Preamble

In exercise of the powers conferred by section 15 of the Elections Act 1958 [Act19J, the Election Commission, with the approval of the Yang di-Pertuan Agong,makes the following regulations:

PART I-PRELIMINARY

Regulation 1. Citation, application and commencement.

(1) These regulations may be cited as the Elections (Registration of Electors)Regulations 2002.

(2) These Regulations apply throughout Malaysia.

(3) These Regulations come into operation on 16 July 2002.

Regulation 2. Interpretation.

In these Regulations, unless the context otherwise requires-

"Chief Registrar", "Registrar", and "Assistant Registrar" mean respectively the ChiefRegistrar of Electors , Registrar of Electors and Assistant Registrar of Electorsappointed under section 8 of the El~ctiQ!1sActJ.9jJ!;

"Adjudicating Officer" means an Adjudicating Officer appointed under section 8 ofthe EkctiQ!1sActJ95.S;

"absent voter" means a citizen who has attained the age of twenty-one years on thequalifying date and is-

(a) a serving member of any regular naval, military or air force of Malaysia, theCommonwealth or other country;

(b) the spouse of a serving member of any force referred to in paragraph (aJ, whoelects to become an absent voter;

(c) in the public service of the Government of Malaysia or of any State or in theservice of any local authority or statutory authority exercising powers vested in itby Federal or State law, who is on duty outside the boundaries of PeninsularMalaysia or Sabah or Sarawak;

(d) the spouse of a person in the public service of the Government of Malaysia or ofany State or in the service of any local authority or statutory authority exercisingpowers vested in it by Federal or State law who is living with her or his husband

or wife outside the boundaries of Peninsular Malaysia or Sabah or Sarawak at thedate of application for registration as a Parliamentary or State elector;

(e) engaged in full-time studies at any university, training college or any highereducational institution outside the boundaries of Peninsular Malaysia or Sabah orSarawak; or

(f) the spouse of a person engaged in full-time studies at any university, trainingcollege or any higher educational institution outside the boundaries of PeninsularMalaysia or Sabah or Sarawak who is living with her or his hnsband or wife at thedate of application for registration as a Parliamentary or State elector·,;

Regulation 3. Registration areas and registration units.

(I) Each Parliamentary constituency unit consists of the State constituency and thepolling district and shall constitute a registration area.

(2) Each polling district shall constitute a separate registration unit in a registrationarea.

(3) The principal electoral roll or the supplementary electoral roll shall be framed inseparate parts for each registration unit in the registration area.

Regnlation 4. Separate letter for each registration unit.

There shall be a separate letter or letters or number or numbers, or both, for eachregistration unit and such letter or letters or number or numbers, or both, shall bedeemed to form part of an elector's number in the principal electoral roll or thesupplementary electoral roll.

Regulation 6. Order of names.

(I) The names in the principal electoral roll or the supplementary electoral roll foreach registration unit shall be arranged in such manner as the Registrar maydetermine and shall be numbered in accordance with the directions of the ChiefRegistrar.

(2) The names of absent voters or members of any police force established by anywritten law in force in Malaysia, other than members of the Voluntary ReserveForce, who are entitled under the provisions of any law relating to elections to bepostal voters, shall be shown in a separate list for postal voters at the end of eachpart of the principal electoral roll or supplementary electoral roll in respect ofeach registration unit in which such persons are qualified to be registered aselectors.

Regulation 7. Alteration of boundaries of constituencies.

Where in any year prior to the certification of the principal electoral roll or thesupplementary electoral roll under these Regulations, the boundaries of anyParliamentary or State constituency are altered by the Election Commission inaccordance with the provisions of the Federal Constitution-

(a) the principal electoral roll last certified or the supplementary electoral roll lastcertified, of the registration area in such constituency, shall remain valid until thenext certification of the principal electoral roll or the supplementary electoralroll;

(b) the ChiefRegistrar may-

(i) make such necessary transfers of particulars of registered electors in theprincipal electoral roll or the supplementary electoral roll;

(ii) make such other changes to, or give such directions in relation to, theprincipal electoral roll or the supplementary electoral roll as he may deemnecessary or expedient in order to give effect to the alteration; and

(iii) give such further certificates in such terms as he may deem necessary orexpedient.

