SHORT TITLE - PURPOSE - SCOPE

SECTION 100 - SHORT TITLE - This ordinance s h a l l be known and may be c i t e d as the"New Lebanon Borough Zoning Ordinance'' h e r e i n a f t e r r e f erred t o as t h e "Zoning Ordinance".

The accompanying map i s hereby dec lared t o b e a p a r t of t h i s ordinance and s h a l l be known and may be c i t e d as t h e "New Lebanon Borough Zoning Map" h e r e i n a f t e r r e f e r r e d t o as t h e ''Z,oning Map".

SECTION 101 PURPOSE - The regula t ions of t h e "Zoning Ordinance" are made i n accordance wi th a comprehensive p lan and designed:

( a ) t o l e s s e n congest ion on t h e roads and highways. (b) t o secu re s a f e t y from f i r e , panic and o the r dangers. ( c ) t o promote h e a l t h and t h e genera l wel fa re . (d) t o provide adequate l i g h t and a i r . (e ) t o prevent t h e overcrowding of land. ( f ) t o avoid undue congestion of populat ion. (g) t o f a c i l i t a t e t h e adequate provis ion of t r a n s p o r t a t i o n ,

water, sewerage, schools , parks , and o the r pub l i c requirements.

Such r egu la t ions are a l s o made wi th reasonable cons idera t ion , among o the r t h ings , t o the' cha rac t e r of t h e d i s t r i c t s h e r e i n a f t e r s e t f o r t h and t h e i r p e c u l i a r s u i t a b i l i t y f o r p a r t i c u l a r uses , and wi th a view t o conserving t h e va lue of bu i ld ings and encouraging t h e most appropr i a t e use of land throughout t h e Borough.

SECTION 103 - STATEMENT OF COMMUNITY DEVELOPMENT OBJECTIVES

The Zoning Ordinance has been developed as a l e g i s l a t i v e and admin i s t r a t ive t o o l t o he lp t h e Borough Council and Planning Commission c a r r y out t h e gene ra l development ob jec t ives p re sc r ibed i n t h e Borough's Comprehensive Plan. 1972, and o f f i c i a l l y adopted by t h e Borough Council on A p r i l 9 , 1973.

This Plan was developed i n

SECTION 202 ZONING DISTRICT BOUNDARY LINE ZONING

202.1 - Lots i n Two Zoning Distr ic ts - Where a Zoning Distr ic t boundary l i n e d iv ides a l o t which w a s i n s i n g l e ownership and a l o t of record a t t h e e f f e c t i v e d a t e of t h e Zoning Ordinance, t h e use thereon and t h e o t h e r Zoning District r egu la t ions and provis ions applying t o t h e least r e s t r i c t e d p o r t i o n of such l o t under t h e Zoning Ordinance s h a l l be considered as extending t o t h e e n t i r e l o t , provided the more r e s t r i c t e d p o r t i o n of such l o t is e n t i r e l y w i t h i n 25 f e e t of s a i d d iv id ing Zoning Dis t r ic t boundary l ine . The use s o extended s h a l l be deemed t o be conforming.

INTERPRETATION AND APPLICATION

SECTION 300 - INTERPRETATION - I n i n t e r p r e t i n g and applying t h e provis ions of t h e Zoning Ordinance, they s h a l l be h e l d t o be t h e minimum requirements f o r t h e promotion of t h e pub l i c h e a l t h , s a f e t y , morals , comfort , convenience, and t h e gene ra l wel fa re : Where t h e provis ions of t h e Zoning Ordinance impose g r e a t e r r e s t r i c t i o n than t h o s e ' o f any s t a t u t e , o the r ordinance, o r r egu la t ions , t h e provis ions of t h e Zoning Ordinance s h a l l be con t ro l l i ng . Where t h e provis ions of any s t a t u t e , o the r ordinance o r r e g u l a t i o n impose g r e a t e r r e s t r i c t i o n s than t h e Zoning Ordinance, t h e provis ions of such s t a t u t e , o t h e r ordinance, o r r egu la t ions s h a l l b e c o n t r o l l i n g . The Zoning Ordinance is n o t intended t o i n t e r f e r e wi th , abrogate , o r annul any easement, covenant, o r o the r agreement between p r i v a t e p a r t i e s . However, where t h e Zoning Ordinance imposes g r e a t e r r e s t r i c t i o n s than those imposed by any such easement, covenant, o r agreement, t h e provis ions of t h e Zoning Ordinance s h a l l govern. Where any such easement, covenant, o r o t h e r agreement imposes g r e a t e r r e s t r i c t i o n s than those imposed by t h e Zoning Ordinance, t h e r e s t r i c t i o n s of t h e easement, covenant, o r o t h e r agreement s h a l l govern.

