Annual Report to Alcohol Regulatory and Licensing Authority

The following report is a summary of activities for the Wellington District Licensing Committee as required by section 199(1) of the Sale and Supply of Alcohol Act 2012 for the financial year 1 July 2016 to 30 June 2017

The Wellington District Licensing Committee (DLC) was appointed by Wellington City Council from 18 December 2013 in accordance with the Sale and Supply of Alcohol Act 2012 (the Act) and with Councilrsquos Terms of Reference and Delegations for the 201316 Triennium adopted on 14 November 2013 and Terms of Reference Committee Structure and Delegations for the 2016-2019 Triennium adopted on 9 November 2016

The DLC is charged under the Act with dealing with alcohol licensing matters for Wellington City

The Wellington DLC continues to be chaired by Commissioners Hon Sir Douglas Kidd (District Licensing Commissioner A) Rex Woodhouse (District Licensing Commissioner B) and Murray Clearwater (District Licensing Commissioner C) all of whom were appointed for five year terms until 31 October 2018

The end of the 201316 triennium meant the termination of the appointments of Councillors Andy Foster and Iona Pannett as Deputy Chairs of the Wellington District Licensing Committee

On 9 November 2016 the Council resolved to reappoint Councillor Foster as Deputy Chair and also as a Committee member The Committee wishes to take this opportunity to thank Councillor Pannett for her participation in and service to the Committee

Otherwise membership of the Wellington DLC has not changed over the past year All DLC members were appointed until 31 October 2018 with the exception of Deputy Chair Councillor Foster whose appointment is for the period of his term as a member of the territorial authority Changes to DLC support personnel in the 2016-17 year included the consecutive appointments of the following Governance Advisors Claire Gilray James Mather Douglas Parker and Nevada Lee-Mariu There were also changes to the Committeersquos administrative support team with the departures of Karen Binnie Aviashni Kumar Chris Ormond and Andrew Reid and the arrivals of Aimee Dartnall Gabrielle Lynch Clare Meyer Lydia Torr and Isaac Sedcole

12 STAFF TRAINING RELATING TO THE SALE AND SUPPLY OF ALCOHOL ACT 2012

On 15 June 2017 members of the Wellington DLC and its support staff attended an LGNZ ldquoDLC Webinarrdquo led by Laurie Gabites

In addition Chairs Sir Douglas Kidd and Murray Clearwater attended the Australasian Drug and Alcohol Strategy Conference held in Wellington on 3 June 2017

DLC Secretariat and support staff and DLC Members and Chairs receive regular internal guidance on process and case law developments

DLC Members Chairs and support staff meet annually to discuss relevant matters including process at DLC hearings decision-making legal developments trends and issues in the sector At the 2016 annual meeting topics discussed included health and safety how to improve the participant experience at a DLC hearing lessons learned from applications considered at public hearings over the past 12 months key case law developments including the High Court decision in Vaudrey and the possible creation by the Health Promotion Agency of a DLC professional development body

13 DLC MEETINGS AND HEARINGS

During this reporting period the Wellington DLC has convened the following meetings and hearings

bull 27 meetings to consider and determine 77 Temporary Authority applications and

bull 20 public hearings to consider and determine

bull 5 new on-licence applications

bull 1 on-licence renewal application

bull 2 new off-licence applications

bull 10 off-licence renewal applications

bull 5 managerrsquos certificates

In the period from 1 July 2016 to 30 June 2017 the Wellington DLC received a total of 2233 applications being 57 more than was received by the Wellington DLC in the previous financial year In the same period the Wellington DLC issued 2177 substantive decisions



New DLC initiatives 2 21 NIGHT TIME VISITS

During the reporting period members of the Wellington DLC went out on night time visits to Wellington cityrsquos entertainment precincts with the Councilrsquos Local Hosts httpwellington govtnzservicescommunity-and-culturecommunity-safety safety-in-wellingtonlocal-hosts The purpose of these visits was to offer the Wellington DLC first-hand knowledge of the alcohol-related night time realities in the city

22 SHARING DLC RESOURCES VIA LGNZ

The Wellington DLC was happy to share resources developed in-house with the wider DLC community via Local Government New Zealandrsquos DLC Resources web portal httpwwwlgnz conzequipprofessional-development-offeringsdlc-resources

