ENDEAVOUR 4th CALL SCHOLARSHIP GRANT AGREEMENT

1. Parties to the Agreement

Whereby the Parties agree to the following: 2. Purpose of the Agreement

2.1 Scholarships Unit within the Ministry for Education and Employment by virtue of the ENDEAVOUR

Project has awarded the Scholarship Awardee a scholarship as defined in Clause 4 of this Agreement and as stipulated in Schedule B hereto attached (hereinafter referred to as the ‘Scholarship’) for the purposes of carrying out studies in Higher Education for :

2.2 The value of the award is subject to the ENDEAVOUR 4th Call Rregulations governing the Scholarship Scheme hereto attached as Schedule E, and the additional provisions of this Grant Agreement.

2.3 The Scholarship Awardee agrees to accept the funding for the intended purpose as stipulated in sub clause 2.1 above, and agrees to undertake the course as indicated in Schedule A in accordance with the conditions stipulated in the Regulations governing the ENDEAVOUR 4th Call (issued with a closing date of 6th June 2018) and in this Scholarship Grant Agreement.

2.4 This Scholarship Agreement shall supersede any other form of agreements which has been signed after the publishing of rankings and before the signing of this Agreement.

3. Explanatory Notes

All definitions listed in Clause 3 of the Regulations governing the Forth (4th) Call shall apply to the Grant Agreement.

3.1. Commencement Date of Scholarship shall mean the date on which payments to the Scholarship Awardee commence as specified in Clause 5.1 of this Agreement.

3.2 Completion Date shall mean the date when the Studies (see definition below) are completed and the final result/s is/are published.

3.3 Department shall mean the department, school, centre or faculty as specified in Schedule A;

3.4 Duration of this Agreement shall mean the period between the Commencement Date and the End Date (see definition below) of Scholarship if not earlier terminated or extended in accordance with Clause 5 and 8;

3.5 End Date shall mean the date as specified on t he Unconditional Letter of Acceptance or the date specified on the Transcript as issued by the Recognised Institution whichever date is the earliest. Payments are calculated to cover the period from the Commencement Date to

the End Date.

3.6 MEDE stands for Ministry for Education and Employment.

3.7 Publication shall mean any conference paper, article for journal, portion of a book, broadcast, or other means of public disclosure that may emerge from the research project.

3.8 The Recognised Institution shall refer to the higher educational institution identified in Clause 2.1 of this Agreement and is awarding the degree as specified in Schedule A.

3.9 Research Project shall mean the programme of research undertaken by the Scholar in order to satisfy the MQF Level 7 or Level 8 qualification requirements of the Recognised Institution as specified on the original Scholar application.

3.10 Scholarship Awardee shall mean the beneficiary of the Scholarship, who is awarded a Scholarship. The Scholarship Awardee is committed to undertake the Studies through the Recognised Institution referred to in Schedule A leading to a degree as specified in sub Clause 2.1 of this Agreement.

3.11 Studies shall mean all work required to be undertaken and to be completed by the Scholarship Awardee and Thesis to qualify for the MQF Level 7 or 8 as specified in the original Application Form submitted by the Scholarship Awardee.

3.12 Supervisor shall mean the member of the Recognised Institution’s academic staff appointed to supervise the Scholar in accordance with the provisions of the relevant regulations of the Recognised Institution.

3.13 Thesis shall mean the dissertation that is to be submitted by the Scholar for examination for admission to MQF Level 7 or Level 8 qualification.

4. Details of the Amount of the Scholarship

4.1 It is hereby agreed that the Scholar will be granted the sum1 of

(Hereinafter referred to as the ‘Amount’) for the purpose of studying as stipulated in Clause 2 of this Agreement. The Scholarship funding shall be payable in accordance with Schedule B.

Provided that the sum indicated is based on Tuition Fees and Bench Fees as officially communicated by the Recognised Intuition at the time of signing this Grant Agreement and that the Allowances incorporated in this sum are subject to continuous verification of eligibility and may be revoked if Scholarship Awardee is found of giving false information at the point of signing this Agreement.

The Scholarships Unit within MEDE guarantees that funding will be available for this Scholarship for its entire duration subject to the terms and conditions of this Grant Agreement and the ENDEAVOUR Scholarships Scheme Regulations attached hereto as Schedule E.

