Introduction

The Department of Environmental Resources (DER) prepared the “Building and Grading Permits Guide” in cooperation with the Department of Public Works and Transportation (DPW&T), the Health Department’s Division of Environmental Health (DEH), the Maryland–National Capital Park and Planning Commission (M–NCPPC), the Prince George’s Soil Conservation District (SCD), and the Prince George’s County Economic Development Corporation (EDC). The purpose of this Guide is to explain the requirementsof the various codes and ordinances, and to facilitate the preparation of permit applications.

Requirements may change; therefore, this Guide should be used for general reference only. Frequent contact with the agencies mentioned above is encouraged.

Requirements of County Agencies

State or local laws may require permit applications to be approved by several County or State agencies. DER distributes copies of applications to all required reviewing agencies, with the exception of the Washington Suburban Sanitary Commission (WSSC) and the SCD. These agencies should be contacted directly. Incorporated towns may require additional permits and should also be contacted directly. Some homeowner associations have covenants requiring approval by an Association Board.

If required, an applicant must submit plans directly to the Health Department, Division of Environmental Health, located at 9201 Basil Court, Suite 318, Largo, Maryland 20774. For your convenience, a Health Department representative is available at the Permits Center located at 9400 Peppercorn Place, 6th Floor, Largo, Monday through Friday from 8:00 a.m. to 12:00 noon. If the property is served by private water (well) and/or sewer (septic system), please contact the Environmental Engineering Program at (301) 883–7681.

n PlanScreening is required on submittals for all new residential and commercial buildings, additions, and townhouses prior to entering the building permit application process. Plans are screened to determine if sufficient information has been included in the package for an engineering plans review to be conducted. Submittal packages that achieve a positive screening will be approved to enter the building permit application process. Packages that do not achieve a positive screening will be returned to the customer for correction.

n MechanicalPermits are not required for new single family homes, additions, or enlargements because installation of heating and cooling systems is covered under the original building permit. The Contractor shall complete a Heating, Ventilating Air Conditioning (HVAC) System Certification and submit it to the County Inspector.

Mechanical permits are required when replacing heating and cooling systems with a new heat pump or gas furnace, with or without ductwork, in existing single family homes.

n ElectricalPermits are required for all new construction and renovation work including the installation of burglar alarms, telephones, TV dish antennas, intercoms, background music systems, etc. Fire alarm systems must

n UseandOccupancyPermits issued by the Building Code Official are required for buildings, structures and land used and/or converted wholly or in part to any other use, occupant, owner or tenant.

Note: Under certain conditions, buildings, structures and land used for agricultural purposes, accessory buildings or home occupations may be excluded from this requirement. If you have further questions, please call M–NCPPC’s Zoning Information at (301) 952–3195 or (301) 952–3208.

Where noted by an asterisk (*), a Haul Road Permit or a Restoration Bond may be required.

1. Agriculture land management practices,

construction of agricultural structures*

and removal of cultivated sod, shrubs and trees for transplant as part of a regular commercial activity.

2. Stockpiling, with slopes at a natural angle of repose, of raw or processed sand, stone and gravel at concrete, asphalt and material processing plants and storage yards.

3. Refuse disposal areas of sanitary landfills* operated in accordance with requirements of Prince George’s County.

6. Grading as a maintenance measure, or for landscaping purposes on existing developed lots or parcels, provided that:a. The aggregate of area(s) affected, or for

earth bared at any one time does not exceed 5,000 square feet;

b. The grade change does not exceed 12 inches at any point and does not alter the drainage pattern;

c. All bared earth is promptly seeded, covered with sod, or otherwise effectively protected from erosive actions; and

d. No grading, filling, stockpiling or other earth moving operation is to be conducted within designated sewage disposal system recovery areas.

7. Grading and related earthwork, incidental to individual water wells and sewage disposal (septic) systems installed pursuant to a valid permit from the appropriate public authority (see a, b, and c from item #6).

8. Grading work related to surface mining operations* conducted in accordance with the provisions of a permit granted pursuant to the Annotated Code of Maryland, Environment, Title 15, Subtitle 8, Section 15-807-834. A Use and Occupancy Permit is required.

9. Logging or timber harvesting operations* on individually owned lots of ½ acre or less in all zones. A Use and Occupancy Permit is required.

To determine if a Letter of Exemption can be issued, the Environmental Planning Section requires a copy of a site plan that clearly shows the total area of all lots or parcels included in the permit application, the location and extent of all woodlands on the lots or parcels, and the limit of disturbance for all grading to be done. A project will qualify for a Letter of Exemption if any of the following conditions can be satisfied: 1. The total tract area of all lots or parcels included

in the permit is less than 40,000 square feet and there is not a previously approved TCP.

