DESIGN GUIDELINES AND STANDARDS

THE SPECIFIC STANDARDS DETAILED BELOW ARE CURRENTLY BEING USEDBY THE COVENANTS COMMITTEE AND THE BOARD OF DIRECTORS TOREVIEW AND APPROVE ARCHITECTURAL MODIFICATIONS. EVEN IF YOURMODIFICATION MEETS THE CRITERIA IN THESE "DESIGN GUIDELINES ANDSTANDARDS" YOU MUST SUBMIT AN ARCHITECTURAL MODIFICATION FORMFOR APPROVAL.

ACCESSORY UNITS: No accessory units shall be permitted within FairfaxLanding unless designated on the house location plat at the time a newly constructed home ispurchased from a builder. Thereafter, all permitted accessory units shall conform to these designguidelines and standards, and shall be approved by the Covenants Committee prior toconstruction. All accessory units shall conform to the Fairfax County Zoning Ordinance.

ANTENNAS & SATELLITE DISHES: Antennas and satellite dishes of a diameter of one

meter or less are permitted on the property, however, they must be installed in the least obtrusive

and least visible location on the lot. Satellite dishes in excess of one meter are not permitted. Tocomply with the Federal Telecommunications Act of 1996, prior approval of the CovenantsCommittee is not required for the installation of a satellite dish or antenna less than one meter in

diameter. However, prior Notice of such an installation or planned installation is requested.Prior Notice will allow the Covenants Committee to assist the homeowner in selecting the bestpossible location for the equipment, while complying with the requirement for the least visibleand least obtrusive location. More specifically:

1. Ground Mount: Should be located on a rear lot location. Where

front or side yard locations are necessary, all equipment should be installed near otherutility equipment; or among shrubbery.

2. Roof Mount: Should be located on the rear of the roof, below anyridge pole or peak. If a tront roof mount is necessary, all equipment should beinsalled to one side of the roof, rahter than in the center; and equipment may berequired to be painted to match the roof (so long as warranties are not voided).

3. Structure Mount: Should be located such that the equipment isadjuacent to a chimney or other structure on the home; if on a deck, the equipmentshould be installed off to one side of the deck or adjacent to the house, if possible.Screening may be required.

ATTIC VENTILATORS: Exterior ventilators are pennitted if painted tomatch the color of the roof (if roof mounted) or the color of the house siding or trim (if mountedon a gable end). Ventilators shall be mounted on the least visible side of the ridge so as tominimize their visibility. Use of turbines is prohibited.

AWNINGS: Exterior awnings may be located on rear decks orpatios only and must be compatible with the architectural design and qualities of the home.

1. They shall be of a plain design and color which is compatible with the color schemeof the house.

2. They shall be consistent with the visual scale of the house to which attached.

3. They shall be retractable in style and be extended only while in use.

When planning a deck, homeowners are advised to

I. Location: Decks shall generally be located in rear yards. Sideyard locations will be evaluated on their individual merit. Decks shall be no closer

than 1 ft. from the adjoining property owners lot line in order to allow the adjoiningproperty owner room to construct a deck.

2. Scale and Style: Decks, particularly elevated decks, shall be of a

scale and style which are compatible with the home to which attached, adjacenthomes and the environmental surroundings.

3. Color: Decks made from wood may be left to naturallyage. Decks which are painted or stained shall generally match the trim or dominantcolor of the applicant's house. Natural or wood-colored stains will be considered.

4. Underdeck Storaf!e: Elevated decks have an underdeck area which can

have a negative visual impact on adjoining neighbors, particularly when used as aninfonnal storage space. The use of decorative screening or landscaping to minimize

adverse visual impacts is encouraged and may be required by the CovenantsCommittee.

