Your Motor Vehicle Insurance PolicyPolicy Wording

Where We explain what a word means, that word will have the same meaning wherever it is used in the policy or

Schedule. These words are highlighted by the use of bold print and start with a capital letter.

We, Our, Us, Insurer:

Edelweiss General Insurance Co. Ltd, authorised and regulated by Insurance Regulatory and Development

Authority of India, to carry out General Insurance Business in India.

You, Your/s, Yourself, Insured:

The person, named in this Contract, having a Valid Driving License, and liable to undergo direct financial loss, in

event, a loss occurred involving a vehicle declared for coverage under this Policy

Contract:

This Insurance is made up of four important documents:

i) This Policy document stating all coverages, exceptions, terms and conditions

ii) The Policy Schedule containing all periods, limits and Premium

iii) The Policy App, downloaded as your mobile application containing the Policy Document, Policy Schedule,

details of Your Vehicles, and facility to add, delete Your Vehicles, and add Insured Trip Periods

iv) The Valid Driving License/s, of the Drivers who will drive Your Vehicle/s, submitted by you, to enter into this

Contract.

All the above four documents are to be read together as the Contract.

Indemnity:

A legal principle which requires that after a loss You are placed in the same financial position that You occupied

immediately before the event.

This insurance is a Contract of Indemnity between Us, the Insurer and You, the Insured.

The basis of this Contract is the information You have given about Valid Driving License/s, for the purpose of entering into

the Contract and that information must be true to the best of Your knowledge belief and fact.

The Contract will be in force for any Insured Trip Period within the Period of Insurance for which You have paid, and We

have accepted the premium.

In return, We will insure You against those losses detailed in this policy document during the Period’s referred to in the

Schedule to the policy and during any further period for which We may accept premium.

We, Our, Us, Insurer:

Edelweiss General Insurance Co. Ltd, authorised and regulated by Insurance Regulatory and Development

You, Your/s, Yourself, Insured:

Contract.

Indemnity:

A legal principle which requires that after a loss You are placed in the same financial position that You occupied

immediately before the event.

Market Value:

The cost of replacing Your Vehicle with one of a similar make, model, history, age and condition.

Valid Driving License/s:

A Driving License/s is/are an official document that authorises its holder to operate various types of motor

vehicles on highways and roads to which the public have access. For the Driving License/s to be valid, it/they

should be in force, and not suspended, revoked or expired.

Drivers:

Any Driver/s, holding a Valid Driving License, that you have declared and added in the Policy App, who will be

driving Your Vehicle/s during a declared Trip Periods

Your Vehicle/s:

The motor vehicle/s, either owned, used , leased or rented by you, for Your usage, and driven by You, and

appearing in the Policy App under current details of Your Vehicle/s.

For the purpose of this Contract, Your making of a proposal and use of such Vehicle(s) post issuance of this

Contract, shall be construed as being on the basis of an express/reasonably implied consent of use, whether in

writing or otherwise, obtained by You from the lawful owner of the Vehicle, wherein You are not the lawful owner

of the Vehicle.

Schedule:

The document that shows details of Your Vehicle/s, the limit of cover provided, premium, and Period of

Insurance.

Policy App:

The App downloaded and activated in your mobile handset, having this Policy Document, Policy Schedule,

functionality to add and delete Your Vehicles, add and delete Drivers with Valid Driving License, functionality to

declare Insured Trip Periods before starting to drive your vehicle for the first time in a particular date, functionality

to deactivate any trip days for any of your vehicle by 9am of a day, or as agreed mutually, upload the pictures of

your vehicles, lodge a claim, pay premiums.

Period of Insurance:

The Start and End date of Your current Motor Insurance Policy and its Schedule.

Insured Trip Period:

The date/s, which You declare on the Policy App, that you are driving one of Your Vehicle/s, and the risk

associated with Insured Trip Period gets covered.