SECTION 301 - APPLICATION - The provis ions of t h e Zoning Ordinance s h a l l apply t o t h e use, and/or occupancy of a l l bu i ld ings , o t h e r s t r u c t u r e s , and/or l o t s .

301.1 - Conformity of Bui ldings, Other S t ruc tu res and/or Lots. - Any bu i ld ing , o t h e r s t r u c t u r e and/or l o t s h a l l be i n conformity wi th t h e provis ions prescr ibed i n t h e Zoning Ordinance f o r t h e Zoning D i s t r i c t i n which such bu i ld ing , o t h e r s t r u c t u r e and/or l o t i s loca ted .

301.2 - Conformity of Uses - The use and/or occupancy of any bu i ld ing , o t h e r s t r u c t u r e , and/or l o t s h a l l be i n conformity w i t h t h e provis ions pre- s c r ibed i n t h e Zoning Ordinance f o r t he Zoning Distr ic t i n which such bu i ld ing , o t h e r s t r u c t u r e and/or l o t is loca ted . l i s t e d s h a l l au tomat ica l ly be i n t e r p r e t e d as a p roh ib i t ed use.

SECTION 400 - PURPOSE OF ZONING DISTRICT - To provide a Zoning District i n which t h e predominate use is now a g r i c u l t u r a l o r open space and t o permit an o rde r ly conversion to r e s i d e n t i a l use i n o rde r t o :

(b) Mobile home u n i t s having less than 500 square f e e t of ground f l o o r area must l o c a t e i n mobile home parks.

(d) A l l mobile home o r t ra i ler l o t s s h a l l abut upon a driveway of n o t less than 24 f e e t i n width which s h a l l have unobstructed access t o a pub l i c street o r highway.

MOBILE HOME PARK

The mobile home park s h a l l conform t o the fol lowing requirements:

(a)The park s h a l l be loca t ed on a well-drained s i t e of a minimum of 5 t o 10 acres i n area, (o r some f i g u r e w i t h i n t h i s range determined by t h e Counci l ) , properly graded t o i n s u r e r a p i d drainage and freedom from s t agnan t pools of water.

(b) Mobile home spaces s h a l l b e provided cons i s t ing of a minimum of 3,000 square f e e t f o r each, which s h a l l b e a t least 45 f e e t wide and c l e a r l y def ined; provided, however, t h a t mobile home parks i n ex i s t ence a t t h e e f f e c t i v e d a t e of t h i s ordinance which provide mobile home spaces having widths o r areas less than t h a t he re in above p resc r ibed may cont inue t o ope ra t e wi th spaces of e x i s t i n g widths and areas, provided t h a t S t a t e Department of Environmental Resources (Health Dept.) requirements are m e t .

NON-CONFORMING USES, STRUCTURES AND LOTS

SECTION 1700 - INTENT AND STANDARDS

Within t h e d i s t r i c t s e s t a b l i s h e d by t h i s ordinance 6r amendments t h a t may la te r b e adopted t h e r e e x i s t s l o t s , s t r u c t u r e s and. uses of land and s t r u c t u r e s which were lawful be fo re t h i s ordinance w a s passed o r amended, b u t which would be p roh ib i t ed under t h e terms of t h i s ordinance o r f u t u r e amendment.