DOG HOUSES AND DOG RUNS: Dog houses must be compatible with the applicant'shouse in terms of color and material. The dog houses may not exceed sixteen (16) square feet offloor space and may not exceed four (4) feet in height at the highest point. They shall be locatedwhere visually unobtrusive to neighbors. The use of appropriate screening is encouraged, andmay be required in some cases, in order to minimize any negative visual impacts. Do~ runs areprohibited.

DRIVEWAY: Extensions and additions to the driveways must beof the same material as the original driveway.

EXTERIOR AIR CONDITIONERS: Individual air conditioning units and or mountedfans extending from windows are prohibited. Exterior air conditioning units or heat pumps maybe relocated or added if there is no adverse visual impact to adjoining neighbors.

EXTERIOR DECORATIVE OBJECTS: All exterior decorative objects, whether natual orman-made, which were not part of the original construction design, either as a standard oroptional feature requires approval. Examples include; bird houses, bird baths, driftwood,weather vanes, sculptures, fountains, free standing poles of all types, house address numerals,and any items attached to approved structures.

These will be evaluated in terms of their general appropriateness, size, location, quantity,compatibility with architectural and environmental design qualities and visual impact onneighborhoods and the surrounding area.

EXTERIOR LIGHTING: Lighting which is part of the original structure maynot be altered without prior approval of the Covenants Committee. Proposed replacement oradditional fixtures must be compatible in style and scale with the applicant's house.

No exterior lighting shall be directed ouside of the applicant's property. Proposed additionallighting shall not be approved if it will result in an adverse visual impact to adjoining neighborsdue to location, wattage or other features.

1. Flood or spot lighting shall be permitted only on the side or rear or homes and only iflighting glare does not present a nuisance to adjacent properties.

2. Flood lighting at play areas shall not be permitted without approval of the CovenantsCommittee which may withhold or condition such approval.

EXTERIOR PAINTING: An application is not required in order to repaint orrestain an object to match the original color. However, all exterior color changes must beapproved. This requirement applies to siding, doors, shutters, trim, roofing and otherappurtenant structures.

FENCES:

1. The fence style and height shall match that installed by the builder and shall beconsistent throughout the community.

2. Fencing shall be restricted to rear yard locations. The height of the fence should becompatible with any partial fencing installed by the builder, but no greater than 72".End unit townhomes may request a variance for a side yard fence location. Whensuch variance is granted, in no case may a fence be installed beyond the mid-point ofthe home. The only exception to this requirement will be in the cases where a fencemay be loated closer to the front comer when required by the County ordinance as aconnecting lillie

3. All fences shall be made of unpainted pressure treated lumber. All fences mustremain unpainted.

4. Gates must be compatible with fencing in design, material, height, and color.

5. Vertical members must be plumb, and vertical boards must be in-line.

6. Prevent moisture from entering the wood through its exposed ends. Use cap boardsor metal caps painted a muted graylbrown to blend in with the fence posts.

7. Your Exterior Modification Application Request must include:

a. A sketch or photograph of the fence design and dimensions,

b. Your house location survey showing the proposed fence, any gate locationsand description and location of existing adjoining fences,

c. The materials you are proposing to use.

8. Chain link fences will not be approved under any circumstances. Chain link fencingmaterial may not be used for any purpose on a lot.

FIREWOOD: Firewood shall be kept neatly stacked and shall belocated to the rear of the residence and in such a manner as to avoid adverse visual impacts toadjoining properties. Screening may be required in certain cases. Other than a limited quantityof firewood intended for immediate use, firewood shall not be stacked on patios or decks.

GREENHOUSES: An attached greenhouse will be treated as a majoralteration to a dwelling unit and subject to the same level of review. Attached greenhouses mustmeet the following criteria to be approved.

1. They must be attached to the rear of the dwelling.

2. The size and design must be architecturally compatible with the home andsurrounding homes.

3. There shall be no adverse visual impacts for adjoining properties.

GRILLS (Permanent): Permanent grills must be placed in the rear yard ofthe house and as far as practical from the adjacent property lines.

