ENGAGEMENT OF 8 DRIVERS ON COTRACT BASIS FOR BANK’S OWNED CAR AT LOCAL HEAD OFFICE, C-SCHEME, STATE BANK OF INDIA, JAIPUR SBIIMS inviting tender on behalf of SBI for providing the services of 08 Drivers (the figure may vary depending upon the requirements of the Bank during the contract, )for a period of 2 years from the experienced and reputed Companies / Agencies / Firms / Sole Proprietors.
The scope of work for the services to be provided is given in Annexure-I with
detailed terms and conditions. 2. Earnest money deposited will be refunded to all except the successful bidder without
any interest, after awarding the work to the successful bidder.
3. Tenders are to be submitted on before 23.07.2020 by 3.30 PM at the Circle office of
the SBIIMS at 5, Nehru Place Tonk Road , Jaipur along with the earnest money of
Rs 50,000/- in the form of DD in favor of AGM (Premises & Estate), SBI payable at
Jaipur. The envelope should be superscribed with the Services of 08 Drivers At
State Bank of India, Local Head Office, C-Scheme, Jaipur (Raj.)
4. The Contractor shall have to deposit equal to one month contract amount as
security deposit inclusive of EMD at the time of execution of agreement. The
Security Deposit will be refunded on termination of the contract after adjusting
the dues payable by the Contractor to the Bank without any interest.
5. Tender fees- a Non refundable tender fees of Rs. 5000/- is payable online

The Technical bid shall be submitted along with the requisite documents and
financial bid will be submitted online only.
6. Technical Bid of the proposals will be opened at 11.00 AM on 24.07.2020, Financial
Bid of vendors who qualified in the technical bid will advised through telephonic mode
or e-mail due CORONA-19 pandemic. (Any changes in date of opening will be
intimated)
7. The Financial Bid of those qualified bidders who’s Part I containing EMD & Technical
Bid and all other enclosures except price bid is found in order will be eligible for
financial bid opening through online mode. The tenders without EMD will be rejected.
Financial Bid will be submitted online only , if any price bid found with the Technical bid
then it may get rejected as per the decision of the prescribed Committee.
8. The contractors/bidders are advised to visit the premises at their own cost before
submission of bid.
9. The Courts in Jaipur city alone shall have the jurisdiction in respect of any or all
matters relating to or connected with the Tender.
10. The Bank/SBIIMS does not bind itself to accept the lowest tender and reserves to
itself the right to reject any or all the tenders received without assigning any reason.
11. Final award of the contract will be subject to the approval of the Competent
Authority in the Bank.
13. Bank/SBIIMS reserve right to cancel the tender process at any stage without citing
any reasons.

TENDER PROCESS
The tender process will be in two cover system. The cover one contain EMD and
Technical bid ,covering letter, certificate of vender all other pages of tender document
other than price bid and cover two contain only price bid in a two separate sealed covers
distinctly marked accordingly and both the proposal then put in a third envelope and
sealed duly super-scribed as “Tender for providing the services of 08 Drivers at
State Bank of India, Local Head Office, C-scheme, Jaipur.
Envelope One: This envelope will contain;
(a) The EMD of Rs. 50000/-(Rupees Fifty thousand only) in favor of AGM (Premises & Estate) payable at Jaipur
(b) Undertaking by the contractor in the prescribed format as detailed in the tender document
(c) Registration certificate of the firm / company. (d) Applicable Labour licenses. (e) ESI / EPF Registration certificate (s) (f) Documents to prove experience as mentioned in the tender document. (g) Turn over for last three years (h) And all other important documents mentioned in application format of this
tender document.
NOTE: TENDER WILL BE REJECTED IF THE TENDERER FAILS TO SUBMIT THE REQUIRED EMD ALONG WITH THE ABOVE CERTIFICATES AND WILL BE RETURNED WITH OUT OPENING THE FINANCIAL BID.
The tender shall be submitted online as per procedure by the conducting agency.