This Amount is part-financed through EU and National Funds. This scheme is part-financed by the European Union, European Social Fund (ESF) under Operational Programme II – Cohesion Policy 2014-2020, “Investing in human capital to create more opportunities and promote the well being of society”.

5. Implementation

5.1 The implementation period for this Scholarship is as follows:

5.2 The completion date of the studies is _________________________________________.

5.3 The Amount in relation to the Scholarship will be subject to the Scholarship Awardee’s entitlement according to the information in Schedule A and B.

5.4 The Scholarship Awardee shall have the right to choose, with the approval of the Recognised Institution, a specific research Topic within the broad field of research originally proposed by the Scholarship Awardee to the ENDEAVOUR Selection Board in the Application and/or Interview stage.

5.5 Any changes to dates set in Clause 5.1 and 5.2 and any changes to information included in Schedule A, B and D of this Agreement must be notified to the ENDEAVOUR Scholarships Scheme Board and approved by the ENDEAVOUR Scholarships Scheme Board. Should the ENDEAVOUR Scholarships Scheme Board agree to the proposed changes, the ENDEAVOUR Scholarships Scheme Office shall draw up an addendum to the Scholarship Grant Agreement in order to reflect such changes to the

prevail and the Agreement shall be amended or terminated by the Project Leader. The grants and allowances shall be calculated as follows. When the course duration established by the Recognised Institution does not cover the whole month (for example 11 months 3 weeks) this will be prorated to the nearest month. Therefore, if the course duration is 11 months 3 weeks, the grant will be based on 12 months. If on the other hand, the course duration is 11 months 1 week, the grant will be based on 11 months. In case of the study abroad allowance, kindly consult with Clauses 3.30 and 13.1.1.

Scholarship Grant Agreement which shall be signed by both Parties. Failure by the Scholarship Awardee to comply with this procedure shall constitute a breach to the provisions of the Scholarship Agreement.

5.6 Any amendment or alteration to this Scholarship Grant Agreement shall have effect only upon being made in writing and executed by all Parties.

5.7 The Scholarship Awardee shall be entitled to the Scholarship subject to, and on receipt of, official acceptance by the Recognised Institution.

6. Supervision of the Scholarship Awardee

6.1 The Parties acknowledge that the Recognised Institution is responsible for the Scholarship Awardee’s supervision.

6.2 The Scholarship Awardee shall see that the Recognised Institution appoints a Supervisor for the Scholarship Awardee who shall supervise the Scholarship Awardee’s Research Project in accordance with the statutes, regulations, codes and policies of the Recognised Institution.

6.3 The Project Leader will correspond with the Recognised Institution Supervisor to obtain confirmation relevant under Clause 7.1 of this Scholarship Grant Agreement.

7. Reporting

7.1 Scholarships Unit within MEDE requires that the Scholarship Awardee shall; Ask for: A short statement every six (6) months in writing to be submitted to the Project Leader from his/her

faculty supervisor confirming progress and attendance of the Scholarship Awardee. Failure on the part of the Scholarship Awardee to submit such statement/s may lead to suspension of payments of further instalments of the Amount awarded;

A report in writing from his/her Recognised Institution Supervisor on the progress at the end of every academic year and to submit this report normally by the end of July of every year to the Project Leader depending on the start date of course / programme;

A final report in writing written and signed by her/his Recognised Institution supervisor following the completion of the thesis and the award of the qualification within one (1) month from the date of conferment;

Provide: A copy of the final course transcript in the case of MQF Level 7 programmes and a copy of the

final certificate in the case of those following MQF Level 8 programmes; A soft copy of the final thesis on publication as specified in Clause 13.24 of the Regulations; A copy of the abstract of thesis including also the sponsorship acknowledgement;

Provided that, failure to meet any of the above requirements may lead to the ENDEAVOUR Scholarships Scheme Board requesting the reimbursement in full or in part of all the Amounts already disbursed to the Scholarship Awardee and/or the respective Educational Institution.

7.2 The Scholarship Awardee shall write a minimum of one (1) article on their work/studies in the Maltese

public media as soon as the official results are published , during which they publicly acknowledge that the degree was, carried out following the award of an ENDEAVOUR Scholarship and that the scholarship is part-financed by the European Union – European Social Fund (ESF) under Operational Programme II – Cohesion Policy 2014-2020, “Investing in human capital to create more opportunities and promote the well being of society”.

