REQUESTED ACTION:The applicant proposes Phase Four (4) of The Bluffs on Trebein, a residential subdivision ofthirty (30) single family lots, two (2) open space lots and one (1) new street, Sagecrest Drivein a PD-1 Planned Residential Development District. This proposed development is adjacentto single family residential and agriculture. Some of the conditions placed on the residentiallots for the overall development include a minimum lot size of 8,125 square feet and aminimum dwelling size of 1 ,500 square feet. The setback conditions include a front yardsetback of 25 feet, side yard setback of 7.5 feet, rear yard setback of 30 feet with 45% lotcoverage.

Upon speaking with the applicant, Jim Obert, Phase Four (4) will continue The Bluffs onTrebein Development and continue the build of single family dwellings over the next twoyears. The build of Phase Four (4) will not require the removal of any existing trees as theland was all agriculture farm land. There shall be 5.0264 acres of open space that includestwo (2) retention ponds adjacent to Trebein Road. Phase Four (4) shall create a secondaccess point into the Bluffs subdivision from Trebein Road which shall be known asSagecrest Drive. The second entrance shall contain signage stating Bluffs On Trebein withlandscaping, similar to the signage at the Brehm Blvd. entrance from Trebein Road.

Public Comment

Dave Lower, on behalf of Candlelite Homeowners' Association, stated concerns at thePlanning Board Meeting regarding the speed of traffic on Trebein Road, questions regardingthe timeline for improvements to Trebein Road and any future improvements to the westernside of Trebein Road. Staff informed the Planning Board and Mr. Lower that the EngineeringDepartment shall follow up on the specific concerns. Staff received no other comments fromnotified neighbors or homeowner associations.

The City of Fairborn improvement project on Trebein Road is likely to be added to the FiveYear Capital Plan as part of the next plan update. The project will include the addition ofcurb and sidewalk on the east and west side of the street from approximately 100' north ofCandlelight Lane to the north city limit. Future road improvements include the widening ofTrebein Rd. with milling, resurfacing of the asphalt and new pavement striping betweenBrehm Blvd north to the city limits. According to the Engineering Department, subdivisionplanning protocol controls the number of street access points. The Bluffs and Candleliteeach have two (2) access points onto Trebein Road. At both intersections, left turn laneshave and shall be provided into both subdivisions. Proposed road signage shall includeforward, right and left turn options. The improvements shall include northbound andsouthbound lane widths of twelve (12) feet and left turn lane widths shall be ten (10) feet.Speed shall continue to be monitored. Any future reductions in speed shall be concludedonly after a required speed study is completed.

The proposal has been reviewed by Vectren, DP&L, Waste Managementand the City ofFairbom Departments of: Community Development, Fire, Police and Public AdministrativeServices Divisions' of Parks & Recreation, Engineering and Water & Sewer. The fire hydrantlocations, water sewer installation, runoff accommodation and street installation have beenapproved as per the site plan. Staff has been in discussion with the applicant, Mr. Obert,regarding the review of Phase Four (4) and the final submitted plans shall reflect allcomments.

Background/History:On September 16, 2013, Applicant Hills Land & Development requested and receivedapproval for a Change of Zoning District from Bath Township A-1 Agriculture Residential toFairborn PD-1 Planned Residential Development District including Concept Planned UnitDevelopment (PUD) Plan approval by means of Ordinance No. 19-13, Which becameeffective October 17, 2013. The purpose of the request was to allow the development of anapproximately 80.292 acre residential subdivision comprised of approximately 195 detached

single-family dwellings on individual lots on 59.29 acres, 11 .2 acres of passive open spaceand 9.8 acres of right-of-way with a density of 2.44 dwelling units per acre. Two (2) accesspoints were proposed along Trebein Road and traffic generation was calculated to beapproximately 1,879 vehicles per day (VPD) with an am peak of 151 vehicles per hour(VPH) and a pm peak of 200 VPH based on 196 dwelling units using 9.57 trips per day perunit.

