• If you are separated or are thinking of separating, it is a good idea to speak to a family lawyer about your situation

• Your local family court can also be a good place to go for more information. These courts offer information sessions on issues affecting separating families.

• Sessions address the impact of separation and divorce on adults and children, and provide basic legal information.

• They are free of charge.

• Family Law Information Centres (Family Courts)

• referrals to services in the community, such as counselling;

• information about court procedure and court forms;

• information and advice about different ways of resolving family law disputes including mediation, arbitration, collaborative family law and going to court; and

1. Family Court of the Superior Court of Justice (Available in 17 locations) Has unified jurisdiction to hear all types of family law matters, including

divorce, custody, access, division of property, restraining orders, adoption and child protection.

Other Ontario districts generally have both Superior Courts and Ontario Courts of Justice:

1. Superior Court of Justice (federally-appointed judges) Deals with divorce, or if you want to get a divorce and ask for custody,

access or support as part of the divorce, as well as restraining orders. Must go to this court (or Family Court) to resolve matters related to the division of your family property, including occupation orders.

2. Ontario Court of Justice (provincially -appointed judges) Support, or resolve issues related to custody of or access to your

chi ldren, as well as restraining orders. This court also hears adoption and chi ld protect ion matters. Cannot deal with divorce or property matters. 4

You and your spouse can also resolve the issues between you through private settlement, negotiation, collaborative family law, mediation or arbitration instead of going to court.

FHRMIRA provides an opportunity for First Nations communities to implement their own dispute resolution process to assist couples to resolve issues relating to the matrimonial home on the breakdown of a relationship.

Update letter on implementation of FHRMIRA - April 17, 2015

Letter sent to First Nations, federal government and Chief Justices in Ontario

Relates only to emergency protection order provisions in FHRMIRA (ss. 16-19)

Defer the designation of judges for 2 years

Provides First Nations with more time to develop their own laws before the emergency protection order provisions in the federal Act begin to apply

Remaining provisions came into force on December 16, 2014

Proposed amendments to the provincial Courts of Justice Act

First introduced in December 2013 (Bill 151) – died on order paper due to election

Bill 85 (schedule 1) – currently at second reading Provides the Ontario Family Law Rules Committee with

authority to make/amend rules or forms in relation to new federal family laws

Directed at FHRMIRA and any First Nations laws, as well as other recent new federal family legislation (Civil Marriage Act)

Existing family court forms can still be used A family lawyer can assist a spouse to complete their court

forms
