BACKGROUNDOn or about January 21, 2011, plaintiffs MARK DRUMHELLER an

3 MIKE TAHBAZ ("Plaintiffs"), individually and on behalf of a class of others4 similarly situated, filed a "Class Action Complaint" against Defendant in the5 Superior Court of the State ofCalifornia, County ofOrange, Case No. 30-2011-6 00442763-CU-OE-CXC (the "Complaint").7 2. The Complaint sets forth a number of allegations, including but not8 limited to: (1) unlawful business practices in violation of California Business and9 Professions Code Section 17200 et seq.; (2) failure to provide accurate itemized

10 wage statements in violation ofLabor Code section 226; (3) failure to pay wages11 when due in violation ofLabor Code sections 201, 202 and 203; and (4) failure to12 reimburse employees for the necessary expenses allegedly required by Defendant13 violation of California Labor Code sections 450 and 2802.14 3. The Complaint seeks the following relief: (1) certification of the15 alleged class as a class action pursuant to California Code of Civil Procedure16 section 382; (2) injunctive relief; (3) an order requiring Defendant to "pay all sum17 unlawfully withheld from the" class; (4) disgorgement ofDefendant's "ill-gotten18 gains" into a restitution fund for the "sums incidental" to Defendant's alleged19 violations; (5) penalties in accordance with California Labor Code section 203; an20 (6) the greater of all actual damages or Fifty Dollars ($50) for the initial pay perio21 in which an alleged violation occurred and One Hundred Dollars ($100) per each22 member of the class for each violation in a subsequent period, not exceeding an23 aggregate penalty of Four Thousand Dollars ($4,000), and award of costs for24 violations of California Labor Code section 226.25262728&