The resources shared included Practice Directions to assist with the smooth running of public hearings and the provision of agency reports that met the minimum statutory requirements and conditions templates for various types of licence

Local Alcohol Policy 3 In accordance with Part 2 subpart 2 of the Sale and Supply of Alcohol Act 2012 Wellington City Council developed a Provisional Local Alcohol Policy (the PLAP)

The PLAP was notified on January 21 2014 Appeals were lodged by eight parties which were heard by the Authority over eight days between October 20 and November 5 2014

The Authority released its decision on January 20 2015 which asked the Council to reconsider elements of its PLAP

The Council resolved on March 18 2015 to receive a ldquoreport to the February 2016 meeting of the Community Sport and Recreation Committee on the opportunities to resubmit an amended Provisional Local Alcohol Policy taking into account

updated local data and the parameters for local alcohol polices arising from the decision on appealsrdquo

On 3 March 2016 the Councilrsquos Community Sport and Recreation Committee resolved that the Council should not at that time resubmit the PLAP to the Authority and should instead continue to monitor alcohol-related data in Wellington work with key stakeholders and consider future ARLA decisions on other PLAP appeals prior to determining if the Council requires a Local Alcohol Policy The Committee also ldquoagreed to continue to advocate to central government for a higher minimum unit price for alcohol including off licencesrdquo



The Sale and Supply of Alcohol Act 2012 has now been in full force for three and a half years

During the reporting period Parliament passed the following amending legislation

bull The Sale and Supply of Alcohol (Display of Low-alcohol Beverages and Other Remedial Matters) Amendment Act 2016 which made the following changes to the principal legislation

bull A definition of ldquoworking dayrdquo that reflects the change to the Holidays Act 1993 by which provision has been made for the lsquoMondayisationrsquo of Waitangi Day and Anzac Day The effect is that where those days fall on a Saturday or Sunday the holiday is observed on the next following Monday and that Monday is not counted as a working day for the purposes of the Sale and Supply of Alcohol Act 2012

bull Adding to the list of persons who can hold an on off or special licence a company incorporated under the Companies Act 1993

bull Permitting the display advertising or promotion of low-alcohol or non-alcoholic beer wine or mead within a single alcohol area

bull Section 87 of the Statutes Amendment Act 2016 which replaced the words ldquosell or supplyrdquo in sections 22(2) and 22(3) of the principal Act with the words ldquosell and supplyrdquo The effect of this seemingly innocuous change is discussed in further detail below

In its previous Annual Reports the Wellington DLC has included a list of issues with the Act that it considers warrant clarification guidance andor legislative amendment Issues raised in the past and yet to be addressed are summarised at paragraph 45 below

In addition the following is a list of the DLCrsquos current thoughts on the legislation

41 lsquoSUPPLY ONLYrsquo SPECIAL LICENCES

In December 2016 amending legislation changed the language of section 22 of the Act to read

22 Special licences

(1) There are 2 kinds of special licence on-site special licences and off-site special licences

(2) On the premises a special licence designated as an on-site special licence is held for the licensee can sell and supply alcohol for consumption there to people attending an event described in it

(3) Where the holder of an on-licence or a club licence for any premises also holds a special licence designated as an on-site special licence for the premises the holder can at a time when the sale of alcohol on the premises would otherwise be unlawful (whether by virtue of a provision of this Act relating to licensed premises or licensed premises of any kind or by virtue of any condition subject to which the on-licence or club licence was issued) sell and supply alcohol for consumption there if it is sold or suppliedmdash

(a) to people attending an event described in the special licence and

(b) in accordance with the special licence

(4) Subsection (3) does not limit or affect the generality of subsection (2)

The Wellington DLCrsquos interpretation of the effect of this amendment is that the Committee can no longer issue supply-only special licences In order for it to be possible for a special licence to issue there must be a lsquosalersquo of alcohol lsquoSalersquo is defined broadly in section 5 of the Act to include the provision of lsquofreersquo drinks as part of an alcohol-inclusive event where there is a fee or koha payment made for attendance

This amendment appears to restore the legal position to that which applied under the Sale of Liquor Act 1989

