This is a preliminary draft of the August 25, 2020, minutes as interpreted by the Clerk of the Board for use in preparing the official minutes. It is expected that there will be corrections, additions, and/or omissions before the final minutes are reviewed and officially approved by the County Board. ****************************************************************************************** The Board of County Commissioners of Fillmore County, Minnesota met in special session this 25th day of August, 2020, at 9:00 a.m. in the Commissioners’ Board Room, Fillmore County Courthouse, in the City of Preston. The following members were present: Commissioners Marc Prestby, Larry Hindt, Randy Dahl, Mitch Lentz and Duane Bakke. Also present were: Bobbie Hillery, Administrator/Clerk; Lori Affeldt, Finance Director; Jessica Erickson, Director of Nursing; Jessica Holst, Registered Dietician; Brett Corson, Attorney; Drew Hatzenbihler, Sanitation; Chris Hahn, Economic Development Authority; Cristal Adkins, Zoning; Blake Lea, Feedlot Officer; Bryce Bushman, Local #49 Representative; Dale Brand and Neil Woellert, Highway Maintenance Specialist; Kristina Kohn, Human Resources; Ron Gregg, Highway; Karen Reisner, Fillmore County Journal. Also present via Webex: Kristi Ruesink, Office Support Specialist, Sr.; Lisa Dierks, Extension Regional Director; Gretchen Mensink Lovejoy, Chatfield Newspaper. The Pledge of Allegiance was recited. On motion by Lentz and seconded by Hindt, the Board unanimously approved the agenda. On motion by Bakke and seconded by Dahl, the Board unanimously approved the following Consent Agenda:

1. August 11, 2020 County Board minutes 2. Successful completion of probation for Amy Hershberger, Child Support Officer, effective 8/23/2020 as

recommended by the Social Services Manager On motion by Dahl and seconded by Lentz, the Board unanimously approved the Commissioners’ Warrants. The Finance Department Warrants were reviewed. Brett Corson, County Attorney presented the 2021 proposed budget for the Attorney Department. Jessica Erickson, Director of Nursing and Jessica Holst, Registered Dietician were present. Erickson noted that Fillmore County Public Health has been presented a national award called the Loving Support Award - Gold Premiere, this award was given to only two Minnesota WIC Agencies and only twelve awards were given to WIC agencies that have provided exemplary breastfeeding promotion and support activities. The Board congratulated the Public Health Department. Fillmore County Public Health Department has received the Southern Minnesota Initiative Foundation’s Grant which provided 381 children books for their clients. Erickson updated the Board of COVID-19 response throughout Fillmore County and the schools. Lisa Dierks, UM Extension Regional Director joined the meeting via webex to present the 2021 proposed Extension budget. Drew Hatzenbihler, Solid Waste Administrator was present.

On motion by Dahl and seconded by Hindt, the following resolution was unanimously adopted: RESOLUTION 2020-042: Municipal Solid Waste market value The Citizen’s Input portion of the meeting was opened and closed at 9:35 a.m. as no one was present to speak. Chris Hahn, Economic Development Authority was present. On motion by Dahl and seconded by Lentz, the following resolution was unanimously adopted: RESOLUTION 2020-043: AcenTek Border-to-Border Grant in the amount of $75,000. On motion by Bakke and seconded by Hindt, the following resolution was unanimously adopted: RESOLUTION 2020-044: Harmony Telephone/MiBroadband Border-to-Border Grant in the amount of $75,000. Hahn presented the Economic Development Authority 2021 proposed budget for Fillmore County. The Chair recessed the meeting at 9:45 a.m. and resumed back in session at 9:50 a.m. Cristal Adkins, Zoning Administrator and Blake Lea, Feedlot Officer were present. Adkins presented the Zoning Department proposed budget for 2021. Lea presented the proposed Feedlot budget for 2021. Bryce Bushman, Local #49 Union Representative presented a proposal for negotiations, the proposal requested a 3% cost of living increase for 2021, 2022 and 2023. Discussion ensued regarding negotiations, it was consensus of the Board to offer a cost of living increase as follows: 2% for 2021, 2.25% for 2022, and 2.25% for 2023. Following discussion with the Union Representative said they would agree to 2% for 2021, 2.25% for 2022, and 2.5% for 2023. The Board agreed with this request. Contract language will be drafted and presented to both parties. Ron Gregg, Highway Engineer was present. Highway Committee report was given with an update on projects. On motion by Dahl and seconded by Bakke, the following resolution was unanimously adopted: RESOLUTION 2020-045: final payment of $53,391.14 for LOST & Wheelage Tax sealcoat. On motion by Bakke and seconded by Hindt, the following resolution was unanimously adopted: RESOLUTION 2020-046: final payment of $1,830.76 for CP 23-20-02, CSAH 16E in Preston and Amherst Townships. Kristina Kohn, Human Resources was present. On motion by Bakke and seconded by Lentz, the Board unanimously approved the second reading as the final version of the Announcements, Recruitment and Selection policy. On motion by Lentz and seconded by Bakke, the Board unanimously approved the resignation of Samuel Judd, part-time deputy, effective August 24, 2020. The Board thanked him for 6 months of service.

