Our Education Sector
Educationgloballyhasbeencharacterisedbyexpansionandfundamentalchangeinrecentdecades.Thesedevelopmentshavecreatedopportunitiesforinnovationandinvestment,buthavealsobeenaccompaniedbyincreasingoperationalcomplexityandproliferatingregulation.
Growthinprivate-sectoreducationinAfricahasbeenprolific.WorldBankstatisticsindicatethatprivateschoolenrolmentinAfricaincreasedby113%overaperiodwhencorrespondingpublicschoolfiguresincreasedby52%.Between2000and2016,thenumberofprivateschoolsinSouthAfricadoubled,andthenumberofpupilsenrolledinprivateschoolsincreasedby130%.
Likewise,therehasbeenconsiderableexpansionintertiaryeducation.Indevelopingcountries,increasingnumbersofstudentsenrolathighereducationinstitutions,signifyinggrowingdemandandopportunity.
Historically,theeducationsectorhasbeenhighlyregulatedbysector-specificlawsandpolicymeasures–frequentlyatbothnationalandprovinciallevels.Thisremainsthecaseuniversally,eventhoughtherehasbeenliberalisationandderegulationinmanyotherfields.
Inaddition,educationalinstitutions’operationsaregovernedbyarangeofgenerallaws,includinganti-trust/competition,employment,dataprotectionandtaxlawsand,insomejurisdictions,localownership/indigenisationlaws.Althoughthesearelawsofgeneralapplication,theyhaveparticularnuancesinthecontextofeducationalinstitutions.
Moreover,schoolsanduniversitiesarerequiredtohaveinplacevariouspolicies(e.g.admissions,disciplinary,humanresource,socialmedia)andalsoneedtosetupstructuresequippedtoimplementthesepolicies.
Commercialtransactionsintheeducationsectorneedtobeconductednotonlywithdueregardtocorporateandtaxcomplexities,butalsoinawaythatensuresdueregulatorycompliancewithsector-specificlaws.