8 WELLINGTON DISTRICT LICENSING COMMITTEE ANNUAL REPORT

Under that Act it was not possible to issue special licences for lsquosupply onlyrsquo events nor for events that were lsquoBYO onlyrsquo

In past annual reports to the Authority the Wellington DLC has sought clarity around the issue of lsquosupply onlyrsquo specials We have said

The Wellington DLC wishes to draw to the governmentrsquos attention the continuing uncertainty around the licensing requirements or not for supply-only alcohol events What is clear is that where alcohol is sold and supplied for consumption at an event a special licence is required Similarly where alcohol is supplied for consumption at an event where the cost of the alcohol is included in the entry price this requires a special licence What is unclear is whether events such as weddings birthdays or an art gallery opening where alcohol is supplied free to attending guests requires a special licence If it is the intention of government that this be so then it needs to be clearly prescribed in the statute We believe that was not the intent of Parliament when drafting this Act For completeness it is noted that according to case law BYO-only events cannot be granted a special licence Parliament may wish to consider reviewing this position It is our view that low risk events with limited quantities of alcohol provided but still subject to sound host responsibility practices should not be required to hold a special licence This category of events could be safely managed using guidance material similar to that currently available through the Health Promotion Agency There is currently significant variation of interpretation on this issue throughout New Zealand and we encourage the government to urgently clarify this matter1

The Wellington DLC notes with concern that while the law has been restored to the pre-2012 Act position it is still not clear whether the organisers of events of the type described above (ie low risk events with limited quantities of supply-only alcohol such as weddings birthdays or an art gallery opening) are lsquosafersquo from prosecution under the Act

Section 235 of the Act makes it unlawful to operate a lsquoplace of resortrsquo for the consumption of alcohol which is undefined in the Act but which case law has indicated could mean operating premises that are used for activities other than the consumption of alcohol and where there has only been one instance of alcohol consumption (Police v Clarke [1977] 1 NZCR 621 (SC)) A single nightrsquos use for a

social purpose involving consumption has been held to be enough to trigger section 2352

The 2016 amendments make it clear that a person wishing to hold a supply only event cannot be provided with a special licence They did not however provide any guarantee of protection for such persons that they would not fall foul of the provisions of section 235

For completeness we note that there is considerable ongoing uncertainty nationally as to the operation of section 22 its interaction with section 235 and its impact on those who wish to organise supply-only events

An urgent amendment to the Act is required to provide certainty for supply-only event organisers that they will not be the subject of prosecution

42 WAIVERS FOR LATE FILED SPECIAL LICENCES

Section 137(2) of the Act provides that a DLC may consider a special licence application that is filed later than the statutory deadline3 if the DLC is ldquosatisfied that the need for a special licence could not reasonably have been foreseen earlierrdquo

On occasion the Wellington DLC is asked to consider late filed special licence applications for worthy community events where it is not possible for the organisers to demonstrate that the need for the licence could not reasonably have been foreseen but where the lateness was not wilful

In such cases because of the long established legal principle that a specific statutory provision overrides any general provision the DLC cannot strictly speaking apply section 208 and waive the lateness

By contrast section 127(2)(b) which sets the deadline for filing base licence renewal applications4 does not contain the restrictive ldquoreasonably foreseeablerdquo test Under section 127(2)(b) a DLC may allow late filing at its discretion Arguably in order to do so the DLC may need to apply the section 208 waiver test and satisfy itself that the lateness was not wilful

There is no clear policy reason that the Wellington DLC can see for applying the restrictive ldquoreasonably foreseeablerdquo test for special licences but not to late renewals

The Wellington DLC would like to see section 137(2) amended to mirror the language of section 127(2)(b) and

give DLCs the discretion to allow late special licence filing where the Committee considers doing so would be appropriate in all the circumstances following consideration of the position taken by the reporting agencies in relation to that specific case


43 PROPOSED CHANGES TO SALES REVENUE REQUIREMENTS FOR GROCERY STORES

The Wellington DLC notes that there is a proposal to amend the Sale and Supply of Alcohol Regulations 2013 ldquoto ensure that small grocery businesses can continue to hold liquor licencesrdquo5 We have not seen the form of the proposed change but it appears that the intention is to amend the regulations ldquoto exclude hellip tobacco excise taxrdquo from the sales revenue figures to which a DLC must have regard when assessing whether or not premises are a ldquogrocery storerdquo as defined in section 33(1) of the Act

