Hospital Visitation Rights Bill Passes House!

For the second year, Representative Mary Lou Marzian’s (D-Louisville) hospital visitation rights legislation, House Bill 118, passed out of the Health and Welfare Committee with bi-partisan support and was placed on the consent calendar of the full House of Representatives. It passed the House on January 27, and will now be sent to a Senate committee. The bill, which would “allow a patient of a health facility who is 18 years of age or older to designate, in writing, an individual not legally related by marriage or blood, who the patient wishes to have visitation rights,” was co-sponsored by Reps. Kelly Flood (D-Lexington), Joni Jenkins (D-Louisville), Reginald Meeks (D-Louisville), Darryl Owens (D-Louisville), Ruth Ann Palumbo (D-Lexington), Arnold Simpson, (D-Covington) and Susan Westrom (D-Lexington). As of the printing of this newsletter no anti-Fairness legislation has yet been filed in either the Senate or the House—a great sign for Fairness! (Check www.Fairness.org for legislative updates—March 1 is the last day new legislation may be proposed in the House, March 3 in the Senate.) This means, for now, we can focus our efforts on supporting the many pro-Fairness bills that have already been filed. It is vitally important you contact your legislator and ask them to support these bills, or thank them if they are already sponsors by calling the Legislative message line at 1-800-372-7181! (The operator will help you determine who your legislators are if you are unsure.) Then, join us in Frankfort for the Statewide Fairness Coalition’s Lobby Day and Rally in Frankfort on Wednesday, February 24. We will meet for a brief lobby training at 9 a.m. in Captiol Annex Room 131, then disburse in groups to speak with legislators about Fairness issues. At 1 p.m. Fairness supporters from across the Commonwealth will fill the Capitol Rotunda for our Statewide Fairness Rally—don’t miss this important opportunity to help build critical support for Fairness in Kentucky. Legislators have to see and hear from you to know you care! (A carpool will leave the Fairness Campaign office at 2263 Frankfort Ave. at 8 a.m.) You don’t have to wait until Feb. 24 to go to Frankfort! A Fairness staffer will lobby at the Capitol almost every Tuesday, Wednesday and Thursday until the legislature adjourns on April 13. Here are the bills we're supporting this session:SUPPORT House Bill 195 (Dual Parent Adoption) Sponsor: Rep. Tom Burch (D-Louisville). The bill would “establish that the definition for stepparent means the spouse of the legal parent of the child to be adopted, or any non-relative adult person who, upon the petition for adoption with the written consent of the legal parent of the child to be adopted, the court finds acts in a parental role to the child.”

SUPPORT House Bill 117 (Statewide Fairness Law) Sponsor: Rep. Mary Lou Marzian (D-Louisville) Co-Sponsors: Reps. Ruth Ann Palumbo (D-Lexington), Kelly Flood (D-Lexington), Joni Jenkins (D-Louisville), Reginald Meeks (D-Louisville). The bill would “include a prohibition on discrimination because of sexual orientation and gender identity” in employment, housing and public accommodations across the state.
SUPPORT House Bill 17 (Marriage Amendment Repeal) Sponsor: Rep. Mary Lou Marzian (D-Louisville). The proposed constitutional amendment would “repeal the definition of marriage” as between one man and one woman.
