NOTIFICATION

New Delhi, the 10th April, 2012

GS.R. 233(E).—1n exercise of the powers conferred by the provision to article 309 of thc Constitution.the President hereby makes the following rules regulating the method of recruitment to the Group ‘A’ & B’posts in the National Investigation Agency under the Ministry of Home Affairs, namely

I. Short title and commencement.—(l) These rules may be called the Ministry of Home Affairs,National Investigation Agency Group ‘A’ and ‘B’ posts Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the post mentioned in column (1) of the Schedule annexedto these rules.

3. Number of posts, classification and scale of Pay.—The number of posts, their classificationand the Pay Band and Grade Pay attached thereto shaH be as specified in columns (2) to (4) of the Scheduleannexed to these rules.

4. Method of recruitment, age limit and other qualifications,.etc.—The method of recruitment.age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of theaforesaid Schedule.

5. Initial Constitution.—The incumbents of the posts mentioned in the said Schedule who on thedate ofpublication of these rules are holding the post on rugular basis shall be deemed to have been appointedunder these rules and the service rendered by them in the said post on regular basis before the said publicationshall be taken into account for deciding their eligibility for promotion to the next higher grade.

6. Disqualiflcation.—No person,—

(a) who has entered into or contracted a marriage with person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permisiible under thepersonal law applicable to such person and the other party to the marriage and that there are other grounds forso doing, exempt any person from the operation of this rule.

7. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedientso to do, it may, by order and for reasons to be recorded in writing, and in consultation with Union Public ServiceCommission relax any of the provisions of these rules with respect to any class or category of persons.

8. Saving.—Nothing in these rules shall affect reservations, relaxation ofage limit and other concessionsrequired to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Exservicemen and other special categories ofpersons, in accordance with the orders issued by the Central Governmentfrom time to time in this regard.