Regulation 8. Use of principal electoral roll or supplementary electoral roll inrespect of new delimitation of constituencies for by-election to undissolvedParliament or State Legislative Assembly.

Where a new delimitation of constituencies has come into force, but the Parliament orany State Legislative Assembly existing prior to such new delimitation coming intoforce has not yet been dissolved, the certification under these Regulations of theprincipal electoral roll or the supplementary electoral roll prepared in relation to thenew delimitation of constituencies shall be valid for the purpose of any by-election inrespect of the Parliament or a State Legislative Assembly which has not yet beendissolved, and the Chief Registrar may give such directions in relation to the principalelectoral roll or the supplementary electoral roll as he may deem necessary orexpedient for the removal of any difficulty or otherwise, and may also give suchfurther certificate or certificates in such terms as he may deem necessary or expedient,for the purposes of the by-election.

Regulation 9. Electoral roll for the purpose of general election or by-election.

For the purpose of a general election or a by-election, the Election Commission shalldetermine the last certified principal electoral roll and the supplementary electoralroll, prior to the dissolution of Parliament or a State Legislative Assembly or avacancy occurring, to be used in the general election or the by-election.

Regulation 10. The principal electoral roll.

(A) 327/1971] and the Elections(Registration of Electors) (Sabah) 1971 [P.O. (A) 328/1971] and certified by theElection Commission on or before 31 December 200 I become the principalelectoral roll under these Regulations.

PARTIV-THESUPPLEMENTARYELECTORALROLL

Regulation 11. The supplementary electoral roll

There shall be a supplemeutary electoral roll which shall contain the names of newlyregistered electors and registered electors whose registration is transferred to differentregistration areas.

Regulatiou.12. Application forrcgistration·or·transfer of registration.

(a) every person who is qualified and desires-te-be-registered as a Parliamentaryelector in any State; and

(3) The Registrar or Assistant Registrar shall forthwith cause an acknowledgement, byusing the tear-off slip referred to in Form A, duly stamped by his official stamp,of every such application received by him to be delivered or sent by ordinary postto the applicant at the address given by him.

Regulation 13. Revision of supplementary electoral roll.

(I) The Registrar shall, once every thr""e L""'o months, revise the supplementaryelectoral roll of the registration area for which he is appointed.

(2) For the purpose of revising the supplementary electoral roll and of satisfyinghimself as to the qualification of any person for registration or determiningwhether the name of any person should be entered or retained in thesupplementary electoral roll or expunged from the supplementary electoral roll,the Registrar may either make such house to house or other inquiry as he maydeem necessary by himself or through any person appointed by him in writing inthat behalf or may send a notice requiring information to the person from whomthe information is required by ordinary letter addressed to such person or bydelivering such notice to him personally or to an adult member of his household.

(3) If any person whose name is on the supplementary electoral roll fails to give suchinformation to the Registrar with regard to his own qualification for registrationwithin seven days after service upon him by the Registrar of a notice undersubregulation (2), he shall, in addition to any penalty prescribed by any writtenlaw, have his name expunged from the supplementary electoral roll.

(4) Every person appointed by a Registrar under subregulation (2) to whom anyinformation relating to the qualification of any person for registration or relevantfor determining whether the name of any person should or should not be enteredor retained in the supplementary electoral roll has been furnished or by whomsuch information has been collected shall forthwith furnish such information tothe Registrar.

(5) On the completion of the revision of the supplementary electoral roll for anyregistration area, the Registrar shall give notice in the Gazette that the revision hasbeen completed and that the revised supplementary electoral roll or a copy of theroll, is open for inspection fO.L1\JJ1i,timlJm_p-erioQ.Qfthiuy-Q!!Y'>IDl<Lat such hoursas may be stated in the notice at the office of such Registrar and that such part ofthe supplementary electoral roll or a copy of such part of the roll as relates to anyregistration unit in such registration area is open for inspection for li.ill.ill-iill\!!!lp-erioQ_oIthiW_.>1ay.sJ!!1lLat such hours as may be stated in the notice and at theplaces in the registration unit as may be specified in the notice. (6) Notice under subregulation (5) may be given by-

(aj the Chief Registrar to apply to the supplementary electoral roll of more thanone registration area; and

(b) the Registrar to apply to the supplementary electoral roll of a registration areaor a registration unit

14. Claims during revision of supplementary electoral roll.

(I) Any person who has--applied q\H!UjjJl~_to be registered in the supplementaryelectoral roll for any registration area for which he is qualified to be soregistered may, if his name has been omitted from the supplementaryelectoral roll, submit a claim to the Registrar to whom he has made theapplication to have his name entered in the supplementary electoral roll.

