FOREWORD

In carrying out its responsibility to make a broad survey of the:patent statutes, the subcommittee has undertaken to determine thefacts as to how the patent system is actually working in practice.The logical starting point for such an inquiry is the compilation ofavailable data showing who obtains and owns the vast number ofunexpired patents in existence today. Accordingly, at the subcom­mittee's request, the Patent Office has compiled the data and infor­mation presented herein showing the number and distribution ofpatents unexpired on December 31, 1955, which were issued to cor­porations, and other related information. The work of compilationwas done under the direction of P. J. Federico, examiner-in-chief inthe Patent Office, who also prepared the report.

The sources of the information and the manner in which it wascompiled is carefully explained in the report. The report is substan­tially limited to the presentation of the data.

The subcommittee is indebted to the Patent Office and Mr. Federicofor the preparation of this report.

Line 3 of table 2a represents the group of companies with 1 to 100patents. These were not counted and hence the number of companiesand patents is not known; however, the number of patents issuedto this unknown number of companies can be estimated by sub­traction from the estimate of the total number of patents issued to allcorpor~tions given in line 3 of table 1, and this estimate is given inline 3 of table 2a. No estimate of the number of companies withfrom 1 to 100 patents can be made from the present data in view of theenormous number of companies with a small number of patents, butit may be stated that the number is believed to be considerably over20,000."

In general, very few financial companies hold any patents; the rew that do would hold them as trustee orin connection witq'a mortgage, Financial companies have hence been excluded from the group {If i\I",:ecompanies.. 'I'tansportation companies also held very few patents. The Department of Oommercc' !;;;tof the200Iargest nonfinancial companies includes 34transportation companies; of this number 29took out nopatents and the remaining 5received only an average of11each. Utility companies, with only a few lmownexceptions, are not holders oflal'ge numbers of patents. The Department of Oommerce list of200includes 47electric and gas utility companies; of this number 38had no patents and the remaining 9averaged 11patentseach. Table 6 lists the total number of patents (excluding reissues and,design and plant patents) issued annually in each of tbe 20 yearscovered, the number issued to United States corporations, the numberissued to foreign corporations, the total issued to corporations, thenumber issued, to individuals, and the number issued to the UnitedStates Government (excluding the Alien Property Oustodian; patentsissued to the Alien Property Custodian are included in the patentsissued column but have not been separately listed). .

The data presented in these tables were obtained in the followingmanner, The number and percentage of patents issued to corpora­tions in the 3·years 1936, 1937, and 1938 are from the study made in

. 1938.· See table 5, The number and percentage for 1955 were ob-tained by counting the patents issued to corporations for the entireyear, in the Index of Patentees for 1955, For the intervening years,1939-54, the number and percentage of patents issued to corporationswere estimated by counting' the patents (from the Official Gazette)issued to corporations for a full month at 6-month intervals. That

is, a sample-of 2 months' patents, January and July, was taken eachyear and the estimates for each year calculated from these samples.The numbers of patents to the United States Government for eachyear were taken from an index of Government-owned patents (exclud­ing the Alien Property Custodian; an annual tabulation .of patents

. issued to the Alien Property Custodian is not separately listed inthese tables) . . . .

Some of the data tabulated in tables 6 and 7 are shown graphicallyin figures 3 and 4. The upper heavy line in figure 3 represents thetotal number of patents issued annually. The next line representsthe number of patents issued annually to all corporations and the linebelow this one represents the number of patents issued annually toUnited States corporations; the difference between th.ese two lines rep­resents the number of patents issued annually to foreign corporations.The difference between the upper two lines represents the patentsissued to individuals except for those issued to the United StatesGovernment and the Alien Property Custodian which are not-indi­cated in the figure. Figure 4 corresponds to figure 3, giving the perccentages for each year. . -' - .

Looking at the percentage curves, it will be noted that while thereare some variations in the percentages of patents issued to corporationsoyer the 20-year period, no significant trend for the entire period isindicated. The average percentage of patents to all corporationsfor the 20-year period is 58.37 percent, and of patents to UnitedStates corporations is 53.93 percent. Straight lines fitted to thepoints of each curve by the method of least squares are nearly .hori- ,~ .zontal, sloping downward by about 1 percent in the entire 20~year

period in each case. The largest deviation above the averagejine,for either curve, is the rise occurring from 1941 to 1946. This rise inpercentage of patentsto corporations appears during the period 'Yhenthe number ofpatents issued to corporations and the total number ofpatents issued annually was declining due to the decline in the numberof applications filed during the war years. The rise in the percen,tageof patents to corporations during the period of diminishing filing ofapplications and issuance of patents indicates that the causes of the

.decrease in filings and issuances affected the individual inventors toa somewhat greater extent than they affected the corporations. Thesharp drop in the proportion of patents to corporations occurringafter 1946 clearly suggests that the.preceding increase. was an effectof.the war. The decrease, obviously caused by the war, and subse­quent increase of both the number and proportion, of patents issuedtoforeign corporations is apparent in both figures.

