Introduction:

The National Program to Combat Smoking at the Ministry of Health, State of Kuwait is proud to host the Sub-regional workshop on the Illicit Tobacco Trade Protocol of WHO FCTC for Parties Members of The GCC Council, 23-24th March 2015.

This important collaboration between Kuwait Ministry of Health, The WHO FCTC Secretariat, EMRO and The GCC executive Office marks an important milestone in the battle against smoking in the Arabian Gulf Countries.

Kuwait was among the first countries to join the global efforts against smoking led by the WHO. The FCTC was signed on 16th June 2003 and ratified in 12 May 2006 and entry into force was in 10th August of the same year.

The Protocol to eliminate Illicit Trade in Tobacco products is the first protocol to the WHO Framework Convention on Tobacco Control ( WH FCTC) and as an important measure to stop fueling the tobacco epidemic , which was adopted on 12 November 2012 at the fifth session of the Conference of Parties (COP) to WHO FCTC (Seoul, Republic of Korea, 12-17 November 2012).

Kuwait was among the first countries to sign the protocol and works towards steering the efforts that will put the articles of the protocol into action.

As people on the front line with the fight against tobacco we will strive to push the efforts towards ratification of the Protocol.

We hope that this workshop will draw the road map for the efforts to drain the tobacco epidemic from a main source of supply, and moti-vate the party members to sign and ratify the protocol.

SPEAKERS

Vera Luiza da Costa e Silva, MD PhD

Dr da Costa e Silva is medical doctor, with a PhD in Public Health and Epidemiology and a Masters in Business Adminis-tration for the Health Sector.

For 16 years she coordinated the department of epidemiology and cancer pre-vention at Brazil’s National Cancer Institute and was involved in legislative, economic, surveillance and regulatory tobacco-control measures, the establish-ment of a country-wide tobacco control network and the introduction of tobacco products as part of the recently established health regulatory agency.

From 2001 to 2005, she was Director of the Tobacco Free Initiative at WHO in Geneva, among other things supervising the work of the Interim Secretariat of the WHO FCTC.

Since 2006 she has worked as a senior public health consultant to WHO, provid-ing advice to the Tobacco Free Initiative and WHO’s Department for the Preven-tion of Noncommunicable Diseases as well as the Secretariat of the WHO FCTC. She also worked as consultant to the Government of Brazil and supported the preparation of Brazil’s 2011–2022 Action Plan on NCDs. In addition, in 2007 she worked as Team Leader of Tobacco Control and Consumers’ Health at the Pan American Health Organization in Washington, DC.

In 2013 she was the founder and the first Coordinator of the Centre for Studies on obacco and Health, within the National Public Health School of the Oswaldo Cruz Foundation, Brazil.

Since the end of June 2014, Dr da Costa e Silva has been the Head of the Secre-tariat of the WHO FCTC. She is responsible for providing support to the Parties to the Convention as they strive to implement their obligations under the treaty. She is also responsible for organizing the sessions of the Conference of the Par-ties and translating the decisions taken by the Parties at those sessions into pro-grammatic activities.

Prof. Tawfik A. M. Khoja

Prof. Tawfik Khoja – The Director General, Executive Board of the Health Ministers’ Council for Cooperation Council States – MBBS. He is the fellow of the Royal College of General Practitioners – UK (FRCGP-1989), the fellow of the Faculty of Public Health (FFPH-2003), and fellow of the Royal College of Physician – UK (FRCP-2007).

He has been awarded in June, 2003 the Professorialship in health systems and quality (Adjunct Professor) from Oklahoma University, USA. At the beginning of 2010 he received the professorial degree from Imperial College, London, UK.

He is a WHO temporary advisor. Prof. Khoja is Family and Community Medi-cine and Public Health Consultant, in addition to other job responsibilities.

He was the author and co-author of more than (40) books and manuals, he pub-lished more than 70 research and scientific articles in various international sci-entific journals. He has been awarded many local, regional and international awards and recognitions.

He is a member of many reputable scientific societies.

