(15) The territorial just transition plans should identify the territories most negatively affected, where JTF support should be concentrated and describe specific actions to be undertaken to reach a climate-neutral economy, notably as regards the conversion or closure of facilities involving fossil fuel production or other greenhouse gas intensive activities. Those territories should be precisely defined and correspond to NUTS level 3 regions or should be parts thereof. The plans should detail the challenges and needs of those territories and identify the type of operations needed in a manner that ensures the coherent development of climate-resilient economic activities that are also consistent with the transition to climate-neutrality and the objectives of the Green Deal. Only investments in accordance with the transition plans should receive financial support from the JTF. The territorial just transition plans should be part of the programmes (supported by the ERDF, the ESF+, the Cohesion Fund or the JTF, as the case may be) which are approved by the Commission.

Those territories should be precisely defined and correspond to NUTS level 3 regions or should be parts thereof. The plans should detail the challenges, the opportunities and needs of those territories, including the green, permanent and quality job creation potential required to achieve a socially just transition which leaves no one behind, and identify the type of operations needed in a manner that ensures the coherent development of climate-resilient economic activities that are also consistent with the transition to renewables-based, highly resource and energy-efficient climate-neutral and circular economy aimed at achieving net zero GHG emissions by 2040 and the objectives of the Green Deal. Only investments in accordance with the transition plans should receive financial support from the JTF. The territorial just transition plans should be part of the programmes (supported by the ERDF, the ESF+, the Cohesion Fund or the JTF, as the case may be) which are approved by the Commission.

(15) The territorial just transition plans should identify the territories most negatively affected, where JTF support should be concentrated and describe specific actions to be undertaken to reach a climate-neutral economy, notably as regards the conversion or closure of facilities involving fossil fuel production or other greenhouse gas intensive activities. Those territories should be precisely defined and correspond to NUTS level 3 regions or should be parts thereof. The plans should detail the challenges and needs of those territories and identify the type of operations needed in a manner that ensures the coherent development of climate-resilient economic activities that are also consistent with the transition to climate-neutrality and the objectives of the Green Deal. Only investments in accordance with the transition plans should receive financial support from the JTF. The territorial just transition plans should be part of the programmes (supported by the ERDF, the ESF+, the Cohesion Fund or the JTF, as the case may be) which are approved by the Commission.

This recital accuses all Member States, across the board, of incapability, while some have, on average, achieved a good outcome in the energy transition, unlike others who have been particularly non-compliant with regard to the agreed renewable energy targets under Europe 2020. It is deemed necessary to highlight what the main characteristics of a climate-neutral economy are, to bring clarity and common understanding. Therefore, the amendment modifying "Climate-neutral economy" into "fully renewables-based, highly resource and energy-efficient, climate-neutral and circular economy aimed at achieving net-zero GHG emissions by 2040", applies throughout the text and its approval would entail the modification of the entire text accordingly. Moreover, growing scientific evidence indicates that, in order to avoid the worst impacts of climate change, the EU should strive for a climate neutral economy by 2040. The latter is achievable in a cost-effective thanks to a highly-energy efficient and 100% renewable based energy system.

This provision deletes the mandatory contributions from ERDF and ESF+. It allows MS, on a voluntary basis, to use part of their ERDF and ESF+ national envelopes to contribute to the JTF up to 60% of the amount of support from the JTF. If all MS were to fully use this provision and with a global JTF allocation of 18,75bn, 30bn could be mobilised under this Regulation. This is in line with the EC proposal where MS are allowed to transfer more than 1.5 times the amount of support from the JTF but not exceed 3 times this amount. Justification

Supported activities under Article 4 of the draft JTF regulation must bring added value in comparison to the business-as-usual scenario. Beyond addressing the social impact on transitioning communities, it must support projects that offer economic opportunities. Crucially, it should finance re-skilling programmes for coal miners as well as investment in renewables, circular economy, environmental remediation, smart electricity solutions and enabling technologies and infrastructure. This would help address the economic and social impacts of the transition by creating job opportunities within the power sector. The current structure of the proposal does not seem to focus enough on the energy aspects of the transition. The mechanism should be as such that if, for instance, a coal power plant is closed down, the energy activity is still kept in the region. This applies above all in regions where a risk for the security of supply is identified, which could jeopardise their economic transformation.

