All artworks/photographs must be submitted prior to Friday, 18 June 2021 at 3:00pm if delivering

to the Shire of Derby/West Kimberley Administration Building in Derby.

Deliveries and Collections

Free Delivery and return of the artwork/photograph from Broome, Fitzroy Crossing and Halls

Creek will be available (see terms and conditions).

All entries must be delivered to The Shire of Derby/West Kimberley Friday, 18 June 2021 by

4.00pm. Late entries will be automatically disqualified from judging but may be exhibited at the discretion

of the curator.

All unsold artworks/photographs must be collected from the Venue on Monday, 19 July 2021

unless otherwise arranged with the Shire. Entries cannot be collected any earlier.

The packing of the artworks/photographs for delivery is the responsibility of the

artist/photographer, including all associated costs.

If not collected within the specified timeframe, the artwork/photograph will become the property

of the Shire and shall be dealt with at the discretion of the Shire.

GENERAL GUIDELINES

1. Artists/Photographers are required to include a written description or interpretation (no

more than 100 words) of their work on the Description Form that will enhance judges and

viewers perception of their work. Please be advised that descriptions more than 100 words

will be reduced to fit the exhibition catalogue.

2. Artists/photographers or a representative are encouraged to attend the exhibition opening

evening on Saturday 3rd July 2021 to collect their award should they win as several

photographs and media opportunities are available at the evening.

TERMS AND CONDITIONS

ENTRY FEES

1. An entry fees apply. Each artwork/photograph may only be entered into one category. A limit of two

entries applies per person. Entry fees are not refundable.

2. Cheques are to be made payable to Shire of Derby/West Kimberley. Credit, debit and cash payments

can be made to Shire Administration on receipt of entries.

3. Artists/photographers posting or freighting entry should notify Shire Administration and make entry

payment by telephone prior to their entry arrival.

4. Entry forms may be hand delivered to Shire Administration, sent by post to Kimberley Art and

Photographic Prize, Shire of Derby West Kimberley, PO Box 94, Derby, Western Australia, 6728, or

emailed to: [email protected].

5. Payment & entry form must be received no later than close of business (4pm) Friday, 18 June 2021.

Late entries will be automatically disqualified from judging but may be exhibited at the discretion of

the curator.

ENTRY DELIVERY

6. Local artworks/photographs must be hand delivered to the Shire Administration, suitably packaged and clearly marked with artwork/photograph label provided.

7. Freight, postage and all other charges relating to delivery and collection of artworks/photographs

submitted are the sole responsibility of the artist. Return instructions are to be pre-arranged and listed on the entry form.

8. FREE DELIVERY & RETURN TRANSPORT. Entries must be lodged & fully paid on or before Friday, 18

June 2021. See ‘FREE TRANSPORT’ terms and conditions of free transport.

ENTRY PICK UP

9. All unsold artworks/photographs must be collected from the Venue on Monday, 19 July 2021 unless otherwise arranged with the Shire. Entries cannot be collected any earlier.

10. Sold artworks/photographs will be collected by the purchaser. The event organiser will contact the

artist/photographer to advise of their artwork/photograph sale.

11. Return freight and postage must be pre-arranged and return instructions should be included with your entry form. Items transported by the free service will be automatically returned to original drop off point, unless otherwise advised.

FREE TRANSPORT

12. All entries must be delivered to the collection point:

a. Broome – Broome Civic Centre – 27 Weld Street, Broome WA 6725 (Box Office Desk)

b. Halls Creek – Halls Creek Shire Office – 7 Thomas Street, Hall Creek WA 6770

c. Fitzroy Crossing Visitor Centre – Cnr of Forest Rd &, Flynn Dr, Fitzroy Crossing WA 6765

13. Entry forms must be lodged with the Shire of Derby/West Kimberley and entries fully paid by the Friday, 18 June 2021 to be eligible for free transport.

14. Entries must be delivered to the collection point fully packaged and labelled. No responsibility is

taken for damage to artworks/photographs that are not packaged to protect the work and the Transport Company and/or Shire of Derby/West Kimberley reserves to right to refuse to transport the artworks/photographs should it not be packaged appropriately.

15. A return Delivery Label must be included with the entry.

16. Unsold entries will be transported via the Return Label details back to the original drop off point. It

is the responsibility of the entrant to collect their artworks/photographs between 26 July and 30 July 2021.

EXHIBITION & ENTRY CONDITIONS

17. The non-entered Acquisitive Award “Overall Winner” can be made to any artist/photographer who qualifies for that award from any category.

18. All categories except the Open Non- Kimberley category are open to all Kimberley residents (a

Kimberley resident is defined as somebody who is currently living in the Kimberley and has resided in the region for a minimum of 6 months).

19. Non–Kimberley residents may enter the Open Non-Kimberley category. The same general conditions

apply in all other respects.

20. Entrants in the Aboriginal Artist category must be Aboriginal, of Aboriginal descent or Torres Strait Islander. Entrants should include their language group in their artist’s description and any other culturally appropriate information that explains where the artists and their art are from.