Policy Sum Insured:

The amount that You have declared and proposed for this insurance Contract, as the value of Your Vehicle/s,

and paid the premium for it. You may enhance or decrease Your sum-insured as you add and delete vehicles in

the Policy App. This Sum-insured will float over all Your Vehicle/s.

Part IYour Vehicle/s

Provided, You have added the details of Your Vehicle/s in the Policy App, have paid the due premium covering the

Period of Insurance as mentioned in the Schedule, and We have accepted the premium, We shall provide You with the

following coverage from the date/s of such additions, till the expiry of this policy:

WHAT IS COVERED

We will pay for loss of or damage to Your Vehicle/s, and its accessories while they are fixed to or in it or on it, while being

in parked condition, in Your garage, whether covered or in the open, or your usual night parking lot, or being driven by

any of the Drivers with Valid Driving License declared and added in the policy, caused by:

Fire explosion self ignition or lightning

Burglary housebreaking or theft

Riot and strike

Malicious act

Earthquake(fire and shock damage)

Flood typhoon hurricane stormtempest inundation cyclone

ailstorm frost

Terrorist activity

Landslide rockslide

If Your Vehicle/s is undrivable as the result of damage covered by this Part of the policy, We will

i) pay the reasonable cost of taking it from the scene of the incident to the nearest competent repairer,

ii) pay the reasonable cost of repairs of the damage,

iii) pay the reasonable cost of delivering it to Your address after the repairs

subject to the condition, that the aggregate of the above shall not exceed the Market Value of Your

Vehicle/s, or the Policy Sum Insured, whichever is lower.

If Your Vehicle/s is/are a Total Loss, or a constructive total loss where the repair cost is more than 75% the Market Value

of Your Vehicle, as the result of perils covered by this Part of the policy, We will pay the Market Value of Your Vehicle/s,

or the Policy Sum Insured, whichever is lower, after deducting the value of wreck.

WHAT IS NOT COVERED

We will not pay for any of the following:

i) theft, or attempted theft, if Your Vehicle keys are left in or on Your Vehicle;

ii) any loss or damage caused by theft or attempted theft if the security system or device fitted to Your Vehicle at the

time of the loss was not activated and working properly. All keys used for engine ignition and activate/deactivate the

alarm/immobiliser fitted to Your Vehicle must be submitted to Us with the claim form;

iii) Loss of or damage to any other vehicle you have, if the details of the same has not been uploaded by You in the

Policy App.

iv) Use of the Vehicle(s) for any purpose that is unlawful or illegal under the laws of India, as may prevail at the time of

such use.

Part IIYour Trips

Provided, You have added the details of Your Vehicle/s in the Policy App, have paid the due premium covering the

Insured Trip Period as mentioned in the Schedule, and We have accepted the premium, and You have declared in the

Policy App before commencement of the trip, that the Vehicle is driven by a Driver having Valid Driving License, already

added in the Policy App, We shall provide You with the following coverage on such date/s that You so declare:

WHAT IS COVERED

We will pay for loss of or damage to Your Vehicle, and its accessories while they are fixed to or in it or on it, while being

so driven, caused by:

Fire explosion self ignition or lightning

Riot and strike

Earthquake (fire and shock damage)

Flood typhoon hurricane storm

tempest inundation

cyclone hailstorm frost

Accidental external means

If Your Vehicle is undrivable as the result of damage covered by this Part of the policy We will

If Your Vehicle is a Total Loss, or a constructive total loss where the repair cost is more than 75% the Market Value of

Your Vehicle, as the result of accidents covered by this Part of the policy, We will pay the Market Value of Your Vehicle,

or the Policy Sum Insured, whichever is lower, after deducting the value of wreck.

