Notes:

The page numbers – shown in the top right corner of the succeeding pages – are the last three digits of the numbers assigned to each of the photo-images of the original record. Each image, photographed by the British Library project team – bears the reference number EAP295_2_6_1-EAP_295-SCR_ (plus the three digits)_L The first page/image of the record book is missing but is believed to have included the names

listed as 001 below; all of which were repeated sequentially in subsequent sections /pages of

the record. Names are listed in black whereas other text, interspersed at the end of each

repeated list of names, is typed in Blue. However, records of the Court , from image 21 (see 4.

Below) are typed in black.

The same list of names, in the exact order, is repeated on some six (6) occasions throughout the

record, with only minor variations in the spelling of some of the names. I have copied the list to

a separate MS Word file to facilitate sorting into alphabetical order etc.

There are some image numbers that are missing (e.g. 39-41) and in a few instances some

images are duplications of others (e.g. 046 is a duplicate of 038)

There is some doubt that the images recorded by the Project are in sequential order in

conformity with the original record. Images 002 – 020 (no 001) relate to the 1795 Act of

Attainder; the terms of which, including lists of the names of persons affected are copied in

Images 042 to 065. Images 021 to 038 cover the initial sittings of the Court of Oyer and

Terminer – from June 27 to July 2, 1796 – whereas Images 066 to 081 cover from the

resumption of the Court on September 19, 1796 (under the King’s Commission dated

September 8,1796) up to its termination on March 1, 1797 with the curious words “None of the

Justices attending the Commission fell to the Ground”

Mr. Palmer then came into Court and having taken the Oaths took his seat on the Bench

Mr. Wise offered some Objections to the manner of Proceeding before the Court and being

answered by the Advocate for the Crown.

The Court then unanimously declared all the Proceedings were regular and that two Pleas could

be received Viz. That the Prisoner surrendered before the period stated in the Bill _2nd_That he

is not the Person named in the Act.

All the prisoners desired to be heard by Counsel and named Mr. Wise… which was granted.

Mr. Wise craving time, Thursday the 30th inst. was appointed for the Prisoners to be again

brought up.

Leave of access to the Prisoners was granted to their Counsel.

The Prisoners were then remanded.

Crugher (sic), Laurent Lemsique and Anthony Casey – which was recorded

Subpoena issued to Dr. Hay and William Ker2 for 13th July next.

The Prisoners against whom the Bill of Indictment was found were then brought up and

acquainted that the Grand Jury had found a Bill of Indictment against them for High Treason a

copy of which would be furnished them.

The Prisoners demanded Counsel and named Mr. Wise who was assigned them by the

Court.

The Prisoners were then remanded to Gaol.

And then the Court adjourned ‘till Thursday 8 O’Clock.

After the evidence had been gone through Mr. Adye observed upon the Evidence and

being answered by Mr. Wise __ Mr. Adye replied when the Chief Justice made his Charge to the

Jury. The Jury then retired when Constables were sworn to attend them _ The Jury returned

into Court and delivered their Verdict that the several Prisoners at the Bar were the same

Persons mentioned in the Act of Attainder which was recorded.

The Chief Justice then proceeded to pass the usual sentence upon the Prisoners when

they were taken away.

Persons as named in the Act of Attainder.

Hypolite Bruce then addressed the Court.

The Chief Justice then passed sentence on the Prisoners when they were remanded.

Louis Parans, Pierre Fuquet and Baptiste Goodish three of the Prisoners who had been

arraigned were remanded for future trial.

The Court ordered a Warrant be prepared directing the Marshall to execute the

sentence on the Prisoners tomorrow Friday the 1st July next.

Six of the above named Prisoners named Timeran, Jean Louis Collet, Jean Pierre Thomas, Jean

Baptiste Cotton, Julien Boredon and Jean Jacques Compton acknowledged themselves to be the

Persons named in the Act of Attainder when the Judge passed Sentence on them and they were

remanded to Gaol.