2. There are less than 10,000 square feet of existing woodlands on the lots or parcels and there is not a previously approved TCP.

3. Less than 5,000 square feet of woodland will be disturbed to complete the project and there is not

a previously approved TCP. This exemption is not permitted when a Preliminary Plat of Subdivision

will be needed for the subject lots or parcels. 4. The property is located in the Chesapeake Bay

Critical Area. Projects in the Critical Area have more stringent requirements that must be met.

5. The application is for logging on agriculturally assessed land when there is not a previously approved TCP.

If a project or activity cannot qualify for a Letter of Exemption based on the criteria noted above, the applicant will be required to submit a Forest Stand Delineation and Type II Tree Conservation Plan to the Environmental

Planning Section for review and approval prior to applying for a Grading Permit. The approved plan must be submitted as part of the permit application documents.

10. Logging or timber harvesting operations* not exceeding 5,000 square feet of forest removal or 5,000 square feet of disturbed area lots in all zones except the Open Space (O–S) or Residential–Agricultural (R–A) Zones that have an agricultural tax assessment, unless the forest removal would violate an existing approved tree conservation plan.

11. Logging or timber harvesting operations on lots in the Open Space (O–S) or Residential– Agricultural (R–A) Zones, and the Residential Estate (R–E) and Rural Residential (R–R) Zones that have an agricultural tax assessment, resulting in the removal of not more than 20,000 square feet of forest cover or 5,000 square feet of disturbed area, unless the disturbance would violate an existing tree conservation plan.

SCD reviews and approves logging permit applications, and the DPW&T Permits Center issues the logging permit. For more information about logging permits, call (301) 574–5162.

To obtain a Grading Permit on those sites that require SCD approval, a representative of the permittee, owner, developer or responsible party who will be actively involved with the project site development and construction must meet with the DPW&T Inspector in the field. When a separate Street Grade Permit, Temporary Entrance Permit, Haul Road Permit or Restoration Bond is required, it is the landowner’s responsibility to contact the DPW&T’s Office of Engineering at (301) 883–5710 for specific requirements.

and wildlife habitat by requiring site planning techniques and construction practices that prevent adverse effects on the land, trees and forests. This policy is expressed in the Prince George’s County Woodland Conservation and Tree Preservation Policy, which is also known as the “Woodland Conservation Ordinance.”

In 1989, the County’s Woodland Conservation Ordinance was enacted, and in 1991, the Maryland State Forest Conservation Act was signed into law. The State Act was modeled after the successful County ordinance and established a statewide forest conservation requirement. By working with property owners and developers through a negotiated tree preservation plan, setting site specific woodland conservation requirements and making commitments to use proper techniques for saving trees, the irreplaceable loss of woodland habitat has been significantly reduced in the County and the State.

Compliance with the Woodland Conservation Policy is addressed during the development review and permitting processes. When a Grading/Site Development Permit is applied for, the applicant must submit either an approved Type II Tree Conservation Plan (TCP) or a Letter of Exemption from the Woodland Conservation Ordinance.

Type II Tree Conservation Plans (TCP) and requests for Letters of Exemption are reviewed by M–NCPPC, Countywide Planning Division, Environmental Planning Section. M–NCPPC’s Countywide Planning Division is located at the County Administration Building, 4th Floor, Upper Marlboro and can be contacted at (301) 952–3650.

Who Needs a Permit?

The owner or an authorized agent shall obtain a Building Permit to erect, construct, enlarge, alter, move, improve, remove, connect, demolish, or raze any building or structure, or to change an exit or alter/install

any equipment regulated by the Building Code. Other permits may be required as described later.

It is the responsibility of property owners or their agents to contact the municipality or homeowner’s association where the property is located for their requirements. Every municipality and homeowner’s association is different and may have separate requirements regarding property under their jurisdiction.

Additional examples for which permits are required include: antennas (over 12 feet in height), carports, chair lifts, chimneys, commercial buildings, escalators, fences (in excess of four feet in height), fire damage repairs (a fire damage inspection and report are necessary prior to filing an application), fire alarm/fire sprinkler systems, fireplaces, flag poles, flood light poles, fuel pumps, fuel tanks, industrial buildings,

the Critical Area require an approved Conservation Plan and Conservation Agreement prior to issuance of a grading/site development or Building Permit. For information on preparing the Plan and Agreement, contact M–NCPPC’s Natural Resources Division at (301) 952–3650.

To determine whether or not a project is within the Critical Area, inquire at M–NCPPC’s Information Section on the 4th floor of the County Administration Building in Upper Marlboro at (301) 952–3195 or call DPW&T’s Office of Engineering (EISD) at (301) 883–5710.