21. The Shire reserves the right of judges and curators to re-assign artworks/photographs to another

category.

22. It is the entrant’s responsibility to confirm that each person depicted in any entry has granted permission to be portrayed.

23. The artworks/photographs must not have been exhibited in any other exhibition or entered in any

other award. If the artwork/photograph is identified as having breached this condition it will be exempt from the judging process and the Shire reserves the right to withdraw the artwork/photograph from the Exhibition and will do so at its discretion.

24. Each entry shall be the original work of the artist/photographer and not copied in full or part from any production or published work or article. Previously entered works will not be accepted.

25. The maximum acceptable size of an artwork for the Art Prize is 1.5m X 1.5m. Sizes exceeding this

limit will be automatically disqualified from judging but may be exhibited at the discretion of the curator.

26. The maximum acceptable size of a photograph for the Photographic Prize is 1m X 1m. Sizes exceeding this limit will be automatically disqualified from judging but may be exhibited at the discretion of the curator.

27. Artworks/photographs must be presentable for exhibiting; suitably framed or stretched on canvas

(no frame required for canvas entries) and fitted with secure hanging wires or string using fixation points and latch systems. Insufficiently hung artworks/photographs or artworks/photographs entered with no hanging system will be automatically disqualified from judging but may be exhibited at the discretion of the curator. (see visual examples)

28. The Shire of Derby/West Kimberley and other sponsors reserve the right to purchase

artworks/photographs prior to the official Exhibition opening event on Saturday, 3 July 2021.

29. All entries must be ‘FOR SALE’ except those which are required to be returned for educational purposes. If you require your artwork/photograph to be marked ‘NOT FOR SALE’ for educational purposes please tick the applicable box in your application form. There are no other exceptions.

30. All entries must be for sale (unless for educational purposes) and the artist/photographer must set

their own price, taking into account a 20% commission paid to the Shire. 31. Each artwork/photograph must have the supplied entry label firmly attached to the back of the

entry.

32. The judges’ decisions are final and cannot be contested. Council and curators reserve the right of the judges to withhold prizes in any section should the supporting information be found to be false. Council reserves the right of the Curator to select works to be exhibited or to choose not to exhibit works.

33. The Overall Winner award is acquisitive. Should a winner carry a sale price in excess of the prize for

that category the artists/photographer agrees to accept the lesser amount.

34. Winners not present at the awards presentation evening will be contacted on Monday 5 July 2021.

35. Proceeds of sales and winnings will be processed by the end of August. Payment of prizes and sales monies will be made by Electronic Funds Transfer [EFT] (Cheque payment by request only). Please contact the Shire should you not have received funds by 6 September 2021.

36. All entries and categories are automatically entered in the People’s Choice Award. Votes will be

counted and the winner of the People’s Choice Award will be contact on Friday 23 July 2021. 37. Judging will take place at the Venue. The winner of the Prize will be announced at the official

opening on Saturday 3 July 2021. Artists/photographers will be invited to attend the official opening (invitations will be sent prior to that date).

COPYRIGHT, INSURANCE AND LEGALITIES

38. No responsibility will be accepted for loss or accidental damage of any works submitted or entered. Council does not accept or insure against any liability for loss or damage of artworks/photographs submitted or entered, before during or after the exhibition.

39. Artists/photographers submit entries at their own risk and insurance is the responsibility of the artist/photographer. All submitted works are required to be available for exhibition for the duration of the competition.

40. In entering a work the artist/photographer grants permission to the Shire of Derby/West Kimberley

to reproduce their work by print or electronic media for the purposes of advertising, promotion and/or any other publication before, during or after the Exhibition.

41. By entering the artwork/photograph for inclusion in the Exhibition, the artist/photographer agrees

to allow the Shire to:

a. Reproduce, publish and display the artwork/photograph, in full or in part, for use in any non-commercial promotional materials and publications, including promotions of the Shire’s future art/photography exhibitions;

b. Publish the artist’s/photographer’s name, artwork/photograph title and artist/photographer statement provided by the artist/photographer in connection with the artwork/photograph; and

c. Provide the media with photos and information about the artwork/photograph and artist/photographer for the purpose of promoting

42. The artist/photographer is responsible for satisfying any copyright requirements concerning the

artwork/photograph.

PHOTOGRAPHIC PRIZE Note: All of the above terms and conditions are applicable to the Photographic Prize unless superseded by the below.

43. Photographs must be Kimberley related or themed.

44. An electronic media copy of all digital photos must be provided with the image for the purposes of

‘fair use.’ The file should be at least 3MB size and on a labelled disc, flash drive or other suitable recording device or emailed direct to [email protected]. JPEG file format is preferred. Photographs are required to be supplied free of water marks.

45. Inappropriate and unrelated Kimberley images will be excluded from the Exhibition and not be featured or judged.

46. Photo ‘editing’ generally consists of smaller changes that do not change the image in any

fundamental way. This is acceptable for all the categories entered.