(2) Every claim by the person referred to in subregulation (I), hereinafter referredto as the "claimant", shall be made in Form B in the Schedule and shall bedelivered to the Registrar of his registration area within seven-thirty daysfrom the date on which the supplementary electoral roll is open for inspectionas stated in the notice referred in subregulation 13(5).

(3) Within seven days after the expiration of the period for making a claim, theRegistrar shall exhibit in a conspicuous place in his office a notice containingthe names and addresses of the claimants.

(4) Upon receipt of a claim under this regulation, the Registrar may, ifhe is of theopinion that the particulars given in the claim are insufficient, request forfurther information from the claimant who shall furnish the informationwithin seven days from the date he receives such request

(5) Where the claimant fails to furnish the information in the manner provided forin subregulation (4), the claim shall be deemed to have been withdrawn andthe Register shall take no further action.

Regulation 15. Objections during revision of supplementary electoral roll.

(I) Any person whose name appears-

(a) in the principal electoral roll-foFthe·-registration-areaforwhich--he--is"'[ualifiedto-be-reg-ister-ed, may object to the inclusion of his name or the name of anyother person in the supplementary electoral roll; or

(b) in the supplementary electoral roll for the registration area for which he isqualified to be registered, may object to the inclusion of his name in thesupplementary electoral roll where the registration area of the person has beench,mgJld_witholllanapp!ki\tioJLsJJIlJnitt",dJ"yJh",p",rs9n.

(2) Every objection by the person referred to in subregulation (I), hereinafter referredto as the "objector", shall be made in Form C in the Schedule and shall bedelivered to the Registrar ofhis registration area within seveu--th1m.days from thedate on which the supplementary electoral roll is open for inspection as stated inthe notice referred to in subregulation 13(5) or in the case of an objection to the

insertion in the supplementary electoral roll of the name of a claimant, withinseven-thi!tY..days from the date on which the notice containing the names of theclaimants is first exhibited under subregulation 14(3).

(3) The objector is allowed to object·once only-and· the-number·ofpersons·jn·Tegard·towhom·thenbjector-is···"llowe<J..t(}·objeet·Bhall·-not·-ex-eeed-tenfor the same person(s)Q!!9_e.Ql)jy.

(5) Upon receipt of an objection under this regulation, the Registrar may, if he is ofthe opinion that the particulars given in the objection are insufficient, request forfurther information from the objector who shall furnish the information withinseven days from the date he receives such request.

(6) Where the objector fails to furnish the information in the manner provided for insubregulation (5), the objection shall be deemed to have been withdrawn and theRegistrar shall take no further action.

(7t If the Registrar is of the opinion that the objector is not entitled to object, he maydisallow the objection and shall so inform the objector.

(8) _The Registrar shall-

(a) in any case where he is satisfied that the particulars given in an objection aresufficient; or

(b) upon receipt of the information requested for under subregulation (5),

forthwith send a notice of the objection to the person in regard to whom theobjection has been made in Form D in the Schedule.

Regulation 16. Disallowance of claim or objection.

If the Registrar is of the opinion that a claim or objection cannot be allowedbecause-

(a) the matter has been concluded by the decision ofa court; or

(b) the particulars given in a claim or objection do not entitle the claimant or objectorto succeed, he may send to the claimant or objector a notice stating his opinionand the grounds for his opinion and that he intends to disallow the claim orobjection unless the claimant or objector gives him notice within seven days fromthe date of the first-mentioned notice that he requires the claim or objection to beheard and, if the Registrar receives no such notice within the said time, he maydisallow the claim or objection.