Recent case law from the Authority6 held that in determining whether or not premises fall within the definition of ldquogrocery storerdquo reference to the statement of annual sales revenue that must be prepared and provided by the applicant pursuant to the Act and regulations ldquobecomes fundamental when determining whether the premises are a grocery storerdquo7

As the Authority explained

[25] Notwithstanding that the premises may have the visual appearance or characteristics of a grocery store if the lsquomainrsquo product sold during the requisite period is not lsquofood productsrsquo then the premises are not a grocery store regardless of how much they may resemble one This is not to say the characteristics of the premises or the range of food products on offer are not relevant to the determination of whether premises are a grocery store In order for premises to be granted an off-licence as a grocery store it is not sufficient for the main products being sold to be food products The premises must also share the characteristics normally associated with shops commonly thought of a grocery shops Conversely it is not sufficient that the premises only have the appearance of a grocery store or sell a range of products If the main product being sold is not food products then the premises cannot be a grocery store

[26] The word lsquobutrsquo in the definition of lsquogrocery storersquo creates a rebuttal (sic) presumption that applies where a decision-maker is of the view that premises do or will have the characteristics normally associated with a grocery shop Where premises are considered to have

the characteristics of a grocery store having regard to the matters set out in s 33(2)(a)(i) and (iii) and any other matters considered relevant (per s 33(2)(b)) this presumption will be rebutted where food products are not the main or lsquofirst in rankrsquo products sold as determined by r 6

The proposed regulatory changes were described in a Ministerial press release as follows

As a result of tobacco excise tax increases the main source of revenue for some grocery stores has changed to tobacco products These stores therefore no longer qualify as grocery stores and cannot be issued an off-licence

ldquoIt is not the purpose of tobacco excise tax increases to restrict small grocery stores from being able to sell alcoholrdquo Mr Mitchell says

ldquoTo address the unintended impacts of these increases on grocery stores the Government is making minor changes to the Sale and Supply of Alcohol Regulations 2013 to exclude the tobacco excise tax when determining a storersquos principal businessrdquo

The Wellington DLC agrees with the policy intention that there not be unintended impacts on grocery stores from unexpected changes to sales revenue patterns An example of another such change that has come to the attention of the Wellington DLC in a recent application is a large proportion of sales revenue coming from Snapper card sales8 In this case the actual percentage profit secured by the retailer is de minimus but the revenue figures are at a level that applying the regulations and the law as set out in Uday9 in the particular case the DLC is considering we would appear to be obliged to make a finding that the ldquogrocery storerdquo definition had not been satisfied Given that the sale of Snapper cards could be viewed as a community service on the part of the retailer the Wellington DLC cannot see how it would have been Parliamentrsquos intention that Snapper sales revenue should in the words of the Ministerial press release act ldquoto restrict small grocery stores from being able to sell alcoholrdquo

The Wellington DLC suggests an alternative legislative approach to address this issue It is suggested that the Act be amended so that DLCs (and the Authority) are given the discretion not to apply the sales revenue figures as a determinative factor if the applicant would have met the lsquogrocery storersquo threshold but for one particular sale item (eg Snapper cards) provided the decision-maker

considers that the other criteria support a conclusion that the premises are otherwise a grocery store

This approach would prevent the Regulations needing to be amended every time a single sales revenue item threatens ldquoto restrict small grocery stores from being able to sell alcoholrdquo It would also be consistent with the evaluative exercise the High Court and Court of Appeal have indicated a decision-maker should apply when considering and determining licensing applications under the 2012 Act10

44 SINGLE ALCOHOL AREAS ndash ENDS OF AISLES

The single alcohol area (SAA) provisions of the Act have been the subject of considerable litigation since their enactment A current unresolved issue with which DLCs across the country have been grappling is how to address ldquoend of aislerdquo displays

The Act does not expressly refer to aisle end displays and whether or not these are to be permitted Case law on this point to date has not provided the DLC with a clear picture of what is expected in this regard The position as we currently understand it to be is summarised below

