Vertical Transportation Fleet
Good afternoon:
The University of Florida is searching to adopt a competitively bid contract as per UF Regulation 6C1-3.020 5 (f) 3 awarded to your company for full maintenance and service for the University’s vertical transportation fleet. The University’s vertical fleet include traction and hydraulic passenger and freight elevators, dumbwaiters, chairlifts, stage lifts, dock lifts, stair glides, escalators from varied manufacturers and ages; as per Exhibit A and B. Contractors are to prepare a proposal for the University to review, the basis of which is the contract that the University may adopt.
Provide a copy of your adoptable contract by 3:00 PM January 4, 2013; hi-lighting adoptable contract features that will address the following provisions: pricing structure of adoptable contract, length of contract including termination clauses, local office availability, list of trained and skilled technicians assigned to account with substantiating qualification(s), list of account manager(s) and resume(s), list of references comparable in size and scope to the University of Florida that the adoptable contract services, stock material listing for readily available repair parts and prices, suggested program for comprehensive preventative maintenance control schedule that include safety inspections, tests, etc., value added solutions for reducing costs, any service level agreements associated with the adoptable contract, response time for call backs and entrapments, remediation solutions for down time and quarterly business review schedules.

After review of all adoptable contracts submitted, a memo of understanding will be finalized with an established elevator maintenance contractor to ensure that the University’s fleet will remain in first class operating condition. The University reserves the right to ask for vendor presentation(s) to support adoptable proposal and final approval of team assigned to UF,

Executive Summary of Qualifications
On behalf of ThyssenKrupp Elevator, I want to thank you for giving us the opportunity to participate in the bid process to continue serving as University of Florida’s vertical transportation equipment maintenance and service provider. We are proud to have been providing these services for over 25 years. During this time we have developed and understanding of your needs, processes, culture and people and we are already working with you to address them. We will continue to challenge our team and our approach to provide you with the best resources ThyssenKrupp Elevator has to offer. With regard to this, we are proposing to manage your account as follows:
Provide the University of Florida with a full-time Project Manager and local Service Foreman. Both will be based out of our Gainesville branch. The Project Manager’s responsibilities will be as follows:
• Ensure the preventative maintenance requirements are met on a monthly basis:• Daily communication with the 3 resident Mechanics.• Perform weekly unit audits. Audits will include reviewing the overall operation of
the elevator to identify any deficiencies that need correction, and to verify that we are keeping up with the necessary documentation of maintenance check charts in the machine rooms.
• Track monthly preventative maintenance for each unit on campus and provide a copy to University of Florida management for review . This will include a report and all PM time tickets. A copy of the report is included in this proposal document.
• Ensure call-backs are minimized and reduce repeat call-backs on the same unit(s).• Daily communication with the 3 resident Mechanics.• Communicate daily activity to the University’s point of contact.• Order parts in a timely manner to support resident Mechanics.• Track call-back activity for each unit on a monthly basis and provide University
management with a report and copy of all time tickets.• Provide annual capital improvement plans for units with the highest number of call-
backs.• Perform audits on units with high call-back activity. Communicate cause(s) of the
call-backs and our corrective actions and effects on the problem(s). Provide the University with solutions to reduce call-backs.
• Manage our inventory that will be stored on campus.• Review inventory on a monthly basis to ensure we have correct parts in stock in an
effort to reduce elevator downtime.• Manage our inventory that will be stored on campus.

• Ensure Mechanics are properly documenting inventory use and re-order is occurring timely.

• Manage the annual inspection process.• Provide breakdown per unit of all inspection violations. Separate the University’s
and ThyssenKrupp’s responsibilities. This will be provided to the University’s management 1 week after initial inspections are completed.
• Provide a schedule for violation corrections for each unity. This will be provided to the University’s management team 2 weeks after initial inspection process has been completed.
• Provide University of Florida’s management with an updated schedule on a weekly basis until all violations have been corrected.
In addition, the Project Manager will be responsible for providing any necessary proposals for work outside the scope of this agreement, accounts receivable questions and scheduling of any repair and/or modernization work.
Our goal is to streamline the communication process for the University’s management team. We believe that having the Project Manager as the main point of contact for all account activity will allow for more effective communication.
The Service Foreman will have the following responsibilities:• Provide the Project Manager with any necessary technical support.• Provide technical support for the 3 resident Mechanics.• Assist with annual inspection corrections to ensure they are completed in a timely
manner.