WHAT IS NOT COVERED

We will not pay for any of the following:

i) If the Driver was not having a Valid Driving License for the class of vehicle the Driver was driving at the time of

accident;

ii) If the Driver was driving under the influence of alcohol, narcotics or drugs;

iii) If any other driver, not declared and added in the Policy App, was driving the vehicle;

iv) If the vehicle so driven, was not used for the purpose for which it is registered with the registering authority;

v) If the vehicle was being used for rallies, speed-testing or any other motor sport activities

vi) Loss of or damage to any other vehicle, if the details of the same was not been declared and added by You in the

Policy App prior to the trip.

Malicious act

We shall not pay, for

1. any accidental loss or damage incurred outside the geographical area as mentioned in the Schedule;

2. any consequential claim arising out of any contractual liability;

3. Normal wear and tear, mechanical and electrical breakdown;

4.loss of or damage to Your Vehicle/s as a result of legal repossession; confiscation or requisition or destruction by or

under order of any Government or Public or Local Authority

5. a claim if Your Vehicle is sold off, wherein You were the lawful owner of that vehicle when this Contract was entered

into ;

6. Loss of use of Your Vehicle/s

7. any liability of whatsoever nature directly or indirectly caused by or contributed to by or arising from ionising radiations

or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. For

the purpose of this exception combustion shall include any self-sustaining process of nuclear fission.

8. Any accidental loss or damage or liability directly or indirectly caused by or contributed to by or arising from nuclear

weapons material.

9. Any accidental loss or damage directly or indirectly or proximately or remotely occasioned by, or contributed to by or

traceable to or arising out of or in connection with war, invasion, the act of foreign enemies, hostilities or warlike

operations (whether before or after declaration of war) civil war, mutiny rebellion, military or usurped power or by any

direct or indirect consequence of any of the said occurrences and in the event of any claim hereunder You shall prove

that the accidental loss damage occurred independently of and was in no way connected with or occasioned by or

contributed to by or traceable to any of the said occurrences or any consequences thereof and in default of such proof,

We shall not be liable to make any payment in respect of such a claim.

GENERAL EXCEPTIONS(Applicable to Sections I and II of the Policy)

1. Mechanical & Electrical Breakdown:

In the event, that the insured vehicle is immobilized on a public road due to any mechanical or electrical breakdown, the

Company shall

a. Arrange for an automobile technician to attend to the insured vehicle on the spot of such breakdown to help mobilize

the vehicle on its own power.

b. Arrange for the towing of the insured vehicle to a nearest Repair shop/ Garage, if mobilization of the insured vehicle is

not possible by carrying out such repairs on spot.

c. Provide for custody and storage of the insured vehicle until the Repair shops/Garages re-open, if the Repair

shops/Garages are closed due to holidays or night hours.

d. Undertake to locate, procure and deliver spare parts required for repair to the Repair shop/ Garage within 72 (seventy

two) hours, if such spare parts are not available with the Repair shop/ Garages, provided that the parts are available

in the open market within the geographical limits of India.

Exclusions

a. Cost of parts or replacement elements or consumables and their transportation cost to the site of breakdown in case

repairs are carried out on spot of breakdown.

b. Cost of parts or replacement elements or consumables and their transportation cost to the Repair shop/Garage, in

case the same is not available with them.

c. Entire cost of Repair shop/Garage’s bill, if the insured vehicle has had to be towed to any Repair shop/Garage for

repairs.

d. Cost of towing beyond 30 kilometers from the spot of breakdown of the insured vehicle.

e. Charges of the automobile technician, if the vehicle could be transferred on its own power on self-propelled basis to

the nearest Repair shop/Garage without his intervention.

f. Any payment to a third-party for on-spot repair/towing/storage/recovery by the Insured or on his behalf, unless

specifically agreed by the Company.

2. Accidental Immobilization:

In the event, that the insured vehicle is immobilized on a public road due to any accident covered by the Policy, the

Company shall

a. Arrange for towing of the insured vehicle to the nearest Company’s Authorized Repair shop/Garage.

b. Provide for custody and storage of the insured vehicle until the Repair shop/Garage re-open, if such Repair

shop/Garage being closed due to holidays or night hours.