Key decisions on end of aisle displays11

The High Court in Christchurch Medical Officer of Health and others v J amp C Vaudrey Limited and others [2015] NZHC 2749 was asked to rule on the legality of a condition imposed by a Christchurch DLC The High Court at paragraph [3] of its decision described the condition and the DLCrsquos decision on it as follows

hellipin granting the application [the DLC] excluded from the application a wine display cabinet at one end of the wine display shelves because it was considered to be in contravention of the purpose of such an area as described in s 112(1) of the Act

Later in its decision the High Court had the following to say regarding the exclusion by the DLC of the end of aisle display

[105] Because in this case the Authority seemed to consider the condition deleting the single display cabinet as part and parcel of ss 112 and 113 rather than 117 it is now impossible to ascertain whether it applied the correct legal test My tentative view however is that it did not if only for the fact the authorities relating to conditions under the predecessor regime were applied unquestioningly On this basis I cannot be satisfied that it was correct to delete the condition Indeed the MOH made the submission in reliance on the conclusions reached in an academic article that there is evidence suggesting restrictions on the use of aisle-ends for the sale of alcohol is ldquoa promising option

to encourage healthier in-store purchases without affecting availability or cost of productsrdquo In this light it may well be that the condition is justifiable under s 117 Indeed on the face of the record there is little to suggest it would not be (Footnotes removed)

The Court of Appeal in J amp C Vaudrey Limited and others v Canterbury Medical Officer of Health and others [2016] NZCA 539 confirmed the High Courtrsquos decision Its discussion of the end of aisle display included the following

[60] After a hearing at which Vaudrey was afforded a proper opportunity to be heard on the CDLCrsquos proposed reduction in the single area by the removal of the wine display cabinet at one end of the wine display shelves the CDLC would have had jurisdiction to describe a reduced perimeter making that alteration

And

[65] The appellants and the Medical Officer were in accord that the structure of the Act precluded a s 117 condition altering the single area as described under ss112(2) and 113(2) We agree with that view Sections 112ndash114 in effect constitute a code relating to the areas in which alcohol can be sold in a supermarket A condition relating to the location of the single alcohol area should not then be imposed under s 117

[66] Mr Browne contended that it would not be inconsistent with the Act for conditions to be imposed under s 117 that affect the arrangement or display either within the single area or adjacent to it He suggested that such conditions might include limits on such things as the height of alcohol displays (so as to reduce their visibility from other areas) and preventing the removal of shelving in the surrounding areas intended to limit shoppersrsquo exposure to alcohol

[67] Mr Goddard acknowledged that it may be open to a DLC to impose conditions under s 117 relating to matters such as displays within a single alcohol area if that would advance the object of the Act as set out in s 4 However he submitted that that issue need not be determined on this appeal as neither the CDLC nor the ARLA imposed any condition under s 117

Discussion [68] In view of Mr Goddardrsquos submission and the limited argument which we heard on the issue we confine ourselves to the following observations First the new power to impose conditions in s 117 is broad While such a condition must be reasonable and not inconsistent with the Act the generality of the power is not limited or affected by any other provision in

the Act Indeed s 115 which provides for delays in the application of single area conditions for certain licence renewals enables conditions to be made in the interim under s 117 The versatility of the power is amplified by s 118 another new provision which enables different conditions to apply to different parts of the premises


[69] Secondly in view of the breadth of the power we consider that Mr Goddardrsquos acknowledgment was appropriately made However any more detailed analysis of the ambit of the s 117 power should await a case where the exercise of the power has been entertained

[70] Accordingly the answer to question 3 is that save for the imposition of an interim condition under s 115(5) conditions may not be imposed under s 117 that have the effect of altering the single-area condition imposed under s112(2) (Footnotes removed)

This year the Authority issued its decision in McMaster v G amp B Hasler Ltd [2017] NZARLA 169 in which it held that a section 117 condition could not be imposed in respect of end of aisle shelving although as we understand it in that case the shelving in question was within the boundary of the proposed SAA and did not abut or protrude beyond that boundary

The Authority held that sections 112 and 113 operate so that a decision-makerrsquos task in describing a SAA is to determine the location of that area relative to the rest of the premises and depict that as a perimeter on a plan of the whole of the premises The Authority said at paragraph [48]

