Starr, Superintendent of Schools Subject: 2015–2016 School Calendar I recommend adoption of the attached calendar for the 2015–2016 school year (Attachments A1 and B). The recommended school calendar allows for the effective use of time for teaching and learning and provides opportunities for professional growth and planning instructional strategies focused on improving student achievement. In preparing Attachment A, I have considered the concerns raised by some representatives of the Muslim community about the desire to recognize Muslim holidays and close schools on Eid al-Fitr and Eid al-Adha, or at least have these days noted on the school calendar. The Montgomery County Public Schools (MCPS) Comprehensive Calendar, a master calendar that contains the school calendar adopted by the Board of Education (Board) as well as a comprehensive listing of all calendar items for each month in MCPS, does in fact note these holidays. The Comprehensive Calendar is distributed to schools every summer and also is posted on the MCPS website. In 2014, Eid al-Adha and Yom Kippur fell on the same day, October 4, and both were noted on the Comprehensive Calendar. I am recommending a different presentation for Attachment A for the 2015–2016 school year, which eliminates the references to Rosh Hashanah and Yom Kippur, as well as the Maryland State Education Association (MSEA) Convention day (Attachment A1). All three of these days are no school days for students and teachers (and no work, no pay days for most Service Employees International Union [SEIU] Local 500 10-month employees). However, as we have discussed in the past, decisions about closing schools on Rosh Hashanah and Yom Kippur, specifically, are not based on honoring or favoring a particular religious, cultural, or ethnic group. The decision to close on these days—originally made in the 1970s—has been based on the experience of significant student and staff absenteeism impacting the school system’s ability to continue an instructional program and operate safe schools. I also have included two other options for the Board’s consideration. The first option is the presentation we have used in the past, in which we include the references to Rosh Hashanah and Yom Kippur as well as the MSEA Convention day (Attachment A2). The second option, presented in Attachment A3, is the same as Attachment A2, except that Attachment A3 also notes Eid al-Adha on September 23, which is the same day as Yom Kippur.

Members of the Board of Education 2 November 11, 2014 My recommendation is for the Board to adopt Attachment A1, as the reason for closing schools on these days is an operational one only. Given the input received from the community regarding Eid al-Fitr and Eid al-Adha, MCPS staff will continue to monitor the impact of the Muslim holidays on school attendance. In prior years, there have been no significant attendance issues on these holidays. Additionally, please note that Attachment A1 identifies those public school holidays that are designated in the Annotated Code of Maryland; therefore a legal requirement that schools close for students on these days. The school calendar is based on 184 instructional days for students (four more than the minimum days required by the state of Maryland) and 193 duty days for teachers. In addition, the Montgomery County Education Association (MCEA) contract includes 16 hours of unscheduled professional time for teachers. The contingency plan, indicating when days will be made up if the number of emergency closings exceeds four days, also is attached (Attachment C). Stakeholder Involvement During the last several years, changes regarding the school calendar have occurred as a result of key stakeholder involvement. Staff in the Office of the Chief Operating Officer uses a collaborative review process to solicit input on drafting the proposed school calendar that includes representation from the Montgomery County Council of Parent Teacher Associations (MCCPTA), MCEA, the Montgomery County Association of Administrators and Principals, SEIU Local 500, the Maryland Association of Student Councils—Montgomery County Region, and other parent/community and school system leadership. Every effort was made to schedule professional days on Mondays and Fridays or following a holiday—a more family-friendly arrangement. During discussions with stakeholders, the following comments or questions were raised.

• Parents and community members expressed an interest in knowing all of the early release dates soon after the calendar is adopted rather than in early spring when the school operations calendar is distributed. Early release days are reflected on the calendar. However, early release days for interims and planning for the first and third marking periods remain tentative and will not be finalized until the school operations calendar is distributed in early spring 2015. Early release days for K–8 parent conferences are considered set dates—November 11 (Veterans Day) and November 12, 2015, as is the early release day on November 25, 2015, the day before Thanksgiving.

• Parents continue to express interest in having as many non-school days as possible

occur on a Monday or Friday. The proposed calendar accommodates that request to the extent possible.

• Leadership from the Muslim community was consulted a number of times during the development of the school calendar. The community leadership acknowledged that we are a school district rich in diverse religions, ethnicities, and cultures and wants to be assured that Muslim students are not penalized for being absent on specific holidays.