Advantages In Selecting ThyssenKrupp Elevator Training: We employ mechanics who have been trained exclusively through the
International Union of Elevator Constructors. This means your equipment will be serviced by people who are experts in their field.
Response Time: In most areas and under normal circumstances, upon receipt of a call for service, our dispatching center will have a mechanic on your premises within one-half (1/2) hour during regular business hours. After business hours, response time will be within one (1) hour. This response time is offered as a result of our well planned routes limiting each serviceman’s area.
Parts Availability: A complete inventory of frequently used replacement parts is maintained in our local warehouse as well as being furnished in our mobile van inventory available for express delivery in case of emergency.

Mike began his career in the elevator industry as an Account Representative in 1996. He has continually increased his responsibilities while working for ThyssenKrupp Elevator in the Miami, Ft. Lauderdale, and Palm Beach offices. Mike served as the Branch Manager for the Tampa and Sarasota offices for 10 years. All of the labor provided by ThyssenKrupp Elevator Corporation is provided by and affiliated with the International Union of Elevator Constructors (IUEC). The Union provides a comprehensive training program that all people entering the trade for the first time must complete. This training period is provided by schools in the local that are operated and administered by the IUEC. The training period is for a period of no shorter than five (5) years and following completion, the eligible mechanic must pass a comprehensive exam prior to becoming a certified IUEC Elevator Mechanic.
All employees (field and office) are subject to background search and drug testing.
ThyssenKrupp Elevator will provide staffing to handle any increase in units by expanding the hours of the second technician as needed to meet the service needs. ThyssenKrupp Elevator currently has the largest staff of technicians of any elevator company in the area and can quickly adjust our staff to meet all the requirements of the University of Florida.

Pat McElhinney, Manager, International Technical Services, AmericasMr. McElhinney began his career in the elevator industry with Dover Elevator Systems in Memphis, Tennessee as a design engineer in 1985. From 1986 to 1993 he held the position of Field Engineer in which he provided national technical support to the Dover field organization. In 1993, he was promoted to International Operations Manager where his responsibilities included technical and product support and development for Dover’s international distributors and operating companies. In 1997, Pat transferred to Arizona Elevator, Inc. as Service Manager. September 1998, Pat was promoted as the Manager of National Technical Services.
Rolland Harrison, National Field EngineerMr. Harrison worked for General Elevator Company from 1985 to 1995. He has worked in both service and modernization and was responsible for some of General’s first solid state projects. After relocating to Dallas, TX he advanced from Adjuster to Maintenance Supervisor in 1989. In 1991, Bryce joined General Elevator in Dallas, TX as Service Mechanic/Superintendent and later became the Service Manager. His responsibilities included servicing Dover as well as a variety of other manufacturer’s equipment such as Otis, Schindler and Montgomery. From 1995-1999, Bryce served as a Service and Modernization Adjuster for a Dallas based Independent Elevator Co. Bryce joined International Technical Services in April 1999 as a Field Engineer. Scott Gibson –National Field EngineerAfter his freshman year at Jacksonville State University, Scott moved to Houston and worked for Westinghouse as an Adjuster’s helper for three (3) years. In 1985, he moved to Dallas and obtained his mechanic’s certificate. Scott continued to work for Westinghouse until October of 1994, filling a number of roles including Construction Adjuster, Service Adjuster, New Product Support, and Modernization Design and Installation. Scott’s primary responsibility, while working at General/Dover, had been Modernization and Fire Service Installation. In 1990, Scott returned to school to complete his Bachelor’s Degree in Computer Science. Scott’s educational emphasis is on Electrical Engineering, Electrical Technologies and Computer Science. In 1997, Scott became the Test Engineer at ITS. He graduated, with honors, in 2002 and started the R&D department. Scott and his team develop test equipment and fixtures that benefit the lab’s diagnostic capabilities.
Gene Kissinger – National Field EngineerMr. Kissinger started in the elevator industry in 1980 as a construction helper. He worked his way up to adjuster in the construction and modernization departments and in 1996, Gene accepted a position in management as a construction and modernization superintendent, managing an adjusting group. Several years later, he was a supervisor for the service department and was responsible for service and repairs in New Castle Del & Philadelphia. In 2000, Gene joined the International Technical Services team as a Field Engineer with responsibilities of technical support for the ThyssenKrupp, C.E.C.-Swift, and Kone equipment. Gene currently supports ThyssenKrupp and Kone equipment

