Congress Can Still Do Much

Congress will convene what istermed ‘a lame duck session’.Mainstream Media is focused

upon what the Republicans may do to redirectmatters towards their ideologies. However,Senator Harry Reid and the Democratic mem-bers of the Senate are still an effective majorityuntil replaced.

It is estimated that about 175 pieces of leg-islation have been passed by the current Houseof Representatives under the leadership ofSpeaker Nancy Pelosi. There is a DemocraticParty majority in the House until after Decem-ber 31, 2010. It is these 175 pieces of legisla-tion which the Senate, under the leadership ofSenator Harry Reid (Democrat) must nowram-rod through its voting procedures so thatPresident Obama may consider them for sig-nature which will make them the ‘law of theland’. That will provide the coming Republi-can majority of the House something to con-sider and cope with. Democrats will stillcontrol the Senate and the White House. AfterJanuary 2011 expect Congress to become ex-tremely ineffective unless the Republican ma-jority is willing to negotiate and compromise.

One of the very important issues beingfaced is the national deficit. The current deficitspending, especially the borrowing of moneyto conduct two wars, must come to an end. Itdoes not matter which administration initiatedthe borrowing. It does matter that the borrow-ing stop. In addition all entitlements and sub-sidies must be re-evaluated and re-assessed. Itis impossible to decrease the national deficitwithout cutting back on spending and cuttingback on borrowing. A pay-as-you-go effort isnot enough. Our nation is strongest when itlives within its means.

The projected monies needed for SocialSecurity entitlements can be funded by contin-uing and applying the “Bush Taxes” to the topone percent of all taxpayers. It is projected byseveral sources that taxes on the ‘ultra-rich’could fund all the Social Security Administra-tion entitlements from now on. The currentstance of the Republicans on extending the“Bush Taxes” to all without modification is notrational. The ‘ultra-rich’ will never miss thatmoney. It has always fallen upon the verywealthy to assist all those who have legitimateneeds.

Another tax issue must be addressed. Cur-rently, many American multinational corpora-tions have parked enormous amounts ofmoney in ‘offshore’ financial institutions. Thisis done to avoid taxes on profits generated off-shore. Some adjustments are called for whichenable this money to come home becausethose multinational corporations can then usethat capital to establish new domestic produc-tion and manufacturing systems which mayprovide employment to many without the useof federal subsidies. The federal funding of‘shovel-ready’ infrastructures can only do somuch. American corporations must step up toundo the damage already done to the Americanconsumer economy by their current practiceswhich establish factory jobs offshore.

If America is to continue to be a super-power, it must have an economy which is en-abled by a domestic work force that iseducated. Therefore, education is the issuewhich must be addressed in a bipartisan man-ner by Congress. Meg Whitman was correct inadvising all who could, to go experience thatdocumentary about our current educationalsystem (Waiting for Superman). Too manychildren having high potential are simply notbeing taught the basics of reading, writing, andmath. Without these skills a developing indi-vidual cannot proceed towards vocations andprofessions which require facility in commu-nications, information technology, and engi-neering. An understanding of science is basicto development of professionals in biology,biomedical sciences, engineering and technol-ogy. The stranglehold of special union interestssuch as the National Education Associationand the National Teachers Association must bemitigated to permit retention of effectiveteachers; the rehabilitation of the incompetent;and the relief of burnt-out teachers.

Simply stated, until the newly elected of-ficials are sworn in and seated, the present U.S.Congress is still dominated by Democrats. TheObama Administration needs to receive fromthe Senate all those 175 legislations that theHouse has already passed. All of us need tocall our Senators and Members of the Houseto let them know that we expect Congress, es-pecially the Senate, to do much before the endof the current congressional session. You willfind their district office phone numbers in the‘blue pages’ of the phone book under FederalGovernment.Δ

Washington, DC – There is renewedurgency around the DREAM Actin Washington. Across the coun-

try, Spanish-language media is chronicling thesedevelopments, showing how important the legis-lation is to a large segment of the Latino popula-tion. Last night, a televised town hall hosted byLawrence O’Donnell on MSNBC made a com-pelling case for the DREAM Act as a key step-ping stone on the way to broader immigrationreform.

