I. Design Theme and Philosophy

The design philosophy of Spring Creek is to create a residential development with a rural elegance that complements the rural character of eastern Boulder County and historical rural heritage of Lafayette and the surrounding agricultural uses.

The architectural theme has been established for individual residences in order to foster compatible designs and create a community which is harmonious with the natural open space of this parcel of land and neighboring agricultural uses. Simple forms and style consisting of durable materials make a strong statement of quality and longevity.

Craftsmanship in construction, as seen in the details of the architecture will convey casual elegance and compatibility with the original rural roots and the present natural environment. Details which appear contrived will be discouraged. The result will be an understated, elegant community consisting of simple forms, consistent roof lines and compatible materials and colors. The photos and renderings included with these guidelines will demonstrate desirable and undesirable design for Spring Creek.

The intent of these Guidelines is to accomplish a community development that achieves harmony among dwellings and between each dwelling and its surrounding landscape, yet allows individual identity to the dwelling. The Guidelines apply primarily to:

A. Assuring compatibility and harmony of exterior color materials and design so the exteriors of buildings are subdued in a manner to avoid negative contrast within the neighborhood.

B. Relating proposed improvements to the natural features of the land, and to neighboring structures and other improvements.

C. Conforming the plans and specifications to the purpose and general plan and intent of the Official Development Plan and Master Declaration.

II. Design Guidelines

A. Site Considerations

The Architectural Control Committee (ACC) will review each plan for a building in relation to the specific characteristics of the subject lot and its surroundings. The basic objective is to achieve compatibility of the building and other improvements with the subject lot and the immediate surroundings. The site consideration review is, in summary, specific to the site itself. Location of the main buildings should consider:

1. Natural and proposed final grade contours.

2. Street grades as installed.

3. Presence of vegetation, trees and shrubs.

4. Existing and final views.

5. Privacy of subject and surrounding lots, including building improvements

on adjoining lots.

6. Access driveways and off-street parking.

7. Setback requirements.

8. Elimination of house siting that results in buildings that appear excessive in height when viewed from adjoining lots, drives, roads, or open space areas. Appearance of buildings from open space, roads, and other lots will be important criteria.

9. Site grading and drainage which minimize required natural grade alterations;

drainage accommodation from adjoining lots or onto adjoining lots in such a manner that does not cause soil erosion or impede drainage flows or result in excessive drainage onto adjacent lots.

10. Site grading which does not require extension of cut or fill slopes onto

adjoining lots, roads, drives, or open space.

B. Main Building

1. Setback Requirements

Setback requirements shall be City of Lafayette setbacks with final review by the ACC.

2. Building Size

The minimum house square footage shall be 2,800 sq. ft., excluding garages, covered porches, and basements.

3. Building Height

To preserve the open, gently sloping character of the hillside, lower horizontal forms will be emphasized. “Big box” elevations will not be allowed. All two story elevations shall be designed with elements that will break up the tall vertical walls.

Key features include one- and two-story structures, simple roof systems, dormers and attached porches. The result will be a group of residences with the essential characteristics of a rural village.

4. Roofs

The following are specific roof criteria:

a. All major roofs shall be either gable or hip with a pitch of a minimumof 6/12 and a maximum of 12/12. Porch roofs and secondary roofscould be of a lesser pitch.

b. All roofs shall be required to appear as if the center of the structure isthe tallest point and the roofs shall appear to “cascade down” to 8’ or9’ plate heights.

c. In order to achieve an interesting character, expansive roof areas shallbe “broken” by varied elevations, heights, and/or other elements suchas dormers, porches, clerestory, or ridge line breaks, etc.

d. Roof vents and flashing shall be painted to match the permanent roofcolor or the trim color, whichever lessens the visual impact.

e. Consideration will be given to use of roof forms that incorporate solarcollection panels; such consideration will evaluate the totalarchitectural accommodation of these devices. Such solar equipmentshould blend into overall architectural and roof form designs.

5. Exterior Walls, Siding and Porches

The exterior wall proportions shall be appropriate to the scale of theresidence. Houses with extensive areas of unbroken two-story (or greater)walls will not be acceptable. By breaking up extensive areas of two-story orgreater walls, the residences will better conform to the site and individuallots. The height and length of the exterior walls will control the proportionsof the residence and whether the structure is properly related to the naturaltopography of the lot and the adjacent open space.

