Average Sale Price, Listings on the Rise

in January

The REALTORS® Associationof Hamilton-Burlington(RAHB) reported 763 proper-

ty sales through the RAHB MultipleListing Service® (MLS®) for the monthof January, representing a 6.4 per centdecrease in sales over the same monthlast year. RAHB also reported a 6.1 percent increase in listings compared to thesame month last year. The average saleprice for all property types was up overJanuary of last year by 6.2 per cent.

“Our sales in January seem to be lowbecause we are comparing them to lastyear,” said RAHB CEO Ross Godsoe.“but they really are right on average forthe month.”

Seasonally adjusted sales of residen-tial properties were 10.2 per cent lowerthan the same month last year, with theaverage sale price up 3.9 per cent for themonth. Seasonally adjusted numbers ofnew listings were 3.5 per cent higher thanthe same month last year.

Actual overall residential sales were6.7 per cent lower than the previous yearat the same time. Residential freeholdsales were 7.6 per cent lower than lastyear; the condominium market saw adecline in sales of only 2.9 per cent. Theaverage sale price of freehold propertiesshowed an increase of five per cent overthe same month last year, while the con-dominium market saw an increase of 4.6

per cent when compared to the same peri-od last year.

The average sale price is based onthe total dollar volume of all residentialproperties sold. Average sale price infor-mation can be useful in establishing longterm trends, but should not be used as anindicator that specific properties haveincreased or decreased in value.

The average days on market droppedfrom 54 days to 53 days in the freeholdmarket and from 61 days to 55 for condo-miniums.

“There are big differences in howthe real estate market performed in vari-ous com- munities”, added Godsoe. “Forinstance, Burlington has an almost 20 per

cent increase in inventory over lastJanuary, where Hamilton has a 13 percent decrease. Looking at the numbersgives the big picture of what’s happeningin the overall RAHB market area, butbuyers and sellers would be wise to con-sult with a REALTOR® when they needinformation specific to their communi-ties.”

Does a minute matter in a real estate deal?Real estate contracts often say deals must be concluded no later than6 p.m. on the day of closing. What happens if you miss the deadline?

The standard Ontario realestate contract says dealsmust be concluded no later

than 6 p.m. on the day of closing. But ifyou’re a minute late, will that kill thedeal?

On Friday, Nov. 30, 2007, lawyerMichael Gatien went to the Cornwall,Ont., registry office to register a deed onbehalf of his client, who had just boughta plaza. He had wired the purchase fundsto the trust account of the seller’s lawyerjust after 4 p.m. and received the finalgo-ahead to register the deed at 4:53p.m. But when he tried to register thedeed, he missed the 5 p.m. deadline byone minute. The registration systemwould not accept anything after 5 p.m.

The seller then tried to cancel thedeal, claiming the deed was not regis-tered in time. The buyer’s lawyer arguedthat since all steps had been taken toclose the deal, the deed registrationcould take place when the registry officereopened on Monday.

The sale had involved difficultnegotiations and there were some hardfeelings, which all contributed to theseller trying to cancel the deal. It went tocourt in March 2009 and a judge ruledthe seller could not refuse to close.

Normally, real estate deals closewhen the money has been deliveredfrom the buyer’s lawyer to the seller’slawyer and title has been transferred tothe buyer. Funds are usually sent by wiretransfer. The seller’s lawyer releases thedeed for transfer on the governmentcomputer registry system and thebuyer’s lawyer then completes the com-puter registration.

Why does the standard agreementsay that deals can be completed by 6p.m. if the computers close down at 5p.m.?

In order for the computer registra-tion process to operate efficiently,lawyers for the buyer and seller sign anagreement that says all the money willbe held in escrow until the deed gets reg-istered. In many cases, buyers are wait-ing for their own sale deal to close inorder to get the money to close their pur-chase. As a result, there is often notenough time to get the money wired intothe trust account and to complete theelectronic registration before 5 p.m. Thisis especially true at the end of the month,when many deals are closing on thesame day.

As a result, in many cases, the dealcloses after 5 p.m. “in escrow.” Thelawyers agree that even though the deedis not registered, the buyers can moveinto the home, the seller’s lawyer willhold the money overnight in their trustaccount and the deed will be registeredthe next morning. This escrow agree-ment is typically completed before 6p.m.