The following prisoners were then brought up viz.,

Mr. Wise moved the Court to postpone the trial of Louis Rapier one of the above named

Prisoners which being granted he was removed from the Bar.

The other six Prisoners were then arraigned when the record of the Act of Attainder was read

to them and they were asked what they had to say why execution should not be awarded

against them they severally acknowledged themselves to be the Persons named in the Act of

Attainder when the Chief Justice passed the usual sentence on them and they were remanded

to Gaol.

The five Prisoners viz Claude Boredon, Edward Letang, Jean Lagrange, Silvestre Jean Baptiste

^John Baptiste Silvestre^ and Jean Baptiste Castaing who were arraigned and denied them

being the Persons named in the Act of Attainder were then put to the Bar, and Mr. Adye,

Advocate for the Crown having averred that they were the Persons named in the Act, the

following persons were impannelled as a Petty Jury to try the five Viz.

of their Judgment when the Majority of the Bench were of the opinion that he should be

discharged upon giving Bail, himself in 500 and two Securities in 250 each.

The Grand Jury having returned into Court with the Indictment – Rex – v.- Hayling Billa Vera and

George this 19 July 1796 beg leave to acknowledge the great satisfaction and pleasure

we felt at the recommendation from His Honor the Chief Judge so entirely corresponding

with our own sentiments. In compliance with that recommendation we have attentively

considered the present condition of the Colony and now submit to the consideration of

your Honor our ideas on that Subject”

“After the dreadful calamities which this Colony has undergone it became our

duty and that of every well wisher to the Community to trace as far as in our power the

cause of these calamities and to endeavour to suggest expedients for the preservation of

them in future.”

“We are unanimously of opinion that the principal cause of them was the

permission granted to so great a number of Foreigners white and coloured to reside

amongst us – Our late unfortunate Lieut. Governor made many exertions to get rid of

obnoxious characters, but partly by that unsuspecting generosity of sentiment which has

ever distinguished Britons, partly by the determined exertions of a certain class of

Inhabitants, his views were frustrated and those characters were unhappily permitted to

remain in the Island. Latterly they have held not the least conspicuous stations among

the Banditti who had so nearly exterminated us._ It gives us real pain & we acknowledge

disappointment when we reflect that by much the greatest part of those stiled (sic) His

Majesty’s new adopted Subjects, disregarding the allegiance they had sworn faithfully to

maintain towards His Majesty, disregarding the mild and lenient government under

which they lived & enjoyed liberties unknown to the deluded enthusiasts of the present

French system, and forgetting even the charitable effusions of the British Inhabitants

towards the French Royalists when lately compelled to search for an asylum amongst us,

were those who so steadily counteracted the political views of our late Lieut. Governor

and were the foremost to take arms against us.”

“Thus disappointed and injured, we cannot surely be accused

of

of harshness or illiberality of sentiment when we inform your Honor, that our suspicions

extend to all the new adopted Subjects now in the Colony as much as to any Foreigner

who by whatsoever means may obtain admittance among us.”

“Under those impressions as to the new adopted subjects, while we express our regret

that several of them are still continued in the Commission of the Peace and consequently

the Guardian of our internal policy we cannot avoid looking on them with a jealous eye,

and attributing to their exertions the easy admission which several persons have lately

experienced on their return to this Country after having shamefully & basely deserted it

in the time of danger.”

“To prevent a return of those evils then under which we have so long & so severely

suffered, the first point to be pointed is, in our opinion, the removal from all public trust

and confidence of every Foreigner of every description whether Capitulant (sic) or

Naturalized.”

