REPUBLIC ACT 9003January 26, 2001 AN ACT PROVIDING FOR AN ECOLOGICAL SOLID ASTE !ANAGE!ENT PROGRA!, CREATING T"E NECESSAR# INSTITUTIONAL !EC"ANIS!S AND INCENTIVES, DECLARING CERTAIN ACTS PRO"IBITED AND PROVIDING PENALTIES, APPROPRIATING FUNDS T"EREFOR, AND FOR OT"ER PURPOSESEcological Solid Waste Management Act provides the legal framework for the countrys systematic, comprehensive and ecological solid waste management program that shall ensure protection of public health and the environment. It underscores, among other things, the need to create the necessary institutional mechanisms and incentives, as well as imposes penalties for acts in violation of any of its provisions.S$%&'(n 2)Declaration of Policiesto adopt a systematic, comprehensive and ecological solid waste management program which shall:(a) nsure the protection of the public health and environment!(b) "tili#e environmentally$sound methods that ma%imi#e the utili#ation of valuable resources and encourage resource conservation and recovery!(c) &et guidelines and targets for solid waste avoidance and volume reduction through source reduction and waste minimi#ation measures, including composting, recycling, re$use, recovery, green charcoal process, and others, before collection, treatment and disposal in appropriate and environmentally sound solid waste management facilities in accordance with ecologically sustainable development principles!(d) nsure the proper segregation, collection, transport, storage, treatment and disposal of solid waste through the formulation and adoption of the best environmental practice in ecological waste management e%cluding incineration!(e) 'romote national research and development programs for improved solid waste management and resource conservation techni(ues, more e)ective institutional arrangement and indigenous and improved methods of waste reduction, collection, separation and recovery!(f) ncourage greater private sector participation in solid waste management!(g) *etain primary enforcement and responsibility of solid waste management with local government units while establishing a cooperative e)ort among the national government, other local government units, non$ government organi#ations, and the private sector!(h) ncourage cooperation and self$regulation among waste generators through the application of market$based instruments!(i) Institutionali#e public participation in the development and implementation of national and local integrated, comprehensive, and ecological waste management programs! and(+) &trengthen the integration of ecological solid waste management and resource conservation and recovery topics into the academic curricula of formal and non$formal education in order to promote environmental awareness and action among the citi#enry.S$%&'(n *)National Solid Waste Management Commissionunder the ,-ce of the 'residentcomposed of fourteen (./) members from the government sector and three members from the private sectorthe government sector shall be represented by the heads of the following agencies in theirex ofciocapacity: (.) 0epartment of nvironment and 1atural *esources (01*)! (2) 0epartment of the Interior and 3ocal 4overnment (0I34)! (5) 0epartment of &cience and 6echnology (0,&6)! (/) 0epartment of 'ublic 7orks and 8ighways (0'78)! (9) 0epartment of 8ealth (0,8)! (:) 0epartment of 6rade and Industry (06I)! (;) 0epartment of anila 0evelopment >0anagement 'lan through its various political subdivisions and in cooperation with the private sector and the 14,s!(/) anagement 'lan!(9) Bonvene regular meetings for purposes of planning and coordinating the implementation of the solid waste management plans of the respective component barangays!(:) ,versee the implementation of the Bity or >unicipal &olid 7aste >anagement 'lan!(;) *eview every two (2) years or as the need arises the Bity or >unicipal &olid 7aste >anagement 'lan for purposes of ensuring its sustainability, viability, e)ectiveness and relevance in relation to local and international developments in the Celd of solid waste management!(=) 0evelop the speciCc mechanics and guidelines for the implementation of the Bity or >unicipal &olid 7aste >anagement 'lan!(?) *ecommended to appropriate local government authorities speciCc measures or proposals for franchise or build$operate$transfer agreements with duly recogni#ed institutions, pursuant to *.ake sure that whatever is being thrown is being done so after it has been used and refused to the ma%imum e%tent possible.
