1. Introduction

Following the December 1995 Madrid European Council, an EU Mission visited Latin

America in September/October 1996 and produced a Report on Drugs in Latin America

(11256/96 CORDROGUE 87) containing 66 recommendations for future EU assistance to the

regIon.

The 1996 European Union Report on Drugs in Latin America, as prioritised in

CORDROGUE 17 (19 March 1998), and supplemented by the Conclusions of the First High­

Level Meeting on Drugs between the European Union and the States of Latin America and the

Caribbean (24 March 1998, CORDROGUE 21 of 31 March 1998), set the basis for this

Action Plan.

This report aims to place these agreed principles and priorities within a thematic action plan,

and to provide the framework for developing specific projects to take forward the

recommendations.

Consistent with the agreements reached at the UN General Assembly's Special Session on

Drugs (8-10 June 1998), this Action Plan is based on the principles of:

shared responsibility;

integrated, balanced and participatory approach;

sustainable development (including the need to observe environmental sustainability

criteria)

conformity with international law , in particular with full respect for the sovereignty and

territorial integrity of States, non-intervention in internal affairs of States, and all lyunan

rights and fundamental freedoms. /

2. General considerations

The Action Plan is governed by the consideration that:

All proposed activities should be compatible with the post-1999 EU Drugs Strategy and

the 1961, 1971 and 1988 UN drugs Conventions.

Highest priority should be given to those recommendations agreed in CODROGUE 17.

The Action Plan integrates those additional priorities discussed on March 23-24 into

potential projects.

Proposed activities should consider the CICAD document ,,Hemispherical Strategy

against Drugs" signed in Buenos Aires (Argentina) in September 1996, as well as the

declaration of Santiago de Chile (May 1998), and the October 1998 "Declaration of

Oporto" by Iberoamerican Heads of State and Government.

All possible sources of funding (see 13269/98 CORDROGUE 75 CODRO 7 ADD 1)

should be considered. In addition, the EU should encourage International Financial

Institutions (including the Inter-American Development Bank and the World Bank) to

provide funding for projects under the Action Plan. Funding from EU Member States

should also be encouraged. UNDCP and OAS/CICAD will continue to be important

partners in this context.

Due to the different local and regional character of the drugs problem, as well as different

levels of institutional and socio-economic development, there is a need for a

differentiated approach focusing on national, sub-regional and regional levels.

Inter-regional co-operation should be encouraged and be consistent with and

complementary to the EU Caribbean Drugs Initiative.

Projects must be based on precise and clear objectives, and methodology should include

proper monitoring and progress evaluation mechanisms, and provide for the necessary

corrective measures where required. In the assessment of projects to be funded, attention

will be paid to the existence of sound institutional and legal framework, as well as to the

availability of all elements regarded as essential for the sustainability in the long run.

Participation of local and regional expertise is essential to ensure a true sense of

ownership, thus creating a real partnership and the conditions for sustainability, which in

tum provide the best guarantee of success in reaching the stated goals of any projected

activities.

Project activities should be developed in the context of the broader framework of co­

operation at both regional and national levels, and should involve an exchange of ideas

with other relevant multilateral and bilateral partners, such as UNDCP and OAS/CICAD.

Given UNDCP' s large number of ongoing and planned projects in the region, it would

seem of interest that EU and UNDCP activities be mutually supportive and, if possible,

complementary .

3. Overall objectives

Drugs control assistance should aim at promoting national co-ordination and policy

development in the field of demand and supply reduction, by supporting the development and

the implementation of national master plans, including access to reliable and comparable

information systems on drugs trends, in line with the relevant provisions of UNGASS

(political Declaration, Guiding Principles on Demand Reduction). Co-operation with relevant

ED institutions and agencies such as EUROPOL and the EMCDDA should be enhanced. ED

experience should be shared with partners in the region. OAS/CICAD will be an important

instrument in this context.

In the following paragraphs areas are identified, in which action may be considered:

In the demand reduction area it should be considered to:

Explore means of transferring the methodology of the EMCDDA to interested Latin

American partners (with a possible extension to the Caribbean).

Continue current efforts of prevention, treatment and rehabilitation programmes for street

children and other vulnerable groups; support the actions in these areas of non­

governmental organisations which demonstrate dedication and professionalism;

Foster contacts at local government (city) and NGO level, bearing in mind the

possibilities of the "URBAL" city co-operation network;

Establish direct links between European and Latin American NGOs, as many activities,

especially referring to prevention/treatment/rehabilitation are executed by those

organisations and closer contacts could lead to a direct transfer of know-how.