Today, the most influential Spanish-languagenewspaper in the nation, La Opinión, made acompelling case for DREAM in an editorial en-titled, “The Time is Now!” The newspaperwrites, “This is the moment to make the effort topass the DREAM Act and open up the path forhundreds of thousands of young people to enterthe university or serve in the Armed Forces. Thislegislative session is filled with dozens of legis-lators who have either lost their reelection or areplanning to retire. They have nothing to lose bydoing the right thing and voting for a bill that willhelp the economy in the short and long term bypreparing our country’s future labor force. At thesame time, they will be strengthening the mili-tary. Political savvy and determination will beneeded to pass this legislation. Opportunitiesexist to attach it to other bills if it appears that itcannot be approved on its own. With so much atstake, the time to act is now!”

Similarly, the leading figure on Spanish-lan-guage television, Jorge Ramos of Univisión,wrote a column (in Spanish) imploring both par-ties to remember that the DREAM Act is a prac-tical and common sense approach tostrengthening America’s military and economicfutures while living up to our best national tradi-tions.

Over the past few days, momentum has builton behalf of DREAM in the corridors of CapitolHill, as Democratic leadership from both con-gressional houses announced plans to move onDREAM during the impending congressionallame duck session. Today, the DREAM Act willbe the topic of a meeting between PresidentObama and leading members of the Congres-sional Hispanic Caucus (CHC), Senator RobertMenendez (D-NJ), Rep. Nydia Velazquez (D-NY) and Rep. Luis Gutierrez (D-IL), who alsoare expected to discuss the need for comprehen-sive immigration reform. Notably, the Demo-cratic leadership support has been joined byimportant Republican voices in recent days, suchas Representative Lincoln Diaz-Balart (R-FL),who yesterday called on Speaker Pelosi to sched-ule a vote on the legislation this year; Congress-woman Ileana Ros-Lehtinen (R-FL), who notedher support for moving DREAM in an interviewwith Univisión; and incoming RepresentativeDavid Rivera (R-FL), who told Jorge Ramos thathe supports the DREAM Act on Al Punto.

According to Frank Sharry, Executive Direc-tor of America’s Voice, “Not only is passage ofthe DREAM Act a priority for Latino voters, butit’s broadly popular with all Americans. Democ-rats have a window of opportunity to show theycan pass real immigration reform. Republicansalso have a window of opportunity to show thatthey can move past their anti-immigrant partyimage and support common sense immigrationreform. Voters are eager to see Washington worktogether to pass exactly this type of bipartisanlegislation, and will hold both parties accountablefor how they handle the debate.”

Newly renovatedCasa Grande

Constructed in 1854 to 1855,Casa Grande (the big house)is the most prominent build-

ing in the Hacienda, the previous miningarea now known as New Almaden. It wasbuilt as a hotel but became the mine man-ager’s residence. The Hacienda also con-tained the homes of additionalmanagement and furnace workers. TheSanta Clara County Parks and RecreationDepartment purchased the house in 1981.

“This is a very exciting day for thecounty, for everyone here, for the Daugh-ters of the American Revolution andwe’re dedicating this Casa Grande after150 years of existence," said SupervisorDon Gage, District One, Santa ClaraCounty. "If you saw it before you would-n’t recognize it, today, it is absolutelybeautiful.”

Casa Grande, the second most histor-ical building was newly renovated, re-ceiving a $5 million transformation madepossible by several grants from the stateand nation. Renovations include re-cre-ations of rooms furnished with periodpieces, a sales area and the mining mu-seum.

The museum has exhibits on quick-silver mining as well as historical photo-graphs and artifacts showing what life

were like in the quicksilver miningtowns. It has maps showing the huge net-work of mining tunnels. There werearound 100 miles of tunnels. Some de-scended hundreds of feet below sea level.

“This is drop dead beautiful, just gor-geous, no matter what side you’re look-ing at. You can see lush foliage orhillsides,” said San Jose City Coun-cilmember Nancy Pile.

Attached to the Casa Grande is theOpry House. This was added on to theCasa Grande in later years. It was a dancehall for miners in the 1920's. Additionsand improvements were made to it overthe years. More recently, until 1998, thetheater in the Opry House was a popularspot for watching baudy vaudeville-re-vival entertainment.

“The Casa Grande set the tone forthe multiethnic community of respectedMexicans, Irish, Swedes, Germans, Span-ish, Chinese, Native American, and oth-ers who call these hills home,” saidkeynote speaker and author Craig Mc-Donald.

Casa Grande is open year-round Fri-days, Saturdays and Sundays except formajor holidays. The district of New Al-maden is located in south San Jose, offthe Almaden Expressway. The Museumis located at 21350 Almaden Rd.