Kenneth W. Pixley, Manager of Technical DevelopmentMr. Pixley has been in the elevator industry since 1978. He holds an Associates degrees in Business Management and Digital Electronics. Love –Technical WriterMr. Love joined Dover National Technical services in January of 1998 serving in various roles, including Technical Writer, Diagnostic Tools Manager, Technical Publications Manager, IT Purchasing Manager, and Field Engineer. He holds a Bachelor of Science degree from the University of Houston and an Associate of Arts degree from South Texas College. In 1979, he began his career in the elevator business with Otis Elevator Company in Houston, Texas. He attended all of the technical and customer relations classes offered by Otis and was active in their after-hours training program. He was appointed Lead Mechanic for one of Otis’ most prestigious Houston-area service contracts. After serving in this capacity for six years, he was recruited by Amtech Elevator Services in 1991 to serve as a Lead Mechanic in the Houston area. He relocated to the Dallas area in 1996 to open a new branch office for Amtech Elevator Services and served as Field Supervisor. Steve currently supports Otis equipment. He has a wide range of experience in maintaining, field trouble-shooting, and repairing of Otis 4 and 6 Program Autotronic, VIP 260, A Base, B Base, CB base elevator systems, as well as all of the Otis MECS equipment platform.

Lois W. Griesser, Technical WriterMs. Griesser possesses advanced computer skills. Her career path has led her to develop a high degree of proficiency in manipulation and integration of a number of different applications to produce computerized desktop publishing documents. As an adjunct instructor at North Lake Community College, she taught Computer Fundamentals, Office Procedures and Business Correspondence as well as numerous hands-on computer application programs. For ten years Lois served as Data Processing Manager at a large non-profit organization where she became skilled in the creation of templates and macros. More recently, as Documentation Coordinator with Signature Home Care Company, she prepared training/resource materials, numerous forms, and technical publications for the tightly regulated healthcare industry. She holds a Bachelor’s degree in Sociology.
Frederick F. Hein II , Manager, Technical Repair FacilityMr. Hein began his electronics education in the Marine Corps in 1983, servicing cryptographic and communications equipment. In 1988, he entered the elevator trade as a bench technician with VTM Elevator in Houston, performing board repair, reverse-engineering and test development. Fred has worked as Field Engineering Support in the Modernization and Service environment with a focus on Westinghouse and Haughton equipment. He joined the Otis Service Center, Houston branch, in 1995 to supervise the Non-OEM Circuit Board Support providing repair, reverse engineering and procurement services for their North American Operations. ThyssenKrupp Elevator believes that accident prevention and efficient production go hand in hand. In our continued effort to provide a safe workplace, all employees participate in the ThyssenKrupp Elevator Employee’s Safety and Accident Prevention Program.
All levels of management have a primary responsibility toward the safety and personal well being of all employees. This responsibility is met by ongoing training and the promotion of safe working practices and operating conditions.
Responsibility for the safety of ThyssenKrupp Elevator employees and the public must be a part of the daily concern of all personnel. Employees are expected to use the safety equipment provided, and Rules of Conduct and Safety must be observed. Our safety program is comprehensively detailed in the Employees’ Safety and Accident Prevention Program manual, a copy of which is provided to every field employee. Service Requirements
Parts Inventory
Our local service center will be our Gainesville office, located at 4330 SW 29th
Avenue, Gainesville, Florida. Our service center from which this contract will be serviced will have access to inventory (throughout the period of this agreement) maintained at a minimum of $125,000 in parts and materials specifically intended for the traction and hydraulic elevators, dumbwaiters, chairlifts, and stage lifts to be maintained and repaired under this contract. All parts to include, but not be limited to those listed in Appendix H of the specifications.

Emergency Call-Out Procedures
Call In Procedure
During regular hours of 7:30am to 4:30pm, office personnel will take all of the information, including building, elevator number, problem that the customer had or is having with the elevator. After receiving all information, the office will dispatch a mechanic to the call via Nextel radio, and email.