8. Payment Process

8.1 The Scholarships Unit within MEDE shall pay into a nominated:

Recognised Institution account (in Schedule C) the Tuition Fees and Bench Fees (where applicable) as specified in Schedule B on evidence of original invoice issued by the Recognised Institution.

Personal account (in Schedule C) any Tuitions Fees and Bench Fees (where applicable) paid in advance by the Scholarship Awardee as specified in Schedule B on evidence of copy of invoice issued

by the Recognised Institution and receipt or equivalent (i.e. receipted invoices where applicable from the Recognised Institution) or confirmation of payment directly from university.

Personal account (in Schedule C) the Grants and Allowances as specified in Schedule B.

8.2 ENDEAVOUR Scholarships Scheme Board acknowledges that the Recognised Institution has procedures whereby progress by a Scholarship Awardee can be reviewed. If the Recognised Institution at any time under those procedures determines that the Scholarship Awardee is not making satisfactory progress in relation to the qualification, payments of the Amount to the Institution / Scholar shall be suspended. Moreover, payments may also be suspended if Section 7 of this Agreement is not honoured. In all such instances, the Scholarship Awardee may be required to reimburse any Amounts already awarded by the ENDEAVOUR Scholarships Scheme Board to date.

8.3 The ENDEAVOUR Scholarships Scheme Board may consider extension for completion of studies. ONLY one Extension beyond the completion date indicated on the scholarship agreement may be considered by ENDEAVOUR Scholarships Scheme Board. Any request for extensions are to be addressed to the ENDEAVOUR Scholarships Scheme Board supported by the approval of the Recognised Institution. Any request for extension is at the discretion of the ENDEAVOUR Scholarships Scheme Board to approve or otherwise. During the extension period, no additional funds will be allocated or paid.

8.4 If a Scholar for whatever reason foresees the probability that he/she will not conclude the studies by the completion date stipulated in 5.2, the Scholar is obliged to inform the ENDEAVOUR Scholarships Scheme Board in writing by not later than three (3) months before the said completion date. The ENDEAVOUR Scholarships Scheme Board reserves the right to terminate the Scholarship and the Scholarship Awardee will be required, within three (3) months, to refund the entire, or part of, the Amount including tuition fees, bench fees, maintenance grants and allowances forwarded to both the Scholarship Awardee and the Recognised Institution.

9. Project Intellectual Property

9.1 Any third party intellectual property including but not limited to patents which shall be utilised by the Scholarship Awardee in order to carry out the research work funded by the Scholarship shall be covered by an Intellectual Property Rights (IPR) agreement signed by the Scholarship Awardee and the owner of the said intellectual property whereby it shall be stated that no royalties or other claims may be claimed from ENDEAVOUR Scholarships Scheme. For avoidance of doubt, the Scholarship Awardee acknowledges and accepts that all liability in relation to claims arising out of the use of third party intellectual party rights shall rest on the Scholarship Awardee and both the MEDE and the ENDEAVOUR Scholarships Scheme shall be excluded from such liability. Furthermore, the IPR agreement shall acknowledge that the research work carried out, is part-financed by the European Social Fund under ENDEAVOUR Scholarships Scheme award reference number as stated in the recital of this Agreement.

9.2 The ENDEAVOUR Scholarship Scheme shall not seek to obtain any intellectual property rights owned by the Recognised Institution and/or Scholarship Awardee.

9.3 Nothing in this Agreement shall give the ENDEAVOUR Scholarships Scheme Board any rights in intellectual property owned by the Recognised Institution and/or the Scholar.

10. Publicity

10.1 ENDEAVOUR Scholarships Scheme is part-financed by the European Union, Operational Programme II – Cohesion Policy 2014-2020 “Investing in human capital to create more opportunities and promote the well being of society” – European Social Fund. Since the thesis is part-financed through Operational Programme II, the ESF logo, the EU Flag, the National Flag of Malta and the co-financing text are to feature of the first pages of the Thesis, as per layout stated under the Visual Identity Guidelines 2014 – 2020.

10.2 All publication arising from the programme of study being sponsored by ENDEAVOUR Scholarships Scheme shall reflect the following acknowledgement on the first pages of the publication: “The research work disclosed in this publication is funded by the ENDEAVOUR Scholarships Scheme (Malta). The scholarship is part-financed by the European Union – European Social Fund (ESF) under Operational Programme II – Cohesion Policy 2014-2020, “Investing in human capital to create more opportunities and promote the well being of society”, provided that if the Scholarship Awardee fails to make the said

acknowledgement, the ENDEAVOUR Selection Board may require the reimbursement, in full or in part, of the Amounts awarded to the Scholarship Awardee.