HOT TUBS / SPAS / SAUNAS: Such structures must be located in the rear yardadjacent to the dwelling unit. The incorporation of hot tubs as an architectural feature of decksand/or patios is encouraged. The exterior finish of an elevated hot tub shall blend with theexterior finish of the home, deck or patio to which attached or most closely related.

1. Filtration equipment must not make noise that is heard beyond the owners propertyline and must be shielded from view of adjacent properties by the use of matureshrubbery or fencing.

2. All hot tubs/spas/saunas shall be appropriately screened using either fencing orlandscaping.

3. Comments from the owners of adjacent properties may be solicited prior to theCovenants Committee making a decision.

LANDSCAPING:

1. Approval is required for plantings intended to form a hedge or natural screen andwhich will attain more than two (2) feet in height. Hedges located forward of thefront plane of the house shall be maintained at a height of no more than 36 inches andshall not restrict sight lines along a roadway.

2. Approval is required for the installation of vegetable gardens, railroad ties, gardentimbers, stones or similar strucutres which will form a wall over 12 inches high and 8feet long.

3. A proposed improvement which is of such a scale or type as to be inconsistent withthe existing design features of the home, adjacent units and the surrounding area will

require approval. Examples include the substantial or total removal of turf andreplacement with another material, such as mulch or gravel.

4. Approval of an Exterior Modification Application Request is not required for minorlandscape improvements.

PATIOS: All patios require approval. Patios shall generallybe located in rear yards, although side yard applications will be evaluated on their individualmerit.

Any adverse drainage condition which might resultfrom the construction of a patio shall be considered and addressed during design andconstruction.

PORCHES (SCREENED): Porches will be reviewed as room additions, withspecial attention given to visibility of interior activities.

1. Size and Scale: Screened porches should be appropriate to the scaleof the home as sited on the lot. They must meet County minimum setbackrequirements and should not be constructed across Building Restriction Lines (BRL)as shown on individual plats or site plans.

2. Material and Color: Screened porches should match the existing housein materials and color, except that they may also be contructed of natural woods. Theuse of a shed type roof is not allowed. A hip or gable roof must be used. The end ofa gable roof must have the same type siding as the house. All trim and facia must be

painted the same color as the house trim and facia. In all cases, the screened porchroof must be shingled to match the existing house.

RECREATION & PLAY EQUIPMENT: Is not allowed.

SATELLITE DISHES: (See Guidelines for Antennas and Satellite Dishes)

SECURITY BARS: In general, the use of security bars or grates onwindows and doors will not be permitted. Exceptions may be made where the security apparatuswill not be visible from the street and from adjoining properties. Homeowners concerned aboutthe security of their residence are advised to consider alternatives, including alarms andsophisticated lock systems.

SIDEWALKS AND PATHWAYS: Sidewalks and pathways (except lead walks) shallbe set back at least four feet from the property line and installed flush to the ground. Only stone,slate, brick, concrete or similar durable construction material shall be used. The scale, locationand design shall be compatible with the lot, home and surroundings.

SIGNS:

1. Real Estate: Only one sign advertising a property for salemay be displayed. Such sign must meet applicable county regulations with respect tosize, content and removal. The sign may only be placed in the front yard of availableproperties.

2. Security: May be displayed only on windows or in alandscaped area directly in front of the house and should not exceed 7" in diameter.

SOLAR PANELS: Solar panels are prohibited.

STORAGE SHEDS: An inappropriately located or poorly designedstorage shed can visually detract from an otherwise pleasing and architecturally harmoniousresidential environment. This in particular is likely to occur with pre-fabricated, free-standingsheds which are purchased from a dealer. For this reason, the use of pre-fabricated sheds isprohibited. Owners are encouraged to build storage sheds that are integrated with the dwelling,or a fence which are compatible with the design qualities of the house and adjacent homes. AShed may be constructed under a deck, however, the underside of the deck must be screened withlattice.