Nontidal Wetland Protection ProgramAny activity in a nontidal

wetland or its 25-foot buffer will require a Nontidal Wetland Permit or a letter of authorization before a Grading or Building Permit can be issued. Contact the State of Maryland Department of the Environment, Nontidal Wetland and Waterways Division, at (410) 631–8094 for more information.

Historic Sites and DistrictsAny activity involving the land or exterior of

a building of a Historic Site or District including painting, repointing, siding, roofing, or any addition, demolition, new construction or signage requires a separate Historic Area Work Permit issued by the Historic Preservation Commission. For more information, contact M–NCPPC’s Historic Preservation Section of the Countywide Planning Division at (301) 952–3520.

Woodland Conservation ProgramIt is the policy of Prince George’s County

Government and the Prince George’s County Planning Board to conserve and protect trees, woodlands

lifting devices, observation stands, oil burners, porches, power elevators, residential dwellings, retaining walls (over two feet high), roadside stands, roofing shingles and sheathing, signs, swimming pools, wood-burning stoves, TV dish antennas and satellite dishes (over three feet in diameter).

A Building Permit is not required for ordinary repairs unless it includes:

1. Cutting away of any wall, partition or bearing support;

2. Removing, changing, or rearranging any part of a structure affecting the exit ways;

3. Any standpipe or any pipe for water supply, sewer, drainage, drain leader, gas, oil, waste vent or similar usage; or

4. Electric wiring and/or mechanical or other work that could affect the general public’s health and safety.

Ordinary repairs that do not require permits include replacement in kind. Some examples are: siding, roofing shingles, gutters, downspouts, driveways,* patios, awnings, private sidewalks, slabs, handrails, cabinets, windows, window screens, residential appliances, gas stoves, storm doors and windows, and re-circulating range hoods.

Provided that the construction does not result in a violation of the Code and the property is not located

Major Environmental Approvals

Stormwater ManagementState regulations require

new developments to provide appropriate stormwater management measures to control and manage stormwater run-off associated with land development. The stormwater management measures will help to maintain water quality standards and

pre-development run-off characteristics of the site.

Additions or modifications to existing single family detached dwellings and residential developments consisting of single family dwellings on lots of twoacres or more in size are exempt from most stormwatermanagement regulations unless located within the Chesapeake Bay Critical Area. However, Stormwater Concept Approval is required. Call DPW&T, Office of Engineering (EISD), at (301) 883–5710 for additional information on obtaining a Stormwater Concept Approval. Development of property located within the City of Bowie requires stormwater approval from the City and is exempt from County stormwater management requirements. Chesapeake Bay Critical AreaThe Prince George’s

County Chesapeake Bay Critical Area extends 1,000 feet landward from the head of the tide or tidal wetlands of the Patuxent, Potomac and Anacostia Rivers as shown on County zoning maps. Projects in

in the Chesapeake Bay Critical Area Overlay Zone or is a Historic Site, permits are also not required for the following:

1. Buildings on one-or-two family dwelling property with less than 150 square feet of floor space not designed or intended for occupation or habitation and limited to only one building per property.

2. Concrete and asphalt paving of less than 500 square feet, unless the area is to be utilized for vehicle parking.

3. Retrofit insulation.

4. Retaining walls not greater than two feet.

5. Fences not greater than four feet in height.

*DPW&T requires a permit for work on the driveway apron.

Permit Applications

Permit applications are submitted at the Permits Center located at 9400 Peppercorn Place, 6th Floor,Largo, Maryland. Permits Specialists enter the requireddata into the E-permits system as it is provided by the customer. The advantage of E-permits is that once a permit application has been created, instant recall of property identification data and permit status is available. A non-refundable filing fee is required.

The applicant must provide the following information on the application:

1. Land/tax account number, building address, town or area; or distance and direction from the nearest intersection or prominent landmark (for grading applications).

2. Lot and block number, liber and folio from a record plot plan or from the Land Records Office or Tax Assessor’s Office.

3. Subdivision name if the property is located within a subdivided tract.

4. Names, addresses and telephone numbers of the owner, occupant, applicant, architect, engineer and contractor. Complete information including zip codes and area codes must be included with the address. Post Office boxes cannot be

sediment control. An approval from SCD is required when the disturbed area exceeds 5,000 square feet. Small pond approval is required pursuant to State law. All County required stormwater management ponds

will be reviewed and processed through DPW&T. Logging Permits are issued by SCD.

WashingtonSuburbanSanitaryCommission(WSSC) authorizes the allocation ofpublic water and sewer systems with the exceptionof private or city controlledsystems; issues Plumbing,Natural Gas and Liquid Propane Permits; and inspects the installation for compliance with WSSC plumbing and gas fitting regulations and house connection authorizations.