After Hours Call In Procedure
After 4:30pm when a call comes in, ThyssenKrupp Communications (our answering service) will take the call and dispatch the mechanic via text message and by calling the mechanic’s cell phone. The same procedure occurs, as the ThyssenKrupp Communications personnel will take the name of the person calling, the building, and elevator number and relay all of the information to the mechanic.
The mechanic is required to call ThyssenKrupp Communications to respond and close out the call. The mechanic will also call the building owner/manager with an estimated time of arrival.

Our MCP is made up of procedures for the examination, maintenance and testing of your elevators and escalators to ensure the utmost in safety and performance, giving you unsurpassed benefits:
Convenient, detailed list of maintenance tasks scheduled to be performed
Maintenance Tasks & Records Log (MTR), allowing for a record of tasks, historical data, list of tests required and test results
Maintenance tasks clearly defined by equipment type – maintenance personnel can visibly understand responsibilities
Permanent, hard copy of records that remain with the equipment owner
This is a CODE REQUIREMENT for most states that is not yet enforced.

Trained EmployeesOnly fully trained and experienced journeyman certified elevator mechanics, and trained elevator mechanic’s helpers, all in the direct full time employment of the Elevator Contractor, shall be allowed to perform work on the vertical transportation systems covered by this Contract Agreement. Any employee of the Elevator Contractor who appears not to perform in a competent manner, or be able to work in a safe manner, can be directed to leave the University premises, and the local office manager for the Elevator Maintenance Contractor shall be notified by a University Representative. Elevator mechanic’s helpers with, or without, temporary mechanic’s status, are not acceptable to work as journeymen elevator mechanics on this Contract Agreement regardless of their standing with a Local Union or the Employer.
Journeymen elevator mechanics shall answer all regular time and over-time call-backs, and perform all routine maintenance examinations, and perform all repairs on the vertical transportation equipment. Elevator mechanic’s helpers can only perform cleaning, painting and replacement of indicator lamps on the elevator equipment, or assist a journeyman elevator mechanic who is working on the site as the same time as the elevator’s helper. Helpers shall not answer emergency call-backs.
Elevator Contractor shall regularly engage in providing and requiring continuing education classes and training sessions to improve the skills of the elevator mechanics. Failure to do so demonstrates lack of commitment on the part of the Elevator Contractor, and is not in compliance with the requirements of this Contract Agreement. Complete records must be maintained indicating the extent and type of training, and shall be made available to the Owner in the event such a request is made during the course of this Contract Agreement.
Elevator Contractor shall maintain, throughout the life of this Contract Agreement, at least three (3) fully trained, highly experienced journeyman classified, State of Florida certified elevator mechanics regularly scheduled to work at the University of Florida, in Gainesville, Florida, to fully maintain, service and repair the elevators and other vertical lifting devices shown on enclosed equipment list, to provide the required routine maintenance services, emergency call-back service, repairs and related work on the elevators covered under this Contract Agreement. More than three (3) fully qualified, certified elevator mechanics may be required, in which case, the Elevator Contractor shall furnish the necessary personnel to accomplish the required work to comply with this Contract Agreement.

Trained Employees (Continued)Qualified, certified, elevator mechanic technicians shall not rely entirely on their time in the industry as the criteria, but qualifications shall also include all of the required training and expertise necessary to fully maintain all of the vertical transportation equipment owned by the University. All such mechanics shall live within twenty-five (25) miles of the area where the elevators are located, in order to suitably respond to any emergency call-backs, entrapments, emergency repairs and other such undefined emergencies in accordance with the time periods listed in this Contract Agreement.
Additionally, at least one (1) fully trained repair crew (certified mechanic and mechanic’s helper), as well as a trained mechanic’s helper, shall be readily available on very short notice (within two hours from the time the need for such additional personnel is recognized, to be on the site), to provide additional support and assistance to at least three (3) certified maintenance technicians that are regularly assigned to the University campus vertical transportation systems.
All certified journeyman mechanics assigned to work on this equipment shall be trained as follows:
Must have the ability to provide maintenance service on all of the different brands and types of vertical transportation equipment covered by this Contract Agreement.
Must have the complete ability to adjust, troubleshoot and repair all of the different brands and types of vertical transportation equipment covered by this Contract Agreement.
Must have the ability to test all of the different brands and types of vertical transportation equipment covered by this Contract Agreement.
Must have the ability to modify or change the operational adjustments on all typed of vertical transportation equipment covered by this Contract Agreement, including those conditions that require modification to better serve the University needs, improve reliability and to increase safety of operation.
Must have the ability to adjust all types and brands of hydraulic control valves to improve reliability, safety of operation and performance of the equipment.
Must have the ability to diagnose intermittent operational problems and make needed corrections, on driving machines, electrical controller equipment, door operators and other technical systems

