ITALY In Italy the problem of the wage gap between men and women does not apply to the

employment contract, but its implementation and access to higher positions (career)

because of an inadequate welfare system. This joint effort should serve to highlight a

problem that can be seen from a reading of the contracts.

AUSTRIA Is therefore not relevant, because implemented at national level long ago

DENMARK We do not discuss documents adopted within the formal social dialogue with our

employers, as they are not party to them. The follow up to the statement (compiling

equal pay statistics) was a horror. Firstly, because we did not agree to use a

methodology that is internationally acknowledged and widely used (i.e. the ISCO-08).

Secondly, because at the end of the day the employers were not willing to honour their

commitment

DENMARK The issues are relevant enough. But the main focus of the Danish social partners in the

state sector has been and is on the so-called service check of our collective bargaining

system and agreements (cf. joint presentation at the DG/TUNED meeting in Budapest),

the tripartite negotiations (to foster competitiveness, growth and jobs) that the

Government called off before they even started, and the up-coming tripartite or more

likely bipartite negotiations on a trust reform in the public sector.

NORWAY The Norwegian debate is not so close to the action that takes place in the EU.

DENMARK Good cooperation between OAO and the State Employer’s Authority on the Danish

contribution to the report

ESTONIA In national and local level is very difficult to have discussions with employers.

NORWAY Most Norwegians can read documents in Swedish // We have a well-developed tripartite

in Norway generally works well when it comes to tariff and contract negotiations.

ESTONIA Employers were not interested of that issue for discussions.

DENMARK I was involved in the preparation and carrying out of the “Diversity through Equality”

Conference, 17 – 18 October 2007, Copenhagen. This also included co-writing the Danish

case that is presented in the report, doing a joint workshop presentation on “Equality and

diversity through recruitment” with a representative from the State Employer’s Authority

and a so-called role model, and co-drafting the Danish DG’s and TUNED spokesperson’s

concluding remarks.

SLOVAQUIA It is necessary to mention that in period 2006 – 2010 SLOVes focused on most urgent

issues in CGA and PA e.g. Labour Code – EU legislation approximation, on CA and PA staff

stabilisation (the Act on Civil Service, the CA reform, …), on CA and PA funding etc.

ITALY The limits of knowledge are due to the alternation of the Italian presence in the informal

social dialogue committee until 2009. One limitation is the absence of strong Italian

translations of documents and under-representation in those years, representatives of the

Italian government.

NORWAY We do not participate in NEA-work, although we have some members that have the

government as employer. We have not prioritized this work, but leaves it to the Norwegian

Association with heavy interests in the public sector

1.3 General comments on ESSD DENMARK General comment about the CGA European Sectoral Social Dialogue not covered in the

responses above: The present situation is most unhappy. We have a formal social dialogue with an employer organisation (EUPAE) that only represents the CGA employers from 9 (now 10) Member States, the majority of which do not have a well-functioning IR and CB structure at national level. We are struggling to attract CGA employers from Member States that do have well-functioning IR and CB structures at national level, but I am not optimistic about our chances of succeeding. A number of these CGA employers are involved in the intersectoral social dialogue via membership of CEEP and they have clearly stated that they are not interested in yet another formal structure, but they have also clearly signaled that they are interested in an informal, structured dialogue with TUNED. It goes without saying that (social dialogue) meetings which include our employers are much more interesting to us than (social dialogue) meetings which do not include our employers. But even if you ignore this important absence of employers in the Sectoral Social Dialogue Committee on CGA, I think it is fair to say that up to now the informal meetings with the DsG have generally been more substantial than the formal social dialogue meetings with EUPAE (e.g. the very interesting presentation of the impact of the crisis on industrial relations mechanisms in Ireland at the Copenhagen meeting this year). So the challenge is gigantic.

Other comments:

GERMANY In the municipalities, employers are not only successful in their employer-active

role, but also as a political representative.

NETHERLANDS The joint statement is in line with the situation in the Netherlands. Many of these

named aspects plays a role in our policy to employers and in the national discussion

with employers.