Can a seller get out of the deal if themoney is not delivered to their lawyerbefore 5 p.m.?

While this did not occur in theabove case, a judge will also look at thelocal practice of how real estate dealsare conducted.

In another case, a buyer’s lawyerwas late getting the cheque to the seller’slawyer. The seller tried to cancel thedeal. The court found that the seller con-tributed to the deal closing late by delay-

ing the final closing visit of the buyerand not giving the buyer’s lawyerinstructions as to how to make thecheques payable until late in the after-noon.

Another question that arises onclosing is when does a seller have to letthe buyer into the house?

This should happen as soon as titleregistration takes place and not laterthan 6 p.m. if it is an escrow arrange-ment. In one case, a buyer’s movers satin the driveway from 6 p.m. on the dayof closing until 9 p.m., waiting for thesellers to leave. It cost the sellers morethan $1,000 to pay for the buyer’s addi-tional moving costs, since they were lateleaving the home.

Sellers also cannot leave junk in thehouse on closing. If they do, the buyercan sue to pay for the cost of removingit.

Sellers, vacate your home early onthe date of closing and take everythingwith you. If you need more time, makechanges in the contract at the time yousell it.

Buyers and sellers, do not try tochange your mind and cancel a dealbecause a deed cannot be registered intime. Let your lawyers complete theescrow and move on.

Keep these tips in mind whenchoosing a moving company to make

your move as stress-free as possible.

Moving is a stressful experience atthe best of times. Add to that the leap offaith involved in trusting all your worldlygoods to a moving company—and thehorror stories we’ve all heard, or worse,experienced firsthand—and it’s easy tofeel nervous about finding the rightmover. However, there’s a lot you can doto make the experience relatively worry-free, and even pleasant. The secret to astress-free moving day is to do yourhomework in advance, so that by movingday there are (virtually!) no surprises.

Look for recommendationsThe best place to start is to ask

friends or your real estate agent for rec-ommendations. You can also check outprofessional association websites like theCanadian Movers Association(www.mover.net). Many larger compa-nies have their own websites as well, giv-ing not only the main details about thecompany and its services, but helpfulmoving tips as well.

Once you’ve narrowed down three orfour companies you want to check out,make appointments to have a rep fromeach one come out and give you a writtenestimate. It’s essential that the companysee your stuff before they can give you anaccurate estimate; rule out a companythat tries to give you a quote over thephone, or tells you that seeing your pos-sessions in advance isn’t necessary.

Questions to ask and tips for an easymove

Over the phone, ask if the companyand its employees are bonded, licensedand insured (long-distance moversrequire a different license than local-onlycompanies), and what their insurancecovers, especially if you pack yourself.Are the movers who will do the jobemployees, or contractors or day labour-ers? (Full-time employees tend to bemore honest, experienced and conscien-tious than casual workers.) How longhave they been in business? If possible,visit the company’s offices and check outits facilities. Are the trucks in good con-dition and marked with the company

name? What about storage facilities? Isthe office clean and professional-look-ing? Finally, ask for (and check out) ref-erences.

Identify items to be movedWhen the rep arrives, take him/her

through your house and list exactly whatwill be moved, pointing out special itemslike mirrors, fragile antiques, a piano (ifyou’re not having it moved by a specialtypiano mover, which is highly recom-mended) or a pool table. Spell out whatyou want the movers to handle and whatyou will do yourself, such as packing ordismantling beds. Know the exactaddress of the new home, and any obsta-cles such as stairs or narrow hallways,and if any items will be put into storage.

Within a day or two, the companyshould furnish you with a detailed writtenestimate, listing everything you dis-cussed: date and time of move, old andnew addresses, estimated number ofboxes, size and value of items, specialneeds, cost of packing (if you are notdoing it yourself), and an estimate of howmuch time and how many movers will be

needed. Be wary of a company that offersto waive the GST/HST if you pay cash;not only is it illegal, but it could voidyour insurance and leave you withoutrecourse if there is a problem. And shunany company that asks for all or a largepart of the cost up-front; the industrynorm is to pay in full, or all but a tokendeposit, upon completion of the move.
