Pursuant to the authority vested in meunder Department of State Delegation ofAuthority No. 236–2, as amended, andpursuant to 19 U.S.C. 2602(f)(1), Ihereby propose extension of theMemorandum of Understandingbetween the Government of the UnitedStates of America and the Governmentof Peru Concerning the Imposition ofImport Restrictions on ArchaeologicalMaterial from the Prehispanic Culturesand Certain Ethnological Material fromthe Colonial Period of Peru, signed June9, 1997. Pursuant to 19 U.S.C.2602(f)(2), the views andrecommendations of the Cultural
Property Advisory Committee regardingthis proposal will be requested.

Bureau of Political-Military Affairs;Denial Policy of Munitions ExportLicenses to Afghanistan
AGENCY: Department of State.ACTION: Notice.
SUMMARY: Notice is hereby given that alllicenses and other approvals to exportor otherwise transfer defense articles ordefense services to the territory ofAfghanistan under Taliban control willcontinue to be denied pursuant tosection 38 of the Arms Export ControlAct (AECA) and in accordance withsection 5 of the UN Participation Act(UNPA) and E.O. 12918 and the longstanding policy of the United States todeny exports of all defense articles anddefense services to Afghanistan.EFFECTIVE DATE: May 8, 2001.FOR FURTHER INFORMATION CONTACT:Mary Sweeney, Munitions ControlAnalyst, Office of Defense TradeControls, Bureau of Political-MilitaryAffairs, Department of State (202) 633–2700.SUPPLEMENTARY INFORMATION: The U.S.has had a policy of denial in place forlicenses and other approvals forexports/transfers of defense articles andservices to Afghanistan, which is listedin Section 126.1 (see 61 FR 33313).However, a new U.N. Security CouncilResolution (UNSCR) mandates an armsembargo against the territory ofAfghanistan under Taliban control. Thisnotice hereby informs the public of theU.S. implementation of theseprohibitions through this notice,including the continuation of the policyof denial for this territory.
Areas of Afghanistan under control ofthe Taliban are being used for shelteringand training of terrorists and planningterrorist acts. Also, the Taliban providesa safehaven for Usama bin Laden.Because of these activities, the United
Nations Security Council adoptedResolution 1333 (December 19, 2000).This resolution requires that all Statesprevent the direct or indirect supply,sale and transfer to the territory ofAfghanistan under Taliban control, bytheir nationals or from their territories,or using flag vessels or aircraft, of armsand related material of all types,including weapons and ammunition,military vehicles and equipment,paramilitary equipment and spare partsof the aforementioned. Also, theresolution requires States to prevent thedirect or indirect sale, supply andtransfer to the territory of Afghanistanunder Taliban control by their nationalsor from their territories of technicaladvice, assistance, or training related tothe military activities of the armedpersonnel under control of the Taliban.The UN arms embargo has limitedexceptions for non-lethal militaryequipment intended solely forhumanitarian or protective use ifapproved in advance by an establishedCommittee of the Security Council.
In accordance with 22 CFR 126.1, theU.S. Government will continue itspolicy to deny all applications forlicenses and other approvals to exportor otherwise transfer defense articlesand services to Afghanistan, includingthe territory of Afghanistan underTaliban control. This action alsocontinues to preclude the use inconnection with this territory of anyexemptions from licensing or otherapproval (e.g. brokering) requirementsavailable under the International Trafficin Arms Regulations.
Under the terms of UNSCR 1333, theU.N. arms embargo of the territory ofAfghanistan under Taliban control willexpire on December 19, 2001 unless itis extended by the U.S. SecurityCouncil. However, the measuresspecified in this notice and the policyof denial for Afghanistan will remain ineffect until a subsequent notice ispublished in the Federal Register.
This action has been taken pursuantto Section 38 of the AECA (22 U.S.C.2778) and § 126.7 of the InternationalTraffic in Arms Regulations infurtherance of the foreign policy of theUnited States, and in accordance withSection 5 of the UNPA (22 U.S.C.287(c)) and E.O. 12918.