Administrator Hillery presented proposed budgets for 2021. It was consensus of the Board to reduce the budget to a 3% levy increase with $164,000 as unallocated funds. On motion by Bakke and seconded by Dahl, the Board unanimously approved the CARES business grant application and the launch of the program on September 1st. Hillery gave a COVID-19 update, noting that today we have 1 new case. A male in his 60’s. Fillmore County currently has 81 total cases with 76 out of isolation. Hillery updated the Board regarding Office relocations within the Courthouse. A review of the calendar was done with the following committee reports and announcements given: Prestby – nothing Dahl – nothing Lentz – law enforcement, technology Hindt – facilities, community services Bakke – DFO task force, One Watershed-One Plan, Planning & Zoning Commission On motion by Lentz and seconded by Hindt, the Board chair adjourned the meeting at 12:15 p.m.

WHEREAS; the Fillmore County Planning Commission has voted unanimously to recommend this amendment to the Fillmore County Ordinance, Section 604.03(13) of the Fillmore County Zoning Ordinance, Conditional Uses in the Ag District be adopted by the County Board of Commissioners.

NOW THEREFORE BE IT RESOLVED, that the Fillmore County Board of Commissioners hereby adopt

Section 502 SSTS Standards; and WHEREAS; the Fillmore County Planning Commission has taken testimony on this new Ordinance at a

Public Hearing held on August 20, 2020; and

WHEREAS; the Fillmore County Planning Commission has voted unanimously to recommend this amendment to the Fillmore County SSTS Ordinance, Section 502 SSTS Standards be adopted by the County Board of Commissioners.

NOW THEREFORE BE IT RESOLVED, that the Fillmore County Board of Commissioners hereby adopt

the amended Fillmore County SSTS Ordinance, Section 502 SSTS Standards as contained herein.

This type of gray water system may be installed by the homeowner if all of the following regulations are met:

a. The owner has a design developed by an individual licensed by the State of Minnesota to design

subsurface sewage treatment systems; b. A septic system permit must be obtained from the County to install the gray water system; c. The owner of the gray water system must attend an instructional class conducted by the Local Unit

of Government for proper installation, operation and maintenance of a gray water system, if the system is installed by the homeowner;

d. The landowner or his/her family members may be the person(s) digging and installing the gray water system. If there are mechanical means used for the installation of the system such as a backhoe, skid steer or any other device used for digging, this person must be an immediate family member or be an individual licensed by the State of Minnesota to do installation of subsurface sewage treatment systems, as well as licensed to use such equipment in general;

e. Toilet waste must not be discharged to a gray water system. There must be proof of use of an outdoor privy that is detached from the house or wash room or the presence of a chemical toilet. New and existing homes must have at least a ten (10’) foot section of Schedule 40 two (2”) inch PVC pipe included in the line leading to the septic tank. This line must be immediately leaving the house of a gray water system. The largest line that may be attached or added to the four (4) inch line is a Schedule 40, two (2”) inch PVC pipe may be used; and

f. The gray water system must be inspected by the LUG before, during, and prior to covering the system with soil in order for compliance inspections to be completed.

g. A gray water system may not be installed by the landowner if the system involves the use of a pump. Pressurized systems, pre-treatment systems, at-grades or mounds cannot be constructed by anyone other than a licensed installer.

Resolution Extending the Declaration of a State Of Emergency – COVID-19

WHEREAS, On March 13, 2020, Minnesota Governor Tim Walz declared a peacetime state of emergency pursuant

to the issuance of Executive Order 20-01 due to the worldwide spread of COVID-19, also referred to as the

Coronavirus; and

WHEREAS, the health and safety of Fillmore County staff and the entire community continues to be a priority for

Fillmore County. Our Fillmore County Public Health Department continues to lead the response to COVID-19 in

Fillmore County, in cooperation with state and federal officials.

WHEREAS, the Fillmore County Board of Commissioners declared Fillmore County in a STATE OF

EMERGENCY by resolution 2020-011 for continuing operations from the COVID-19, also referred to as the

Coronavirus. The Fillmore County Board of Commissioners supports the Continuity of Operations Plan for Fillmore

County (COOP) and approved the outlined operations in the “Fillmore County Emergency Declaration for COVID-

19” document. The Fillmore County Board of Commissioners supports the County Administrator and Department

Heads as they continue to work through the pandemic.

WHEREAS, the Fillmore County Board of Commissioners extended the declaration by resolution 2020-012 through

May 5, 2020, by resolution 2020-016 through May 26, 2020 by resolution 2020-023 through June 23, 2020, by

resolution 2020-027 through July 28, 2020 and by resolution 2020-035 through September 1, 2020.

WHEREAS, the Fillmore County Board has allowed public access to the facilities since June 1st, 2020 with further

safety precautions implemented such as 6 foot distancing markers, spit guards, hand sanitizing station at entrance of

buildings that are accessed by the public and regular sanitation of common areas.

WHEREAS, Fillmore County Board meetings and committee meetings may be held according to current State of

Minnesota provided COVID-19 guidelines. Each Committee meeting structure can be determined by the

Department Head and/or Commissioner of that committee with the intent to provide the option for electronic

participation.

NOW, THEREFORE, BE IT RESOLVED, that the Fillmore County Board of Commissioners declare Fillmore

County in a STATE OF EMERGENCY for continuing operations from the COVID-19, and extend this emergency

declaration through October 6, 2020.