ESTONIA The statement is a joint message to the European Council and national

governments. A joint committee has been set-up by the social partners in local

government (the so-called 2A Committee) for the purpose of discussing

developmental trends and major societal challenges. Up to now the committee has

focused on the tripartite negotiations (to foster competitiveness, growth and jobs)

that the Government called off before they even started. The present focus is on the

up-coming tripartite or more likely bipartite negotiations on a trust reform in the

public sector

FINLAND There is difficult something to do, because Government reduced Income Tax for

LRG.

SWEDEN We already have this on agenda with the employers' organisation on national level.

When we write here and below that we think the statement was strong enough we

NETHERLANDS Social agreements for shrinking organisations in LRG, main due to austerity

measures but also to other developments (by example ICT). How to keep our

members employed in suitable jobs?

FINLAND Some of the issues are adequate. Mostly the issues discussed on national level are

more concrete.

DENMARK The most relevant priority in relation to national discussions/negotiations is skills

and life-long learning. There was a dialogue between the social partners in local

government on skills and life-long learning in the run-up to the tripartite

negotiations that were called off, and skills and life-long learning will be a topic in

the up-coming collective bargaining round (starting at the end of this year).

The social partners agree that investing in skills and life-long learning is crucial. But

whereas the employers focus on skills and life-long learning that are directly linked

to the job, the trade unions emphasize that focus should be on the improvement of

the workers’ market value (i.e. on enhancing their employability).

Equality is not really on the top of the agenda in Denmark. There have been two

minor joint projects. One project was on increasing the number of women in

managerial positions. The other project was a survey on gender mainstreaming in

the local (i.e. workplace level) wage development

implemented the European intersectoral agreement on work-related violence

(including 3rd party violence) through collective bargaining.

NETHERLANDS The guidelines are in international perspective relevant, but not so relevant

anymore for the situation in the Netherlands. The awareness and policy against

third party violence has grown and is already there for the most part.

GERMANY Third party violence is discussed with us, especially in the area of ??job centres,

social administration, wardens and bathrooms. For this purpose, making the

company offers comprehensive accident insurance for occupational development of

strategies for preventing violence.

SWEDEN The guidelines have not been used but the discussions leading up to them were

useful and the SD was a good arena for discussions.

SERBIA For these issues we spoke with competent ministry and the issues of migrant rights

to dignity and rights are matter of the ethical codes.

DENMARK Has been taken into account in discussions about recruitment in the works councils

NETHERLANDS However recruitment abroad hardly is an issue anymore at this moment, the

framework is starting point in recruitment issues. The framework also was one of

the principles of the (non-mandatory) certification for recruiters of the joint

associations of employers organisations in Health Care in the Netherlands.

NORWAY We have collaborated with the largest union for healthcare workers (not registered

nurses, but auxiliary nurses) and the employers union (hospital sector) and made

sure the code of conduct has been translated to Norwegian and joined forces to

promote it in various forums.

NORWAY It is a challenge that Norwegian authorities are not particularly concerned about this, but

focus on WHO's rules on ethical recruitment, as Health Directorate has made important

progress on

FINLAND It is yet not such a big issue in Finland. But we translated the framework of action

together with the employer so we should be unanimous of the basic principles. It is good

to have it done because cross-border recruitment is growing because of the staff

shortage.

ARMENIA Problems of international recruitment and placement in Armenia there. In the Republic

of the high and staffing (39.6 physicians of all specialties to 10 000), there is a problem of

uneven distribution of personnel between urban and rural areas, the solution of which

can take into account the principles of the European ethical rules.

SWEDEN We also have and use the WHO code, but mobility of health care staff to an from

Sweden is still very low so the codes have not been needed.

3.3 General comments on the ESSD:

FRANCE Concernant le secteur HSS, pour avoir un impact réel en France et pouvoir décliner les

différents accords de bonnes pratiques et autres dans le cadre de négociations nationales

dans les différentes convention collectives du secteur il faut que les employeurs ayant

capacité d’engagement et de négociation au niveau national s’organisent au niveau

européen. Une réelle politique européenne dans le secteur de la santé prendra tout son

sens quand un dialogue social européen sera aussi mis en place et reconnu au niveau du

secteur social.