Exterior siding may be of wood, painted hard board, brick, stone, rock,shingle, or stucco. Application may be in a variety of styles but should becontinuous and consistent on all elevations to achieve a uniform andcomplete design statement. Lap and shingle siding shall maintain amaximum lap exposure not to exceed 5”. Masonry veneers shall beconsistent on all elevations, i.e. no use of both stone and brick on theexterior of the same building.

Covered front porches are required. Porches shall be integrated into theoverall main body structure and roof design of the home. Porches thatare just attached to the front of the home will not be approved. Porchroof support posts shall be in proportion to the home and appropriate tothe style of the home. Rock, brick, stucco and wood enhanced with trimor molding detail are suggested materials for posts. Wood or metalrailings should add architectural interest to the porch and home.

6. Exterior Colors

Primary colors shall be “light natural tones”, including grays and whites. Siding materials may be left natural. Fascia, trim, columns, entry doors, and beams may have accent colors.

All projections including, but not limited to, chimney flues, vents, gutters, down spouts, utility boxes, porches, railings, and exterior stairways, shall match the permanent color of the surface from which they project or shall be of an approved trim color.

7. Miscellaneous

a. Foundations – No more than 12 inches of exposed concrete may be

visible on any elevation

b. Garages – There shall be a minimum of two and a maximum of four fully enclosed garage spaces for each dwelling unit. Minimum dimensions for each space are 10 feet by 20 feet. Visual impact of garage doors shall be minimized by such measures as, but not limited to, siting of the building, protective overhangs or projections, special door facing materials, landscaping, or door design which blends with or enhances the overall architectural statement. Side loading and garage door setbacks a minimum of 10 feet back from the forward corner of the structure are preferred.

c. Windows – Window frames, if metal, shall be anodized aluminum or

painted a color consistent with the design character of the building. Window design shall be consistent with architectural design statement in size, proportions, detail, and placement on the elevations.

d. Elevation Treatments – Architectural design shall incorporate a

consistent level of architectural interest in all elevations.

C. Other Improvements

1. Driveways and Private Lanes

All driveways and private lanes shall be concrete. Asphalt or colored stamped concrete may be used upon approval of the committee. Driveways and private lanes shall be constructed to specifications which consider vehicle loads such as trash trucks and moving vans. Appropriate measures must be taken to contain edges and control erosion and washouts.

2. House Address Numbers

Address numbers shall be used at the mail box (Phase 1) and on the dwelling unit.

The address number at the dwelling unit shall not exceed in overall size a total of one half square foot for each number in the address number, i.e. a three number address – 254 – shall not be greater than 1.5 square feet. The address number on the mail box shall comply with the mail box specifications for Spring Creek (Phase 1 only).

3. Antennas & Satellite Dishes

All TV, radio, or special communication antennas or aerials and Satellitedishes (maximum of two) shall be concealed or must be approved in writingby the ACC.

4. Exterior Mechanical Equipment

All exterior mechanical equipment or tanks shall be either incorporated intothe overall form of the dwelling or be permanently enclosed by a material,other than plant material, approved by the ACC.

5. Accessory Structures

Accessory structures shall be architecturally compatible with the dwelling.Dog runs or enclosures for other pets shall be installed in accordance withguidelines. If deviation from these guidelines is intended for suchconstruction, prior approval by the ACC is required.

6. Exterior Lighting

Because of the project’s rural setting, the exterior lighting incorporated ineach residence must avoid impact on adjacent lots and surrounding area.The intention is for the development to blend in with the existing characterof the agricultural uses by not creating a brightly lit complex contrastingwith the adjacent open space and agricultural land.

All lighting mounted on Spring Creek homes shall be either a “Dark Sky”style light fixture or a similar fixture that utilizes opaque style glass. “DarkSky” fixtures have sharp cutoff design where the light source is not seenexcept from below and the light is aimed downward. Fixtures that utilizeglass that is sufficiently opaque such that the light bulb is not visible fromthe side will be considered if the light bulb is 450 lumens or less and thelight is not located in an area that will glare into an adjacent home. Nobulbs in excess of 800 lumens are permitted for outside use (see chartbelow). Installation of, or changes to existing exterior house mounted lightfixtures must be approved.

