Introduction

Drafting is the primary stage, of writing. A good writing is an outcome of a good draft. The principles of good drafting and good writing are identical. The principles of good writing irrespective of the purpose are the same, though the subsidiary rules differ according to the different purpose of working.

Pleadings are the backbone of legal profession. It is a paramount requirement of a good lawyer to be proficient in the art of pleadings. The eminent Jurists have time and again stressed the need that the pleadings should be concised and to the point. Therefore, it goes without saying that a successful lawyer should have the clear grasp of principles of pleading. As per Order VI, Rule 1 of the First Schedule of the Code of Civil Procedure, 1908, Pleading means plaint or written statement. The plaint is a document for instituting a suit in the proper court i of law. It is a very important document which is drafted by a pleader in consultation with his client A civil suit shall be instituted by presenting a plaint to the court. There are different grades of courts in a State according to pecuniary, territorial or other exclusive jurisdiction with regard to the subject-matter. Every suit shall be instituted in the competent court. A written statement is the reply filed by the defendant to answer the claim and pleas raised by the plaintiff in his plaint, which is sent to the defendant along with the summons calling upon him to put up appearance at the first hearing of the suit The summons indicates the name of the Judge presiding in the trial court and the number of the suit. The defendant on receipt of the plaint files para-wise reply of the plaint, which is called written statement. RESEARCH METHODOLOGYThis project is based upon doctrinal method of research. This project has been done after a thorough research based upon intrinsic and extrinsic aspects of the project.

OBJECTIVES

The objective of this project is to -

To discuss the concept of Negligence, Pleadings, Drafting, Conveyancing.

To discuss and draw the format of Plaint and Written Statement as provided under Civil Procedure Code, 1908.