AUSTIN ROWAN

Austin Rowan was appointed as the Advisor on the illicit tobacco trade in the European Commission›s Anti-Fraud Office (OLAF) in June 2012. As well as advising the Com-missioner and senior management on policy and investiga-tions, he represents OLAF in media interviews (television, radio and newspapers) and at international conferences on the fight against the illicit tobacco trade in the EU and further afield such as the USA, Canada and China.

Before his current appointment, from 2006 Austin Rowan was the Head of Unit of the European Commission’s Task Group Cigarettes, heading an internation-al team of investigators tackling the contraband and counterfeit tobacco trade around the world.

He has a considerable experience with initiatives to combat cigarette smuggling at national, European and international level, most notably by heading the investigation which resulted in litigation in the New York Courts against several of the World’s leading tobacco producers.

He negotiated Article 15 of the FCTC on behalf of the EU and Member States and chaired the World Expert Group appointed by the Conference of the Parties to the WHO Framework Convention on Tobacco Control to draft a Template for a Protocol on the Illicit Trade in Tobacco Products. He was also responsible for negotiating and coordinating the EU position in the negotiations and representing the views of the European Union at the meetings of the International Negotiating Body (INB) to agree a Protocol on the elimination of the illicit trade in tobacco products as well as chairing several working groups during the negotiations, for example in South Africa and South America.

Austin Rowan started his career in the Revenue Commissioners in Ireland, moving from his position as leader of a team of investigators dedicated to combatting excise fraud in the Customs & Excise Special Investigation Branch to the European Commission’s Anti- Fraud Office (OLAF) in 1989.

He worked on a number of major investigations, both in Europe and further afield, for example in China, Pakistan, Bangladesh, Lebanon, South Africa before being appointed Head of Operations in the Task Group Cigarettes in February 1995.

LUK JOOSSENS

Advocacy Officer, Association of European Cancer Leagues (ECL), Tobacco Control Expert, Belgian Foundation against Cancer, International expert on illicit tobacco trade.

Since 1994, Luk Joossens has published, together with Martin Raw, several sci-entific articles on cigarette smuggling and advised the World Bank, The Eu-ropean Commission, the World Health Organization, the US Surgeon General, the International Union against Cancer, the Association of European Cancer Leagues, the Framework Convention Alliance, the Bloomberg Initiative to Re-duce Tobacco Use and many national organisations about smuggling.

He was of one the rapporteurs of the WHO expert group on illicit tobacco trade in 2007, which prepared a template for a protocol on illicit trade which is the basis for discussion of the negotiations on the protocol on illicit tobacco trade in 2008. He attended all five INBs which negotiated the Illicit trade protocol.

He was the lead author of the background paper on cigarette smuggling of the 2000 World Bank Report “Curbing the Epidemic”.

He wrote a report on tracking and tracing systems which was funded by the Euro-pean Commission Seventh Framework Programme Grant Agreement HEALTH-F2 in 2011.

He has given more than 100 presentations on cigarette smuggling in 50 coun-tries.

CAXTON MASUDI NGEYWO

Caxton Masudi Ngeywo is Head of Market Surveillance Office in the Kenya Revenue Authority. He has extensive experience in the Tax Policy and administration.

He has represented Kenya in the intergovernmental ne-gotiations on the WHO Protocol to Eliminate Illicit Trade in Tobacco. He has also been instrumental in regional initiatives to harmonize tobacco tax laws and procedures in the East African Community. In this re-gard, he has made presentations to various forums international forums includ-ing, SADCC, EMRO, South East Asia, AFRO, and East African Community.

He is a member of the Kenya National Budget Team as a tax expert with a bias in consumption taxes and specifically Excise tax.

Caxton Masudi Ngeywo is an expert in illicit trade and is instrumental in the development of controls and measures for the elimination of illicit trade in Ke-nya. He is the lead expert in the development of the Track and Trace System in Kenya.