La amenaza en las es-cuelas se ha conver-tido en una epidemia

con graves consecuencias paralos pequeños y adolescentes. Laamenaza cibernética se ha con-vertido en una forma de violen-cia incontrolable, peligrosa queha terminado en el suicidio.

El pasado 16 de noviembre,estudiantes del Distrito Escolarde Campbell padres de familia yestudiantes asi como la Concejaldel Distrito 9 Judy Chirco se reu-nieron para hablar sobre el temaque amenaza a todas las escue-las.

Durante la audiencia más de30 estudiantes procedentes de di-ferentes escuelas dieron testimo-nio que fueron víctimas deamenaza, de acoso y tambiénfueron testigos de todo.

Tanto la SuperintendenteRhonda Farber del Distrito Esco-lar de Campbell, asi comomiembros de la mesa directivadel distrito escolar se reunieronpara debatir esta problemática.

Lamentablemente, los niñosy los adolescentes reportan queno sienten que tienen un lugar se-guro para ser oídos cuando sonmolestados o intimidados. In-cluso con las nuevas leyes esteaño en materia de seguridad y laeducación, las escuelas son in-compatibles en la forma de hacercumplir esas leyes y adoptar me-didas preventivas

“Me acosaron, me insultaroncomo retardada mental por ser laúnica estudiante sorda de la es-cuela”, dijo Mycaela Avila-Terrade la Escuela Secundaria Leigh.

PACT pidió a las autorida-des educativas a que se compro-metan a tomar cartas en el asuntosobre este grave problema. Recordemos que uno de loscargos bien sonados fue el deAmanda Solorio Brownell quienintentó suicidarse por las conti-nuas amenazas que recibió el 11de diciembre de 2008 mientrasestudiaba en la escuela secunda-

ria Del Mar en San José.Una amiga le salvó la vida

cuando Amanda intentaba suici-darse en su propia escuela. Lajoven se quedó en estado vegeta-tivo.

“Afortunadamente mi hijavive, fue rescatada de las garras

de estas amenazas que existen enlas escuelas. No permitan queesto suceda a sus hijos”, dijoAnne Brownell, madre deAmanda.

El 11 de diciembre se reali-zará una vigilia en honor a Ama-lia y para combatir las amenazasy acoso en las escuelas.

De acuerdo a las estadísticasnacionales se sabe que más de

160 mil estudiantes a diario novan a la escuela por temor a seramenazados y atacados.

El 85% de los incidentes re-portados por amenaza las autori-dades no han intervenido.

Uno de cada 7 estudiantes dela escuela secundaria han con-templado el suicidio como unarespuesta a las amenazas persis-tentes.

On November 16, hundreds of students, parents,faith leaders, and People Acting in CommunityTogether (PACT) held the second annual commu-

nity action meeting at Cambrian Park United MethodistChurch to raise awareness about bullying.

One of the goals of PACT’s anti-bullying campaign is tohold schools accountable by creating systemic, long-term,school and district-wide solutions to this challenging problem.Another goal is to empower students to prevent and to stopbullying.

Recent school bullying statistics show that 85% of re-ported incidents receive no intervention. Each day 160,000 stu-dents miss school for fear of being bullied. Nationwide, oneof seven students seriously considers suicide as a result of per-sistent bullying nationwide.

“I was cheated out of a full high school education, becauseof all the bullying and harassment I faced during my years inhigh school. For more than two months straight I spent breaksand lunch in the girls bathroom or in an empty hallway to avoidverbal threats or things being thrown at me as I walked throughcrowded halls,” said Ashley Garnica, former student atProspect High School.

Garnica went on to share her most difficult moment in highschool was contemplating suicide and at one point acting onit. Her best friend, who reminded her that people cared abouther, talked her out of it.

“I can’t wait anymore. Something needs to change imme-diately,” said Garnica.

There are several types of bullying that include verbal,psychological, physical/sexual, and cyber bullying. Cyber bul-lying is an increasing form of violence. Yet many members ofthe community are not aware how pervasive and severe thisproblem is or that it is directly linked to increases in teen sui-cides and poor academic performance.