(I) Subject to regulations 14, 15 and 16, the Registrar shall, as soon as practicahleafter receiving a claim for or an objection to the inclusion of any name in thesupplementary electoral roll, hold a public inquiry into the claim or objectionwhich has been duly made, giving not less than seven days' notice in Form E inthe Schedule to the claimant or the objector or the person in regard to whom theobjection has been made and any person who appears to the Registrar to beinterested in or affected by the inquiry may appear in person and be heard.

(2) Where an ohjection is made to the insertion of any name in the supplementaryelectoral roll, the Registrar shall, at the public inquiry, call upon the objector togive prima facie proof of the grounds for the ohjection.

(3) If such prima facie proof as aforesaid is given, the Registrar shall require proof ofthe qualification of the person in regard to whom the objection has been made,and~

(a) if such person's qualification is not proved to the Registrar's satisfaction, shallexpunge such person's name from, or, as the case may be, refuse to includesuch person's name in the supplementary electoral roll;

(b) if such person's qualification is so proved, shall retain such person's name, or,as the case may be, include such person's name in the supplementary electoralroll.

(4) If at a public inquiry into any objection, the objector fails to appear or appears butfails to give such prima facie proof as aforesaid, then-

(a) if the objection is to the inclusion in the supplementary electoral roll of thename of a person appearing in the roll, the Registrar shall retain such person'sname in the supplementary electoral roll without calling upon such person toprove his qualification;

(b) if the objection is to the inclusion in the supplementary electoral roll of thename of any claimant, the Registrar shall require proof of the qualification ofthe claimant and-

(i) if the claimant's qualification is not proved to the Registrar's satisfaction,shall refuse to include the claimant's name in the supplementary electoralroll;

(ii) if the claimant's qualification is proved, shall include the claimant's namein the supplementary electoral roll.

(5) Without prejudice to subregulation (2), the absence or non-attendance of theperson in regard to whom objection has been made at such public inquiry shall notrelieve the objector from giving such prima facie proof to establish the fact thatthe name of the person in regard to whom objection has been made improperlyappears, or is not entitled to remain, in the supplementary electoral roll.

(6) Before proceeding to hear the objection at such public inquiry, the Registrar shallbe satisfied that the person in regard to whom objection has been made has beenserved with a notice in Form E in the Schedule.

(7) If such prima facie proof is given in the absence of the person in regard to whomobjection has been made, it shall be lawful for the Registrar to expunge suchperson's name from, or refuse to include such person's name in, the supplementaryelectoral roll, as the case may be.

(8) If no such prima facie proof is given by the objector, the Registrar shall retainsuch person's name in the supplementary electoral roll.

Regulation 18. Objection without reasonable cause

If an objection is made and is disallowed by the Registrar and, in his opinion, theobjection was made without reasonable cause, the Registrar may, in writing, order theobjector to pay to the person in regard to whom objection has been made a sum ofmoney not exceeding two hundred ringgit as compensation for any loss of time orinconvenience incurred by such person in consequence of the objection.

Regulation 19. Withdrawal of Objection

(I) An objector may withdraw his objection at any time not later than five days beforethe date fixed for public inquiry as specified in Form E in the Schedule.

(2) Where a withdrawal is made after the expiration of the period specified, theRegistrar may, in writing, order the objector to pay a sum ofmoney not exceedingtwo hundred ringgit to the person in regard to whom the objection has been made.

(I) Any claimant, objector, or person in regard to whom objection has been mademay, if he is aggrieved by a decision of the Registrar in respect of a claim orobjection, appeal to an Adjudicating Officer.

(2) Every such appeal shall be in writing and-

(a) shall be signed by the appellant;

(b) shall state shortly the grounds of appeal; and

(c) shall be delivered to the Adjudicating Officer together with a fee of fiveringgit, within ten days from the date of the decision in respect of which theappeal is made.

(3) An Adjudicating Officer shall hear such appeals in public after giving not less thanfour clear days' written notice of the date, time and place of the hearing of theappeal to the parties concerned and may at his discretion hear any furtherevidence.