Caxton Masudi Ngeywo is a holder of Executive Masters Degree in Business Administration from Jomo Kenyatta University of Science and Technology and a degree in Economics from Makerere University, Kampala and is a member of the Kenya Institute of Management.

KATHARINA KUMMER PEIRY

Katharina Kummer Peiry is owner and principal of the Swiss consulting firm Kummer EcoConsult, which she founded in 2000.

A specialist in international environmental law and policy, she held increasingly responsible positions in Swiss and interna-tional public institutions since 1988, and taught at the University of Berne (Swit-zerland) between 1999 and 2007.

From 2007 to 2012, she was Executive Secretary of the Basel Convention on hazardous wastes. She is a Visiting Fellow at the University of New South Wales, and a member of the Board of Directors of Sustainable Recycling International (SERI).

Katharina Kummer Peiry holds a PhD in International Law from the University of London; a Master of Law from the University of Zurich (Switzerland); and a Certificate of Advanced Studies in Mediation from the University of St.

Gallen (Switzerland). She has authored numerous academic publications on in-ternational environmental law and policy.

1995 saw the publication of her book International Management of Hazardous Wastes: The Basel Convention and Related Legal Rules (OUP, Oxford Mono-graphs in International Law).

It is still widely considered the standard work on the Basel Convention.

ULRIKE SCHWERDTFEGER

Ulrike Schwerdtfeger is a Legal Officer at the WHO FCTC Secretariat in Geneva.

Ulrike holds a post-graduate degree in law. She is qualified to work as a prosecutor, litigator and judge in the German legal system.

Before joining WHO, Ulrike worked at Germany’s Federal Parliament for four years, where she was a consultant to the Speaker of the Par-liament and subsequently, to a Member of Parliament of a major political Party.

Ulrike joined WHO in 2006 as part of the interim Secretariat for the WHO FCTC. Since then, she has been a core member of the WHO FCTC Secretariat and has worked on a wide variety of tobacco control matters and in all regions of the world, especially covering legal aspects.

Ulrike is the Secretariat’s focal point for the Protocol to Eliminate Illicit Trade in Tobacco Products. She has been closely engaged in the Protocol negotiations as the “right hand” of the Chairperson.

Ulrike is responsible for coordinating assistance to FCTC Parties on technical and legal Protocol questions. She is also the liaison officer for partner organiza-tions and agencies on various matters, such as the UN Office of Legal Affairs, World Customs Organization, the United Nations Office on Drugs and Crime and WTO.

Dr Nuntavarn Vichit-Vadakan

Highlights of my accomplishment include being instru-mental in establishing both the Faculty of Public Health and the School of Global Studies at Thammasat Uni-versity.

My research in areas of air pollution and health as well as tobacco control have produced numerous publications and led to various national policy and intervention.

I continue to serve as the lead negotiator for Thailand at the Conference of the Parties for the WHO Framework Convention on Tobacco Control (FCTC) and chaired major committees at the Conference of the Parties, as well as chaired the working group that negotiated the Protocol to Eliminate Illicit Trade in Tobacco Products until its adoption at COP.

I was awarded with WHO World No Tobacco Day Award for Southeast Asia Region in 2011.

Vinayak M Prasad

Dr Vinayak M Prasad is the Project Manager Tobacco Free Initiative at , World Health Organization Headquarters in Geneva in the department of Prevention of Non Commu-nicable Diseases .

He is leading the Bill and Melinda Gates foundation fund-ed Africa project at WHO HQ to provide technical assis-tance to countries on tobacco control.

Dr Prasad also facilitates TFI’s work on tobacco taxation, illicit trade and on mHealth.

Prior to joining WHO in 2009, Dr Prasad worked with the Government of India for two decades in various capacities in the Ministry of Finance/Department of Revenue and in the Ministry of Health and Family Welfare.

He was the Director, Public Health 2004-09 and responsible for tertiary health care scale up, public health programs such as tobacco control, deafness preven-tion, mental health as also for telemedicine .

Dr Prasad is a trained medical physician and also holds a MBA in Public Service Management .