All exterior lot lighting (not house mounted, usually for the purposes of illuminating landscaping, driveways or walkways) shall be low voltage (12 volts or less) fixtures. This type of lighting may be installed by homeowners without application to the ACC if the lighting source is not visible from adjoining dwellings. Exceptions include light fixtures mounted on decks, outbuildings or other structures, which are discouraged and shall be considered on a case by case basis by the ACC. Only “Dark Sky” fixtures shall be allowed on decks, outbuildings or other structures.

Decorative or specialty lighting such as, but not limited to, holiday lights, white twinkle lights, party themed lights or cafe lights should only be illuminated during an event or an appropriate seasonal time period, in the case of holiday lights. They should not be considered general lighting for a home and used as such.

Dark Sky light fixture definition: Dark Sky compatible light fixtures are fully shielded lights such that the light source is covered from all sides except directly below with an opaque cover that allows NO light to pass through it. Examples would be soffit mounted can lights or fixtures with metal shades that are open on the bottom only. Proper light bulbs must be used in Dark Sky fixtures so that the bulb is not visible.

Regardless of type of bulbs used, all should be “warm white” in color.

7. Parking Areas

Off drive parking bays or areas and circular driveways will be consideredfor approval by the ACC.

8. Basketball Backboards

Standard size basketball hoops may be installed upon the roof of a garagestructure with approval by the ACC. Free standing portable units arepreferred and must be located on owner’s property. Portable basketballhoops should be stored out of sight from the street when not currently in use.All basketball hoops, nets, backboards, posts, bases, etc. must bemechanically sound, clean and well maintained.

9. LandscapingAll landscape plans shall be prepared by a landscape design professionalwith their title block included on the drawing.

Landscape plans shall be approved by the ACC prior to the commencementof landscape improvement construction. Each owner is responsible forlandscaping and landscape maintenance of the lot. This responsibilityincludes the area between the lot property line and street paving; at the front,side or rear of a lot; since these areas may be used for surface water runoff,landscape improvements should not restrict water flow and should preventerosion in these areas.

In lots which adjoin open space or greenbelts, landscape plans shouldprovide for a transition between the natural landscape that exists in the openspace or greenbelt area and the improved landscape areas constructed by theowner. Existing trees shall be retained.

Landscaping is the preferred method for screening undesirable areas andproviding privacy for decks and yards.

Irrigation systems shall be included in all landscape designs to promoteefficient water use and insure the ongoing maintenance of plant material.

Consideration should be given to use of plant materials that do not requireexcessive moisture and to maintaining separation between plants and sodand building foundations to avoid excessive moisture conditions nearfoundations.

Each home shall include installation of street trees as stated on the SpringCreek PUD plan. “Canopy trees are provided along all streets in SpringCreek where the lots front and side onto the street. These trees shall occurbetween the curb and detached sidewalk and shall be spaced 40 feet oncenter. Trees shall be a mix of no less than three species to protect againstdisease that may attack one specific species”. Trees approved for streetinstallation include Norway Maple, Hackberry, Shade Master Honey Locust,Northern Red Oak or American Linden. Two inch caliper is the minimumsize required.

All ash trees have been removed from approved listing due to the EmeraldAsh Borer. On November 13, 2013 the Colorado Department of Agricultureissued a ban on any tree from the Genus Fraxinus to be planted in BoulderCounty due to the Emerald Ash Borer.

The front yard minimum requirement, not including street trees, is asfollows:

a. 2 – 2 ½” deciduous treesb. 2 – 6’-8’ evergreensc. 15 – 5 gallon shrubs

Back yard minimum is as follows:

a. 2 – 2 ½” deciduous treesb. 2 – 6’-8’ evergreensc. 10 – 5 gallon shrubs

All mulch or bark used in landscaping must be natural wood color (shades of brown). Rock for paths, planting beds and other landscape purposes shall be neutral colors i.e. grays, browns, or white/cream. River rock type rounded stones are preferred. Landscape boulders and stepping stones must also be neutral in color.

