EXECUTIVE ORDER NO. ^3

"AN ORDER IMPLEMENTING THE RECONSTITUTION OF THE WATERSHEDMANAGEMENT COUNCIL (WMC), THE BARANGAY MANAGEMENT COUNCILS

AND THE WATERSHED MULTI-PARTITE MONITORING TEAMS IN DAVAO CITYAS MANDATED IN THE WATERSHED CODE"

WHEREAS, the City Government of Davao recognizes the importance of ahealthy and ecologically sound watershed area in achieving the ecological balancewhere human beings and nature thrive in harmony with each other;

WHEREAS, the City Government of Davao recognizes that watershed areas arecentral to the aspirations of a livable city for the Dabawenyos who must maintain itssustainability through a participative, empowered and environmentally consciouscommunity;

WHEREAS, the City Government of Davao recognizes that the watershed areasfor the City's aquifers must be protected, conserved and managed as they are thesources of the City's drinking water;

WHEREAS, Ordinance No. 0310-07, Series of 2007, otherwise known as TheWatershed Code was enacted on January 23, 2007, its Implementing Rules andRegulations (IRR) approved October 15, 2008 and published in a locally circulatedpaper on January 7, 2009;

WHEREAS, there is a need to develop general directions for interaction amonggovernment agencies and stakeholders, multi-sector participation and collaborativemanagement; create administrative and policy-making bodies to craft policies,guidelines and strategies towards ensuring the health and susta inability of thewatershed areas;

WHEREAS, the Watershed Code, under Articles 12 to 17, creates; identifies thecomposition; defines the administration, functions, powers and duties, and specifies thesource of funds for operations of the Watershed Management Council, the BarangayWatershed Management Councils and the Watershed Multi-partite Monitoring Teams;

WHEREAS, the City Government of Davao prioritizes the protection andconservation of the city's watershed areas as crucial to development and sustainabilityfor the use of present and future generations and deems important the managementand monitoring by the aforementioned bodies;

WHEREAS, the effective, efficient and consistent implementation of theWatershed Code can only be assured with the organization and operationalization ofthese bodies for participatory monitoring and evaluation headed by councils of relevantstakeholders and interest groups;

NOW, THEREFORE, I, SARA Z. DUTERTE, Mayor of the City of Davao, byvirtue of the power vested upon me by law, do hereby order the following:

SECTION 1 : ReconStitution. - There is hereby reconstituted the following bodieswhich will implement the Watershed Code:

1) WATERSHED MANAGEMENT COUNCIL (WMC) which shall issue policies andguidelines and set the direction of collaborationo in gathering, processing andevaluating information on watershed areas in Davao City and develop plansand strategies towards ensuring its health and sustainability;

2) BARANGAY WATERSHED MANAGEMENT COUNCIL (BWMC) which shall beorganized in every barangay within designated watershed areas or having aportion of a watershed area within its boundary to assist the WMC in ensuringthe effective, efficient and consistent implementation of the Watershed Code;

3) WATERSHED MULTI-PARTITE MONITORING TEAM (WMMT) which shall beorganized in every designated cluster of watershed areas to assist the WMCin ensuring full compliance by all the provisions of this Code, its IRR andother environmental laws.

Section 2 : Composition. - The above-mentioned Watershed Code implementingbodies shall be composed of the following:

(i) The City Mayor as Chairpersoon(ii) The City Administrator as Vice-Chairperson(iii) Members:

1. The Chairperson of the Committee on Environment and NaturalResources of the Davao City Council;

2. The Chairperson of the Committee on Housing, Rural and UrbanPlanning;

Section 3BWMC. -

Selection Process of Representatives to the WMC, WMMT and

1. For sectoral representatives - The Chairpersons of WMC, WMMT and BWMC,or their designated representatives, shall separately convene meetings of theconcerned sectors where the sectoral representative to the variousWatershed Code bodies shall be elected. Those elected shall then be officiallydesignated as members during a meeting conducted by the bodies.

2. For organizational representatives - The incumbent of the highest localposition of the organization designated as member of the Watershed Codebodies is the principal member officially representing that organization. Theseprincipal members may designate their respective permanent alternate torepresent them during meetings and activities when they could not bepersonally present.

Section 4 : Administration, Functions, Duties and Powers. - The WMC, WMMTand BWMC shall abide by the defined administration, functions, duties and powers ascontained in the following articles of the Watershed Code:

1. Watershed Management Council - Article 13, letters (b), (c) and (d);2. Watershed Multi-partite Monitoring Team - Article 14, letters (b), (c) and (d);3. Barangay Watershed Management Council - Article 15, letters (b), (c) and (d).

Section 5 : Budget. The1 operating requirements and honoraria and such otherexpenses to be incurred by WMC, WMMT and BWMC shall be funded from thebudgetary allocation under the City's Annual Budget for their exclusive and specific use.

Section 6 : Separability Clause. - If, for any reason, any part or provision of thisorder shall be held to be invalid, other parts or provision hereof which are not affectedthereby shall continue to be in full force and effect.

Section 7 : Effectivity. - This Executive order shall take effect immediately.