~ In the field of supply reduction it should be envisaged to:

Mainstream alternative development into broader development issues in order to ensure

project impact and sustainability, as well as the necessary project funding;

Use alternative development as the key instrument for the elimination of coca and opium

poppy cultivation wherever low income peasant production structures are dominant;

Provide long-term support to alternative development in the Andean countries to

substantially reduce and eventually eradicate crops used for illicit purposes, principally

coca, as short term strategies have proven not to be effective;

Carefully co-ordinate alternative development and eradication efforts in such sense, that

there should be no eradication efforts in areas where alternative development

programmes are implemented as long as there are no viable alternative sources of

mcome;

Implement the projects and programmes in full accordance with the principles enshrined

in the "Action Plan on International co-operation on the Eradication of Illicit Drug Crops

and on Alternative Development" to co-ordinate the efforts of the EU and its member

states as well as with the efforts of other bi-and multilateral donors;

Pay special attention to the institutional capacities of the recipient countries and to

consider the possibilities of institutional strengthening programmes where necessary;

Support alternative economic opportunities that respond to farmers needs and constraints,

to local social and ecological conditions, have good market potential, and are

economically, socially and environmentally sustainable;

Promote the provision of physical, economic and social infrastructure which can extend

the provision of goods and services to drug crop producing areas;

Promote local participation through the strengthening of grass roots organisations and

participation of women. Promote local participation in project design and monitoring;

Strengthen intermediary institutions, including local government and NGOs;

Regard law enforcement as a necessary complement to alternative development; law

enforcement activities should respect human rights;

Avoid linking alternative development projects with eradication conditionality or with

any coercive intent to eradicate the drug crop;

Co-ordinate EU efforts in this field, also in relation to other international donors, to avoid

overlaps and achieve greater effectiveness, with the ultimate goal to playa fuller role in

alternative development in the drug producing areas of the Andean Region aimed at the

re-incorporation into legal economic activities of the poorest sectors.

In the field of law enforcement, actions should aim to

Support the structural modernisation of law enforcement agencies in respect to law

enforcement methods and techniques - acquisition of intelligence, information and crime

analysis.

Ifnecessary, improve methods of control at ports, airports and frontiers through technical

assistance and aid for equipment. Create a streamlined and effective communications

network between the Caribbean, Central America and the Andean Group, establishing in

each country a national contact point that is determined locally.

Improve links between the anti-drugs centres in the EU Member States, Latin America

and the Caribbean. This would include links with Europol, in line with the policy on co­

operation with third States and organisations as laid down in the Europol Convention.

Give specific emphasis on the training of experts.

Compile a manual of operative focal points.

Encourage networking of drug liaison officers or developing mechanisms for the

exchange of operational information. Where appropriate, Europol' s potential should be

used. In this respect reference is made to operational projects which are being carried out

by interested Member States in close co-operation with Europol and the Heads of Europol

National Units and which could be extended to include, where feasible, Latin American

and/or Caribbean partners.

In the fields of licit drug control, with emphasis on precursor chemicals, actions should

aim to

Fully apply the agreements on precursor control which have been concluded with the

countries of the Andean Pact, Mexico and Chile and support the negotiations of precursor

agreements with the Mercosur countries.

Encourage the compatibility of laws, including those specifying the precursor chemicals

to be controlled, and the monitoring systems in existence.

Enhance the domestic and inter-regional systems for precursor control, provision of

scientific and technical co-operation through training in assessment of licit needs,

information exchange, monitoring and investigation systems for chemical diversion,

taking into account existing activities of CICAD.

Promote the exchange of best practices in the field of precursor control, to facilitate more

effective co-operation both within the region and with the EU.

In the field of synthetic drugs, it could be considered to

Exchange information on risk assessment and control of synthetic drugs.

With respect to controlled deliveries, actions should aim to:

Support the elaboration and implementation of legislation on supervised/controlled

deliveries, as well as relevant mechanisms for international judicial co-operation.

Compile a manual on supervised/controlled deliveries, on the model of the European

Union manual on the subject.

The problem of growing violence resulting from drugs-related arms trafficking should

be taken into account by:

increased co-operation to hinder illegal arms trafficking and to achieve concrete results in

this field through appropriate measures. Special emphasis should be given to the OAS

Convention on Arms and Ammunition.

In the field of judicial organisation and drug legislation, it should be considered to

Establish an overview of ongoing joint activities

Where necessary, provide technical assistance for the upgrading oflegislation regarding

controlled deliveries and money laundering in line with the provisions of the 1988 UN

Convention, avoiding overlapping with UNDCP ongoing law and legislation

development projects, as well as existing CICAD model legislation activities.

Encourage the modernisation of central, autonomous judicial institutions to deal with

serious drug offences, in accordance with the principles of good governance and rule of

law.

Organise judicial training seminars and courses on drug matters, in close co-operation

with UNDCP and CICAD if possible.

Foster the establishment of a Latin American Financial Action Task Force (LAFATF)

through effective co-ordination ofEU members at FATF meetings.

Encourage the adoption of the 40 F ATF recommendations.

Support the creation of specialised units to deal with money laundering:

Financial Intelligence Units (FlU), which could at a later stage become effective

members of the Egmont Group

Law enforcement units.

Provide training for legal, financial and police experts on money laundering.

Co-operate closely with UNDCP and CICAD in the study of new global and regional

mechanisms of prevention on money laundering.

In order to ensure proper evaluation of the drugs situation in the region, the EU should

Consider to give active support to the Multilateral Evaluation Mechanism (MEM) of

CICAD, to the mutual benefit of both sides.