10. Future Improvements

Future improvements or modifications that alter or affect the exteriorappearance of a dwelling or yard must be submitted to and approved by theACC. Approval includes, but is not limited to:

a. Room, porch or garage addition to main house.b. Repainting in a different color scheme.c. Play house, dog house, or other separate building or structure

exceeding 5’0” in height or visible to an adjacent lot, road, or openspace.

d. Decks, or patio extensions and deck/patio covers.e. Free standing flag poles.f. Sports courts, hot tubs, swimming pools.g. “Hardscapes" which are the non-living or man-made fixtures of a

planned outdoor area. For example, rock walls, water features,fireplaces and walkways.

11. Fences

All fence plans, including color selection, shall be submitted to the ACC�for approval. The ACC has adopted fence and location standards for�Spring Creek. Fence standards will include the following:

a. Perimeter Fencing

i. Fences shall be constructed of rough sawn cedar, treated withwater preservative or natural/clear stain. Other stain colorsmust be consistent with the dwelling and submitted as part ofthe approval process with the ACC.

ii. Fences shall be 3-rail using 2”x8” rails and 4”x6” posts withchamfered post tops.

iii. When attaching perimeter fencing to the home, the fence mustbe set back from primary front corners of residence and alongproperty lines and side yards.

iv. Fence may be installed along rear and side yard property linesonly.

v. Homeowners installing perimeter fencing must install all railsto the exterior side of their lot on all sides.

vi. If wire mesh is desired, it may be added and it shall be 2”x4”welded mesh installed on the house side of the rails betweenthe rails and posts.

b. Dog Run Fencing

i. Fences shall be constructed of rough sawn cedar, treated withwater preservative or natural/clear stain. Other stain colorsmust be consistent with the dwelling and submitted as part ofthe approval process with the ACC.

ii. Fences shall be 3-rail using 2”x8” rails and 4”x6” posts withchamfered post tops.

iii. Dog run fences may not be attached to perimeter fence. Itmust be kept at least 20’ from property line or perimeterfencing.

iv. Maximum length shall be 24’.

v. Maximum width shall be 12’.

vi. Fence may be installed in rear or side yard only.

vii. If wire mesh is desired, it may be added and it shall be 2”x4”welded mesh installed on the inside of the rails between therails and posts.

c. Privacy Fencing

i. Fences shall be constructed of rough sawn cedar, treated withwater preservative or natural/clear stain. Other stain colorsmust be consistent with the dwelling and submitted as part ofthe approval process with the Architectural Committee.

ii. Privacy fences may not be installed as a perimeter fence andmust be attached to the house.

iii. Fences may be installed in rear or side yard only.

iv. Maximum length shall be 40’.

v. Maximum height shall be 6’.

vi. Minimum set back from property lines shall be 10’.

vii. Top of fence to be level with optional 2”x4” cap.

viii. Posts shall be 4”x4”, stringers to be 2”x4”, vertical boardsscrewed to stringers shall be 1”x4”.

III. Construction Regulations

The ACC has established certain construction and safety regulations for the benefit of allSpring Creek owners, residents, and builders in order to ensure safe, neat and orderlyactivities during the construction period. These regulations apply to landscapers andremodeling contractors, also.

It is of the utmost importance that anyone conducting construction activities in SpringCreek Exert Extreme care in preventing conditions that are unsafe or that could constitutefire, wind or other hazards.

A. Storage of Materials and Equipment

Owners and contractors are permitted to store construction materials and equipment on the construction site during the construction period. It shall be neatly stacked, properly covered and secured. Storage of materials or construction equipment outside of the approved construction site (owner’s or builder’s lot) will be done only with the approval of the ACC. Any storage of materials or equipment shall be the responsibility of the owner or contractor.

Any POD or other storage container must be located entirely on the owner or builder’s lot and cannot block sidewalks, neighbor’s driveways or any part of the street.

Owners and contractors will not disturb, damage, or trespass on other lots or the open space. Should any such damage occur it will be restored and repaired at the offender’s expense.