On March 17, 2014 Hills Land & Development received approval for the Preliminary PlannedUnit Development (PUD) of The Bluffs on Trebein by means of Resolution No. No. 38-14.The Preliminary Plan set conditions for the layout and design of the subdivision. Theconditions include that all residential units shall have a maximum height of two and halfstories or 35 feet and shall contain a minimum living area of 1500 square feet excludinggarages, porches and unfinished basements. All garages shall be attached toaccommodate a minimum of two vehicles with detached garages being prohibited andsheds are not to exceed 200 square feet. Driveways shall be a minimum of 16 feet wide andconstructed of concrete or pavers. Metal sheds, above ground pools, chain link fences andabove ground wiring shall also be prohibited. The use of aluminum as primary siding shallbe prohibited, but use as an accent shall be permitted. No same model dwelling havingidentical material and color appearance shall be located side by side. Landscaping willbuffer the subdivision along Trebein road and will not be located in any swales oreasements. The landscaping for each dwelling will include two (2) trees and (4) bushes.Easements will be maintained for future connectivity along the southern and northeasternproperty lines.

May of 2014, Resolution No. 39-14 approved Phase One (1) located in the southern portionof the subdivision and contains approximately 12.257 acres comprised of 30 detachedsingle family residential lots on 7.506 acres, 2.692 acres of dedicated street right-of-way andtwo (2) open space lots containing 2.059 acres.

February of 2016, Resolution No. 05-16, approved Phase Two (2) located north of PhaseOne (1) continues development to the north along Brehm Boulevard, Bluffview Drive andcreates one (1) new street, Indigo Drive. Phase Two (2) contains 10.4668 acres comprisedof 29 detached single family residential lots on 6.8766 acres, 1.6180 acres of dedicatedright-of-way with one (1) open space lot containing 1 .9722 acres.

June of 2016, Resolution No. 25-16, approved Phase Three (3), located north of PhaseTwo (2), continues development to the north along Brehm Boulevard and creates two (2)new streets to the north, Standing Rock Lane and Sunset Canyon Court. Phase Three (3)contains 8.2587 acres comprised of 28 detached single family residential lots on 6.7964acres and 1.4623 of dedicated right-of-way.

RESOLUTION NO. 3-17

APPROVING THE FINAL PLAN FOR SECTION FOUR (4) OF THE BLUFFS ONTREBEIN PLANNED UNIT DEVELOPMENT (PUD)

WHEREAS, Jim Obert of Inverness Group, Inc., is seeking Final Plan approval

for section four (4) of The Bluffs on Trebein Planned Unit Development (PUD) under

Fairbom Codified Ordinances (FCO) Chapter 1145 pursuant to FCO Chapter 1146; and

WHEREAS, the development proposes thirty (30) single family lots and two (2)

open space lots, contains 15.0414 acres and is located north of Phase Three (3), continues

development to the north along Brehm Boulevard and creates one (1) new street,

Sagecrest Drive; and

WHEREAS, the Planning Board unanimously recommended approval of the Final

Development Plan with conditions for Section Four (4) of The Bluffs on Trebein; and

WHEREAS, Staff recommends the approval of the request with the conditions set

forth herein.

NOW, THEREFORE, THE COUNCIL OF THE CITY OF FAIRBORNHEREBY RESOLVES:

SECTION 1. That the recommendation of the Planning Board to approve the

Fmal Development Plan for Section Four (4) for The Bluffs on Trebein PUD with the

following conditions is accepted:

a. Condition 1: All landscape and topography changes are in compliance withState and Federal regulations, and

b. Condition 2: The approved site plan shall be in accordance with the PublicAdministrative Services Department.

c. Condition 3: All remaining and unaffected provisions, restrictions andrequirements of Ordinance No. 19-13 and Resolution No. 38-14 shall remainin full force and effect.

d. Condition 4: Two (2) durable Mylar copies of the approved document shall besubmitted to the City for sigxiatures: both copies shall be signed andsubsequently stamped as recorded within ten (10) monAs of City Councilapproval and one (1) Mylar copy shall be returned to the City ofFairbom'sEngineering Division.

SECTION 2. That the City Manager be and he is hereby authorized to approve

the Final Plan for Section Four (4) of The Bluffs on Trebem PUD with the above-stated

conditions.

SECTION 3. That this Resolution shall take effect immediately upon its passage.