(4) The determination of the appeal by the Adjudicating Officer shall, under theseRegulations, be final-tlfl<hshall-net-be-ebaHenged-er-questiened--in,er-i'ever"Sed,a1t<l1'ed-er-quasbed-by,any-oourt-en-any-gr-euna.

(5) Without prejudice to subregulation 23(2), if at any hearing of the appeal-

(a) the appellant fails to appear though he has been served with the written noticereferred to in subregulation (3), the Adjudicating Officer may dismiss theappeal;

(b) the respondent fails to appear though he has been served with the writtennotice referred to in subregulation (3), the Adjudicating Officer may hear anddetermine the appeal.

(6) If, upon an objection being disallowed by the Registrar, the objector appeals undersubregulation (1) to the Adjudicating Officer, and in the opinion of theAdjudicating Officer the appeal was made without reasonable cause, theAdjudicating Officer may, in writing, order the objector to pay to the person inregard to whom the objection was made a sum of money not exceeding twohundred ringgit as compensation for any loss of time or inconvenience incurredby such person in consequence of the appeal.

(7) If any such appeal as aforesaid is allowed by the Adjudicating Officer, he shallhave power to revise or cancel any order made by the Registrar for the payment ofcompensation by the objector.

(8) When the Adjudicating Officer has determined the appeals which have beenlodged with respect to claims or objections, he shall forward to the Registrar a

statement under his hand containing the names which he has decided shall beentered or retained in the supplementary electoral roll and those which he hasdecided shall be omitted or expunged from the supplementary electoral roll andthe Registrar shall amend the supplementary electoral roll accordingly.

Regulation 21. Recovery of sums awarded.

Any sum awarded under regulation 1L18, 19 or 20 shall be recoverable as though theorder of the Registrar or the Adjudicating Officer were an order of a Sessions Courtfor the recovery of money by the person to whom such compensation is payable dulymade in civil proceedings before such Court.

Regulation 22. Certification of supplementary electoral roll.

(I) The Registrar of each registration area shall, as soon as possible after claims andobjections have been determined, certifY the supplementary electoral roll for theregistration area in Form F in the Schedule and shall, as soon as possiblethereafter, give notice in the Gazette that the supplementary electoral roll, or acopy of the roll, is open for inspection at such reasonable hours as may be statedin the notice at the office of the Registrar or at such places in the registration areaas may be specified in the notice.

(2) Notice under subregulation (I) may be given by-

(a) the Chief Registrar in respect ofthe supplementary electoral roll of more thanone registration area; or

(b) the Registrar in respect of one registration area or one registration unit.

(3) The certified supplementary electoral roll shall corne into force upon the date ofthe publication in the Gazette of the notice under subregulation (1) and, subject tosuch alterations, if any, in the supplementary electoral roll shall continue in forceuntil the supplementary electoral roll is merged with the principal electoral rolland then re-certified.

PART V - MISCELLANEOUS

Regulation 23. Notices

(I) Except in the case of subregulation 13(2), all notices required to be given by aRegistrar or an Adjudicating Officer shall be deemed to have been duly given ifsent by registered post to the address, if any, given in a claim or objection, or, indefault of such address, to the address given in the principal electoral roll or thesupplementary electoral roll.

(2) A Registrar or an Adjudicating Officer may, from time to time, adjourn anyproceedings before him under these Regulations to any convenient date, time andplace.

Regulation 24. Merger of principal electoral roll and supplementary electoralroll.

The Chief Registrar shall, after the revision of the principal electoral roll aod thecertification of the supplementary electoral roll, merge the principal electoral roll withthe supplementary electoral roll and re-certify the rolls which have been so mergedafter which the re-certified rolls shall become the principal electoral roll for that year.

Regulation 25. Chief Registrar may restore name in the electoral roll.

(I) Notwithstanding anything in these Regulations, but subject to subregulation{5)sllbregullijions(5),(61and{7), the Chief Registrar may, at any time, on beingsatisfied that the name of any person has been omitted or removed from theprincipal electoral roll or the supplementary electoral roll as a result of any erroror wrongful act or for any other reason, restore the name of the person in theprincipal electoral roll or the supplementary electoral roll.