The delineation of the perimeter of a lsquoblank arearsquo depicted on a plan of the wider supermarket will be sufficient to satisfy the requirement to describe a single alcohol area provided that the configuration and arrangement of the supermarket outside the alcohol area is apparent and able to be understood

And at paragraph [50]

hellipwhat is envisaged is that the area is identifiable relative to the wider premises where alcohol cannot be displayed or promoted It is this relative position of the area that limits exposure of shoppers to the display promotion and advertisement of alcohol in supermarkets and grocery stores

The Authority went on to say at paragraph [51]

There is nothing in s 112(2) 113(2) or 113(5) which requires the DLC or Authority to describe the internal area of the area other than to ensure the area is not on one of the relevant pedestrian routes (in order to avoid the area defeating the purpose in s 112(1))

Regarding the imposition of a section 117 condition prohibiting an end of aisle display the Authority said

[55] Turning to s 117 the Authority is bound by the Court of Appeal in Vaudrey which said at [70] that conditions may not be imposed under s 117 that have the effect of altering the single-area condition imposed under s 112(2) It follows from what we have already said that as the alcohol area condition is to identify where in the premises alcohol may be displayed and promoted thereby giving effect to the purpose set out in s 112(1) the licensee is entitled to use all the space within the alcohol area subject to any conditions imposed which do not have the effect of altering the area

[56] Subject to any such conditions within the area the licensee is not restricted as to how the space may best be utilised The licensee is free to arrange shelving and display units within the perimeter of the alcohol area once it has been described Similarly ss 112 and 113 do not restrict the use of end-of-aisle shelving within the area Such a restriction would amount to a condition that has the effect of altering the area by leaving what the respondent has referred to as lsquodead spotsrsquo or pockets within which the display promotion and advertising of alcohol is rendered lsquoimpermissiblersquo This would be inconsistent with the stated effects of the area condition in s 114

[57] In Vaudrey (CA) it was acknowledged that it may be open to a DLC to impose conditions under s 117 relating to matters such as displays within an single alcohol area if that would advance the object of the Act as set out in s 4 However the Court of Appeal did not decide the matter beyond confirming that conditions may not be imposed under s 117 that have the effect of altering the single-area condition imposed under s 112(2) [at 67 to 70]

[58] For the reasons just stated the Authority does not consider that a s 117 condition can be imposed in respect of end-of-aisle shelving

[59] Even if the angled shelving did increase the visibility of alcohol products however the Authority would need to be satisfied that a restriction on the angling of would be a proportionate response to the risk of harm caused by the excessive or inappropriate consumption of alcohol As the Authority has not had the benefit of any argument on this point the use of s 117 for this purpose is not considered further in this appeal

From the above the Wellington DLC understands the following to be the law according to the Court of Appeal High Court and the Authority12

is possible provided the applicant is given a fair bull It may be open to a DLC to impose conditions under opportunity to be heard However ARLA appears to

section 117 relating to matters such as displays within a disagree Indeed the Wellington DLC acknowledges single alcohol area (High Court and Court of Appeal) that even if a reduced perimeter was applied in order

bull However it is not possible to exclude end of aisle to exclude an existing end of aisle display it would displays from a SAA by way of section 117 (ARLA) It is remain open to an applicant to simply shift its end of unclear whether the Authority intended this to apply aisle displays into the SAA only when an end of aisle display was positioned well The Wellington DLC considers that there is a real need for within a SAA or whether it was meant to have the legislative clarity on the issue of aisle end displays effect of preventing the exclusion of end of aisles that abut the perimeter of a proposed SAA

45 MATTERS PREVIOUSLY RAISED AND AS YET NOT ACTIONED

The Wellington DLC refers the Authority to its past comments on the following topics which it continues to wish to see actioned by way of legislative reform

Topic Summary of concerns

Temporary Authority orders The Wellington DLC wishes for the DLC Chair to be empowered to opt whether to determine a temporary authority order application on the papers without a 3 person quorum and meeting or to direct that a public hearing be convened in order to do so This could be effected by adding temporary authority order applications to the list of matters in section 191(3) of the Act