B. Debris and Trash Removal

Owners and contractors shall clean up all trash and debris on the construction site at the end of each day. A trash container shall be located on each building site at all times for containment of lightweight materials, packaging, or other trash materials which may blow off the site. This trash container must be located entirely on the building site and cannot block sidewalks, driveways or any part of the street. Owners and contractors are prohibited from dumping, burying, or burning trash anywhere in Spring Creek.

All excess concrete shall be removed. Wash out of concrete chutes and equipment is not allowed in Spring Creek.

During the construction period, each construction site shall be kept neat and shall be properly policed to prevent it from becoming a public eyesore, affecting other lots and the open space. Any trash not promptly picked up by the owner/contractor shall be removed by a service hired by the HOA and costs billed to the owner/contractor.

Dirt, mud, oil, or debris resulting from activity on each construction site shall be promptly removed and cleaned up from public or private roads, open spaces and driveways or other portions of Spring Creek every Friday afternoon or contractor/ builder/owner will be billed and charged for this clean up.

C. Sanitary Facilities

Each owner and contractor shall be responsible for providing adequate sanitary facilities for his workers. Portable toilets or similar temporary toilet facilities shall be located only on the construction site and shall not be located on the sidewalk or street.

D. Parking Areas

Construction crews will not park on, or otherwise use other lots or the open space. Private and construction vehicles and machinery will be parked only on the construction site.

E. Conservation of Landscaping Materials

Owners and contractors are apprised of the fact that the lots and open spaces may contain valuable native plants and other natural landscaping materials that should be salvaged before and during construction, such as topsoil, shrubs, and trees.

F. Excavation Materials

Excess excavation materials will be hauled off the project or placed in areas designated by the ACC, if any. No excess excavation material shall be stockpiled even temporarily on other lots or open space without approval of owner. If any blasting is to occur, the ACC shall be informed far enough in advance to allow it to make such investigation as it deems appropriate to confirm that all appropriate measures, including protective actions, have been taken prior to the blasting.

G. Restoration or Repair of Other Property Damaged

Damage and scarring to other property, including, but not limited to other lots, open space, roads, driveways and/or other improvements will not be permitted.

Construction vehicles are not allowed to drive on Common Area parks or open spaces in Spring Creek. If any such damage occurs, it will be repaired and/or restored promptly at the expense of the person or entity causing the same.

Upon completion of construction, each owner and contractor shall clean the construction site and repair all property which was damaged, including but not limited to restoring grades, planting grass, and trees as approved by the ACC, and repair of streets, driveways, pathways, drains, culverts, ditches, signs, lighting and fencing.

H. General Practices for Construction and Contractor Activities

1. The following practices are prohibited at Spring Creek:

a. Changing any fluids on any vehicle or equipment.

b. Allowing concrete suppliers and contractors to clean their equipment

other than at the designated location.

c. Removing any rocks, plant material, topsoil, or similar items from any property of others within Spring Creek.

d. Carrying any type of firearms on the property.

e. Use of spring or surface water for construction.

f. Careless disposition of cigarettes and other flammable material.

Builders, contractors, and subcontractors shall not bring pets, particularly dogs, onto the property.

In the event of any violation of this regulation the Spring Creek Homeowners shall have the right to contact the City of Lafayette authorities to impound the pets, or to refuse to permit such contractor or subcontractor to continue work at Spring Creek, or to take such other action permitted by law or the Spring Creek Covenants, Conditions, and Restrictions.

All lot owners in Spring Creek will be responsible for the conduct and behavior of their representatives, builders, contractors, and subcontractors. All applicable Occupational Safety and Health Act (OSHA) regulations and guidelines and applicable City of Lafayette codes and regulations will be strictly observed at all times.

I. Construction Time Period

Work must be commenced within three months of the date of ACC approval of the working drawings; if not, approval will be considered void and a new submittal will be required. All building construction and lot grading work must be completed within one year of work commencement.

IV. Review Rules and Procedures

A. Purpose

The review and approval procedures are not intended to impose unreasonable or excessively costly controls nor to duplicate the functions normally provided by public agencies, such as the City of Lafayette Planning and Building Department, but rather to coordinate the design and construction of buildings by many different owners, architects, engineers, and contractors so as to achieve a pattern of continuous quality and identity, as contemplated and required by Spring Creek Covenants, Conditions, and Regulations. The role of the ACC is directed toward review and approval of exterior design, appearance, architectural vocabulary and esthetics. The ACC assumes no responsibility with regard to structural, mechanical, electrical or other details.