1. All the tenderers are requested to note that State Bank of India /SBIIMS will not accept any incomplete or conditional tender and the tender will be rejected if any tenderer found quoted conditional tender and if the same are not withdrawn at the time of opening of tender / price bid. All conditions, if any, to be loaded with rate. The rate should be inclusive of all taxes payable and necessary insurance premium / service charges etc., for the labour and machinery etc. exclusive of GST
2. The tenderer should satisfy him-self of the scope of work before quoting the rates and clear the doubts if any. No deviation of conditions or request for change of specifications or additional rate will be entertained at any stage.
3. DETAILS OF PAYMENT: The payment to the Contractor will be released on submission of monthly bills along with proof of adhering to the contract conditions.

Minimum Eligibility Criterion
1. The initial period of two years contract may be extendable for one year on satisfactory performance at the same terms and conditions. It is obligatory on the part of the tenderer to ensure that all statutory requirements such as Minimum Wages, Provident Fund, Employee State Insurance etc., as applicable, are complied with. The rates quoted by the tenderer would be valid for a period of 2 years and the request for increase in rates during the tenure of the Contract shall not be entertained.
2. The Drivers have to be provided by the successful bidder within 07 days from the date of contract, as per the detailed Terms and conditions which are given at Annexure-I.
3. Only those who fulfils the following minimum criteria need to submit their bids:
(a) The interested bidders should be registered with the Government authorities such as Rajasthan Shop and Commercial establishment Act, ESI, EPF, GST Tax, Labour and Income Tax Authorities, as applicable, and a copy each of the registrations shall be attached with the bid.
(b) Average Annual Financial turnover during the last 3 years, ending 31st March of the previous financial year, should be at least 30% of the estimated cost.
(c) Experience of having successfully completed similar works during last 5 years ending last day of months previous to the one in which applications are invited should be either of the following : a. Three similar completed works costing not less than the amount equal to 40% of the estimated cost. OR b. Two similar completed works costing not less than the amount equal to 50% of the estimated cost. OR
c. One similar completed work costing not less than the amount equal to 80% of the estimated cost.
(d) The bidders should not have been blacklisted by any
Ministry/Department/Bank/Organization. The tendering bidders shall have to submit notarized affidavit on a stamp paper of appropriate value of this effect that they have not been blacklisted or their business dealing with the Government Ministries/Department have not be banned.
(e) The contractor must undertake to pay minimum rates of wages to the
drivers as per the relevant orders of Govt. of India. The L1 may be decided on the basis of sum of charges mentioned at Sr. No. 1,2 of the Financial Bid i.e. Annexure III.
4. An earnest money deposit of Rs. 50,000/- (Rs. Fifty Thousand only) in the form of Demand Draft drawn in favour of Assistant General Manager, Office Administrative Department, State Bank of India, local Head Office, Jaipur payable at Jaipur should be submitted along with the technical bid, failing which the bid shall not considered valid.
The absence of any of the above-mentioned document/s in technical bid
should result in the rejection of the entire tender.
5. The “Financial Bid” will be online only as per Annexure III. 6. The financial bids of only those bidders whose technical bids are found
to be in order will be opened through Online. The representative of only those bidders found successful at the technical bid stage would be allowed to be present at the time of financial bids.
6. The successful tenderer has, however, to follow all labour laws and
transport related laws requirements without fail while providing the services. It may clearly be noted that it is the sole responsibility of the bidder to comply with the applicable laws, Rules and for any failures/Breach, the tenderer shall be solely liable for breach. 8. The tenderer should take special care to prepare the technical bid as well as financial bids. Omission of any of the required documents or EMD would result in the rejection of their entire tender.
9. The Bank reserves the right to cancel any or all the Tenders without assigning any reason there for.
10. The individual signing the tender form or any document forming part of the tender on behalf of Company/partnership firm shall be responsible to produce an authenticated copy of the resolution passed by the company or Power of Attorney duly executed in his favor stating that he has the authority to bind other such persons of the firm/company, as the case may be. In case of registered or unregistered Partnership firm, all the partners should sign the tender.