(2) Subject to subregtlhlt-ien§:-(!ib!nd:{-61__Sl!lm"gul"tio_nLC5)~{(iJ.J!ll!t{lLthe ChiefRegistrar may, at any time, make such alterations or changes to the principalelectoral roll or the supplementary electoral roll as he deems necessary for thepurpose of-

(a) carrying out the decision of aoy Registrar or Adjudicating Officer withrespect to any claim or objection;

(b) correcting aoy error or omission with regard to the particulars of theregistration of any person;

(c) inserting any new particulars with regard to the registration ofany person;

(e) striking out any superfluous entry in the principal electoral roll or thesupplementary electoral roll;

(e) deleting the name of any person who the ChiefRegistrar is satisfied is dead;

(f) striking out the name of any person who has renounced, or who has beenlawfully deprived of, his citizenship; or

(g) striking out the name of any person who, in the opInIOn of the ChiefRegistrar, is not entitled, for any reason, to remain or be in the principalelectoral roll or the supplementary electoral roll.

(3) Where an error has resulted in aoy person being registered as ao elector of aregistration area which is not a registration area in respect of which that personshould have been registered, ~u.bje_c1Jo __Sl!b~egl!lationsJ5), C6Jlllld.(1),jhe ChiefRegistrar may enter that person's name in the principal electoral roll or thesupplementary electoral roll for the appropriate registration area.

(4) In exerclsmg the powers under subregulations (2) and (3), §J!bje.9LJQ§J!bregJ!latiQns_(J), ({i)and{7),the Chief Registrar-

(a) may give such directions in relation to the principal electoral roll or thesupplementary electoral roll as he may deem necessary or expedient; and

(b) may also give such further certificate or certificates in such terms as he maydeem necessary or expedient.

(5) No alteration or change pursuant to these Regulations shall be made to theprincipal electoral roll or the supplementary electoral roll for a registration areaduring the period beginning on the day of -

(a) the dissolution of Parliament or any State Legislative Assembly;

(b) the establishment of a casual vacancy by the Election Commission; or

(c) the notification of such casual vacancy by the Speaker of the House ofRepresentatives or any State Legislative Assembly, as the case may be, to theElection Commission,

and ending on the day of the completion of the election_

Regulation 26. Evidence on oath.

A Registrar or an Adjudicating Officer may, for the purpose of considering ordetennining atly application, claim, objection or appeal which he is required toconsider or determine under these Regulations, summon any person to appear beforehim to give evidence on oath or affirmation, atld may administer any such oath oraffinnation for such purpose, and may order the production of any document relevantto atly issue which such officer is required to consider and determine.

Regulation 27. Free copies of principal electoral roll and supplementary electoralroll.

The Registrar ofany registration area maY~h"U, on request, supply free of charge-

(aJ one copy of the principal electoral roll atld the supplementary electoral roll to eachcatldidate at a Parliamentary election or his election agent;

(bJ one copy of atly part or parts of the principal electoral roll and the supplementaryelectoral roll relating to any State constituency or part of such constituencyincluded in the registration area to each candidate at a State election for suchconstituency or his election agent.

Regulation 28. Sale of principal electoral roll and supplementary electoral roll.

The Registrar shall on application-

No misnomer or inaccurate description of any person or place named or described inany principal electoral roll or supplementary electoral roll or other document preparedor issued under or for the purposes of these Regulations shall in any way affect theoperation of these Regulations as respects that person or place if that person or placeis designated in the principal electoral roll or the supplementary electoral roll ordocument as to be identifiable.

Regulation 30. Publication of notice.

Where any notice is required by these Regulations to be published and, in the opinionof the authority who is required to publish such notice, the prescribed mode ofpublication does not give sufficient publicity to the notice, he may, in addition topublishing the notice as required by these Regulations, exhibit copies of the notice inconspicuous places within the constituency to which the notice relates or take suchother steps as he may deem necessary for giving publicity to the notice.

Regulation 31. Revocation.

The Elections (Registration of Electors) Regulations 1971 [P.u. (AJ 326/1971]theElections (Registration of Electors) Regulations (Sarawak) 1971 [Po U. (AJ327/1971] and the Elections (Registration of Electors) Regulations (Sabah)1971 [Po U. (AJ 328/1971] are revoked.
