Preliminaries& General Conditions1. Overview
This information is for your review, and is to compareagainst existing labour supplies to enable you, the Client,to determine best value and standards required.The information submitted is for the Client to analyse inorder to determine if Employ Staff Limited can become apreferred supplier of Temporary Labour (Civil EngineeringOperatives, M&E Labour and Technical Services includ-ing Site Management).There will be a provision for volume discounts and a feeproposal for situations where the temporary workerbecomes a permanent employee of the contractor.The projects we supply to consist of a variety ofschemes involving the upgrade or new build of electricitysubstations and the refurbishment and upgrades ofoverhead lines throughout the UK.
2. Description of Services
The services are for provision of temporary site labourand permanent placements.Time sheets will only contain the descriptions of labourcontained on this list. Changes to the descriptions of thelabour provided can only be undertaken with the prioragreement of the Commercial Manager of the Client.Rates for specific roles will only be reviewed on an annual basis or upon a change in relevant UK legislation
3. Qualifications/Competencies
All operatives are to hold the appropriate qualificationsfor the role they are appointed for and per the schedulecontained in the Training Matrix.Employ Staff check all the operatives’ qualifications,certificates and experience in the role prior to supplyof the services and ensure that they remain valid for theanticipated duration of the services.Any training or renewal of certification required by theoperatives to meet the criteria in the Training Matrixshall be arranged by Employ Staff.Training – Operative / Employ Staff are responsible forqualifications and maintenance of approvals andverifying that they are genuine and valid.D&A test within the last 2 years prior to mobilisation tosite by an appropriate independent testing organisation.This will be confirmed prior to mobilisation onsite.
4. Background Checking
Employ Staff will at our cost comply with the NationalGrid background checking policy.For the avoidance of doubt all costs associated with thebackground checking at any levels will be at the sole cost of Employ Staff.These background checks will be completed beforethe individual is offered to the Client to fulfil a role andevidence that the background check has been complet-ed will form part of the “CV” for each individual offered.
5. Contracts
As part of the process a standard sub contract will beagreed with each project having an individual purchaseorder number.
6. Payments
Employ Staff shall submit application for payment to therelevant Clients QS and clearly identify the particularproject and order number on the application.The application shall specifically contain the following:
(a) Order Number(b) Project Name(c) Contractor Name(d) Week Commencing Date(e) Application value with cost back-up.
In the relation to time sheets, the name and trade foreach operative will be stated on each time sheet. It willinclude the actual start time, breaks and finish times,hours worked per day and a total for that week. Timesheets are to be signed by an appropriate Site Managerprior to submitting to the QS, only one project to be listed on each time sheet. There will be a separate time sheet for each site detailing the operatives times. The allocations of time sheets must reflect the work on each sheet and only authorised time sheets will be submitted with invoices. Employ Staff understands that traveling time and subsistence will not be paid for in addition to working times. It is Employ Staff’s responsibly to meet the labour requirements at the various substations locations/sites. Only overtime instructed by the Site Managers will be paid after normal hours have been worked. Weekend working undertaken will be with the approval of the Site Manager, or a suitability authorised representative of the Client.

Working hours can only be varied by authorised Clientpersonnel, i.e. Construction Managers, Site Managers.Adverse weather payments – lightning risks will be paidup to the standard 9 hour day. Snow falls resulting in,failure to attend site, no payment. If the site is closedduring the morning half a shift will be paid. If the site isstopped in the afternoon the full shift will be paid.
7. Hours of work
Standard hours of work are as follows:Monday to Friday: 8.00am – 5.30pmStandard work days are 9 hours per day and 45 hoursper week.The proposed operative is only paid for each hour ofworking time and includes annual leave, sickness andthe like.A minimum 0.5 hours will be taken for lunch breaksin a standard day.Changes to work hours can only be varied by authorisedClient personnel, i.e. Construction Managers,Site Managers.
8. Variations
Employ Staff will only action an instruction if it is issuedin writing by the authorised personnel from the Client.A list of the authorised personnel is to be provided toEmploy Staff.
9. Notice Periods
The Client shall provide Employ Staff Ltd with a minimumof 1 weeks’ notice prior to ceasing the operative’stemporary assignment.The Client reserves the right to request a replacementor cancel a temporary assignment of an individualimmediately based on any non-performance or due tonot meeting the expecting minimum standards.
10. Health and Safety Requirements/PPEProvisions
Employ Staff shall ensure all operatives have thefollowing PPE prior to reporting for work:
• Light Eye Protection (to EN166 –F1)• White Hard Hat (to EN397)• Lace up Safety Boots (to EN345)• Standard Work Wear (to BS5426) and Hi-VisibilityWork Wear (to EN471)

One piece overall with yellow hi visibility jacketor waistcoat.
Option 2
Two piece overall with yellow hi visibility jacketor waistcoat.The client will provide site specific PPE such as:
• Banksman orange hi visibility jacket or waistcoat(to EN531)
• Gloves (to EN388)• Ear Defenders or Ear Plugs (to EN352)
The site operatives shall comply with the informationprovided by the Project Site Managers during the siteinductions and other instructions issued from time totime. Failure to have PPE as specified may result in theoperative being excluded from the site and no paymentwill be made in respect of that day.
11. Alcohol and Drug Policy
Employ Staff will ensure that each worker offered foran assignment will have undertaken a drug and alcoholtest within the preceding 24 months.Employ Staff will certify that the worker has passedthat test and will arrange at no cost to the client,bi annual testing of the workers inline with NG policy.For clarity with regard to this requirement the testsmust be carried out by an independent accreditedtesting company.
12. Bribery and Corruption
Employ Staff shall not offer, give or agree to any giftor consideration as any kind of gift or reward to anyemployee of the Client.
13. Security Checks
Employ Staff shall check on the operative’s identityand confirm their right to work in the UK. Shouldhigher checks be required Employ Staff shall providethe operatives address for a period of 3 years prior totheir engagement and criminal certificate under section112 of the Police Act 1997 of their criminal record forunspent criminal convictions.

Employ Staff has 14 members of staff employed toselect and vet prospective workers and ensure that ourQA systems are adhered to. We engage workers to workon projects throughout the UK but as a recruitmentagency they are not classed as our employees.

Our database increases by approximately 200 workersa month and currently stands at 14,543 which consistsof all types of blue collar and white collar workers.

Quality AssurancePrinciples
Every worker has their qualifications checked,with copies of qualifications available upon request prior to starting onsite.
We cover at least 3 years employment history with each worker, with 5 years being tracked on most occasions.
Every worker has to provide at least 2 workingreferences from a supervisor/manager to whomthey have reported.
Eligibility to work in the UK is checked by either passport or birth certificate prior to start onsite.
All qualifications, work history and relevant details are held on file for seven years which enables historical audits to take place. This can be requested inline with data protection regulations.
No worker is paid or invoiced to the client without an approved timesheet that has been signed by a designated site manager.
All invoices are accompanied by the associated timesheets.
We evaluate all workers prior to start onsite, during their contracts and at the end of the project to ensure that the best workers are made available to clients in the future.
All commercial queries are dealt with in a timelyfashion, with a maximum resolution timeframe of10 working days.
All candidate paperwork, registration forms and T&C’s are based on REC models and therefore meet all legislation.
All Employ Staff team members must demon-strate competence and knowledge of NG proce-dures before dealing with requirements. This is backed up with regular training sessions and exams.
Employ Staff is currently undertaking ISO9001 toensure that our QA is strictly documented in a quality management manual. Investor in People (Bronze level) was awarded in June 2013.
