______________________________________________________________________ PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommends that PLN-USE-2016-006 be APPROVED with the following stipulations: (8-0, Kish/Perry, Van Laethem excused) 1. The applicant/owner acknowledges that the City will improve Harris Street,
a paper street adjacent to the property subject to this use permit, as part of the City’s “Freeman Ave. Railroad Overpass” project. Further, applicant/owner acknowledges that the existing fence on the subject property which is adjacent to Harris Street must be removed upon the commencement of construction, either by the applicant/owner or the project contractor. The City shall give the applicant/owner notice of the need to remove the fence. If the applicant/owner fails to remove said fence within 30 days of such notice, the project contractor shall remove the fence and bill the applicant/owner for the cost. The applicant/owner shall install screening/fencing along the entirety of the subject property’s border with Harris Street, subject to the review and approval of the Director of Development and Permits or designee, within 30 days of the removal of the existing chain link fence.
2. The applicant/owner shall remove all vines, vegetation, debris and the like
from all of the existing chain link fence on the property subject to this use permit. The applicant/owner shall also repair the fence to good condition and install slats or other methods approved by the Zoning Administrator or designee to make the entirety of the fence opaque. Further, the applicant/owner shall replace any portions of the existing chain link fence that are less than 8 feet in height so that all of the existing chain link fence shall be an 8 foot high opaque fence. All of the referenced improvements to the fence shall be completed within 90 days of the date of approval of this conditional use permit and shall be subject to the inspection and approval of the Zoning Administrator or his designee. The applicant/owner shall maintain the opaque 8 foot high fence in good condition.

3. The applicant/owner shall drain all fluids from any leaking tank(s) or reservoir(s) of any damaged vehicles, so as to prevent further leakage, prior to bringing them to the site. The applicant/owner shall also ensure that oil absorbent mats and chemicals are kept on the site, along with a Spill Prevention and Response Plan outlining their proper and effective use.

Staff Presentation:
Mrs. Shaffer stated that based on the findings in the staff report, Planning staff recommended that PLN-USE-2016-006, be APPROVED with stipulations as listed in the formal agenda.
Proponent:
Walton P. Burkhimer, Jr. P.E., Agent, Able Towing, 448 Viking Drive, Suite 170 Virginia Beach, VA 23452 appeared before the Commission on behalf of PLN-USE-2016-006 representing the applicant.
COMMISSION VOTE:
Commissioner Kish moved that PLN-USE-2016-006, be APPROVED as listed in the official agenda and as recommended by staff. Commissioner Perry seconded the motion. The motion was carried by a vote of 8 - 0. Commissioner Van Laethem was excused.