In general, a shed must be of a size which isappropriate for the size of the home and lot, as well as surrounding dwellings, and shall becompatible with the architectural qualities ofthe house and adjacent houses.

The height of a shed which is attached to a housemay vary with the size and design features of the house.

However, sheds located adjacent to a fence shall notexceed six feet in height inclusive of roof, which is the maximum permitted height for a privacyfence. Placement of the shed shall be in accordance with County zoning setback restrictions.

More specific guidelines are provided below fordifferent categories of sheds.

STORAGE OF BOATS, TRAILERS, CAMPERS, MOBILE HOMES ANDRECREATIONAL VEHICLES: The following types of vehicles may not beparked or stored in open view of residential lots, common parking areas, public or private streetswithin the boundaries of the community or on common open space.

1. Any boat, jet ski or boat trailer.

2. Any motor home or self-contained camper.

3. Any camper slip-ons where the camper backs are higher than the roof line of the cab ofthe truck.

4. Any mobile home, trailer, or fifth wheel vehicle.

5. Any popup camp/tent trailer or other similar recreation oriented portable or transportablefacility or conveyance.

6. Any other vehicle not defined above which is not nonnally or regularly used for dailytransportation, including dune buggies, non-operational automobile collections or otherautomotive equipment not licensed for use on the highways of Virginia.

7. Any vehicle with commerical tags or commerical signs, advertising or visible commercialequipment.

8. Any private or public school or church buses.

Any vehicle falling in the above classifications may be stored in a garage out of open view.

9. The repair or extraordinary maintenance of vehicles shall not be carried out on any lot orcommon area, except that non-commercial repair of vehicles is permitted within enclosedstructures.

STORM/SCREEN DOORS AND WINDOWS:

1. Storm/Screen Doors: In general, storm/screen doors which are fullview (no panels) and which are painted the same color as the unit door to whichattached are appropriate and may be approved.

2. Storm/Screen Windows: Storm/screen windows shall have frames whichmatch the color of the exterior window trim. White aluminum may be acceptable incertain cases.

SWIMMING POOLS: In-ground swimming pools will not be pennitted.Small above-ground seasonal wading pools shall be pennitted.

PROPERTY MAINTENANCE STANDARDS

1. All portions of a lot which are not improved by an impervious surface or a structuremust be maintained with grass (or other vegetation installed by a builder or approvedby the Covenants Committee). No bare earth may be exposed on a lot (except forflower beds or vegetable gardens with appropriate approvals as required).

2. All turf areas on a lot must be kept neatly mowed during the growing season. Grassshall not be permitted to exceed six (6) inches in height.

3. Any dead plants, shrubs or trees shall be immediately removed.

4. Turf areas shall be kept as weed free as possible. At no time shall weed cover exceedmore than twenty-five (10%) of the total turfed area.

5. No trash or debris may accumulate or be stored on a lot. Construction materialsrequired for the improvement of a home or lot shall be neatly stored in as unobtrusivea location on the lot as possible when not in use. Construction material must beremoved when the work is complete or upon the expiration of the building permit.

6. All hedges, trees and shrubs must be neatly trimmed and maintained and their sizemaintained in proportion to the lot and home through pruning.

7. The exterior of a home must be maintained in an attractive manner. No significantblistering or peeling of exterior painted surfaces is permitted.

Any exterior building components (i.e., siding, gutters and downspouts, roof shingles,windows and doors) which are missing, broken or otherwise in a state of disrepairmust be repaired.

FAIRFAX LANDINGDESIGN GUIDELINES AND STANDARDS

INTRODUCTION

About the Community

Fairfax Landing is a 79-unit townhouse community. All owners within Fairfax Landingare members of the Fairfax Landing Homeowners Association, Inc., a Virginia non-stockcorporation. The Board of Directors of the association is charged with the duties andvested with the powers prescribed by law and as set forth in the association documents.

