Jury Duty...A Privilege of Citizenship

"Oh no!" I exclaimed as I opened the summons to report for jury duty, "there goes

my summer!" So, I filled out the initial form and reported for jury duty several weeks

later. The courtroom was full of prospective jurors as the roll call was being taken. Most

of the potential jury pool was present and accounted for with the exception of a few "no

shows". 12 jurors were selected to serve on the Grand Jury. The rest of us were released

early after being informed that we would be on call for the next three months to poten-

tially serve. If anyone had a hardship or vacation plans, the court would be happy to work

with us. I was curious about the "no shows", is there a penalty for skipping out on jury

duty?

Several weeks had passed when I received the call on Tuesday to report for duty on the

following Friday. This time, the attorneys were all in place at the front of the courtroom

and their client was prepared for his case to be heard. As I glanced the back of the court-

room, there were only 13 to 14 seats taken for the potential jury pool of 24. The presid-

ing Judge Kuster entered the room with a somewhat puzzled look. After the roll call was

taken, it was confirmed that there were not enough potential jurors present to make up a

fair jury pool. Since there was barely over 50% of us present, Judge Kuster announced

that court would have to be cancelled for the day, he had not encountered this problem

before. He apologized to the court, potential jurors, and thanked us for our service.

As for the "no shows", normally, courts ignore those who don't show for jury service.

However, when the number of no-shows gets above a certain percentage, some courts will

issue contempt citations with orders to "show cause" why the person who failed to appear

should not be held in contempt. For the most part, if the jurors show up in response to the

show cause order with a good excuse, they will be let off with a lecture. If their excuse is

not particularly good, they may get a small fine. Both criminal defendants and those in

civil law suits have the right to have their case decided by ordinary folks serving on ju-

ries. If enough folks don't show up, the cases have to be rescheduled. Jury service is part

of the responsibilities that go with the privileges of citizenship. For the most part, enough

people take that responsibility serious enough that the courts need not take further action.

But every now and then, it helps to remind folks that it is an obligation to serve when

called, not an option! Let us celebrate the Fourth of July and remember our flag. It

stands for peace, honor, truth, justice & freedom. Remember this while we are enjoying

our freedoms, that freedom is not free.

Male Sensitivity

The room was full of pregnant women with their partners. The

class was in full swing. The instructor was teaching the women

how to breathe properly and was telling the men how to give the

necessary assurance to their partners at this stage of the preg-

nancy.

She said "Ladies, remember that exercise is good for you. Walking is espe-

cially beneficial. It strengthens the pelvic muscles and will make delivery

that much easier; just make several stops and stay on a soft surface like

grass or a path."

She looked at the men in the room, "and Gentlemen, remember -- You're in

this together--It wouldn't hurt you to go walking with her".

The room suddenly got very quiet as the men absorbed this information.

Then a man at the back of the room slowly raised his hand.

"Yes", answered the Instructor.

"I was just wondering if , ...if it would be all right if she carries

a golf bag while we walk?"

…..This kind of sensitivity just can't be taught.

The Licking Valley Campus of Maysville Community & Technical College will

soon be hosting Kids College for over one hundred 6-12 year olds. Kids College, a

tradition for over 20 years, will be taking place July 11th through the 15th.

This year’s students will have the opportunity to take a trip around the

world! With classes such as World of Culinary Delights and Dance Around the

Globe, students will be able to explore different cultures through cooking, dancing,

music art, and history.

Due to the overwhelming popularity of Kids College, an extra section for each

hour has been added to the schedule this year. This will help ensure space for in-

terested children. Kids College is a valued enrichment experience covering many

academic areas. The program is designed to engage kids through discovery as

they work their way through fun and challenging hands-on activities.

Kids College is always full of repeat students. Once they have attended this excit-

ing week-long experience they can’t wait to go through it again. Many students

are given their first opportunity to attend Kids College through a generous schol-

arship program sponsored by the Harrison County Board of Education. Four

students from each elementary school and the 6th grade class at the Middle School

are chosen to receive scholarships to attend Kids College. The Board of Education

has been offering this opportunity to the lucky students for nearly 20 years.

Any Child can attend Kids College. Cost is $65 per student or $50 per student for

households with 2 or more attending. Please contact Lisa Harmon at 234-8626

extension 66403 to register your child.

NCAA wants UK to apologize, for what?

The NCAA has demanded the University of Kentucky publicly apologize

for commemorating the 500th career win of Coach John Calipari last season.

In their opinion the celebration was a complete lie. Former Calipari coached teams,

U Mass and Memphis, had games forfeited due to player infractions, officially re-

ducing his number of wins by 42 games. With these reductions, the NCAA has

Cal’s official record at 467 wins before the season begins this fall.