DepartmentofEnvironmentalResources,PermitsandReviewGroup(PRG)reviews plans for compliance with fire protection, electrical, mechanical and energy codes, accessibility codes, structural design, limited stormwater requirements and grading.

PRG also issues permits for building, electrical, signs, mechanical, and Use and Occupancy Permits.

accepted. A contact person’s name, address and telephone number should be included. The company or corporation officer must also be included.

5. Intended use and prior use.

6. Estimated construction cost (for Building and Grading Permits).

7. Details regarding the structure: dimension of the structure, height, depth, width, number of floors and floor area.

8. Utilities information.

9. Documentation showing approval from the local public water and sewer utility or the Health Department if it is a private well and septic system.

10. Site area, disturbed area and number of parking spaces.

11. License information. a. New Home Construction — Contractors

must be licensed with the Maryland Attorney General, Home Builder Registration Unit of the Consumer Protection Division and the Prince George’s County Business License Office, prior to the issuance of Building Permits. Allow four weeks for approval. Individuals building their own homes are required to be licensed by the Prince George’s County Business License Office and have a County Homeowner’s Waiver.

b. Home Improvement — For home improvements done by a contractor and not the homeowner, the contractor’s Home Improvement License number, issued by the Maryland Home Improvement Commission, must be included on the application. A copy of the Home Improvement License must be provided.

DPW&T also issues permits for all utility construction and paving work affecting public rights-of-way.

All building permit applications are referred toDPW&T for determination of requirements to complywith the County Road, Grading and StormwaterOrdinances. Building Permits may be withheld untilDPW&T requirements are met. Those requirementsmay include construction, extension or improvementof adjacent roads or streets; recordation of easements;construction of standard entrances; the preparation of detailed plans; payment of street construction,entrance or other permit fees; and the posting of bonds for all work in the public rights-of-way, includingcertain storm drain construction and the issuance ofthe DPW&T permit. In some cases, a Restoration Bond may be required or a letter of responsibility may be required to be signed by the owner of the property.

Maryland–NationalCapitalParkandPlanningCommission(M–NCPPC) reviews plans for zoning regulations, parking, subdivision plats, special exceptions, subdivision ordinances, departures, variances, nonconforming uses, streets and highways, Historic Site/District preservation, zoning conditions, landscaping, tree preservation, conformance with previously approved site plans, signs, private right-of-way access authorization and assignment or verification of property addresses. M–NCPPC also acts as the conduit for review of permit applications by the Maryland State Highway Administration (SHA) concerning the need for State permits for connection to or work within public rights-of-way of the State, through authority of State law, and determines the need for payment of School Impact Fees.

PrinceGeorge’sSoilConservationDistrict(SCD) reviews plans for grading, erosion and

c. Electrical Permits — Issued only to applicants who are Licensed Master Electricians, Limited Master Electricians and selected classes of heating, ventilation and air conditioning mechanics that are licensed through the Business License Office. However, a homeowner may obtain his/her own Electrical Permit by completing a Homeowner’s Certification and Hold Harmless Agreement Form.

d. Sprinkler Permits — All new single-family dwellings require automatic sprinkler protection. Additions to homes with existing sprinkler systems must also have sprinkler protection. Permits are issued only to individuals licensed by the State of Maryland to do sprinkler installation.

12. The Homeowner Improvement Authorization Letter — Authorizes an individual to apply for a permit on the homeowner’s behalf. This letter does not authorize the individual applying for the permit to perform the scope of work. The licensed contractor or the homeowner named on the permit as the contractor is permitted to perform the scope of work at the address specified.

Applications are reviewed promptly by the appropriate agencies. A non-refundable filing fee is required. Agency personnel will communicate directly with the applicant concerning any noncompliance with regulations or deficiencies in the plans. Each agency will require compliance within a specified time period. An application is considered abandoned if there are still noncompliance issues after a specified time period.

Permit Review Functions of Agencies

HealthDepartment,DivisionofEnvironmentalHealth(DEH) reviews plans for private/community well and septic systems, all food facilities, public swimming pools and spas, solid waste disposal methods (landfills and rubblefills) and institutional facilities (nursing homes). DEH reviews and comments to M–NCPPC on the development of new subdivisions and requires preliminary review of grading for limit of disturbance (LOD) in those subdivisions to be developed on septic systems. DEH performs demolition inspections preliminary to issuance of Raze Permits. Referrals to the Maryland Department of the Environment (MDE) are required for businesses installing sources of air pollution, such as gasoline storage tanks, printing presses, degreasing operations, asphalt plants and other major combustion sources. DEH also issues separate permits relating to these requirements. Kennels and animal hospitals are regulated by the Zoonosis Program of the Health Department at the Cheverly Clinic.