B. Organization

1. Architectural Committee

The ACC is the Architectural Committee referred to in the Spring Creek Covenants, Conditions, and Regulations.

2. Committee Staff

The current Spring Creek community management company will act as a liaison between applicants and the Committee.

3. Address

C. Review and Plan Submittal Procedure

1. General

The Review and Plan Submittal Procedures have been written to accommodate the most complex conditions such as building a new home that may exist in the variety of development activities that may occur in Spring Creek.

There will be cases where many of the step by step procedures will not have to be followed or certain listed submittal items may not be required. Check lists for each type of project should be consulted to determine what information will be required for the ACC’s review of projects on existing homes or existing landscapes.

2. Architects for Homes and Other Structures

All preliminary drawings and working drawings must be prepared by an architect licensed in the State of Colorado. The ACC reserves the right to waive this requirement based on the background and experience of the applicant or his agents and if the submittal is complete and adequate.

3. Pre-Design Review

It is suggested that each owner and his/her architect or agent meet at a mutually convenient time with the ACC in a “pre-design review.” The purpose of such a conference is to establish an early understand with respect to design concept and architectural philosophy and to avoid unnecessary and costly changes in preliminary and/or working drawings.

An application may omit the submittal of preliminary drawings, if the pre- design review is before a meeting of the ACC. If the applicant chooses to omit submittal of preliminary drawings, the submittal of “pre-design” or conceptual drawings must contain scale drawings of all elevations and a preliminary site plan. Submittal timing shall be the same as required in Paragraph 4(a) below.

4. Preliminary Drawings Submittal

The submittal of preliminary drawings is optional, but strongly encouraged. It is the ACC’s opinion that such a submittal as early as possible in the planning process will save the applicant time and expense plus unnecessary revisions of the working drawings.

a. Timing for Submittal

In order for submittal to be reviewed by the ACC at a regularly scheduled meeting, a complete set of preliminary drawings as described herein must be received 7 days in advance of such meeting. The owner or his/her designated representative is encouraged to be present at the meeting.

b. Number of Sets of Drawings and Contents

A total of two (2) sets of preliminary drawings is required to be submitted to the ACC, each set to consist of the following items:

1. Site and Grade Plan

Location and finished floor elevations of main buildings on the lot, at a scale of not less than 1” = 20’, and including:

a. Legal description; north arrow; name, address, and telephone

number of owner.

b. Property lines.

c. Building envelope dimensions with envelope established in relation to property lines.

d. Front, rear, and side yard dimensions to buildings from

property lines.

e. Drives, parking areas (if any), and walkways.

f. Square footage of the building footprint for each building.

g. Topographic plan of site at two-foot (2’) intervals showing existing contours and drainage courses, and proposed changes to contours and draining courses and cut/fill areas.

h. Location and elevation of access road and off-street parking lot

design, if any, including ingress and egress points.

i. Location, elevation, and square footage of other improvements such as tennis and basketball courts, swimming pools, and patios.

j. Reference to adjoining properties, streets, utility and other

easements, drainage courses; and reference to buildings on adjoining properties and their uses.

2. Building Plan

Indicate for all buildings the following at a scale of 1/8” = 1’ or ¼” = 1’.

a. Roof Plan

Pitch, valleys, hips, materials, and overhangs.

b. Floor Plan

Main structures and all accessory structures, including balconies, decks and square footage of each floor within the main building and square footage of each accessory out- building.

c. Exterior

All exterior elevations with materials, dimensions, final and original grade lines, and finished floor elevations clearly

indicated. A lighting plan must be submitted showing the location of all exterior light fixtures along with their specifications.

d. Sections

To include finish grade, finish floor, and maximum roof height.

c. ACC Action

Following review of preliminary drawings, the Committee will:

1. Conditionally approve the drawings with requirements and

suggestions for changes to be included in the working drawing submittal.