Additionally, we received a number of communications (e-mail messages, letters, and conversations) expressing the desire to ensure that Muslim holidays were recognized by MCPS and requesting that the school system consider closing on Eid al-Fitr and Eid al-Adha when those holidays fall on a regular school day and asked to have them noted on the school calendar. For the 2015–2016 calendar, Eid al-Adha falls on the same day as Yom Kippur (September 23, 2015).

• All three employee associations were pleased that the collective bargaining agreements were amended in spring 2011 regarding the early release day on the Wednesday prior to the Thanksgiving Holiday. The three agreements allow for employees to leave two hours early without using their leave.

• Appreciation was expressed by all stakeholders for our continued commitment to

seek collaborative feedback annually and prior to the development of a Board-adopted calendar.

• While MCCPTA did not take any formal vote or position, representatives commented that they recognize the dilemma when schools close on certain religious holidays (Jewish and Christian) but not on others (Muslim). They acknowledged that we are a diverse community and it is difficult to determine where to draw the line when closing school. Concerns also were expressed that many students are put in the difficult position of choosing to stay home for a particular holiday and missing school. It should be noted that absences for religious holidays are considered excused; students may make up work and are not penalized.

It is important to note that the MCPS comprehensive calendar distributed to every employee identifies religious holidays so teachers and other school-based staff are aware of those days when students may be absent to observe religious holidays. A copy of the Interfaith Calendar for 2015–2016 has been provided (Attachment D) as a reference for religious holidays that MCPS would consider as excused absences. The school system reminds staff of the need to be aware of regulations and expectations that guide how homework and testing should be managed for students who may be absent due to a religious holiday. In addition to the stakeholder feedback listed above, members of the Board of Education and some stakeholders expressed an interest in receiving school calendars for two years. As such, a draft calendar for the 2016–2017 school year is attached (Attachment E). The greatest challenge with proposing a school year calendar two years in advance is the Maryland State Department of Education (MSDE) testing calendar. MSDE testing dates have changed a number of times during the last several years, and changes could impact the scheduling of professional days and spring break. Given the transition to the Partnership for Assessment of Readiness for College and Careers assessments, it is quite possible that the state testing calendar will be updated. Additionally, in previous years during discussions regarding the school calendar, members of the Board of Education indicated that they desire to know the testing dates when adopting the Board

Members of the Board of Education 4 November 11, 2014 calendar. The most current version of the MSDE testing calendar is provided for your information (Attachment F). It is important to note that the state of Maryland has changed these dates in prior years. Finally, Board Member Patricia O’Neill requested that we include information in this memorandum and our discussion about what the impact would be on the calendar if we could not open school prior to Labor Day as proposed by Maryland Comptroller Peter V.R. Franchot. Labor Day in 2015 is September 7, 2015, which is as late as it can occur on the calendar. If we were not able to start school until September 8, 2015, the last day of school would be June 24, 2016, and the contingency calendar would extend until July 1, 2016. This would have a tremendous impact on school system operations including summer school and training programs. It also would impact community programs for students that begin when school ends in June. Professional Days As previously indicated, the MCEA contract includes 16 hours of unscheduled professional time for teachers. The designated professional days/time will be used to implement professional learning communities for teachers and other staff to discuss best practices and instructional strategies and review student data, focusing on specific activities related to the achievement of their students and the teaching and learning process. The 16 hours of professional time provides flexibility to meet the needs of school staff and individual teams and departments. The schedule for these hours will involve work after the normal school day, on weekends, or on other days not scheduled as duty days for teachers, including additional preservice time. The professional days at the end of each marking period—November 2, 2015, January 25, 2016, and April 4, 2016—will be non-school days to be used for report card preparation, planning, and professional development. The early release days on the calendar are for interim grade reports and planning, parent conferences in November for elementary and middle schools, and the Wednesday prior to Thanksgiving. Summary The following considerations are included in the recommended 2015–2016 school year calendar:

• School beginning on Monday, August 31, 2015

• A student year of 184 instructional days, including 4 contingency days

• A teacher year of 193 duty days, plus 16 hours of unscheduled professional time

• Nine professional days with no school for students—five preservice days beginning Monday, August 24, 2015; three days for report card preparation/planning—Monday, November 2, 2015; Monday, January 25, 2016; and Monday, April 4, 2016; and the last day of the school year for teachers on Friday, June 20, 2016.

Please refer to Attachment C, the School Contingency Calendar for 2015–2016, which identifies when days will be made up if we exceed four days of emergency closings.
