1 Overview____________________________________________________________

1.1 Purpose of ETA

Enabled by legislation, Ohio’s Electronic Title Application (ETA) has been functioning since

2005. The intent of the ETA Interface is to provide an electronic means for title applications to

be submitted to Clerks of Courts’ offices. Electronic exchanges of messages provides for

increased data accuracy, reduces the need for duplicate data entry and allows for more efficient,

timely title processing.

Transactions received through ETA are reviewed and processed by Clerks of Courts staff using

the Automated Title Processing System (ATPS). In conjunction with a wholesale rewrite of ATPS

implemented in January of 2017, ETA was also upgraded.

1.2 Becoming an ETA Participant

ETA Participants need to register with the Ohio Department of Public Safety through use of the

ETA Participant Agreement. Prior to submitting an agreement, potential ETA participants must

establish a working relationship with one or more Clerks of Courts to ensure that transactions

routed to the county will be processed.

The agreement includes an attachment called “Acknowledgement of Financial Arrangements”

that must be completed by a Clerk of Courts indicating the Clerk’s agreement to process

transactions from the ETA participant and acknowledging that the participant and the Clerk have

a financial arrangement to ensure proper payment to the Clerk. The ETA participant may submit

multiple attachments from counties if they choose to do business in more than one county. The

ETA Participant Agreement must be completed in its entirety and is submitted to the BMV’s Title

Support section for processing.

1.3 How it Works

Transactions submitted by ETA participants must contain scanned images of the same

evidentiary documents that would be presented to a Clerk of Courts title office if the request for

the title transaction was made in person. The transaction moves through the following general

process:

A transaction is initiated through the participant’s application or through a service

provider’s system.

If the request passes validations performed by the ETA system, the transaction will be

placed in a queue at the county designated within the request.

Clerk of Courts staff at the designated county will perform their due diligence on the

transaction verifying the data and the scanned images received from the participant. The

transaction will either be approved or rejected.

If rejected, a response message indicating the reason for the rejection will be returned to

the participant.

If approved, Clerk of Courts staff will pass the transaction into the core ATPS for title

issuance.

Once the title has been issued, a response message and document(s) are readied by the

system and, when inquired upon, will be sent to the participant.

The diagram below portrays the flow of a transaction through the ETA process.

1.4 Information Security

Upon completion of ETA participant agreement, the ETA participant will be provided with an ETA

access key. This key will be used to authenticate the participant, and should be submitted only

over an HTTPS connection. ODPS provides for Transport Layer Security encryption (TLS1.2).

ETA Participants must also account for non-repudiation when exchanging data. DPS assumes

that any data submitted with a valid ETA Participant’s account and access key were actually

submitted by that ETA Participant.

2 Application Submission__ __________________________

2.1 Information Contained in Request

Transactions submitted must contain the ETA Access Key provided by ODPS. This key is

system-generated and will be provided to the participant or their service provider after approval

of the participant agreement and entry of the new participant into ATPS by Title Support.

Each transaction must also contain an indication of which county the transaction should be

routed to for processing. If the destination county is not one for which the participant has

submitted an “Acknowledgement of Financial Arrangements”, the transaction will be rejected.

Once the system accepts the transaction it validates the participant and the request and then

routes the transaction to the appropriate county for verification and ATPS title processing. The

ETA Participant is able to inquire on the status of submitted applications, and receive appropriate

response messages (e.g., Approved, Rejected).

2.2 Title Types

Title Type - Code Description

Original - O Original – This title type is issued when there is an ownership change or, in the case of a vehicle coming in to Ohio from out-of-state, the first time a title is issued in Ohio for a particular owner.

Replacement - R Replacement – A replacement title is issued when there is no change of ownership but a new title is necessary due to a change in data (such as a typographical error) or because the title has been defaced (such as when a sale falls through after the assignment has already been made on the back of the title).

Duplicate - D Duplicate – A duplicate title is issued when the previous title has been declared lost, stolen or destroyed.

Salvage - S Salvage – A salvage title is issued when a vehicle has been declared economically impractical to repair by an insurance company or other entity or when a vehicle is left unclaimed and a title is issued to a law enforcement agency. A change of ownership has occurred when a salvage title is issued.

Salvage Replacement - V Salvage Replacement – A salvage replacement title is issued when there is no change of ownership and the vehicle has been declared economically impractical to repair.