Exclusions

a. Cost of towing beyond 50 kilometers from the spot of such accident of the insured vehicle.

b. Any payment to a third-party for towing/storage/recovery by the Insured or on his behalf, unless specifically agreed by

the Company.

We will be providing the following Road-Side Assistance in the situations described below:

3. Flat Tyre:

In the event, that the insured vehicle is immobilized on a public road, due to a flat tyre caused by puncture of or damage

to the tyre /tube/valve or bolts of the tyre, the Company shall

a. Arrange for an automobile technician to attend to the insured vehicle on the spot of such event to replace the flat tyre

with the spare tyre carried in the insured vehicle.

Exclusions

a. Cost of parts or replacement elements or consumables and their transportation cost to the site of immobilization due

to flat tyre in case repairs are carried out on spot of immobilization.

b. Entire cost of Tyre Repair shop/Garage’s bill, and their transportation cost to and from the site of immobilization if the

flat tyre had to be taken to any Tyre Repair shop/Garage for repairs.

4. Dead Battery:

In the event, that the engine of the insured vehicle fails to start due to a dead battery, the Company shall

a. Arrange for an automobile technician to attend to the Insured vehicle on the spot of such event, to help jump start the

vehicle so that it can be driven on its own power on self-propelled basis to the nearest Repair Shop/Garage.

Exclusions

a. Cost of parts or replacement elements, consumables and recharging of battery and its/ their transportation cost to and

from the site of immobilization due to dead battery in case battery jump start could not be carried out on spot of

immobilization.

b. Entire cost of replacement battery and its transportation cost to the site of immobilization if the dead battery had to be

replaced by another.

5. Keys Locked-In:

In the event, that the insured vehicle is immobilized on a public road, due to loss of its keys, or its keys being either locked

inside the vehicle or broken, resulting in a situation where the Insured is unable to gain entry into the insured vehicle, the

Company shall

a. Locate and retrieve duplicate set of keys under due authorization of the Insured to do so, and deliver such keys to the

Insured or his authorized representative upon production of personal identification and authorization.

b. Arrange for an automobile technician to attend to the insured vehicle on the spot of such event in order to attempt the

opening of the vehicle door with normally available tools, if the Insured desires to attempt opening the vehicle, since

retrieval of a duplicate set of keys would be time consuming,.

Conditions

Personal Identification details of the Insured matching with the Policy and vehicle records shall be produced for verification

by the automobile technician, before any such attempt to reopen the vehicle is undertaken.

6. Contamination/ Incorrect or Running Out of Fuel:

In the event that the insured vehicle is immobilized on a public road at least one kilometer away from the nearest petrol

pump, due to the insured vehicle running out of fuel, or the fuel in the insured vehicle being incorrect or contaminated, or

there is a air lock in the fuel system, the Company will

a. Arrange for delivery/ replacing/ changing the fuel – as the case may be, up to a maximum of ten liters- on the spot

where the insured vehicle stands immobilized.

b. Arrange for bleeding of fuel line to dissipate the air lock.

Exclusions

a. This service is not available if the Fuel type of the insured vehicle is other than Petrol or Diesel.

b. Actual cost of the Fuel.

7. Continuation of Journey:

In the event that the insured vehicle is immobilized on a public road, at least 50 kms away from the address of the Insured

as appearing in the Policy Schedule, and On-the-spot repairs fails to mobilize the vehicle on its own power on self

propulsion basis, and it has had to be towed away to a Repair shop/Garage for repairs, the Company shall

a. Make arrangement for an alternate hired car/ taxi with capacity to carry all the occupants of the immobilized vehicle

(subject to the maximum of licensed carrying capacity of the insured vehicle), for continuation of their onward journey

or return home.

Exclusions

a. The Car hire/ Taxi expense beyond the first 50 Kilometers.

b. Any Car hire/ Taxi expense incurred by the Insured, if the arrangement of hiring such vehicle is done on his/ her own,

without prior consent of the Company.