All certified journeyman mechanics assigned to work on this equipment shall be trained as follows (continued):
Shall not need the assistance of other elevator technicians to correct at least 99+% of all operational problems which may arise.
Shall be trained to be efficient, accurate and responsible for completing all tasks without delays in accomplishing the tasks assigned in connection with the Contract Agreement.
Shall be a courteous, self-starting, highly motivated, accurately focused, safety oriented person.
Certified mechanics shall always exhibit an interest in carrying out each and every requirement of this Contract Agreement, without delays and excuses.

Additional Performance Requirements
The University shall be responsible for the following items, equipment and conditions:
• Finished flooring materials on elevator car platforms.
• Wear and tear on car and hoist way entrance thresholds or sill, except wear or damage created by failure of the Elevator Contractor

Elevator Equipment or Work Not Included in Contract
This elevator maintenance Contract Agreement is intended to provide the Elevator Contractor with sufficient available time for the elevator maintenance technicians to perform the required preventative maintenance work necessary towards keeping the elevator equipment in the highest quality condition or standards at all times.
Elevator Contractor is expected to perform the preventative maintenance work in a manner that will keep the elevator call-backs and outages to a minimum. For purposes of this Contract Agreement, the following number of call-backs or outages due to equipment failure should not exceed the following number, otherwise the Elevator Contractor may be considered to be failing to maintain the elevator equipment in a suitable manner:
• Three (3) call-backs, per year, per hydraulic elevator; four (4) call-backs, per year, per traction elevator.
The number of call-backs or equipment outages shown does not include conditions related to power failure, excessive vandalism or abuse, or other conditions over which the Elevator Contractor has not control.

Memo Of Clarification for Scope of Work –Elevator MaintenanceBid Number FAC82952-11 (Changes to scope of work to reflect University of Florida units, and modifications to existing contract between ThyssenKrupp Elevator Corp. and Florida State University)
For the purpose of adjoining the University of Florida to the existing Elevator Maintenance Contract referenced above, the following changes and pricing shall be incorporated to reflect the location, unit count and type, and scope of work clarification necessary to reflect conditions and pricing provided in this proposal and resulting agreement.
All references to Florida State University the in the above referenced proposal shall become The University of Florida. All references to Leon County the in the above referenced proposal shall become Alachua County. The number of mechanics on site shall be three (3). Residences for mechanics shall be within 50 miles.Response time for repair crews and additional labor help shall be 24 hrs.Callback acceptable levels shall be an average over all units.Page 11 paragraph H replace specific quantities on hand with “adequate spare parts to maintain all units in good working order” Anticipated value of spare parts stock shall be 20% of total contract annual price.Scheduled preventive maintenance work per month is estimated to be

Pricing in proposal and resulting agreement will be stated as “Monthly and Annually” and payment terms shall be Monthly Net 30 days.
Please Note: These modifications were made in an effort to provide the University of Florida with similar pricing to what it has experienced over the last several years. If the University of Florida elects to remove these modifications then the monthly pricing will need to increase to reflect the same pricing as Florida State University. Monthly contract amount will increase to $72,013.00 and escalate proportionately to the schedule for 10 yr pricing in the proposal.