It is t h e i n t e n t of t h i s ordinance t o permit thesetnon-conformities t o cont inue u n t i l they are removed. t o b e incompatible w i t h permit ted uses i n t h e d i s t r i c t s involved. Non- conformit ies may be enlarged and expanded as determined by t h e Zoning Hearing Board t o be i n conformity wi th e x i s t i n g l a w .

(a) No such non-conforming use s h a l l b e en larged o r i nc reased , nor extended t o occupy a g r e a t e r area of land than was occupied a t t h e e f f e c t i v e d a t e of adopt ion o r amendment of t h i s ordinance, except as s p e c i f i e d by Sec t ion 1700 of t h i s Ordinance.

(b) No such non-conforming use s h a l l be moved i n whole o r i n p a r t t o any o t h e r p o r t i o n of t h e l o t o r parce l .occupied by such use at t h e e f f e c t i v e d a t e of adopt ion o r amendment of t h i s ordinance.

(c) I f any such non-conforming use of land ceases f o r any reason f o r a per iod of more than 30 days, any subsequent use of such land s h a l l conform t o t h e r egu la t ions s p e c i f i e d by t h i s ordinance f o r t h e d i s t r i c t i n which such land is loca ted .

(d) Regardless of any o t h e r provis ion of t h i s ordinance, every junk yard e x i s t i n g as a non-conforming use s h a l l w i t h i n two (2) yea r s a f t e r becoming non-conforming be completely enclosed w i t h i n a continuous s o l i d fence o r evergreen hedge found on a de termina t ion of t h e Zoning Hearing Board t o be of such h e i g h t and cha rac t e r as t o screen a l l ope ra t ions of such es tab l i shment and which fence o r hedge s h a l l be maintained i n f u l l conformity wi th any condi t ions a t t ached t o such approval.

SECTION 1704 - NON-CONFORMING USES OF STRUCTURES ,

I f a l awful use of a s t r u c t u r e , o r of a s t r u c t u r e and premises i n com- b i n a t i o n , exists at t h e e f f e c t i v e d a t e of adopt ion o r amendment of t h i s ordinance, t h a t would no t be allowed i n t h e d i s t r i c t under the terms of t h i s ordinance, t h e lawful use may be continued s o long as i t remains otherwise lawful , s u b j e c t t o t h e fol lowing provis ions :

1704.1 (a) An e x i s t i n g s t r u c t u r e devoted t o a use not permit ted by t h i s ordinance i n t h e d i s t r i c t i n which i t is loca ted may be en larged , extended, cons t ruc ted , r econs t ruc t ed , o r s t r u c t u r a l l y a l t e r e d t o any reasonable amount upon g ran t ing of a var iance by t h e Zoning Hearing Board.

Any non-conforming use may be extended throughout any p a r t of a bu i ld ing which were mani fes t ly arranged o r designed f o r such use a t t h e t i m e of adopt ion o r amend- ment of t h i s ordinance, b u t no such use s h a l l b e extended t o occupy any land ou t s ide such bu i ld ing .

(b)

(c) I f no s t r u c t u r a l a l t e r a t i o n s are made, any non-conforming use of a s t r u c t u r e , o r a s t r u c t u r e and premises, may be changed t o another non-conforming use provided that t h e Zoning Hearing Board e i t h e r by genera l r u l e , o r by making f ind ings i n t h e s p e c i f i c case, s h a l l f i n d that t h e proposed use is equal ly appropr i a t e o r more appropr i a t e t o t h e d i s t r i c t than t h e e x i s t i n g non-conforming use. I n permi t t ing such change, t h e Zoning Hearing Board may r e q u i r e appropr i a t e condi t ions and safeguards i n accord wi th the provis ions of t h i s ordinance.

(d) Any s t r u c t u r e , o r s t r u c t u r e and land i n combination, i n o r on which a non-conforming use i s superseded by a permit ted use, s h a l l t h e r e a f t e r conform t o t h e r egu la t ions f o r t h e d i s t r i c t i n which such s t r u c t u r e is loca ted , and the non-conforming use may n o t t h e r e a f t e r be resumed.

ZONING HEARING BOARD

SECTION 1900 - CREATION AND FUNCTION