Specific emphasis should be given to enhance

Interregional co-operation between Latin America and the Caribbean

Explore means of transferring the methodology of the European Monitoring Center for

Drugs and Drug Addiction to interested Caribbean and Latin American partners.

Support the establishment ofa Drugs Liaison Officers (DLO's) network between Latin ...

America and the Caribbean.

Support inter-regional co-operation in the area of law enforcement training

Make full use of the existing training centres for customs and police co-operation, and

demand reduction. Develop the European dimension of partnership of such centers,

principally in the Caribbean, by offering multi-lingual curricula. At the yearly meeting of

the Co-operation and Co-ordination Mechanism, concrete training programmes should be

diffused systematically, in order to enhance the interest of partners in interregional

programmes.

Enhance inter-regional co-operation on maritime agreements based on the 1988 UN

Convention and maritime cooperation in general through the exchange of information and

best practices with the Latin American countries, including the activities of the PMO

(Project Management Office for Maritime Cooperation) in the Caribbean.

- Support inter-regional co-operation on exchange of information on movements of

precursor chemicals in close co-operation with OAS/CICAD.

Support inter-regional co-operation to combat money laundering based on the

implementation of international standards (UN Convention of 1988, FA TF

recommendations; Strasbourg Convention etc.).

Consider expanding the present CF ATF regional money laundering programme to

include additional Latin American countries, e.g. specific Andean countries and/or the

Central American countries who are members of the CF ATF but are currently excluded

from the programme.

Define specific interregional recommendations on the model of the 19 Aruba's

recommendations for the CF ATF.

.. Support inter-regional co-operation on drugs epidemiological surveillance, while

exploring the means of associating the European Monitoring Center for Drugs and Drugs

Addiction.

4. Proposals for short term action in the region:

1) Create a national drug observatory in Venezuela, with prospects of developing an observatory

for the Andean region by providing 2 MECU Commission funding, and assess the feasibility

of assessing interested countries to develop comparable structures in other parts of

LA/Caribbean.

2) Foster co-operation between Latin American and European NGOs in the field of demand

reduction, in close co-operation with the EMCDDA.

3) Execute 8 MECU Commission project for the upgrading of Colombian mapping systems:

foster co-ordination of Member States, as well as UNDCP and CICAD activities.

4) Taking into account the alternative development project that the Commission is developing in

Bolivia (30 MECU), as well as the project in Peru which at the moment is in the preparation

phase (28 MECU), foster close co-operation and co-ordination with Member States bilateral

and multilateral activities in the region, through regular co-ordination meetings on the spot,

with active participation of the recipient countries' authorities. An exchange of views with

other donors such as the US and Japan could be of interest.

5) Continue negotiations with a view of coming to the conclusion of a precursor agreement with

the Mercosur countries.

6) Create an information exchange network on law enforcement projects: National contact points I­

should gather relevant information on law enforcement projects, in order to give more

coherence for training and equipment support. UNCDP should playa key role in the

elaboration of an information exchange network, especially to avoid overlap with the existing

database of the Caribbean Co-ordination Mechanism. Furthermore, close co-operation with

the (regional) Dublin Group should avoid overlap.

7) Undertake missions to assess specific law enforcement training and equipment needs in the

regions, with the view of co-ordinating future activities.

8) Arouse the awareness of countries of the region to the effectiveness of controlled deliveries,

e.g. by offering special Europol seminars on the subject.

9) Enhance the creation of a regional Task Force on Money laundering for Latin America,

through a co-ordinated EU position in F ATF meetings

10) Consider calling for the accession of Latin American countries to the Council of Europe

Convention 141 on Money Laundering (Strasbourg Convention).

Short Term Interregional co-operation (Latin America/Caribbean)

1) Support inter-regional co-operation to support NGOs in the area of demand reduction by

organising interregional seminars and workshops to assess ongoing efforts with a view to

exchange relevant experience and know how. Co-operation between EUILA/Caribbean NGOs

should be fostered by involving actively the EMCDDA, with the view to support networking

in the field of demand reduction, taking into account the links already created by the

Cartagena meeting of Spanish/LA/Caribbean NGOs.

2) Strengthen the multilateral framework in the field of drugs co-operation in Latin America by

supporting the establishment of a Multilateral Evaluation Mechanism (MEM), presently under

consideration under the aegis of the CICAD. Possibilities for synergies with UNDCP's Global

Monitoring Project should also be identified.

3) Make full use of the existing training centers for customs and police co-operation and demand

reduction by offering multi-lingual curricula, and, at the yearly meeting of the Co-operation

and Co-ordination mechanism, diffuse concrete training programmes diffused systematically,

in order to enhance the interest of partners in interregional programmes.

4) Elaborate an inter-regional anti-precursor strategy, taking into account the ongoing regional

CICAD project, presently being implemented in the Caribbean region.

5) Foster interregional co-operation between Latin America and the Caribbean regarding existing

and/or future money laundering control programmes.