General Terms & Condition
1. The individual signing the tender form or any document forming part of the tender on behalf of Company/Partnership firm shall be responsible to produce an authenticated copy of the resolution passed by the company or Power of Attorney duly executed in his favour stating that he has the authority to bind other such persons of the Company/Firm, as the case may be, all matters pertaining to the tender. If subsequently, the person so signing fails to provide the said copy of Resolution passed or Power of Attorney within a reasonable time, the Bank, without prejudice to other civil and criminal remedies may cancel the tender and hold the signatory liable for all costs and damages. In case of registered or unregistered Partnership firm, all the partners should sign the tender. In case any person signs the agreement on behalf of any limited company. He will produce letter of authority/ resolution passed by firm/company empowering him to sign the agreement on behalf of the company or firm.
2. The rates quoted should be inclusive of all taxes/levis/duties whichever is applicable. However, GST/TAX, whichever is applicable, shall be reimbursed by the Bank on production of sufficient proof of payment as per government rule applicable from time to time.
3. The Bank reserves the right to reject any bid which, in the opinion of
the Bank, is too low or unrealistic for effectively carrying out the obligations of the successful bidder under this tender.
4. The rates shall be valid for two years with effect from the date of
acceptance of tender and may be extendable, if required, with such amendments as may be mutual agreed, for a period not more than one year
5. The EMD of unsuccessful Bidders will be returned, without interest, After 30days from Completion of awarding of tender process.
6. The contractor to whom, the contract will be awarded, shall have to
deposit a sum of Rs. 1,00,000/- in the form of STDR in favoring in the name of contractor marking lien in the name of the Bank as security Deposit for the period of contract within 7 days from the date of award of work. The security deposit will be refunded only on the completion of the contract. Failure of the bidder to submit the above-mentioned security Deposit shall constitute sufficient grounds for the annulment of the contract award. If the successful bidder fails, in course of the contract period, to comply with the terms and condition of the Agreement/contract, thesecurity Deposit may be forfeited in full or in part as decided by the competent Authority. The Security Deposit will not carry any intrest and will be refunded only on completion of the contract. The Security Deposit will be refunded within a month of expiry or termination of the contract as the case may be after adjusting the dues payable by the contractor to the Bank.
7. The tenderer shall provide the drivers within 07 days from the date of
receipt of the order or as desired in the order, failing which EMD as well as Performance Security submitted by the tenderer shall be forfeited.
8. The Bank reserves the right to cancel the tender or to withhold payment
in the event of non-commencement or unsatisfactory performance by the tenderer. In such eventuality, the Bank further reserves the right to get the work done from open market at the cost of the tenderer. The tenderer may be black listed by the Bank for a period of three years to participate in any type of tender & his security money shall also be forfeited.
9. If any information furnished by tenderer is found to be incorrect or false at any time, the tender will be liable to be terminated without any notice and the EMD/security deposit is liable to be forfeited including back listing of agency.
10. The Bank reserves the right to terminate the tender at any time without
assigning any reason.
11. The tenderer shall indemnify the Bank against all damages/charges and expenses for which the Bank may be held liable to pay on account of the negligence of the tenderer/drivers provided by him or any person under his control whether in respect of accident, injury to the person or damages to the property of the Bank or any member of the public or any person or in executing the work or otherwise and against all damages and demands thereof.
12. In the event of any dispute arising out in connection with the
interpretation of any clause in the terms & conditions of the under agreement, or otherwise the matter shall be referred to the committee of three members constituted by the Bank, whose decision shall be binding on both the parties.

14. The estimated requirement of drivers in the Bank is 8(Eight). However,
the number of drivers may vary according to the requirement of the Bank from time to time, but not less than 6 at a given time.
15. In the event of specified date of submitting /opening of tender is declared as a holiday, the tender shall be submit/opened at the same place and same time of next working day.