Additional Work Price Adjustment Provisions
1. The mechanic’s straight time rate for any additional vertical transportation related work, that is not included in this Contract Agreement, shall be adjusted by the percentage of increase or decrease in the straight time hourly rate for the elevator mechanic in the area in which the elevator equipment is maintained, in effect on the contract anniversary date, as compared to the hourly labor cost used in establishing the prior year’s price. The hourly net labor cost used in establishing the initial price for this contract was $62.85.
2. For purposes of this Contract Agreement, and any subsequent extra labor adjustments, the “straight time hourly labor cost” shown in number 1 above shall be the actual hourly rate paid to the mechanics, plus the employer/employee negotiated fringe benefits. Negotiated fringe benefits include only: pensions, vacations, paid holidays, group life insurance, group sickness and accident insurance and hospitalization insurance. (Note: the straight time labor rate cost is not the billing rate to the University, nor shall the amount shown above include overhead and administrative costs.

Mark-up on “Extra Work” Not Included in Contract Agreement
The Elevator Contractor shall restrict his or her mark-up on any University approved additional work that is not included in the Contract Agreement, to a maximum of 30% on his or her actual cost of materials, expenses of all types, and direct labor costs (based entirely upon the hourly rate paid to mechanics, plus the employer/employee negotiated fringe benefits and employment taxes only), and a maximum of 20% on all contracted labor and materials perform by workmen not in the employment of the Elevator Contractor.
Any Extra Work, beyond the scope of this Contract Agreement, shall be approved by a representative of the University prior to the work being performed. The University shall advise the Elevator Contractor of the names and telephone numbers of all representatives that can make contractual commitments on the part of the University.

Contract Agreement Suspension; Billing Credits During Major Repairs, Equipment Shut-down, or Buildings Removed from Use
The Elevator Contractor shall suspend the monthly billing or provide billing credits for maintenance on one (1) or more elevators, during any time period that an elevator is removed from service for an extended period of time of over fifteen (15) days during any single occurrence when the elevator equipment is removed from service. These conditions can be the result of a number of events such as building renovation, fire damage, storms or other catastrophic events or other occasions during which the University is not beneficially using the elevator equipment.
Additionally, the University is permitted to permanently remove specific elevators, or other types of vertical transportation equipment, from this Contract Agreement, in the event a building is: destroyed due to unavoidable causes; sold; closed; torn down; or fi the elevator equipment is permanently removed from service. The respective price for maintenance of any elevator(s) impacted by such events shall be deducted from the contract price, based on the price listed in the elevator maintenance Contract Agreement, or any addendums to the Contract Agreement.

Addition of Elevators or Other Vertical Transportation Equipment to Contract Price
During the term of this Contract Agreement, the University shall have the right to include additional elevators to the Contract Agreement. The maintenance pricing structure for elevators to be added shall be on the basis of similar elevators already included in the Contract Agreement, or on a “fair price” basis as determined by University and University retained Elevator Consultant.
University Shall Have the Right to Solicit Competitive Bids for Elevator Renovation Work While This Contract Agreement Is In ForceDuring the term of this Contract Agreement, the University shall have the right to solicit competitive bids from other Elevator Companies to replace, renovate or modernize elevator equipment. The Elevator Contractor, whom is a party to this Contract Agreement, shall have an opportunity to competitively bid on such work, but shall not be considered as being a sole source vendor for purposes of the Contract Agreement.

Additional insured is defended and indemnified for claims arising from Contractor’s acts, actions, omissions or neglects; but is not defended or so indemnified for its own acts, actions, omissions, neglects or bare allegations. Substance Abuse Policy
ThyssenKrupp Elevator is dedicated to providing a safe and productive work environment for all employees. It is the policy of ThyssenKrupp Elevator that employees shall not be involved with the use, possession, sale or transfer of drugs or alcohol in any manner that may impair their ability to perform assigned duties or otherwise adversely affect ThyssenKrupp Elevator’s business. The purpose of this policy is to eliminate the use of drugs and alcohol in the work place, increase work place safety and efficiency, and assist employees who have substance abuse problems. This policy is further intended to re-emphasize the prohibitions against the use or possession of alcohol or illegal drugs in the work place.
Procedures
ThyssenKrupp Elevator performs several types of substance testing including pre-employment, probable cause, post accident and periodic.
Pre-employment drug testing will be performed on all applicants who have accepted offers of employment with the company. All offers of employment are contingent upon the successful completion of the drug test screening, which means that no positive levels of illegal drugs will be accepted.
An employee will be required to undergo testing when probable cause exists to believe the employee is impaired on the job. Probably cause will be deemed to exist under the following circumstances, though the following is by no means an exhaustive list:
• The employee’s conduct or actions indicating alleged impairment shall be observed by a supervisor and confirmed by a second supervisor if practical. The supervisor(s) shall record their observations in writing stating the date, time, length of observation, and actions of the employee which they believe constitute drug or alcohol impairment. Such statements shall be signed.
• A determination is made that the employee’s conduct is symptomatic of alcohol or drug impairment by an independent physician or health care professional qualified to make such a determination, following a consultation with the employee. The physician or health care professional shall be the Company’s choosing and the cost of such consultation and determination shall be borne by the Company if it is not covered by applicable insurance.