A copy is to beprovided with the permit application with any applicable updates to reflect resulting design modifications.

Processing Changes to Applications/Permits(Amendments/Revisions)

Changes to applications on file prior to issuance of a permit are filed as amendments. Changes to a permit that has been issued are filed as revisions.

All changes are filed in the same manner as the permit application. A completed transmittal sheet describing the nature of the change is required for all changes.

Changes are reviewed and approved by the agencies affected by the change. The change may result in the need for a review by agencies that may have already approved the plan. Most changes require an in-depth review. However, some minor changes (i.e., change of contractor) can be walked-through, providing all involved agencies agree.

Fees for amendments and/or revisions are contingent upon the extent of plan review with a minimum charge of $15.00 ($10.00 if M–NCPPC review is not required).

Electrical Permit Applications

Electrical Permits are required for all new construction and renovation work including the alteration or extension of existing circuits. The following rules apply to Electrical Permits:

1. The permit must identify all work including burglar alarms, telephone equipment, TV dish antennas over three feet, intercoms, background music systems, etc.

2. Electrical Permits for shell construction should be applied for by floor and wings, if applicable, with service equipment identified on the appropriate Floor Permit.

3. Multi-occupancy residential construction requires a separate Electrical Permit for each residential unit. The main service for the building and the house panel should be on separate permits to facilitate inspections.

4. Fire alarms must be listed on a separate permit application without other electrical equipment,

5. All Use Groups with an estimated construction cost of $5,000,000 or more;

6. Any Use Groups when deemed necessary by the Fire Code Official due to complexity or scope of the design;

7. Any automatic fire suppression, fire detection, fire alarm or smoke management system shop drawings when deemed necessary by the Fire Code Official due to the complexity or scope of the design; and

8. Any building design for a Use Group when deemed necessary by the Fire Code Official due to submission of drawings containing extensive or repeated code deficiencies that create an undue burden upon the review process.

The intent of this requirement is to minimize Fire Code design deficiencies during the design phase of a building. The plans must be reviewed and evaluated by a Fire Protection Engineer whose report is prepared to advise the Architect of any necessary changes, corrections, and/or alternative measures for Code conformance. The Architect is expected to incorporate these corrections prior to submission for a permit.

The following information lists the minimum requirements that must be addressed by the Fire Protection Design Evaluation.

since the approval of Electrical Permits for fire alarms has a different approval procedure than other Electrical Permits. Upon completion of the work, fire alarm systems must be inspected and certified by a Professional Engineer or authorized County personnel.

5. Electrical Permit applications must be complete. The land tax account number must be entered before the permit can be processed. This information appears on all issued Building Permits and should be available from the general contractor or from the owner’s tax bill when there is no Building Permit for the address.

Prince George’s County has implemented a revised and simplified procedure for processing commercial walk-through Electrical Permits. The revised process will save time for both the contractor and the Permits and Review Group. Application(s) not requiring walk-through

processing may be left for pick-up on the second business day after receipt of the application(s).

Guidelines for Fire ProtectionEngineering Design Evaluation

Guidelines for Fire Protection Engineering Design Evaluation are contained in Section 106.3.4.3, 2003 Amended International Building Code (IBC).

All designs for new construction work, alterations, additions or modification work for buildings of the Use Groups listed in this section shall be evaluated by a Fire Protection Engineer who is a Registered Professional Engineer in the State of Maryland. An analysis bearing the Engineer’s signature and seal shall be submitted. This analysis should demonstrate design compliance with the applicable code requirements concerning egress, fire protection systems, construction type in accordance with Table 602, the fire endurance ratings of structural elements contained in Table 503, applicable provisions of Chapter 4, and any applicable National Fire Protection Association codes and standards. The analysis may be contained in a separate report, or may be included as a portion of the design drawings, and must be submitted with the plans accompanying the application for a Building Permit for the following:

1. Use Group “A,” Assembly, with an occupant load of 1,000 persons or more;

2. Use Group “H” High Hazard;

3. Use Groups “I-2 and I-3” Institutional;

4. Use Group “M” all covered malls and open malls exceeding 30,000 square feet in gross area;

Permit Walk-Through Procedures

The walk-through process has been designed to allow an application to be reviewed more expeditiously by all agencies. The permit is issued once all of the reviewing agencies’ requirements have been met.

The walk-through system is available Monday through Friday, from 8:30 a.m. to 12:00 noon and 1:00 p.m. to 3:00 p.m., for Residential Permits for single family dwelling units or less (additions, alterations, etc.). This provision has been amended to include spot builders who are building one house at a time or multiple houses on noncontiguous lots and are not on a production scale. Proof of water/sewer availability is required prior to walk-through of a single family dwelling. The processing and issuance of a Driveway Entrance Permit or the posting of a Restoration Bond may be required by DPW&T prior to the issuance of some permits.