For the purpose of supplying additional material whichmight sh.owany trends in the number of patents received by the larger corpora­tions, a furtherstudy was made of the patents issued each year to asmall group of the largest patent-obtaining corporations:

"Fable 8 presents the number andproportion of patents issued eachY8~'r to the 15 corporations which received the largest numbers ofpatents in that year, for the 20 years 1936 to 1955. The 15 corpora­tions of one year are not entirely the same as the 15 in another year, foreach year includes just the particular 15 corporations which receivedthe largest number of patents in that year. From year to year therewas a shift of two (8 times), one (8 times), or none (3 times) in the 15companies which received the most patents. Of the corporationsin­cluded, 9 were among the top 15 each .year of the 20-year period.Th.ese nine are, in order of their total number of patents: (1) GeneralElectric Co., {2) American Telephone & Telegraph Co., {3) RadioCorporation of America, (4) Westinghouse Electric Corp., (5) E, I.du-Pont de Nemours & Co., (6) Esso Standard Oil Co., (7) GeneralMqtors Corp., (8) Eastman Kodak Co., (9) Bendix Aviation Corp.Inaddition to these 9, 5 companies appear among the top 15 from 11to 15 times each. Referring to column (2), giving the percentage of total patentsissued to the topt5 companies, the first 5 years, 1936 to 1940,8how .an average of 11.72 percent, with very little variation about. tJ:dsaverage; The last 5'years, 1951 to 1955, show an average of lQ,71percent,. a decrease of about one-eleventh from the value of the per­centage for the earlier years.. However, there isa rise in' the 1'.W­centage to the top 15 corporations from 1940 to 1946 and thereaftera decline to the recent figures. This rise occurs during the same timeas the rise in the percentage of patents to all corporations which-hasbeen discussed in the preceding section. In the preceding section itwas pointed out that during this period the total number of patentsissued. each year was decreasing and smaller. than normal and con-.sequently the increase in the percentage of patents issued to corpora"tions (occurring while the actual number of patents issued totl\em

. was decreasing) merely indicated that the causes of the decrease infilings and issuances of patents operated less strongly on corporationsthan on individuals. The present tabulation of the patents issued-tothe top 15 corporations indicates that the causes for the decreaseinfilings and issuances operated still less strongly on the larger corp9,a,tions, Considering the W'iJ' period and the years thereafter as.abnormal and not included, the trend in the proportion of patentsissued each year to the largest patent obtaining companies exhibitsadecline, as has been noted,. However, considering each year ofthe2Q-year period, a straight line jitted to the data by statistical methodswould also show a similar decreasing trend.

Referring to column (3), giving the percentage of patents issued-tothe top 15 companies relative to the number of patents issued to allcompanies, the first 5 yeats, 1936 to 1940, show an average of 20.38percent. The last 5 years, 1951 to 1955,·show an average of 18.61percent. A similar decline would also be shown if all years were con­sidered and the straight-line trend calculated. The rise in the per­centage from 1940 to 1947 and the subsequent decline to the recent

. figures indicates that the causes of the drop in the number of patentsissued during the war operated less strongly on the top corporationsthan on the others, as has been stated. .

9. PATENTS ISSUED TO CORPORATIONS IN 1955

The total number of patents issued to corporations in the year lQ55and the total number of corporations receiving patents in this yearwere counted from the annual Index of Patentees for 1955, a newarrangement of the entries making it convenient to do this for thatyear. There were 5,316 corporations receiving a total of 17,947 pat­ents (this number includes 119 reissues) in 1955. The proportion ofpatents issued to corporations in this year, 58.58 percent, is. almostthe same as the average for the 17 years 1939-55, although thspro­portion to United States corporations is a little over 1 percent lowerthan the average to United States corporations for the 17-year period.The year 1955 shows a drop in the proportion of patents issued totheselected group of 176 large corporations, as pointed out in section. 5.