Substance Abuse PolicyAn employee will be required to undergo testing for the presence of alcohol or drugs after being involved in an accident which results in professional medical treatment or damage to Company property. The Company, in its sole discretion, may waive this requirement if it can be determined based on the circumstances of the accident that drugs or alcohol were not a contributing factor.
The Company also used periodic testing to insure a continuing drug and alcohol free work environment. Periodic testing will be conducted at a selected location and all full time and temporary employees, contractors and subcontract personnel at the selected location will be required to participate.
If the employee refuses to participate in a drug test or unduly delays the test, then the employee is subject to termination.
The Company will use a drug testing facility that meets federal and state requirements, with sufficient facilities and quality control features to ensure accuracy in test diagnosis and the capability to store samples. Chain of custody procedures will be observed at all times.
The results of the test of an employee who tests positive the first time, must be confirmed by an alternative scientific method. An employee who disputes positive results shall have the right within ten working days of when he/she is notified of the test results to have his or her initial sample independently re-tested by an authorized laboratory of his/her choice at his/her own expense. If the independent re-test indicates a negative result, the Company may elect to re-test the employee’s initial sample. If the results are again negative, the employee will be returned to work immediately (if he/she is off work) and mad whole for any loss of pay occasioned by the first positive test results. If state law provides for different re-testing procedures, those procedures will apply to the extent they are more favorable to the employee.
The employee may be disciplined, up to and including discharge, for his or her conduct in connection with the circumstances surrounding the request for drug testing. In circumstances where the employee is not discharged, an employee whose final test results are positive will be referred to a recognized and approved rehabilitation or counseling program. The cost of such programs may be offset by appropriate medical coverage. If the employee enters such a program, his/her status as an employee will not be affected by the positive test result alone, and he/she will be allowed to continue working under the condition established by the program.

Substance Abuse PolicyAn employee who refuses to enter and participate in such a program may be discharged for such refusal. Testing may be for drug or alcohol impairment only and not for any other medical condition. Neither the employer, nor any medical or testing personnel, shall disclose any information regarding the fact of testing or the results of testing to any other employee or customer. All test results and related information will be given the same confidentiality as any other medical information in the Company.
All employees are forbidden to use or possess alcohol or illegal drugs at any time during working hours or anywhere on the employer’s premises. Workers also are forbidden to engage in any sale or other transaction involving illegal drugs on the employer’s premises. Violators will be subject to immediate discipline. Additionally, employees who are under the influence of alcohol or drugs while on the job will be subject to discipline.
Any sale of illegal drugs on the employer’s premises will be treated as gross misconduct, punishable by immediate discharge for the first offense. Any off-duty employee who is arrested for selling drugs will be discharged if he or she subsequently is convicted of a criminal offense.
Employees who must use a prescription drug that causes adverse side effects (e.g., drowsiness or impaired reflexes or reaction time) should inform their immediate supervisor that they are taking such medication on the advice of a physician. Such employees are responsible for informing their supervisor of the drug’s possible effects on performance and the expected duration of use.
Department of Transportation (DOT)The federal government has recognized the serious impact of drug use and alcohol abuse. The Federal Motor Carrier Safety Administration (FMCSA) issued regulations, which require the Company to perform alcohol and controlled substances testing. The purpose of the FMCSA issued regulations is to establish programs designed to help prevent accidents and injuries resulting form the misuse of alcohol or controlled substances by drivers of commercial motor vehicles. All drivers who operate commercial motor vehicles that require a commercial drivers license under 49 CFR Part 383 are subject to the FMCSA’s drug and alcohol regulations, 49 CFR Part 382.