2. Disapprove the drawings as submitted.

One set of the drawings and the committee’s comments will be returned to the applicant within 7 days of ACC meeting.

5. Working Drawings Submittal

All working drawings must be approved by the ACC prior to submittal to the City of Lafayette’s Building Department for a building permit prior to any construction.

a. Timing for Submittal

In order for plans to be reviewed by the ACC at a scheduled meeting, they must be received 7 days in advance of such meeting. The owner or his/her designated representative should be present at the meeting.

b. Number of Drawings and Content

A total of three (3) sets of working drawings and specifications must be submitted to the Committee, each set consisting of the following items:

1. All of the completed and revised drawings required under

preliminary drawings submittal.

2. Sufficient exterior construction detail to allow the ACC to review finish design characteristics.

3. Exterior colors, materials, and finishes shall be presented in the

form of a white, rigid 1/8” board approximately 24”x24” displaying each material in sufficient size to evaluate its final use and appearance.

Proposed paint or stain finishes shall be applied to the trim and siding materials in the same manner as will be done on the building. Finishes shall identify product brand and color identification. Such sample board must indicate the name of the applicant and legal description of the property.

c. ACC Action

Following review the ACC will:

1. Approve the working drawings in which case the applicant may

proceed with development.

2. Conditionally approve the working drawings in which case the applicant must revise the plans to comply with the stated conditions and file the drawings with the ACC and receive written approval prior to beginning development.

3. Disapprove the working drawings in which case the applicant will

be required to resubmit new plans as requested by the ACC. Two sets of drawings with the ACC’s comments and action will be returned to the applicant within 7 working days of the meeting. One set of the approved drawings must be kept on the construction site at all times.

d. Construction Procedures

1. Changes During Construction

Changes during construction affecting the finished grade of the site, exterior appearance of any structure or landscaping require approval of the ACC prior to execution of the change. Such changes may necessitate submittal and approval of revised drawings; this requirement will depend on the complexity of the change and is at the discretion of the Committee.

2. Right of Entry

When construction work requires the use of adjoining property for any purpose, such as transporting labor or materials for the work, the applicant shall obtain written permission from the adjoining property owner (including the Master Association or any Sub- Association if the adjoining property is so owned) for “Right of Entry” during the course of construction.

3. Workmanship

All workmanship affecting the exterior appearance of a structure must be executed in a manner that is consistent with acceptable industry standards.

4. Inspection

Upon completion of the work as indicated on the drawings and specifications approved by the ACC, the owner shall notify the ACC in writing for final inspection. The ACC will inspect the property and notify the owner within 10 days following the next regularly scheduled meeting of the ACC indicating its acceptance or noting deficiencies requiring corrective action.

5. Additions or Alterations

a. Any additions or alterations after completion affecting the

finished grade of the site, exterior appearance of any structure, or landscaping may require approval of the ACC.

b. The ACC should be contacted to determine if the addition or

alteration as submitted is consistent with approved guidelines for the area and if ACC approval is required.

V. General Provisions

A. Conditions Not Defined

Any matter, condition, or material not defined herein shall remain a matter of discretion on the part of the ACC.

B. Variances

The ACC and Spring Creek Board of Directors reserve the right to vary at any time from procedure or standards as establish herein. The ACC and Spring Creek Board of Directors further reserve the right to amend, supplement, or repeal these Guidelines and Review Procedures at any time.

C. Zoning Ordinance and Declarations

Additional standards and requirements are set forth in the applicable subdivision plat and the Master Declaration. Each owner must read and become familiar with all such documents so as to avoid violating the standards and requirements set forth therein.

VI. Enforcement

Failure to conform to these guidelines or obtain necessary approval from the ACC will constitute a violation of the Spring Creek Covenants, Conditions and Restrictions, and shall require modification or removal at the expense of the owner.

VII. Effective Date

These guidelines, as may be amended or supplemented from time to time, are adopted and effective as of the date shown.

Spring Creek Design Guidelines 2020 Xeriscape Supplement

Changes in weather conditions, fluctuating water supplies and rising water costs in recent years have increased interest in the use of xeriscape landscaping techniques. This supplement is intended to provide guidance for residents wanting to use the option of xeriscape principles in all or part of their landscape design. Using this information will enable residents who wish to use xeriscape principles to conserve water while still having landscape designs that will be beautiful, functional and conform to the overall design philosophy of Spring Creek.