16. The contractor shall not replace the driver at random. This shall be done
with the prior approval of the Bank and full particulars of personnel so deployed shall be given to Bank immediately.
17. The contractor shall be liable to make substitute arrangements in case
of the absence of the driver. Similarly, the contractor shall have to make substitute arrangements in the case of the weekly offs, and no extra payment shall be payable on this account. No leave shall be permitted to the drives unless the Contractor provides suitable substitute without any extra payment.
18. Working hours would be normally from 9.00 AM to 5.00 PM during
working days. However, in exigencies, the services of driver shall be required beyond prescribed time and will be paid at the rates as mentioned under;
1. Charges per hour per
person beyond prescribed 8 hours per person.
Rs.50/- will be paid by the Bank MAXIMUM RS,150/- FOR THREE HOURS
2. Outstation Night Halting Charges. (Hours after 11.00 PM to 05.00 AM) will be treated as Night)
Rs.300/-per night per person will be paid by the Bank.
3. In case of local duties if the duty closes on or after 11.00 PM
Rs.250/-per day per person will be paid for dinner by the Bank.
4. Working on Sundays and three National Holidays i.e. Republic Day (26 January), Independence Day (15 August) and Gandhi Jayanti (2 October).
Rs.300/- per day per person will be paid by the Bank.
19. Payments to the contractor would be strictly on certification by the officer
with whom Driver is attached that his services were satisfactory and attendance as per the bill preferred by the contractor.
20. The contractor shall be accessible at all times and message by
phone/mail/Fax/ Special Messenger from the Bank to him shall be acknowledged immediately on receipt on the same day. The contractor shall strictly observe the instructions issued by the Bank implementing the contract from time to time. The drivers should also be equipped with the mobile Handset along with active cell number.
21. The contractor shall comply with all the statutory provisions as laid
down under various Labour Laws/Act/Rules like Minimum Wages , Provident Funds, ESI, , Bonus, Gratuity, Contract Labour (R&A) Act, as applicable, in force from time to time at its own cost. In case of violation of such statutory provision under Labour Laws and/or any other laws applicable, by the Contractor, there will not be any liability on part of Bank. The contractor must submit along with monthly bills the proof of having deposited GST/PF/ESI or any other government dues, as applicable, with the concerned authorities.
22. The successful bidder shall obtain sufficient insurance for drivers against
any injury which may arise in the course of providing service to the Bank. If the insurance so obtained is considered insufficient either by
practice or in law, or if so determined by a court of law, the successful bidder shall be solely responsible for the shortfall in the amount.
23. GST, as applicable, should be paid as applicable by Government from
time to time.
24. The Contractor shall, at its own cost, provide the drivers with proper uniforms and ensure that the drivers wear their said uniform at all times while rendering service to the Bank.
25. The service provider shall not assign, transfer, pledge or subcontract the
performance or service without the prior written consent of the Bank. The successful bidder shall ensure, that the drivers are following the Government / Bank’s Guidelines relating to COVID-19.
26. The contractor shall provide the drivers as required by the Bank office.
The drivers must possess the valid commercial license having age of 21-50 years and must have knowledge of motor mechanism.
27. The drivers Deployed shall be responsible for up keeping maintenance,
cleaning and servicing of vehicle on day to day basis. The driver shall also be responsible to maintain and update log book and fuel records of the vehicle on daily basis. In case of any default, the erring driver shall be immediately removed by the department.
28. The contractor shall provide list of drivers along with details of the DOB,
Driver’s License, Contact Number, Aadhar Card and Residential address along with proof thereof, in case of change of drivers in between, if any, the details thereof should also be provided.
29. The Bank will be under no legal obligation to provide employment to any
of the driver of the contractor during or after expiry of
tender/arrangement/contract period and the Bank recognizes no employer-employee relationship between Bank and the personnel deployed by the contractor. The relation of successful bidder is principal-to-principal basis.