PACT, faith and community leaders, parents and studentsasked school officials to make commitments to identify thescope of the problem at their schools through district-wideschool climate surveys, create accountability structures to en-sure the surveys are acted upon and that results are made pub-lic, prepare and implement pilot (and eventually adopt)reputable school-wide programs that not only prevent bullyingfrom being a norm on campus, but also intentionally extendinto every facet of the school culture. The objective and goalis to create safe, high achieving learning environments, and toresearch the best practices of schools in our community thathave little to no bullying with the intention of replicating whatworks where needed.

tuosos hacia los adultos, y losniños pasan horas en el telé-fono y en la computadora, ex-puestos a estos mensajes.

Es difícil enseñarle a losniños que no pueden tener todolo que quieren, o lo que tienensus amistades. El estimularlesa apreciar lo que tienen, a dis-frutar la naturaleza, y a ahorrarpara algo especial tomatiempo, atención, y paciencia.

Es trabajo de los padres,familiares y maestros dedicarletiempo a los niños, y no usar eldinero o los regalos como sus-titutos de la atención. Eltiempo juntos es el mejor re-galo que podemos darle anuestros niños.

Los adultos comunicamosnuestros valores por medio denuestras expectativas, pala-bras, y acciones. Los niñosven lo que hacemos, y si nosven mostrando generosidadhacia otros, aprenderán a sergenerosos. Si nos ven agrade-cidos por las pequeñas cosas,no serán codiciosos. Si exigi-mos que usen buenos modales,aprenderán a decir “por favor”y “gracias.”

On November 15, the California SupremeCourt rejected a challenge to AssemblyBill 540 (AB 540), which allows undoc-

umented students to pay in-state tuition for higher ed-ucation. California is one of 10 states to grant tuitionequality to its students.

“This is a great idea because there are many un-documented students who deserve to pay the sameamount of tuition as everyone else. Just becausethey’re AB 540 students doesn’t mean they haven’tlived in California for most of their lives or that theydon’t deserve to have the same tuition rate as every-body else,” said Viridiana Cisneros, senior at San JoseState University. “As it is, it is very difficult for AB540 students to get into college and pay for collegeand why try to take that away.”

Currently, an out-of-state nonresident Americancitizen attending one of California’s public colleges oruniversities pays out-of-state tuition. In contrast, anundocumented student who physically resides in Cal-ifornia can attend a California public college or uni-versity and pay in-state tuition under state law. A classaction lawsuit against the California policy, filed bystudents paying out-of-state tuition costs, claimed thatfederal immigration law preempted California Educa-tion Code section 68130.5.

“Some out of state students might be upset overthat but the point of the matter is that they’re not outof state students, they went to high school for fouryears, they applied to be AB 540 students, they wereaccepted, so it shouldn’t make a difference for out statestudents,” said Cisneros.

The U.S. Congress passed legislation that pro-hibits states from granting postsecondary educationbenefits to undocumented students unless the samebenefit is given to all U.S. Citizen-students without re-gard to residence. The California law granted in-statetuition to undocumented students if they attended aCalifornia high school for three years and graduated.The court said that was not a residence requirement.

"The court correctly rejected a misguided and po-litically-motivated campaign that attacked the state'seducation policy and tried to stifle the hopes and in-tellectual ambitions of the students California. Thislawsuit and similar lawsuits in other states are short-sighted, mean-spirited and driven purely by politics.We hope the court's decision will send an unmistak-able message that dedicated college students shouldnot be used as pawns for political purposes," saidLucas Guttentag, Director of the ACLU Immigrants’Rights Project.

As it now stands this law remains in effect. AB540 provides that students who have attended at leastthree years of high school in California, graduatedfrom a California high school, and meet certain otherconditions may attend state colleges and universitiespaying the same tuition rate that is charged to state res-idents. Those students who qualify for AB 540 are un-documented immigrants who live in California. Othersare U.S. citizens who attended school in California inthe past but are now unable to establish state residence,such as those who live in a neighboring state or thosewho recently returned to California after living else-where. Well, it is that timeof year again –fluseason is upon

us. I wanted to take a few mo-ments to talk about the flu andgive you information about get-ting the flu vaccination. Accord-ing to the Santa Clara CountyPublic Health Department, the fluis a respiratory infection and it iscaused by a virus. There aremany different types of virusesthat cause the flu. Flu symptomsrange from fever, headache, bodyaches and pains, to cough, sneez-

ing, and chest discomfort. Mostof the time, the fever will goaway after 4 days. However,feelings of weakness and tired-ness can last for two to threeweeks. Serious flu complicationscan be life-threatening, especiallyin people who are chronically ill.Check with your doctor if youhave flu-like symptoms or youneed more information on a suc-cessful recovery.