Definitions: Xeriscape While many people call a certain style of landscape a “xeriscape”, xeriscape is actually a process of landscaping that follows seven principles which improve soil, conserve water and utilize plants suitable for or adapted to the local climate and soils (see resources below for details). It is characterized by diverse landscapes of resilient, low water usage plants featuring attractive colors, textures and forms. Entire yards can be planted using xeriscape techniques or zones of traditional landscaping, like turf for a high traffic children's play area, can be combined with zones based on xeriscape principles. Either choice can help reduce landscape water usage and result in a beautiful, usable yard.

Zero-scape Zero-scape designs are often seen in desert communities. While some people confuse this type of landscape design with designs based on xeriscape principles, they are quite different. Zero-scape designs combine gravel, often in patterns and multiple colors, covering the soil with a limited number of plants, usually cactus. Zero-scape landscape plans are not compatible with the overall Spring Creek design philosophy and will not be approved by the ACC.

Requirements for Spring Creek Landscape Plans Using Xeriscape Principles (Please also refer to Spring Creek Design Guidelines Section C 9. Landscaping)

1. Street Tree and Minimum Tree and Plant Information (Same as Original Design Guidelines) • Each home shall include installation of street trees as stated on the Spring Creek PUD

plan and required by the City of Lafayette. Trees for street installation shall be selected only from the following approved trees: Norway Maple, Hackberry, Shade Master Honey Locust, Northern Red Oak or American Linden. Two inch caliper is the minimum size allowed. Street trees shall be planted between the curb and sidewalk, spaced 40 feet apart on center.

• Front Yard Minimum a. 2 - 2 1/2” caliper minimum deciduous trees b. 2 - 6'-8' evergreens (height when planted) c. 15 – 5 gallon shrubs

• Back Yard Minimum a. 2 – 2 1/2” caliper minimum deciduous trees

Information on specific trees and shrubs that would be acclimated to this area and follow xeriscape principles can be found through many resource publications and through landscape designers and nurseries. Whenever possible, native trees, shrubs, grasses and plants appropriate for your site and landscape plan can be selected to minimize water usage and insure hardy performance.

2. Garden Design Elements To avoid a barren looking yard during the dormant months, incorporate some of the following in the landscape design to enhance the landscape year round: ▪ Plants with fall color and winter interest ▪ Ornamental grasses to provide texture, color and shape that are not cut back in the fall ▪ Evergreen shrubs ▪ Trees and shrubs with colorful and/or textured bark ▪ Hardscape and decorative items like boulders, stone retaining walls, dry creek beds,

arches, sculptures, benches and other furniture, etc. to give shape and structure to the garden

3. Ground Cover Use of organic mulches, such as natural color bark, or river rock or low water usage ground cover plants on all soil areas between plants and trees will be required to limit erosion, retain moisture and provide a well kept appearance in planting zones.

2019 Supplement to Design Guidelines Rules and Regulations for S. Creek Homeowners Association

This Supplement provides updated information and clarification for the following specified Sections of the S. Creek Design Guidelines based on availability of newer materials and

technology not included in the original or amended document.

II. Design Guidelines, C. 1. Driveways and Private Lanes All driveways and private lanes shall be concrete. Colored stamped concrete or pavers may be used upon approval of the ACC. Asphalt will no longer be a paving option for use in Spring Creek. Driveways and private lanes shall be constructed to specifications which consider vehicle loads such as trash trucks and moving vans. Appropriate measures must be taken to contain edges and control erosion and washouts. II. Design Guidelines, C. 8. Basketball Backboards Standard size freestanding portable basketball hoops may be used in Spring Creek with approval of the ACC. They must be located on the owner's property in an area that will not impact an adjacent owner's property and should be stored out of sight from the street when not currently in use. All basketball hoops, nets, backboards, posts, bases, etc. must be mechanically sound, clean and well maintained. Permanently installed basketball backboards and hoops are only allowed in backyards and must be approved by the ACC as a landscape change.