10.3 The ENDEAVOUR Scholarships Scheme Board reserves the right to publish the names and Identity Card numbers of potential Scholarship Awardees provisionally selected for Scholarships on the website for the Ministry for Education and Employment. For the avoidance of doubt, in applying for a Scholarship, the Scholarship Awardee has given consent for such publication in the event that her or his application is successful.

11. Termination prior to completion of programme

11.1 A Scholarship Awardee who, for any reason whatsoever, discontinues/fails his/her studies, shall immediately inform the ENDEAVOUR Scholarships Scheme Board in writing.

11.2 The ENDEAVOUR Scholarships Scheme Board shall on thirty (30) days written notice terminate the Scholarship if -

the Scholarship Awardee’s progress is deemed unsatisfactory by the Recognised Institution;

the Scholarship Awardee discontinues the Studies; and/or

the Scholarship Awardee is in breach of any provision of this Agreement and the ENDEAVOUR Scholarships Scheme Regulations and such breach is not remedied within thirty (30) days of receipt of written notice requiring him/her to do so.

11.3 The Scholarship Awardee who has his/her Scholarship terminated under the above mentioned conditions in Clauses 11.1 and 11.2, shall be required to refund the entire Amount including tuition fees, bench fees, maintenance grants and allowances forwarded to both the Scholarship Awardee and the Recognised Institution within three (3) months of failing the course or failing to complete the course of studies.

11.4 The Scholarship Awardee shall not be deemed to be in breach of this agreement ONLY in case of serious illness and demise of the awardee. In case of serious illness, the Awardee needs to provide medical certificates and testimonials to the ENDEAVOUR Scholarships Scheme Board. Thus, awardees who cannot pursue further studies due to serious illness might be required to refund grants on a pro rata basis as approved by and at the discretion of the ENDEAVOUR Scholarship Board upon evaluation of the situation.

In such situations, the Scholarship Awardee must provide justifiable explanation as to why the course was not completed or why the Scholarship Awardee failed to obtain the qualification. Documented evidence, medical certificates and testimonials must accompany each claim. The ENDEAVOUR Scholarship Scheme Board shall in no way be bound to waiver all claims put forward.

The ENDEAVOUR Scholarships Board reserves the right to appoint its own expert/s, be it medical or otherwise, to advise and assess the case of the Scholarship Awardee claiming such exemption as specified in this Clause 11.4.

12. Notices to the Project Leader

12.1 Any notice or communication made pursuant to this Agreement must be in writing addressed as

shown below:

12.1.2 Any correspondence sent pursuant to this Grant Agreement shall be deemed only to be

received by the receiving Party if signed by the sending Party or any other person duly

authorised to sign documents and letters on behalf of the sending Party.

13 Governing Law and Jurisdiction

13.1 This Agreement shall in all respects be construed as an agreement made in accordance with and

subject to the Laws of Malta and Community Rules.

14 Severability

14.1 The invalidity or unenforceability of any one or more of the provisions hereof shall not invalidate or

render unenforceable the remaining provisions of this Grant Agreement and this shall remain in full

force and effect.

15 Other Agreements

15.1 In the eventuality that the Scholarship Awardee has applied for and/or granted any similar awards for

the same course of programme of studies, the Scholarship Awardee must make a declaration at point

of interview or before formally accepting the other awards. All declarations require approval from the

ENDEAVOUR Scholarships Scheme Board. Any unapproved awards additional to ENDEAVOUR

Scholarship Scheme for the same course or programme shall be deemed to be in breach of the Grant

Agreement and cancellation of the Scholarship and the Scholarship Awardee shall be bound to refund

the entire Amount granted by then by the ENDEAVOUR Scholarships Scheme Selection Board.

16 Interpretation

16.1 This Grant Agreement together with all attached Schedules shall be the entire agreement between the two Parties and any amendments to the Agreement shall not be valid unless consented to in writing by both Parties.

16.2 The official Regulations of the ENDEAVOUR Scholarships Scheme 4th Call are those available on the official website. The scholar is expected to refer to this official documentation.