Commercial Tenant Permits with the accompanying Use and Occupancy Permit for Fire, Electrical and Mechanical Review (when required) can also be walked through Tuesdays and Thursdays from 8:30 a.m. to 3:00 p.m.

Applications for Use and Occupancy Permits without construction can be walked-through Monday through Friday from 8:30 a.m. to 12:00 noon and 1:00 p.m. to 3:00 p.m. This procedure does not apply to buildings erected prior to 1971, properties served by private well and/or septic systems site and service facilities, or revisions to proposed use of original buildings.

• Concealing or closing-in walls/ceilings;

• Changing electrical contractors (electrical inspections);

• Occupying the structure; • Erecting fencing; and • Any work occurring in the public rights-of-way.

Call the AIRIS number to arrange for an inspection after completion of the following: • Installing tree protection devices if required by

the Woodland Tree Conservation Plan — Type II; • Installing

temporary sediment and erosion control facilities;

•Stripping vegetative cover;

• Stockpiling topsoil, rough grading and/or final grading;

• Permanent drainage and erosion control facilities including ground cover and planting; and

• All work on the permit.

All approved plans and permits must be available on site for all inspections. An adult representative is requested to be on site for all inspections. If this is not possible, and the construction is accessible without entering a fenced area or a dwelling, the plans and permits may be placed on the front door with instructions for what is to be inspected. If alternative arrangements are requested, the inspector may be contacted at (301) 883–3820 between 7:00 a.m. and 8:00 a.m.

Issuance of Straight Use and Occupancy Permits

Straight Use and Occupancy Permits are Non-Construction Permits that denote a change of name, owner, occupant/tenant or use of an existing business or building. If new construction has been undertaken, the Use and Occupancy Permit should be made part of the Construction (C or CG) Permit.

These permit applications are applied for at the Permits Center and sent to M–NCPPC for approval. The permit application is then returned to the Permits Center where the Use and Occupancy Permit file is created and forwarded to the Property Standards Group (PSG) for issuance. PSG, upon request of the applicant, will schedule an on-site inspection to meet with the applicant once other agency inspections are completed. When all requirements are fulfilled, the Use and Occupancy Permit is issued by the Property Standards Inspector. This permit must be displayed at all times on the premises.

LIG is unable to schedule inspections in advance. Inspection requests are received each day and scheduled accordingly. The Inspector cannot usually predict his arrival time due to the variable nature of each inspection. If more information is desired, the customer may contact the Inspector between 7:00 a.m. and 8:00 a.m. by calling (301) 883–3820.

Residential inspections are completed by a combination of Inspectors. These Inspectors will make electrical, mechanical and sprinkler rough-in inspections during the framing inspection. Plumbing inspections are conducted by WSSC and must be completed prior to arranging the framing inspection with the County. The third-party fire protection inspection for the sprinkler system must also be completed prior to arranging for final inspection.

You must request an inspection before doing any of the following:

• Installing a stormwater management system and/or storm drain(s);

• Initiating clearing or grading operations;

• Pouring concrete for footings, slabs and retaining walls;

The final inspection cannot be made until all required agencies have signed off. This may include WSSC, DEH, Fire/EMS Department, DPW&T and DER’ s Electrical Unit.

It is to your benefit to adhere to the inspection requirements stated on your permit. Failure to do so may delay your construction.

Please note that inspections cannot be requested until 24 hours after the permit is issued. Inspections by Construction Standards Inspectors and DPW&T Inspectors can be made by calling the Automated Inspection Request and Information System (AIRIS), with a touch-tone telephone only, at (301) 883–5390 between 7:00 a.m. and 1:00 p.m., Monday through Friday (see the Scheduling Inspections sheet for instructions). Applicants should follow the inspection requirements on the “Notice” information sheet provided at the time of application for permit. This will avoid delays in the issuance of the Use and Occupancy Permit.

Information regarding site development, grading, stormwater management, and street construction inspections can be obtained at DPW&T’s Office of Engineering, Engineering and Inspection Service Division (EISD), at (301) 883–5710.

To ensure occupancy at the earliest date, call the inspection numbers indicated on the Scheduling Inspections sheet to obtain final inspection when the work is completed. The final inspection cannot be made until all required agencies have signed off. This may include WSSC, DEH, Fire/EMS Department, DPW&T and DER’ s Electrical Unit.

It is to your benefit to adhere to the inspection requirements stated on your permit. Failure to do so may delay your construction.