Salvage Duplicate - L Salvage Duplicate – A salvage duplicate title is issued when the previous title is already a salvage title and the title has been lost, stolen or destroyed.

Memo Only – M Memo Only – A memorandum certificate (memo) is a non-negotiable document used to apply for a registration. It is generally issued when a lienholder is holding the original title. A memo-only is issued when the title is already in the customer's name and all you need is the memorandum certificate.

2.3 Evidence Types

Evidence Type - Code Description

Ohio Title - OT Indicate ‘Ohio Title’ as the Evidence Type when an Ohio Title is presented as evidence and a lienholder is not repossessing the property. The title type must be Original, Salvage, Replacement or Salvage Replacement.

Non-Ohio Title - NT Indicate ‘Non-Ohio Title’ as the Evidence Type when an out of state title is presented as evidence and it has not been reassigned. The title type must be Original or Salvage.

MCO In State - MC Indicate ‘MCO – In State’ when an Ohio Dealer is selling property directly from the Manufacturer’s Certificate of Origin (MCO). The title type must be Original or Salvage.

MCO Out of State - MO Indicate ‘MCO – Out of State’ when an out of state dealer or Ohio Manufacturer is selling property from the Manufacturer’s Certificate of Origin (MCO). The title type must be Original or Salvage.

Unclaimed Affidavit 4505/4585 - UA

Indicate ‘Unclaimed Affidavit 4505/4585’ when an unclaimed affidavit is presented as evidence for a vehicle abandoned at a repair garage or place of storage or when a watercraft has been abandoned on private property. The title type must be Original or Salvage.

Unclaimed Affidavit 4513/1547 - UB

Indicate ‘Unclaimed Affidavit 4513/1547’ when an unclaimed affidavit is presented as evidence for a vehicle or watercraft that has been ordered towed by law enforcement. The title type must be Salvage.

Unclaimed (4505/4585) – UC Indicate ‘Unclaimed’ when a Salvage title is being applied for as a result of a non-law enforcement Unclaimed Affidavit abandoned at a repair garage or storage facility or when an insurance company is applying for a title without an assigned title.

Unclaimed 4209 Affidavit - UD Indicate ‘Unclaimed 4209 Affidavit’ when an unclaimed salvage motor vehicle affidavit is presented as evidence for a vehicle that has been left abandoned at a repair garage, towing service or storage facility and the value of the vehicle is less than $1500. Any vehicle issued a title with this evidence type cannot be used for anything except parts or scrap metal. The title type must be Salvage. The title will be immediately and automatically inactivated as ‘Junk’ once it is issued.

Authorization Letter - AL Indicate ‘Authorization Letter’ as the Evidence Type when an official Authorization Letter from the BMV or ODNR is presented as evidence. An Ohio Title record must exist in ATPS. The title type must be Original or Salvage.

Bill of Sale - BS Indicate ‘Bill of Sale’ as the Evidence Type when a bill of sale is presented as

evidence. The title type must be Original or Salvage.

Assembled - AS Indicate ‘Assembled’ as the Evidence Type when property has been self-assembled. The title type must be Original.

Affidavit of Ownership - AO Indicate ‘Affidavit of Ownership’ as the Evidence Type when an affidavit of ownership is presented as evidence. This evidence type can only be used when the body type is AT, OR, US, UV or MT. The title type must be Original or Salvage.

Court Order - CO Indicate ‘Court Order’ as the Evidence Type when a court order is presented as evidence. The title type must be Original or Salvage.

Registration - RG Indicate ‘Registration’ as the Evidence Type when a Registration is presented as evidence. The title type must be Original or Salvage.

Reassignment - RS Indicate ‘Reassignment’ as the Evidence Type when a title has been assigned to an out of state Dealer and then reassigned to another owner without a new title being

issued. The title may be an Ohio Title or an out of state title. The title type must be Original or Salvage.

Repossession - RP Indicate ‘Repossession’ as the Evidence Type when an Ohio Title is presented as evidence and the lienholder is taking possession of the property. The title type must be Original or Salvage.

None - NO Indicate ‘None’ as the Evidence Type when the Ohio Title is lost, stolen or destroyed. The Title Type must be either ‘Duplicate’ or ‘Salvage Duplicate.’

3 Approved and Rejected Transactions____________________________________

3.1 Approved Transactions

A transaction request will be validated with the structures defined in Section 2.4

“Message Requirements”. If the validation succeeds, the transaction will be

marked for further processing and routed to the destination county indicated within

the message for further processing otherwise the message will be marked

rejected, an error message will be sent to the ETA Dealer and no further

processing will take place.