16.3 This Grant Agreement is construed under and governed by the Laws of Malta and any disputes arising as a direct result of this Agreement shall be submitted to the Courts of Malta.

Data Protection: The ENDEAVOUR Scholarships Scheme collects and processes information to carry out its functions under the Education Act. All data is collected and processed in accordance to the Data Protection Act 2001, other subsidiary legislation and the Privacy Policy of the Scheme, a copy of which is available on demand. ______________________________________________ On signing this Agreement, the Scholar is agreeing also to Footnote 3 on Page 9.

SCHEDULE B: Payments

PAYMENTS

The Scholarships Unit with the Ministry for Education and Employment shall through the Treasury Division:

a) pay the tuition and bench fees (where applicable)

to the Recognised Institution University € ____________________________________________________ on receipt of invoice for Recognised Institution tuition fees and bench fees (where applicable), following final signing of this Agreement.

AND/OR

to the Scholarship Awardee € ____________________________________________________________ on receipt of invoice for Recognised Institution Tuition fees and Bench fees (where applicable) and official receipt or equivalent (i.e. receipted invoices where applicable) from the Recognised Institution (if fees already paid by Scholarship Awardee) following final signing of this Agreement. AND

Pay to the Scholarship Awardee:

A) € __________________________________________ for the Maintenance Grants by the end of this Grant Agreement. Payment of Maintenance Grants will be disbursed in two instalments every year

B) a further € ____________________________________ for the Additional Allowances by the end of this Grant Agreement and as specified in the ENDEAVOUR Scholarships Regulations. Payment of Additional Allowances (if any) will be disbursed on presentation of the relevant documents, including but not only limited to,

(i) Boarding Passes in case of Scholarship Awardee pursuing studies in a foreign Recognised Institution and who are entitled for an allowance. A pro-rata amount shall be paid if the Scholarship Awardee is not abroad for the whole duration of the programme of studies (See Regulations and footnote on Page 3 of this Agreement).

(ii) Proof that child/children are residing with parent/s in case of Scholarship Awardees pursuing full-time studies only as per Clause 12.1.2 of the regulations.

(iii) An official document showing proof that a student studied in a school in Gozo for three (3) scholastic years, which document has to be verified by the Ministry of Gozo. This document is necessary for Scholarship Awardees residing in Gozo and are entitled for the relevant allowance as per Clause 12.1.4 of the regulations.

(iv) Boarding passes of the Spouse/Legal Civil Union member of the scholarship awardee are to be produced and an official letter from the spouse’s / Legal Civil Union member’s employer on the status within the place of work were the Scholarship awardee will be studying abroad on full time basis or any other proof that may be deemed necessary. A prorate amount shall be paid if the Scholarship awardee or the spouse / legal civil union member is/are not abroad for the whole duration of the programme of studies as per Clause 12.1.3 of the regulations).

(v) In the case of Scholarship Awardees with disability that may hinder their free movement, they are required to provide proof of attendance on campus and proof of expenses claimed as per Clause 12.1.5 of the regulations.

The Amount stipulated in this Schedule B shall be the total Amount granted to the Scholarship Awardee. In the eventuality that the completion of the programme of study requires further expenditure and/or Tuition Fees and Bench Fees that shall exceed the Amount granted by the ENDEAVOUR Scholarship Scheme the Scholarship Awardee shall bind himself/herself to pay the remaining amounts, provided that in the eventuality that non-payment of any remaining amounts by the Scholarship Awardee is the reason for the non-

completion of the Scholarship, the Scholarship Awardee shall refund the entire Amount granted by the ENDEAVOUR Scholarships Scheme in relations to the Scholarship.

SCHEDULE C: Banking Details

BANKING DETAILS It is required that a Financial Identification Form, commonly referred to as TR/S-9, is to be filled in by both the Recognised Institution and the Scholar. In this form the Treasury will have the necessary information on the Recognised Institution and/or Scholarship Awardee for the proper execution of bank credit transfer. This applies to both local and cross-border payments. The Treasury will issue payment against the details of the latest TR/S-9 form; therefore, payments into other accounts will not be effected unless the Recognised Institutions and Scholar submits a new TR/S-9. The TR/S-9 must be duly signed by the awardee or his legal representative in possession of the Power of Attorney irrelevant of who is the account holder. Payments are made via a bank credit transfer only.