The Wellington DLC would also like to see consideration given to expanding the matters to which a DLC may have regard when considering a temporary authority order application to include at least suitability but also any other relevant matters in section 105(1) of the Act It would also be of assistance if section 136 contained express reporting requirements and power for the DLC to consider any matters raised by reports

Notice period for special licence hearings The Wellington DLC would like provision to be made for the DLC Secretary to truncate the 10 working day notice period for special licence hearings where such applications need to be dealt with urgently

Notification for special licences The DLC Secretary has discretion to require public notification of special licence applications but may only do so by notice on the site It is suggested that this be expanded to include other media (eg online public notices) in appropriate cases

Designation issues The current designation requirements for lsquohotel stylersquo on licensed premises are not in line with modern reality The vast majority of hotels at least in urban centres such as Wellington no longer include a separate ldquopublic barrdquo area in which patrons gather for the specific purpose of drinking More common in such premises are lobby bar areas which are often not distinct from the reception thoroughfare to the hotel rooms These areas often are not used for the sale and supply of alcohol at all times Designating such areas to exclude children can pose real practical problems for licensees

Similarly the requirement to designate a lsquotavernrsquo can cause difficulty for premises that trade more in the nature of a cafeacute during the day and a bar at night Time split designations have been adopted for this purpose on the basis that the operation morphs from a restaurant to a tavern at a particular time of night which section 118 permits It would be helpful to have clearer legislative support for such an approach

Catererrsquos licences The Authority has provided guidance in a Practice Direction (28 July 2015) on how caterersrsquo off licences issued under the 1989 Act can be converted into endorsed caterersrsquo on licences under the 2012 Act We suggest the Act be amended to reflect the Authorityrsquos directions

Change to acting temporary managers regime A temporary manager can be appointed for an unspecified period to cover an illness absence or the resignation or dismissal of a certificated manager A temporary manager must apply for a certificate within 2 working days of being appointed An acting manager may be appointed for up to three weeks to cover for a certificated manager who is ill or absent An acting manager is not required to apply for a certificate Licensees who appoint acting or temporary managers must notify the DLC and Police within 2 working days Within 5 working days after that the DLC may inform the licensee it does not approve the appointment (under section 231(4)) In order to do so the DLC must first convene a meeting of a 3 person Committee In practice the 5 working days allowed is inadequate The Committee will only be alerted to any issues with an appointed manager if the Police or Inspector raises those Time is required for this to occur Natural justice then requires that those issues be put to the licensee and acting or temporary manager and an opportunity to respond be given A full Committee must then be convened to consider and determine the matter and a notice must then be issued It would assist to speed the process if this decision was added to the list in section 191(3) of matters that can be determined by a District Licensing Chair alone It would also assist if more time were allowed for the Committee to issue a non-approval notice It may be that it would make sense to draw a distinction between acting and temporary manager appointments Allowing more time for an acting manager could mean a non-approval order would come too late to make a difference to a particular appointment13 But it would still send a signal re any decision to appoint the individual in future Allowing more time for a temporary manager could have a practical effect A temporary manager who is appointed for longer than 48 hours must apply for a certificate and may remain appointed until that application is determined If there were grounds for a notice of non-approval then that would remove the temporary manager in these circumstances and could discourage his or her application for a certificate Under the current regime the Wellington DLC has never had an acting or temporary managerrsquos appointment queried by the Police and has not issued any section 231(4) notices

Review of Forms The Wellington DLC secretariat has reviewed and updated the suite of alcohol licence application forms14 In past Annual Reports to the Authority we have detailed suggested changes to the forms to achieve consistency with current law We again recommend a review of the forms including to ensure they comply with information privacy principles and with best practice in customer communications

5 Other matters

The DLC and the Wellington City Council welcome any coordinated centralised promotion of best practice in the operation of the Act and its Regulations

In this regard the Wellington DLC would welcome a review by the Authority of its dissemination of Practice Directions and decisions to ensure they reach all DLCs

Similarly the Wellington DLC would welcome steps being taken to ensure that legislative changes that impact on

the operation and decision-making functions of DLCs nationwide be notified directly to the Committee by the central government agency responsible for the change By way of example during the reporting period the change to section 22 through the omnibus Statutes Amendment Act 2016 was not brought to the attention of DLCs despite it having a significant impact on an aspect of their daily operations (ie special licence applications)