This January the Fairness Campaign joined Statewide Fairness Coalition partners the American Civil Liberties Union of Kentucky (ACLU-KY), Kentucky Fairness Alliance (KFA), the Kentucky Commission on Human Rights, and Lexington Fairness to host the 2010 Statewide Fairness Summit at Paul Sawyier Public Library in Frankfort. Building upon the ground laid at the first Statewide Fairness Summit at Centre College in 2008, the 2010 Summit brought together nearly 100 Fairness supporters from across the Commonwealth, including student representatives from Bellarmine University, Centre College, Eastern Kentucky University, Elizabethtown Community College, Kentucky Community & Technical College, Murray State University, Northern Kentucky University, University of Kentucky, and University of Louisville. It was a truly historic gathering, and everyone in attendance came prepared to share their honest thoughts and ideas around the Statewide Fairness Coalition’s strategy to pass a statewide Fairness law, which would protect all lesbian, gay, bisexual, and transgender Kentuckians f rom discr iminat ion in employment, housing, and public accommodations. Fol lowing a br ief Coalition history lesson by ACLU-KY Executive Director Michael Aldridge and a 2010 Coalition Work Plan orientation by Kentucky Fairness Alliance Board Chair Travis Myles and Lexington Fairness leader Jessica Martin, Summit attendees participated in four Coalition Working Committee break out sessions. Morgan Ransdell, Managing Attorney for the Kentucky Commission on Human Rights, facilitated a committee on Statewide Organizing/Passing Local Ordinances alongside Travis Myles in which they began building strategies to pass local anti-discrimination Fairness ordinances in Richmond and Paducah by the end of 2010. Michael Aldridge joined Fairness Campaign and KFA board member Nick Wilkerson in a committee on Media and Messaging, which worked toward developing messaging for the “moveable middle” population, whose support will be central to the passage of a statewide Fairness law. A New Ideas and Initiatives committee to foster innovative thought around how we do our collective work was lead by Fairness Campaign Co-coordinator Phoenix Lindsey-Hall and Yana Baker, while I joined KFA lobbyist Wes Wright and newly appointed Lexington Fairness Board Chair Craig Cammack for a Legislative Strategy committee where attendees helped us break down the current political landscape of key legislative committees to guide our 2010 plan. By Summit’s end, I felt confident that the palpable energy, excitement, inspiration, and—most importantly—involvement of those in the room would help catapult us into the Coalition’s very focused campaign to bring about the passage of Kentucky’s statewide Fairness law sooner rather than later (think April 2012). While we still have a long, arduous journey ahead of us, we must look towards taking the next steps to victory, such as growing the number of legislators sponsoring Fairness legislation in the House and Senate, and reaching out to communities throughout the whole state to host lobby trainings and listening tours, where we may better understand the case for Fairness across the Commonwealth. If you are part of any community in Kentucky (church group, reading circle, dinner club—any group) that you think would be willing to host a Fairness Listening Tour or Lobby Training, contact [email protected] or call 502-893-0788. I also ask you to consider joining one of our Statewide Fairness Coalition’s committees—without your voice at the table, we will never know what you think! In the coming months, we will hold committee meetings at various locations across the state, with call-in options for those outside the meeting area. OPPOSE Senate Bill 38 - This bill would force women seeking an abortion to review the results of a mandatory ultrasound and receive “in person” counseling a minimum of 24 hours prior to the procedure.
Statewide Fairness Coalition Awarded $30,000 The Tides Foundation’s State Equality Fund, a philanthropic partnership that includes the Evelyn and Walter Haas, Jr. Fund, the Gill Foundation, and anonymous donors, has awarded the Kentucky Statewide Fairness Coalition $30,000 to promote lesbian, gay, bisexual, and transgender (LGBT) equality across the state. The Fund is programmatically staffed on behalf of the donors by the Gill Foundation’s Movement Building Center. “The State Equality Fund promotes equality through the work of state and local organizations,” said Toni Broaddus, Executive Director of the Equality Federation, national alliance working to further equality in a state-based movement. “Support from the State Equality Fund will assist the Coalition in advancing their work around nondiscrimination and parenting rights of LGBT Kentuckians.” Members of the Kentucky Statewide Fairness Coalition are: Kentucky Commission on Human Rights, Fairness Campaign, Lexington Fairness, Kentucky Fairness Alliance, and ACLU-KY.

lobby (v.) To try to influence the thinking of legislators or other public officials for or against a specific cause.