47. Creative / Altered Reality Prints are digital art images created or drastically altered in software such as Adobe Photoshop® or Microsoft Office. The digital techniques used to create the picture must be detailed in the description of your photograph. Creative / Altered Reality Photographs can only be entered in the Creative / Altered Reality category.

SNAP AND SEND

HOW TO ENTER

1. Download the Instagram or Facebook app for Android or iPhone

2. Take and edit your photo

3. Upload the photo to Instagram or Facebook with the hashtag #SnapKAPP50 (Instagram privacy settings must be set to ‘public’ for us to retrieve your photo and Facebook entries must tag the Shire of Derby/West Kimberley Facebook page in their post including the hashtag #SnapKAPP50.

We encourage you to geotag your photo, although non-geotagged images will not be excluded from the competition.

TERMS AND CONDITIONS

1. Any Kimberley resident (a Kimberley resident is defined as somebody who is currently living in the Kimberley and has resided in the region for a minimum of 6 months) or visiting person to the Kimberley is eligible to enter the Smartphone ‘Snap & Send’ Prize.

2. Snap and Send entries will not be for sale and will feature in a montage.

3. Inappropriate and unrelated Kimberley images will be excluded from the Exhibition and not be

featured or judged.

4. Snap & Send entries are NOT eligible in any other category.

5. Entries are limited to a maximum of two (2) per entrant. Users found in breach of this limit will forfeit their right to compete.

6. Information on how to enter form part of the terms and conditions of entry. Entry into the

competition is deemed acceptance of these terms and conditions.

7. The promoter is the Shire of Derby/West Kimberley (ABN 99 934 203 062), 30 Loch Street Derby WA 6728, phone 08 9191 0999

8. Employees of the Shire of Derby/West Kimberley are ineligible to enter the competition.

9. The competition commences at 8:00am (AWST) on Monday, 12 April 2021 and closes at 3:00pm

(AWST) on Friday, 18 June 2021.

10. Only entries submitted via Instagram or Facebook and which are appropriately hashtagged will be accepted. Photographs submitted must be original works. We encourage entrants to geotag their photos but this is not essential and non-geotagged images will not be excluded from the competition.

11. Judging will take place on Thursday, 1 July 2021 at the Shire of Derby/West Kimberley. If the winner

is under the age of 18 years, the prize will be awarded to their parent or legal guardian.

12. The competition is a game of skill and chance plays no part in the selection of the winner. We are looking for the most inspired image in line with the Kimberley theme. Submissions will be judged according to the following criteria:

a. The relevance of the submitted photo to the theme in question, as decided by our judge.

b. Artistic interpretation of the theme, as decided by our judge.

c. Originality of the submission. Entries that are deemed to not belong to or be taken by the user will not be eligible.

13. Judge’s decision is final and no correspondence will be entered into. Prizes cannot be transferred.

14. The promoter reserves the right to verify the validity of entries and to disqualify any entry which, in

the opinion of promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry or who has, in the opinion of promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or promoter. The promoter reserves the right to disqualify a winner if the promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

15. Entries must be received by 3:00pm (AWST) Friday, 18 June 2021. The time of entry will in each case

be the time the online entry is received by the Shire of Derby/West Kimberley database. The promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

16. The cost of accessing the promotional website will be dependent on the entrant’s individual internet

service provider.

17. Use of images:

a. All images published on Instagram with #SnapKAPP50 may be moderated and displayed on the Shire of Derby/West Kimberley website, Facebook and Instagram page. These images and associated usernames will be public to all.

b. By entering the competition and accepting the terms and conditions you agree your images can be broadcast via digital feeds or printed for physical events by the Shire of Derby/West Kimberley.

c. In consideration for the Shire of Derby/West Kimberley awarding the prize to the winners, the winners give the Shire of Derby/West Kimberley non-exclusive rights to use their submitted image and Instagram name in promotional formats such as announcing the winners via the Shire of Derby/West Kimberley website, Facebook page and Instagram page and in subsequent competition promotions (with attribution). The winner will not be entitled to any fee for such use.

18. Use of personal information: a. By entering the competition and accepting the terms and conditions, you agree that the Shire

of Derby/West Kimberley may use your personal details for the purpose of conducting the competition, including the use of your Instagram name in promotional formats.

b. By entering the competition, you give the Shire of Derby/West Kimberley permission to contact you via Instagram if you are a winner of the competition.

19. The promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the promoter.

20. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the

prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

21. The promoter shall endeavour to contact the winners via their Instagram account within one week of

the prize draw. In the event that the winner/s cannot be contacted after one month, an alternate winner/s will be selected and the original winner/s will forfeit any prize.

22. The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but

not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s, except for any liability which cannot be excluded by law.

23. The promoter is not responsible for any incorrect or inaccurate information, either caused by the

phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

24. If for any reason this competition is not capable of running as planned, including due to infection by

computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under state regulation.

25. Prizes are as follows:

$100 in cash for 5 winners. (Total prize value is $500).

26. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