Messages marked for further processing will be picked up by the respective Clerk

of Courts Title Office where staff will perform the verification against submitted data

and scanned images. County Title Office staff will take appropriate action based

on submitted information. If the county approves the transaction based on the data

and images submitted, the county will issue the title.

As noted, if all of the validations and verification are successful, the title will be

issued at the destination county specified by the ETA dealer in the original request.

After the title is issued, the information related to the fees, receipt and

memorandum certificate, if applicable, will be marked completed.

3.2 Rejected Transactions

Transactions can be rejected at different stages throughout the ETA process. If the transaction

does not pass initial validations, below is a list of rejection messages that may be returned.

6 Approval for Production – Testing Requirements_______________________

After registering with ODPS as an ETA participant, it is recommended than an exchange of

messages take place to ensure both systems are interpreting and employing standards in the

same way. ODPS will put you in touch with a technical support analyst to help with testing and

analyzing test results.

To ensure valid tests, ODPS support analysts are not authorized to modify any test data provided

by the participant, however, ODPS support analysts will provide the sender with data values that

are valid in the ODPS test environment (active title numbers, valid VINs, etc.). The

Test/Production Indicator must be set to “T,” or the messages will be rejected before any other

validations take place.

7 GLOSSARY OF TERMS

The following terms are used throughout this document or are related to ETA processing:

ATPS - Automated Title Processing System. The data processing system for motor vehicle and watercraft titles for the State of Ohio.

Brand - An indicator on a title that describes a vehicle’s history as it relates to the vehicle’s previous use or to damage incurred.

Control Number - For printed titles, the Control Number is pre-printed on the paper form on which the title is printed. Control Numbers help secure and audit title paper stock. For non-printed titles, Control Number is the only identifier guaranteed to uniquely identify a title in the State of Ohio. It is also maintained for compatibility with printed titles. Control Numbers for non-printed titles have no interdependence with the printed title Control Numbers.

DPS - Ohio Department of Public Safety.

ETA Participant - A DPS registered entity authorized to send and receive transactions electronically via the ATPS ETA interface, with or without the use of a Service Provider.

ETA Transaction - A cohesive collection of data and control elements that has the purpose of modifying or retrieving information about a single entity, such as a vehicle title or a lien.

Memorandum Certificate (Memo) - A non-negotiable document printed on non-title stock (plain paper). A Memo is not assignable and is used primarily for vehicle registration purposes.

Message - A data stream that is transferred as a unit between business partners.

Non Negotiable Evidence of Ownership - A document printed on plain paper at the office of the ETA Participant intended to be used in the same manner as a Memorandum Certificate.

Non-printed Title - A title that exists only within Ohio’s ATPS system and does not have a paper or hard copy counterpart. Also referred to as an electronic title.

NMVTIS - National Motor Vehicle Title Information System - Title II of the Anti Car Theft Act of 1992 required the Department of Transportation (DOT) to implement a National Motor Vehicle Title Information System. NMVTIS makes it difficult for automobile thieves to obtain legitimate vehicle ownership documentation. The Anti Car Theft Improvements Act of 1996 was signed into law on July 2, 1996. It amends the Anti Car Theft Act of 1992 to give the Department of Justice the responsibility for the information system. NMVTIS reduces titling of stolen cars and fraud by allowing state titling agencies to verify the validity of ownership documents before they issue new titles. NMVTIS also checks to see if the vehicle is reported "stolen" -- if so, the states don't issue the new titles. Brands are not lost when the vehicle travels from state to state, because NMVTIS keeps a history of all brands ever applied by any state to a vehicle.

Printed Title - A title that exists both within Ohio’s ATPS system and on paper; i.e., there exists a legal paper document representing ownership. Also referred to as a physical title. Printed Ohio certificates of title are printed on secure paper.

Property - In addition to land-based vehicles of all types and body styles (e.g., automobiles, trucks, trailers and mobile homes) includes watercraft and outboard motors.

TOD – Transfer on Death. Use of this feature allows an owner to designate a person or persons to whom ownership of their vehicle, watercraft or outboard motor will pass in the event of the death of the owner.

Transaction – A transaction is a single message exchange that includes a request and an acknowledgement. WROS – With Rights of Survivorship. Use of this feature allows two joint owners to ensure that upon the death of one, ownership will pass to the other.