Be Prepared. You may get less than a minute of time with a legislator, so know WHO you are going to talk to, and WHAT you are going to say. You can try to anticipate common questions, but it’s even more powerful to be able to tell them WHY you believe what you do. If you have a meeting scheduled with your legislator, know who in your group is going to say what and in what order. Know the main points that you need to get across. Be sure to allow time for questions and comments from the legislator.
Be Clear. Identify yourself and let the legislator know if you are a constituent or have some connection with his/her district. Let the legislator know who you are with and that you are a volunteer. Know the name and number of the bill you are lobbying on. Clearly ask the legislator to take a specific action.
Be Honest. Tell your personal story. Expressing to an elected official why YOU care about an issue is always more effective than telling them what you think they want to hear. If you don’t know the answer to a question, tell them so. Make a note of their question and let them know someone will get back to them. Pass it on to a member of the Fairness Campaign's Legislative Committee. We will find out the answer and communicate it to the legislator.
Be Polite. Know when to agree and to disagree. Your visit to a legislator is part of a process, so while you may not change any minds today, we can and will make a difference together. Never threaten or insult a legislator, or anyone else for that matter.
Follow Up. Write a thank you note to any legislator to whom you speak and be sure to include your name and address. Make notes about any encounter you had and provide those to the Fairness Legislative Committee. This helps us be prepared for our next visit with the legislator.
Always remember that lobbying is a long-term strategy Your efforts as a citizen lobbyist are a crucial part of a much larger picture. You help put a face on LGBT issues and you help communicate to the legislature that LGBT people and our allies are everywhere and that we are engaged citizens. It’s hard to know which story or which visit will finally make our issues real for a legislator, so your visit is a very, very important part in the ongoing struggle for justice and full equality for all. Lobbying 101 - You Make an Impact
Phoenix Lindsey-Hall Named Co-Coordinator Phoenix Lindsey-Hall has been appointed as Co-Coordinator of the Fairness Campaign. Partnering with current co-c o o r d i n a t o r J e f f R o d g e r s , Phoenix will help l ead Fa i rness ’ C o o r d i n a t i n g Committee, plan o rg a n i z a t i o n a l strategy and foster both leadership d e v e l o p m e n t and fundraising efforts. Phoenix moved to Louisville in August 2004 just after obtaining her BFA in Photography from Savannah College of Art and Design. She has worked both locally and nationally on LGBT issue campaigns and as the Volunteer Coordinator and Lobby Coordinator for Fairness. Phoenix is currently the Development Director and Special Projects Coordinator for the Metropolitan Housing Coalition, which is an advocacy organization dedicated to making fair, safe, and affordable housing possible for all. She serves on the Board of Directors of the ACLU of KY and the Policy Council of Head Start/Early Head Start with JCPS.
The Fairness Campaign’s Dismantling Racism Committee joins forces with the Kentucky Health Justice Network (KHJN) in February to explore the roots of homophobia and the intersection of oppression for different groups with a three part film series titled Unlearning Homophobia. The films, including Straight from the Heart, All God’s Children, and De Colores (all approximately 30 minutes in length), take us into a Latino community, an African American community and to families of LGBT individuals to explore and understand from where their homophobia comes, and how many in their communities begin to “unlearn” their homophobia. When asked why KHJN reached out to the Fairness Campaign to partner in hosting the series, Organizer Shannon Garth-Rhodes shared, “In thinking about dismantling generalizations of homophobia, we feel that we must also dismantle the narrow view of reproductive health and access only pertaining to heterosexual relationships.” The first two films will be shown at the Fairness Campaign office (2263 Frankfort Ave.) February 4 and 11 at 7 p.m. The final film will be shown during the Fairness Campaign’s African American History Month Gala at the University of Louisville’s Red Barn Friday, February 19, 7 p.m. Each event will include a group discussion on issues of racism, homophobia and prejudice. The events are free and snacks will be provided by the Fairness and KHJN.
