Genesis of EPAS

• Initially The Department of Justice approached the Office of Traffic Safety regarding funding for the replacement of the fifteen year old Intoxilyzer 5000’s.

• O.T.S. indicated that their emphasis was on the development of new technologies.

EPAS Conception

• To develop a Self-contained Portable System capable of Roadside Evidential Breath Testing and Screening.

• To utilize Ethanol/Nitrogen Dry Gas for Determination of Accuracy Testing.

• To meet the requirements of California Department of Health Services and Title 17 of the California Code of Regulations.

EPAS Development

• OTS approval of funding for development of prototype system.

• At that time no truly portable evidentialbreath testing devices existed.

• Companies responded to the challenge.• The Department of Justice is using the

Draeger 7410 plus.

EPAS - Description

• A rugged case• A built-in power supply• A data-entry system• A breath analyzer (Draeger Alcotest 7410

Plus)• Magnetic card reader• Printer

EPAS Components

• Draeger Alcotest 7410 Plus – uses fuel cell technology for determination of BrAC

• Subject/Operator data entry using palm-sized computer (presently a Casio “Cassiopeia”) and magnetic card reader

• Printer uses LED’s to print, no cables necessary• Rechargeable battery system- unit lasts about a

week between charges

• The unit maybe used as Preliminary Alcohol Screener

• Or as an Evidential Breath Testing Device

Benefits of Portable Evidential Testing ?

• The best evidence - BAC at the time of the stop.• Minimizes “rising BA” argument.• Better utilization of time for the officer on the

street. • Remote areas are better served.• Estimated 1/3 the cost of stand alone instruments. • Current breath testing instruments are more than

15 years old.

Requirements for Evidential Testing

(Department of Health Services, Title 17)

• Under the Jurisdiction of a Licensed Forensic Alcohol Laboratory.

• Instruments must be on the U.S. Department of Transportation “Conforming Products List”.

• Licensed Labs shall have on file with DHS written descriptions of each method it uses for Forensic Alcohol Analysis .

• Over 8.5 Million People. (Representing 26 % of the State’s population)

• Serving 46 Counties. (Comprising 72% of the State’s Land area)

• Over 400 Law Enforcement Agencies.

DOJ Lab Service

• Through the support of the Office of Traffic Safety.

• The initial distribution is based on the implementation of 1000 units throughout the BFS service areas.

• Analysis of BFS blood/breath alcohol program for the previous years determined the percentage allotted to each Regional Laboratory.

• Additional units can be accommodated by the program as it develops.

Data Transfer

Transferring Data to the D.O.J. computer network

• Breath Test Data is ultimately stored in the Police report and the D.O.J. computer network.

• The data transfer from the EPAS unit to the computer network is the responsibility of the user Agency.

• For security purposes the operator must use their operator I.D. to complete the Dial DOJ connection.

Current Program Status for DOJ

• Central Valley Lab- Stanislaus and San Joaquin Counties fully deployed

• Court accepted in Stanislaus (over 30 cases) and San Joaquin has several adjudicated cases, no court testimony to date

• Sacramento Lab- Most service areas operator trained, Yolo County deployed

• No court testimony to date for Sac Lab

• Freedom Lab, Santa Rosa Lab, Riverside Lab, Santa Barbara Lab, Redding Lab and Chico Lab staff have been trained and have begun and/or scheduled operator training (of officers)

• MTV Big Urban Myth show came to Riverside lab to dispute “Penny under the tongue” Myth