Among those duties for which the Board is responsible is the establishment of rules andregulations governing the visual aesthetics of the community. The Board of Directors hasappointed and authorized the Covenants Committee to implement these standards andevaluate and act on applications for exterior modifications.

Purpose and Intent of the Desi~n Guidelines and Standards

As stated in the Declaration for Fairfax Landing ("Declaration") Section 9.1, the purposeand intent of the standards are (in part) to:

(i) Provide for visual harmony and soundness of repairs.(ii) Avoidance of activities deleterious to the aesthetics or property values of

the community.(iii) Promote general welfare and safety with the community.

More generally, the standards are intended to assist in the regulation of external design,signage, appearance, use and maintenance of properties within the community. TheDesign Guidelines and Standards are guidelines that will be applied in a flexible manner,each taking into consideration the specific characteristics of each lot.

Covenants Committee

As a means of implementing the Fairfax Landing Design Guidelines and Standards, theBoard has established a Covenants Committee. The committee is charged withestablishing and administering such standards as the Board of Directors adopts.

In general, the duties and powers of the Covenants Committee are:

(i) To regulate external design and appearance of properties, and administerthe covenants and restrictions and enforce the adopted standards.

(ii) Establish requirements for submission of applications for proposedexterior modifications.

(iii) Approve, modify or disapprove applications for exterior modifications.(iv) Keep records and issue such interpretations of adopted standards as may

be required.(v) Act upon all matters or applications within 45 days of submission of such

as authorized by the Board.

When all Application for Exterior Modification is Required

In general, all exterior modifications require the submission of an application to thecovenants committee. As an example, such modifications include, but are not limited to:decks, patios, fencing, additions, landscaping, hot tubs, lighting, painting, storm doors,recreation equipment, etc.

Processin~ of Applications

An application describing the proposed modification must be completed and submtittedby the applicant. Applications are available from Covenants Committeemembers or the property management company.

Completed applications should be mailed or faxed to the address listed on the application.The application will then be forwarded to the Covenants Committee forconsideration. The committee will endeavor to respond as quickly aspossible. However, the committee has up to forty-five days to respond tocompleted applications. Failure to respond within the forty-five dayperiod results in an automatic referral of the application to the Board ofDirectors which must respond within fifteen days after the first Boardmeeting held following the referral. Failure of the Board of Directors torespond within the fifteen day period will constitute consent of theproposed structural addition, alteration or improvement, as long as themodifications are in accordance with the "Design Guidelines andStandards".

You will be advised in writing as the approval, approval with conditions ormodifications, or disapproval of your application. Detailed applicationsmay require a meeting with the Covenants Committee to properlyevaluate.

Enforcement

The Covenants Committee has been charged by the Board of Directors to insurecompliance and/or enforce the covenants, standards, rules and regulations adopted by theBoard and as stated in the Bylaws and Declaration for the association. Failure to complywith the covenants, standards, rules and regulations may result in such legal action asmay be required to enforce compliance.

Appeal Provisions Waiver Variance

Any action, ruling or decision ofthe Covenants Committee may be appealed to the Boardof Directors. Any such appeal requests must be submitted in writing to the Board ofDirectors. Any such decision subsequently reached by the Board of Directors shall befinal and binding. The Board of Directors or the Covenants Committee may waiveenforcement or grant variances from the written Design Guidelines and Standards. Uponwritten approval of any specific variance or exception, all development conforming tosuch variance or exception shall be deemed to comply.

Certificate of Compliance

Any owner obtaining approval from the Covenants Committee must commenceconstruction or alteration in accordance with and without material deviation from the

approved plans and specifications. All construction or alterations must be completedwithin six months after the date of approval. Upon completion of any construction ormodification, at the request of the applicant, the committee shall, after inspection thereof,and as appropriate, issue a certificate evidencing full compliance with the applicablestandards.