Go figure this, the coach coached his 500th victory. Whether or not some were

later taken away is a moot point. I agree there should be an asterisk (*) in the pro-

gram to reference the reduction, but the man still coached his 500th win at that

point in his life. UK had every right to recognize him for this milestone.

Now that being said, has U Mass. taken their Final 4 banner down? No, Accord-

ing to Louisville Courier Journal reporter Eric Crawford, they haven’t been asked

by the NCAA to remove it. The Lexington Herald reported that UK’s Todd was

sent a 5 page letter demanding the public apology. UK is to admit that the com-

memoration was wrong and allow the NCAA Committee on Infractions to

approve the wording of the apology before it is made public. ...Come on, folks!

The NCAA Board doesn’t uniformly enforce their own rules. They allowed Au-

burn’s Cam Newton to play football after his father tried to sell his son’s services to

another school (without Cam’s knowledge of course), and they should have. They

barred Enes Kanter from playing for UK because he was considered a paid PRO in

Europe. They don’t have college athletics in Europe, what was he to do? He was 16

years old, from a low income family and only used the money for his education,

which is allowed by the NCAA. The rest is in an escrow acct. still held by his par-

ents. They should have allowed him to play college ball. I wonder if the NCAA

would have approved Kanter to play for the University of Washington? It doesn’t

matter now, because Kanter is projected as a top 5 pick in the NBA draft. Anyway,

Coach Cal shot his mouth off about the NCAA’s ruling on Kanter (which he should

have), so I guess they are getting even by asking UK for the public apology.

Isn’t it time to start a new college athletics association & do away with the NCAA

antics? You would think that the governing board for college athletics would have

better things to do than scold UK for honoring its coach. Let’s be realistic, what

about that awful smell at Ohio State or the foul odor coming from Tennessee?

' ASK YOUR OWN LAWYER ' Notice; This column is not to be considered as any legal advice, always ask your own lawyer when you need legal advice.

The stories depicted in this column are commonsensical in approach and are intended for purely entertainment purposes.

Question: I recently bought a late model car from a used car dealer. He claimed that he

had purchased the car at an auction and needed to move it quickly. He offered the vehi-

cle to me for $ 4,500 under the blue book value. Great deal I thought, so I bought it and

drove it for a few months, then decided to trade it in on a new car. I went to the local

dealer and we worked out the trade-in value. Everything was fine until I went to sign

over the car title for the trade-in and the dealer dropped his offer to trade. He explained

to me that the car I was trading in has a „Salvage Title‟ and that they didn‟t want it under

any circumstances. What can I do, can I go back on the used car dealer and demand my

money back?

Answer: I doubt you can, in Kentucky as in all states, used car dealers are required by

law to tell purchasers about a „Salvage Title.‟ I suspect you were told about the title, but

were blinded by the big savings. A „Salvage Title‟ is issued on a vehicle when it has

been partially destroyed in a wreck (around 70% damaged), declared a total loss by an

insurance company, sold as salvage and bought by someone and repaired. If those re-

pairs can be documented by the rebuilder and notarized, the Ky. DMV will inspect and

certify the vehicle, then issue you a rebuilt certificate. You can then apply for a „Rebuilt

Title‟. Still, the cars value will be significantly reduced. There is nothing wrong with

buying a certified rebuilt car, but remember, every great deal comes at a price!

gian house was originally built between 1803-1806 by Williiam

Palmateer to serve as an inn & tavern called "The Sign of the

Green Tree" before the property became the home of politician

and businessman, Robert S. Todd in 1832. Daughter Mary

Todd, born in December, 1818, resided here until she moved to

Springfield, Illinois in 1839 to live with her elder sister. There

she met and married Abra-

ham Lincoln, whom she brought to visit this home

in the fall of 1847. The Todd family resided here

until Mr. Todd‟s death in an 1849 cholera epidemic.

Due to a discrepancy in his will a public auction

was forced resulting in the sale of the house and its

entire contents. From this sale a copy of an inven-

tory list was obtained and used in selecting the an-

tiques to place in the house when it was restored.

On December 24, 1879, Lexington's notorious Belle Brezing began to work for

Jennie Hill, a madam who ran a brothel out of the Mary Todd Lincoln House. Brezing

worked there for two years until she had saved enough money to start her own house

and assume the position of madam. Miss Brezing is widely credited as being an inspi-

ration for the character of Belle Watling in Gone With the Wind.

In the mid-1970s, Beula C. Nunn, wife of Governor Louie B.