Please note that inspections cannot be requested until 24 hours after the permit is issued. Inspections by Construction Standards Inspectors and DPW&T Inspectors can be made by calling the Automated Inspection Request and Information System (AIRIS), with a touch-tone telephone only, at (301) 883–5390 between 7:00 a.m. and 1:00 p.m., Monday through Friday (see the Scheduling Inspections sheet for instructions). Issuance of Straight Use and Occupancy Permits

Straight Use and Occupancy Permits are Non-Construction Permits that denote a change of name, owner, occupant/tenant or use of an existing business or building. If new construction has been undertaken, the Use and Occupancy Permit should be made part of the Construction (C or CG) Permit.

These permit applications are applied for at the Permits Center and sent to M–NCPPC for approval. The permit application is then returned to the Permits Center where the Use and Occupancy Permit file is created and forwarded to the Property Standards Group (PSG) for issuance. PSG, upon request of the applicant, will schedule an on-site inspection to meet with the applicant once other agency inspections are completed. When all requirements are fulfilled, the Use and Occupancy Permit is issued by the Property Standards Inspector. This permit must be displayed at all times on the premises.

you may schedule inspections with the Construction Standards Inspectors by calling (301) 883–3820 between 7:00 a.m. and 3:30 p.m., Monday through Friday. For the DPW&T Inspector, you may call (301) 883–5710 between 7:30 a.m. and 4:00 p.m. Commercial electrical inspection requests may require 72 hours advance notice. For inspections in the City of Laurel, please call (301) 725–5306, ext. 238.

LIG is unable to schedule inspections in advance. Inspection requests are received each day and scheduled accordingly. The Inspector cannot usually predict his arrival time due to the variable nature of each inspection. If more information is desired, the customer may contact the Inspector between 7:00 a.m. and 8:00 a.m. by calling (301) 883–3820.

Residential inspections are completed by a combination of Inspectors. These Inspectors will make electrical, mechanical and sprinkler rough-in inspections during the framing inspection. Plumbing inspections are conducted by WSSC and must be completed prior to arranging the framing inspection with the County. The third-party fire protection inspection for the sprinkler system must also be completed prior to arranging for final inspection.

You must request an inspection before doing any of the following:

• Installing a stormwater management system and/or storm drain(s);

• Initiating clearing or grading operations;

• Pouring concrete for footings, slabs and retaining walls;

• Concealing or closing-in walls/ceilings;

• Changing electrical contractors (electrical inspections);

• Occupying the structure; • Erecting fencing; and • Any work occurring in the public rights-of-way.

Call the AIRIS number to arrange for an inspection after completion of the following: • Installing tree protection devices if required by

the Woodland Tree Conservation Plan — Type II; • Installing

temporary sediment and erosion control facilities;

•Stripping vegetative cover;

• Stockpiling topsoil, rough grading and/or final grading;

• Permanent drainage and erosion control facilities including ground cover and planting; and

• All work on the permit.

All approved plans and permits must be available on site for all inspections. An adult representative is requested to be on site for all inspections. If this is not possible, and the construction is accessible without entering a fenced area or a dwelling, the plans and permits may be placed on the front door with instructions for what is to be inspected. If alternative arrangements are requested, the inspector may be contacted at (301) 883–3820 between 7:00 a.m. and 8:00 a.m.

Sign Permits may be walked through on any regular business day.

Properties located in the Chesapeake Bay Critical Area, Historic Sites and applications determined by the reviewing agency to be inappropriate for the walk-through process, must go through the regular process.

Issuance of Permits

The applicant must return to the Permits Center located at 9400 Peppercorn Place, 6th Floor, Largo, Maryland to receive the permit. Prior to issuance, all permit fees must be paid to the Cashier. The applicant will be advised if it is necessary to post bonds prior to the issuance of a permit.

Guidelines for Fire ProtectionEngineering Design Evaluation

Guidelines for Fire Protection Engineering Design Evaluation are contained in Section 106.3.4.3, 2003 Amended International Building Code (IBC).

All designs for new construction work, alterations, additions or modification work for buildings of the Use Groups listed in this section shall be evaluated by a Fire Protection Engineer who is a Registered Professional Engineer in the State of Maryland. An analysis bearing the Engineer’s signature and seal shall be submitted. This analysis should demonstrate design compliance with the applicable code requirements concerning egress, fire protection systems, construction type in accordance with Table 602, the fire endurance ratings of structural elements contained in Table 503, applicable provisions of Chapter 4, and any applicable National Fire Protection Association codes and standards. The analysis may be contained in a separate report, or may be included as a portion of the design drawings, and must be submitted with the plans accompanying the application for a Building Permit for the following:

1. Use Group “A,” Assembly, with an occupant load of 1,000 persons or more;

2. Use Group “H” High Hazard;

3. Use Groups “I-2 and I-3” Institutional;

4. Use Group “M” all covered malls and open malls exceeding 30,000 square feet in gross area;

Permit Walk-Through Procedures

The walk-through process has been designed to allow an application to be reviewed more expeditiously by all agencies. The permit is issued once all of the reviewing agencies’ requirements have been met.