8. Local Travel when on Tour:

In the event that the insured vehicle is immobilized at a place, at least 100 Kilometers away from the address of the

Insured as appearing in the Policy Schedule, and the vehicle is in a Repair shop/Garage for repairs, the Company shall

a. Arrange for an alternate hired car on best availability basis in that area, for the period the vehicle is undergoing repairs

in the Repair Shop/ Garage but not exceeding 3 (three) days on 8 (Eight) hours/ 80 (Eighty) kilometer basis, to provide

for the local travel of the Insured.

Exclusions

a. The Car hire expense beyond the first 8 (Eight) hours/80 (Eighty) kilometers in a day.

b. Any Car hire expense incurred by the Insured, if the arrangement of hiring such vehicle is done on his/ her own, without

prior consent of the Company.

9. Overnight Accommodation Expense when on Tour:

In the event that the insured vehicle is immobilized at a place, at least 100 Kilometers away from the address of the

Insured as appearing in the Policy Schedule, On-the-spot repairs could not be carried out , the vehicle has had to be

towed away to a Repair shop/Garage for repairs and the vehicle is not delivered back on the same day within close of

business hours of the Repair shop/Garage, the Company shall

a. Arrange for hotel accommodation for the occupants of the vehicle (subject to the maximum of licensed carrying

capacity of the insured vehicle), for the period the vehicle is under repair in the Repair Shop/ Garage but not exceeding

3 (Three) days, subject to the following conditions:

i. The hotel accommodation will be provided on twin sharing basis for all the occupants of the immobilized insured

vehicle subject to maximum of the licensed carrying capacity of the vehicle.

ii. The cost of such accommodation will be subject to maximum of `2,500/- per person per night, but not exceeding

`25,000/- per event.

iii. This benefit will not be available, if the Insured is availing of the benefit of Local Travel when on Tour.

iv. Any hotel accommodation charges incurred by the Insured, if the arrangement of such accommodation is done on

his/her own, without prior consent of the Company, will not be reimbursed.

10. Repatriation of Vehicle:

In the event that the insured vehicle is immobilized at a place, at least 100 kilometers away from the address of the

Insured as appearing in the Policy Schedule, On-the-spot repairs could not be carried out and had to be towed away to

a Repair shop/Garage for repairs, and the repaired vehicle was delivered after 3 (Three) days, the Company will

a. Repatriate the repaired vehicle to the address of the Insured as appearing in the Policy Schedule.

This benefit is also available to any insured vehicle immobilized after an accident, at least 100 kms away from the

address of the Insured as appearing in the Policy Schedule, and no Company’s authorized Repair shop/Garage is

available.

Exclusions

a. Any Repatriation expense incurred by the Insured, without prior consent of the Company.

11.Medical Coordination:

In the event of the insured vehicle meeting with an accident, and any of the occupants getting injured, the Company may

a. Provide for a conference call with nearest Medical Service Provider including an Ambulance service Providers.

The cost of such service providers has however to be borne by the Insured. The Company shall however be in no way

responsible for the quality of service rendered by such Service Providers

12. Urgent Message Relay:

In case the insured vehicle is immobilized at least 100 kilometers away from the address of the Insured as appearing in

the Policy Schedule, the Company will

a. Provide an urgent message relay service to the Insured/ or person in lawful possession of the vehicle at the time of

immobilization of the insured vehicle to communicate with the family back home.

Conditions applicable to Road-side Assistance:

1. Not withstanding anything mentioned above, the services under this Add-On cover will not be available outside the

geographical limits of India, as well as under the following circumstances:

a. Confiscation/ Intervention by Legal Authorities: Any immobilization of the insured vehicle due to or arising out of

confiscation, intervention, commandeering, requisition, detention or destruction by order of any Government or

lawfully constituted Authority.

b. Act of God Perils: Any immobilization of the insured vehicle due to Natural catastrophe like Flood, Inundation, Storm,

Tempest, Cyclone, Earthquake, Tsunami, Volcanic eruption, Landslide, rockslide or other convulsions of nature.

c. War/ Riot/ Terrorism : Any immobilization of the insured vehicle during or as a consequence of war, invasion, act of

foreign enemy, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power, terrorism, riot, civil

commotion or loot or pillage in connection with it.