Nunn, along with Kentucky Mansions Preservation Foundation,

Inc., and the Metropolitan Women's Club of Lexington, was re-

sponsible for the preservation and restoration of the Mary Todd

Lincoln House. In June 1996, the Beula C. Nunn Garden at the

Mary Todd Lincoln House was dedicated and opened to the public.

Today, the 14 room house contains period furniture, family por-

traits and furnishings from the Todds as well as the Lincolns. The

original property also contained separate slave quarters, outdoor

kitchen, wash house, smoke house, and stables with a carriage

house. Unfortunately, no evidence of the outbuildings remain. A

recently added garden reflects the charm of the original and offers a

pleasant respite for visitors. The house is open March 15- November 30th, Monday -

Saturday (closed Sundays). Tours are conducted from 10 a.m.-3 p.m.

Oklahoma Joe's Pulled Pork

[ 1/4 cup salt , 1/4 cup firmly packed light brown sugar, 2 tablespoons sugar , 2

tablespoons garlic powder, 2 tablespoons onion powder, 2 tablespoons Spanish pa-

prika, 2 tablespoons chili powder, 1 tablespoon celery salt, 1 tablespoon freshly

ground black pepper, 1 teaspoon freshly ground white pepper, 1 teaspoon dried

thyme, 1 (4 to 7 pound) bone-in pork shoulder (Boston butt) roast, 1 cup apple juice,

1/2 cups your favorite BBQ sauce, 4 cups oak or hickory wood chips, soaked in wa-

ter for 30 minutes …..(Special equipment: spray bottle for apple juice) ]

Combine all the spices in a bowl, mix well. Pat the spice rub onto the meat, mak-

ing sure to heavily season the entire surface area. Cover or wrap the pork and let it sit

at room temperature while getting the smoker or charcoal grill fired up. Do not leave

at room temperature for longer than 1 hour.

The grill is ready when the charcoal has burned to a white ash. If using a grill

instead of a smoker, arrange the coals on 1 side of the grill, leaving an area large

enough for the pork to cook indirectly with no coals directly underneath the meat.

When the grill has reached 200 to 225 degrees F, scatter 1/4 of the wood chips over

the coals, close the grate, put the pork on the grill and close the lid.

Maintain a 200 to 225 degree F cooking temperature inside the grill, adding coals

every 2 hours or as necessary. Add wood chips and spray the pork with apple juice

every time you add new coals. Try not to lift the lid of the cooker at any other time.

When the pork reaches an internal temperature of 165 to 170 degrees F on an in-

stant read meat thermometer (after about 4 to 5 hours), remove it from the grill and

double wrap in aluminum foil to keep the juices from leaking out. Return pork to the

grill (or smoker) The pork is finished cooking when it pulls apart easily and reaches

an internal temperature of 190 to 195 degrees F, about another 1 to 2 hours. Let rest

for 1 hour, then unwrap the pork butt and pull the bone out. "Pull" the pork by hand,

shredding it and discarding any large pieces of fat. Serve with your favorite BBQ

sauce. 4 to 6 servings.

Mom's Old Fashioned Potato Salad

[ 5 pounds potatoes, peeled and chopped, 10 eggs, 1 large onion, chopped, 1 (24

ounce) jar sweet pickles, drained and chopped, 2 cups mayonnaise ]

Place the potatoes in a large pan of water and boil over medium-low heat until

tender, about 12 minutes. Drain the potatoes, and place in the refrigerator to cool.

Place the eggs in a saucepan of cold water over medium heat, and bring to a full boil.

Turn off the heat, cover the pan, and allow the eggs to sit in the hot water for about

15 minutes. Cool the eggs thoroughly under cold running water and shell them. Chop

the cooled eggs and place them in a large salad bowl.

Stir the onion, sweet pickles, and mayonnaise into the eggs, and let the mixture chill

in the refrigerator at least l/2 hour to blend the flavors. Mix in the chilled chopped

potatoes, and refrigerate for at least 1/2 hour. Serve cold. 8 servings.