“The next appears in our opinion to be the withdrawing every permission of residence

already granted and a positive refusal to Foreigners of every description to reside

amongst us during the continuance at least of the present destructive and unnatural

“A third we are convinced is equally necessary to be attended to, we mean the

most speedy removal from this Colony of every Female white, black or coloured, who by

any ties of blood or marriage are or have been attached in any manner to any person

who has been concerned in the late dreadful insurrection. Many of this description we

are sorry to observe with His Honor the Chief Judge, are at large in the Community, no

doubt disseminating as far as they can those nefarious principles to which they have

been accustomed and which we have but too great reasons to dread, if they be

permitted to remain, will one day kindle again that flame of destruction now so nearly

Doctor Christopher Rapier and his Securities John Whiteman and John Cox then came

before the Court when they entered into Recognizance as Ordered by the Court, conditional

that the said Christopher Rapier should well and truly make his Appearance in his proper

person at the Court of Oyer and Terminer to be held in the town of Saint George on Tuesday

the 4th day of October 1796 or if the Court should not be then sitting at the next Meeting after

that day.

Doctor Rapier then withdrew.

The Bench then signed Warrants for the Execution of the Culprits condemned yesterday

for Execution on Monday and Tuesday the 26th and 27th inst.

The Grand Jury then came into Court and returned the Indictment Rex v. Fraser Billa

Vera which was published.

Cornelius Hogan and Patrick Cusack then entered into Recognizance in £50 each to

appear at the adjourned Court tomorrow to answer an assault committed on Thomas

Anderson.

Caleb Hayling with his Securities George Garry and Anthony Wilson entered into

Recognizance for his Appearance on Tuesday the 4th October next or the next sitting to answer

The Court called etc.,

Lawrence Vonweiller brought up and the Petty Jury Thomas Forbes and Fellows were

impannelled to try the Issue. William Muir instead of James Horne.

The Solicitor General opened the Indictment and proceeded to call his Evidence in support

thereof and having observed upon the same.

The Counsel for the Prisoner proceeded to his Defence and having called one Evidence, the

Counsel for the Crown replied.

When the Judge summoned up the Evidence and the Jury retired soon after returned with a

Verdict of Not Guilty which was recorded.

The Prisoner was then discharged by Proclamation on paying his fees.

Then the Habeas Corpus for the Body of Philibert Fauchier was returned and filed when he was

brought up and Mr. Wise as his Counsel moved the Court for his Enlargement Generally.

The Solicitor General consented to his being enlarged upon Bail.

The Court ordered him to find Bail himself in and two Securities in answerable

for his appearance in March Sessions 1797 then and there to answer what shall be alledged

(sic) against him and upon giving such Security to be discharged upon paying his fees.

Then William Mitchell and James Lain entered into Recognizance with the Prisoner and he was

discharged.

Adjourned to 10 tomorrow.

then brought up to the Bar but the Chief Justice stating his indisposition to be so great as to

hinder him from proceeding in the Business of the Court at present.

The Court ordered him to be remanded to Gaol when Mr. Wise his Counsel moved the

Court for his Bail being continued which was refused.

The Court was adjourned to Wednesday 1st March next.

On July 2, 1796, the Chief Justice read a letter in French written by Edmond Rapier which had given to the Marshall of the Court by the Sentry at the Gaol. As a result, he was confined to the Dungeon presumably until his execution on the 9

th.

Mr. Fauchier was discharged with Bail of on a Writ of Habeas Corpus filed by his Attorney Mr. Wise. However he was ordered to appear at the March 1797 Sessions of the Court to answer “what shall (then) be alleged against him”. The outcome of that trial is not known 17

Mr. Fuquet was one of 16 Prisoners brought before the Court under Indictment on Monday 10th

October 1796 but whose trials were put off to the next day on a motion by their Counsel Mr. Wise. Of the 16, only four – Magneval, Duparquet, Renaud & Vonweiller- were subsequently brought to trial before the Court was adjourned on the 17

th November. The fate of Fuquet and the others is therefore not known.

18 Mr. Magneval had been out on Bail due to illness but was brought to Court on Nov 17, 1796. However, because

the Chief Justice was severely ‘indisposed’ the Court was adjourned to March 1, 1797 and Magneval was remanded in Gaol until then. No records of the Court are held for 1797 so that it is not known what became of him.
