I have received the rukka at about 7:25 AM. The FIR

was reduced in my handwriting in the D.O. room. Along with the

writing the FIR I was also looking after the other works of the Duty

officer with the assistance of DD writer. I took about 40/45

minutes in registering the FIR. AT the time of recording FIR, HC

Harish Chand who came with rukka, was also sitting in the DO

room. After 50 minutes HC Harish Chand left the P.S along with the

copy of FIR and original rukka. It is wrong to suggest that HC

Harish Chand not brought any rukka to me or that I am deposing

falsely at the instance of senior police officers.

Summons sent to PW2 Smt. Savitri Devi received back

with the report that she expired on 30-09-2004. Copy of her death

certificate has also been filed along with the report. Accordingly,

she is dropped from the list of witnesses.

Summons sent to Witness Babita Aggarwal received

back with the report that no one in the name of witness is residing

at the address furnished.

Summons sent to Witness Shri O.P. Aggarwal received

back with the report that the witness has left the tenanted

premises long time back.

However, it is observed that it was mentioned on the process that the witness is retired from the service and the contact number of witness was mentioned in the process but it appears that no efforts were made by process server to serve the summons upon the witness. In view of this, notice under section 60/122 D.P. Act be issued against HC Naresh Kumar for the next date. In the meanwhile, fresh summons be served upon Witness Joginder Taluja through the same process sever HC Naresh Kumar. Process server is directed to obtain the current residential address of the witness either telephonically or through his last office and thereafter serve the summons upon her.
