above said lines mentioning the following:-

(i) That the NRC in compliance of the directions of the Hon’ble High Court conducted the inspection of the institution on 13.8.2012. After considering the Visiting Team Report in 206th meeting of the NRC, a Show Cause Notice was issued to the institution vide letter No. NRC/NCTE/PB-339/206th