Mattie Dee Todd

Niece of Abraham Lincoln, First Woman Postmaster of Cynthiana George Rogers Clark Todd was born in Lexington, Ky., July, 1825, son of Robert Smith & Eliza (Parker) Todd. His mother died of childbed fever when he was only days old. His father died July 16, 1849. George R. C. Todd obtained his medical degree from Transylvania University and located in Cynthiana, where he started his practice. His sister, Mary Todd married the 16th President of the United States, Abraham Lincoln. In Cynthiana, where George Rogers Clark Todd set up his medical practice, he married Anna (Curry) Todd, who was the daughter of Major J. R. Curry, a veteran of the War of 1812 and a lead-ing attorney in Cynthiana. They were the parents of one child, Mattie Dee Todd who was born in Cynthiana, Ky., September 19, 1853. Mattie Dee's parents were married but a short time, when her mother, Anna (Curry) Todd divorced her father on the grounds of cruelty. Anna Todd remained in Cynthiana and raised her daughter. Mattie Dee was a woman possessing a fine education and very cultured, with marked business abilities. She never married and has the distinction of being Cynthiana's first female postmaster, a position she held for sixteen years. Her father served in the Confederate army and was a Texas Ranger, and later practiced medicine in Barnwell, South Carolina, where he died April 29, 1900. (Charles W. Feix/Historic Battle Grove Cemetery) Although Mattie Dee was a Democrat, she was able to obtain an appoint-ment to the position by a Republican president (Rutherford B. Hayes) through

the influence of her cousin, Robert Lincoln, son of Abraham Lincoln. She became the longest serv-ing postmaster, male or female, in Cynthiana his-tory, serving sixteen years from Dec. 12, 1878 until March 1, 1895. It was during her tenure that a lot on the south side of Pike Street, two doors west of Rohs' Opera House, was purchased in 1879, on which property a new building was erected and which served as Cynthiana's Post Office until Sept. 9, 1914, when it was moved to the then-new government building at Walnut & Pleasant Streets. (William A. Penn/Harrison Heri-tage News) Mattie Dee Todd died on January 12, 1909 and was buried in the Battle Grove Cemetery next to her mother, Anna H. Todd.

VERY IMPORTANT FACTS

FROM YOUR FINANCIAL ADVISER!

Dan was a single guy living at home with his father and

working in the family business. When he found out he

was going to inherit a fortune when his sickly father died,

he decided he needed a wife with which to share his for-

tune. One evening at an investment seminar, he spotted

the most beautiful woman he had ever seen. Her natural

beauty took his breath away. "I may look like just an or-

dinary man," he said to her, "but in just a few years, my

father will die and I'll inherit $200 million." Impressed,

the woman obtained his business card .... And three days

later, she became his stepmother.

Women are so much better at financial planning than men.

Good-Bye Grandpa A father put his three-year-old daughter to bed, told her a story, and listened to her prayers, which ended by saying, "God bless Mommy, God bless Daddy, God bless Grandma, and good-bye, Grandpa." The father asked, 'Why did you say good-bye Grandpa?' The little girl said, "I don't know, Daddy; it just seemed like the thing to do." The next day grandpa died….The father later thought it was a strange coincidence. A few months later, the father put the girl to bed and listened to her prayers, which went like this, "God bless Mommy, God bless Daddy, and good-bye, Grandma." The next day the grandmother died. "Holy Crap" thought the father, "This kid is in contact with the other side." Several weeks later, when the little girl was going to bed, the dad heard her say to her mother, "God bless Mommy and good-bye Daddy." He practically went into shock. He couldn't sleep all night, and got up at the crack of dawn to go to his office. He was as nervous as a cat all day, had lunch, and watched the clock. He figured if he could get by until midnight, he would be okay. He felt safe in the office, so instead of going home at the end of the day, he stayed there drinking coffee, looking at his watch, and jumping at every sound. Finally, midnight arrived. He breathed a sign of relief and went home. When he got home, his wife asked, "I've never seen you work so late. What's the matter?" He said, "I don't want to talk about it, I've just spent the worst day of my life." She replied, "You think you had a bad day?? You'll never believe what hap-pened to me,…..This morning my golf-pro dropped dead in the middle of my lesson!"

A Virginia State trooper pulled a car over on I-64 about 2 miles south of

the Virginia/West Virginia State line...When the trooper asked the driver why

he was speeding, the driver explained that he was a Magician and Juggler and

was on his way to Beckley, WV to do a show at the Shrine Circus. He didn't

want to be late.

The trooper told the driver he was fascinated by juggling and said, “If you

will do a little juggling for me, then I won‟t give you a ticket. The man ex-

plained to the trooper that he had sent his equipment ahead and didn't have

anything to juggle. The trooper told the man that he had some flares in the trunk of his

cruiser and asked if he would juggle them. The juggler replied that he would, so the

trooper got 5 flares, lit them and handed them to the driver.

While the man was juggling, a car pulled in behind the patrol car. A drunken good old

boy from West Virginia staggered out, watched the performance briefly, then staggered

over to the patrol car, opened the rear door and got in. The trooper observed him and

went over to the patrol car, opened the door and asked the drunk, “What the heck are you

doing?” The drunk said, "You might as well take my butt to jail, because there ain't no

way I can pass that test."