Subject otherwise to the terms exceptions conditions and limitations of the Policy.

Above mentioned coverages will be provided by the Service provider on behalf of the Company.

1. Looking after Your Vehicle/s:

You must take all reasonable precautions to prevent loss or damage; and keep Your Vehicle in a roadworthy

condition. When left unattended, Your Vehicle must be locked and secure and the ignition key removed. If You

do not do this, We may not pay a claim

2. No Claim Bonus:

In case, you are transferring your Motor Insurance on its renewal date, from another Company or Ours, to this

Driver based Insurance, we will keep a record of the No Claim Bonus that you were eligible under the Motor

Insurance on renewal. Provided you have continued with this Policy for 365 days and have not made any

claims under Part I and Part II, we will issue a NCB eligibility certificate to You, at the end of 365 days, equivalent

to what You would have got, if you had continued under Motor Policy.

3. Making a Claim:

If You need to make a claim , You may do so, through the Policy App, or phone the Customer Care telephone

number shown on the back cover of this policy. You should inform Us about such accidents and incidents

leading to a claim, immediately , or at the most within seven days giving us the full details of the accident or

incident.

4. Other insurance:

If You have any other motor insurance policy which covers a claim made under this Contract, We will only be

liable to pay our share of the claimed amount.

5. Fraudulent claims:

If You knowingly make a claim under this Contract that is false, fraudulent or exaggerated, We will not pay the

claim, all covers and benefits will end and no refund of premium will be allowed.

6. Hypothecation/Hire Purchase/Lease/Rental/Non-pecuniary usage:

If, to Our knowledge, Your Vehicle is subject to a hypothecation or hire purchase agreement or leasing

agreement or rental agreement or non-pecuniary usage grant from the lawful owner, We will need You to inform

Us the details of the person or entity who/which holds lawful ownership of such Vehicle and provide Us with

written consent as may be required by Us in relation to a claim or the subject matter involved. Accordingly,

i. any payment due to be made by Us owing to total loss or constructive total loss of Your Vehicle – will be

made to such lawful owner, the details of whom/which are obtained from You;

ii. any payment due to be made by Us towards repair/replacement of Your Vehicle, wherein through

reimbursement of such expenses – will be made to such lawful owner, the details of whom/which are

obtained from You;

7. Discharge:

The payment We make towards settlement of a claim, made by You under this Contract, whether to You or to

the lawful owner of Your Vehicle shall be Our full and final discharge from any and all liabilities towards such

claim under this Contract. If such lawful owner of Your Vehicle or any other unrelated person were to make a

claim against Us with/without regard to any claim You have made with Us, You shall be liable to indemnify Us

at actuals and/or defend Us at You sole expense.

8. Arbitration & Governing Law:

If a claim has been accepted but there is disagreement over the amount to be paid, such dispute shall be heard

by a sole arbitrator chosen by Us. The seat of arbitration shall be Mumbai and the conduct of proceedings and

award shall be in the English language. The decision of such arbitrator shall be final and binding on both You

and Us. This Contract shall be governed solely by the laws of India.

9. Cancellation of this Contract:

the policy may be cancelled at any time by You on seven day notice by recorded delivery, You shall be entitled

to a return of unused premium remaining on your Policy account. In case We decide to discontinue the product

or policy, depending on which option You are comfortable with, the following options would be explored :

• allow the policy to run its course or

• cancel the policy and refund the unused premium lying in your Policy account to You.

• port Your Vehicles to traditional motor Stand Alone Own Damage Policies, by collecting difference of

Premium from You