There are a number of thingsyou can do to keep from gettingsick or, if you are sick, to keepfrom spreading illness to others

including:* Avoid touching your eyes,

nose, and mouth;* Covering your mouth and

nose when you cough or sneeze;* Throwing away tissues

right after you use them, don’tsave them on a table or couchuntil you feel well enough tothrow them all out;

* Wash your hands oftenwith soap and warm water, par-ticularly after coughing, sneez-ing, or blowing your nose.

* Stay healthy by eating ahealthy diet, drinking plenty of

water, exercising, and gettingenough rest.

If you are, or someone inyour family is, sick, you shouldstay home from work - Sick kidsshould not go to school or day-care. It is important for us all tostay home when sick to preventthe spread of illness to others.

There are groups of peoplewho are at a higher risk to devel-oping complications from the flu.These include:

* Anyone over the age of 50;* Pregnant women;* People with underlying

health conditions such as asthma,chronic obstructive pulmonarydisease (COPD), diabetes, heart,or neurologic disease;

* Adults with a Body MassIndex over 40;

* Residents of nursinghomes or chronic care facilities.

There is a vaccination thatcan be given to almost anyoneover 6 months of age. This vac-cination will help to protect you

from a variety of different flutypes that are expected to be inour community this year. If youremember last flu season therewas a concern over H1N1 andmany people got both a flu shotand an H1N1 shot. This year,only one shot is needed. The cur-rent flu vaccination includes pro-tection against H1N1, along withseveral other flu strains. Care-givers of individuals in thesegroups – particularly health careworkers and anyone who takescare of a baby less than 6 monthsof age – should also get their flushot sooner rather than later.

It is very important for thosein the high-risk categories listedearlier to consider getting a fluvaccination. Those who are aller-gic to eggs, have had a reaction tothe flu vaccine in the past, orthose who are seriously ill maynot be able to get vaccinated.Please check with you doctor ifyou have any questions aboutyour eligibility to get the vaccina-tion.

Don’t forget, too, that in Cal-

ifornia, Pertussis has been de-clared an epidemic. Although itcauses mild symptoms, if any, inadults, this disease causes seriouscomplications for babies underone year who have not been fullyvaccinated. This year, in Califor-nia, ten babies, most under threemonths of age, have died fromPertussis – which is passed tothem by the people around them.The TDAP vaccination is recom-mended for all adults who are liv-ing with, or are in regular contactwith, children under one year ofage.

SACRAMENTO –The California De-partment of Public

Health (CDPH) announcedtheir annual compliancechecks at retail outlets showedtobacco sales to minors are atan all-time low. The 2010Youth Tobacco Purchase Sur-vey revealed the lowest ratesof tobacco sales to minors inthe survey’s 15 year history,with sales transactions beingcompleted at just 7.7 percentof the 742 retail outlets sur-veyed this year.

When the state first startedmonitoring in 1995, the mi-nors participating in the sur-vey were able to buy tobaccoproducts during 37 percent oftobacco purchase attempts. In

2008, it was 12.6 percent, andin 2009 it was 8.6 percent.This year that number wentdown to 7.7 percent.

Among types of storessurveyed in 2010, drugstoresand pharmacies had no illegalsales in 43 purchase attempts.Traditional stores, such as gro-cery, drug, tobacco, liquor, andgas stations, sold an all-timeaverage low of 6.8 percent.Among these store types,those with lower illegal salesrates were liquor stores (4.5percent) and supermarkets(5.5 percent). Tobacco sales atdoughnut shops dropped sig-nificantly, from 21.6 percentin 2009 to 8.7 percent in 2010.

Discount or gift storeshave the highest rate of illegal

tobacco sales with 22.6 per-cent in 2010, considerablyhigher than its rate of 8.9 per-cent in 2009.

This annual survey of ille-gal sales of cigarettes to mi-nors is conducted to gauge therate of illegal tobacco salesacross the country and to com-ply with the Stop Tobacco Ac-cess to Kids Enforcement(STAKE) Act. States withrates of illegal sales of tobaccoto youth above 20 percent, risklosing as much as 40 percentof federally provided drug andalcohol prevention and treat-ment funds. California retail-ers that sell tobacco productsto minors are also subject tofines ranging from $200 to$6,000.