30. The Bank shall not be responsible financially or otherwise for any injury
to the driver in the course of performing the function/duties as per this tender.
31. The Contractor will have to provide the replacement of Driver in case of
any eventuality. The Bank has the right to ask the contractor to removal of any Driver, who is not found competent or disciplined.
32. The payment to the successful bidder shall be made on a month-to-
month basis only. It shall be the responsibility of the successful bidder to make timely payments to the drivers. The payment to the drivers should be made through a Bank Account only. The bills shall be presented by the successful bidder to the …………………………………………………………………., Jaipur along with proof of payment of Wages to the drivers provided to the Bank, EPF, ESI and Service Tax /GST/life insurance of drivers etc. and proof of any other statutory requirements, as applicable, as may be required by the Bank from time to time. If the successful bidder fails to provide proof of such payments, the Bank may withhold further payments due to the successful bidder till such proof is provided. However, such proof of payment of wages need not be furnished for the first month, in lieu of which, an undertaking to carry out such payments shall be provided by the successful bidder.
33. The character and antecedents of the Drivers is to be got verified from
the Police authority by the contractor and same must be submitted to the Bank. The Bank reserves the right to get the verification of the drivers from the Police Authorities and may reject if not cleared by the Police.
34. Medical fitness certificate in respect of Drivers from a qualified MBBS Doctor must also be submitted by the contractor to the Bank.
35. The agreement can be terminated by either party giving one month’s
notice in advance. If the tenderer /bidder fails to give one month’s notice in writing for termination of the agreement then the performance security shall be forfeited, besides blacklisting may be done.
36. The Bank reserve the right to terminate the contract by giving 30 (thirty)
days’ notice and without assigning any reason whatsoever.
Without prejudice to the above the Bank reserves its right to terminate the agreement for any reason at its absolute discretion including but not limited to the following: - (i) The Bank may, without prejudice to any other remedy for breach of contract, may terminate the contract/agreement by 30 (thirty) days' notice in the event of unsatisfactory performance or on breach of any stipulated conditions or qualitative dimensions of the various services specified/agreed upon by the contractor, or the engagement is not in the interest of the Bank or the Bank no more requires any such service and the Contract shall be deemed to have been terminated for all purposes on the expiry of the 30 (thirty) days day from the date of receipt of the notice. (ii) Other Grounds for Termination: The Bank is entitled to terminate this contract/agreement for any reason at its absolute discretion forthwith without notice without assigning any reason and without payment of any compensation, in the following cases: -
a) The bidder is adjudicated insolvent by a Competent Court or files for insolvency or if the bidder being a company is ordered to be wound up by a Court of competent Jurisdiction.
b) If any charge sheet is filed by a competent authority of the Government against the Agency / Company, or the bidder is convicted by a criminal court on grounds of moral turpitude.
37. The selected bidder will have to sign a service agreement on the given
format within seven days from the date of the receipt of work order.
38. No conveyance charges shall be paid by the Bank to the driver for attending his duty to and from his residence to place of work.
39. Any legal dispute arising out of the above contract shall be settled in the
jurisdiction of Jaipur Courts. All terms & condition Sl No. 1 to 39 are accepted and binding on me/us. (Signature of the Tenderer)

1. In case, the rate quoted under column (12) is less than the Minimum Wages evaluated in column (11) of wages charges for Manpower (2), the
tender shall be summarily disqualified.
2. If the amount quoted by the bidder in the Price Bids is unreasonable/unrealistic or with Zero Profit Margin, based on the statutory payments or
otherwise, the SBIIMS/SBI reserves the right to reject such bids.
3. Contractor to submit a copy of the latest Circular published by the competent authority in support of minimum wages prevailing as per Central
Govt. applicable for public sector banks and considered by them in their Quote.(If any changes found in the above mentioned rates)
4 Bank will not pay any additional charges to the contractor during the contract period, if any statutory changes happened in Minimum wages act
or any other employee benefit scheme mentioned above will be paid as per prevailing government rules from time to time.