Justification

Supported activities under Article 4 of the draft JTF regulation must bring added value in comparison to the business-as-usual scenario. Beyond addressing the social impact on transitioning communities, it must support projects that offer economic opportunities. Crucially, it should finance re-skilling programmes for coal miners as well as investment in renewables, the circular economy, environmental remediation, smart electricity solutions and enabling technologies and infrastructure. This would help address the economic and social impacts of the transition by creating job opportunities within the power sector. The current structure of the proposal does not seem to focus enough on the energy aspects of the transition. The mechanism should be as such that if, for instance, a coal power plant is closed down, the energy activity is still kept in the region. This applies above all in regions where a risk for the security of supply is identified, which could jeopardise their economic transformation

Justification

In order to speed up the transformation and reduce CO2 emissions, a very rapid development of RES and the transformation of the energy sector towards sources based on the combustion of natural gas is necessary during a transitional period. We suggest to extend the scope of JTF support by the inclusion of investments in natural gas infrastructure. Without these investments, many Member States and EU regions will not be able to make progress in the transformation process (for example, Poland's gasification rate is only 58%, and the country does not use nuclear energy like many other Member States do).

Justification

Amendment linked to the amendments suggested to Article 4(2). Supported activities under Article 4 of the draft JTF regulation must bring added value in comparison to the business-as-usual scenario. Beyond addressing the social impact on transitioning communities, it must support projects that offer economic opportunities. Crucially, it should finance re-skilling programmes for coal miners, as well as investment in renewables, the circular economy, environmental remediation, smart electricity solutions and enabling technologies and infrastructure. This would help address the economic and social impacts of the transition by creating job opportunities within the power sector. The current structure of the proposal does not seem to focus enough on the energy aspects of the transition. The mechanism should be as such that if, for instance, a coal power plant is closed down, the energy activity is still kept in the region. This applies above all in regions where a risk for the security of supply is identified, which could jeopardise their economic transformation. Moreover, the wording on the possibility for projects put forward by enterprises bigger than SMEs to be considered under the JTF does not provide clear signals for the right investments to be made in the needed areas. Large enterprises are the biggest employers in transforming sectors of the economy and all companies should have the possibility to contribute to the just transition.

The use of funds under the JTF is aimed at accelerating the reconversion of fossil fuel dependent activities towards fully environmentally sustainable activities, in line with the aim of achieving a fully renewables-based, highly resource and energy-efficient, climate-neutral and circular economy by 2040. GHG reduction technologies in ETS sectors can instead be financed via a multitude of other EU funds with many more resources, for instance: the EU innovation Fund, InvestEU, the EU Modernisation Fund etc.

We suggest to extend the scope of JTF support by the inclusion of investments in natural gas infrastructure. Without these investments, many Member States and EU regions will not be able to make progress in the transformation process (for example, Poland's gasification rate is only 58%, and the country does not use nuclear energy like many other Member States do). Moreover, we would like to point that the construction of the article makes it impossible to invest in the development of new technologies related to carbon, for instance hydrogen. Justification

We would welcome this addition in Article 5 that would clarify the inclusions in the scope of support, so as not to exclude companies that carry out activities in the broadly understood sector of the processing of products derived from fossil fuels. For instance, if a company dealing with propane processing, which has low CO2 emissions in its production technology, would like to implement an investment, e.g. in renewable energy sources: due to the wording of the proposed regulation, the operation in this sector could be excluded, which would not be conducive to low-emission transformation. Therefore, we would like to propose modifying this provision or clarifying it to the effect that companies operating in this sector that are characterised by low CO2 emissions (low GHG index) are not excluded from the scope of support.

To be consistent with the proposed amendment to Article 4(2) (a, b, c and e), it is proposed to exclude economic revitalisation activities from the scope of support, in order to focus JTF ressources on social and environmental issues induced by the transition. Economic revitalisation activities need a stronger financial support than the foreseen JTF budget and can be supported by other EU financial instruments (EIM, ERDF, Invest EU etc.).

- the investments are retrofitting and/or replacing existing more carbon-intensive infrastructure;

- the derogation shall only be used and granted for the purposes of the transition period until 2050.

Justification

To ensure security of supply we need more investments for a smooth and just transition from carbon to green electricity production. During this transitional period, it seems impossible to rely only on renewable energy production, and consequently we have to ensure that the natural gas might be used only for the transitional period as an energy source. In order to decrease emissions in the transport sector, we have to switch both passenger and freight transport to e-mobility and alternative fuels. Insofar as transport becomes more dependent on electricity production, we need a security of energy supply.