The walk-through system is available Monday through Friday, from 8:30 a.m. to 12:00 noon and 1:00 p.m. to 3:00 p.m., for Residential Permits for single family dwelling units or less (additions, alterations, etc.). This provision has been amended to include spot builders who are building one house at a time or multiple houses on noncontiguous lots and are not on a production scale. Proof of water/sewer availability is required prior to walk-through of a single family dwelling. The processing and issuance of a Driveway Entrance Permit or the posting of a Restoration Bond may be required by DPW&T prior to the issuance of some permits.

Commercial Tenant Permits with the accompanying Use and Occupancy Permit for Fire, Electrical and Mechanical Review (when required) can also be walked through Tuesdays and Thursdays from 8:30 a.m. to 3:00 p.m.

Applications for Use and Occupancy Permits without construction can be walked-through Monday through Friday from 8:30 a.m. to 12:00 noon and 1:00 p.m. to 3:00 p.m. This procedure does not apply to buildings erected prior to 1971, properties served by private well and/or septic systems site and service facilities, or revisions to proposed use of original buildings.

5. All Use Groups with an estimated construction cost of $5,000,000 or more;

6. Any Use Groups when deemed necessary by the Fire Code Official due to complexity or scope of the design;

7. Any automatic fire suppression, fire detection, fire alarm or smoke management system shop drawings when deemed necessary by the Fire Code Official due to the complexity or scope of the design; and

8. Any building design for a Use Group when deemed necessary by the Fire Code Official due to submission of drawings containing extensive or repeated code deficiencies that create an undue burden upon the review process.

The intent of this requirement is to minimize Fire Code design deficiencies during the design phase of a building. The plans must be reviewed and evaluated by a Fire Protection Engineer whose report is prepared to advise the Architect of any necessary changes, corrections, and/or alternative measures for Code conformance. The Architect is expected to incorporate these corrections prior to submission for a permit.

The following information lists the minimum requirements that must be addressed by the Fire Protection Design Evaluation.

since the approval of Electrical Permits for fire alarms has a different approval procedure than other Electrical Permits. Upon completion of the work, fire alarm systems must be inspected and certified by a Professional Engineer or authorized County personnel.

5. Electrical Permit applications must be complete. The land tax account number must be entered before the permit can be processed. This information appears on all issued Building Permits and should be available from the general contractor or from the owner’s tax bill when there is no Building Permit for the address.

Prince George’s County has implemented a revised and simplified procedure for processing commercial walk-through Electrical Permits. The revised process will save time for both the contractor and the Permits and Review Group. Application(s) not requiring walk-through

processing may be left for pick-up on the second business day after receipt of the application(s).

Electrical Permit Applications

Electrical Permits are required for all new construction and renovation work including the alteration or extension of existing circuits. The following rules apply to Electrical Permits:

1. The permit must identify all work including burglar alarms, telephone equipment, TV dish antennas over three feet, intercoms, background music systems, etc.

2. Electrical Permits for shell construction should be applied for by floor and wings, if applicable, with service equipment identified on the appropriate Floor Permit.

3. Multi-occupancy residential construction requires a separate Electrical Permit for each residential unit. The main service for the building and the house panel should be on separate permits to facilitate inspections.

4. Fire alarms must be listed on a separate permit application without other electrical equipment,

The Fire Protection Design Evaluation report must cite any Fire Code-related design deficiencies that have been determined, the Code section(s) applicable, and a recommended correction to the design to bringit into Code compliance. A copy is to beprovided with the permit application with any applicable updates to reflect resulting design modifications.

Processing Changes to Applications/Permits(Amendments/Revisions)

Changes to applications on file prior to issuance of a permit are filed as amendments. Changes to a permit that has been issued are filed as revisions.

All changes are filed in the same manner as the permit application. A completed transmittal sheet describing the nature of the change is required for all changes.

Changes are reviewed and approved by the agencies affected by the change. The change may result in the need for a review by agencies that may have already approved the plan. Most changes require an in-depth review. However, some minor changes (i.e., change of contractor) can be walked-through, providing all involved agencies agree.

Fees for amendments and/or revisions are contingent upon the extent of plan review with a minimum charge of $15.00 ($10.00 if M–NCPPC review is not required).

c. Electrical Permits — Issued only to applicants who are Licensed Master Electricians, Limited Master Electricians and selected classes of heating, ventilation and air conditioning mechanics that are licensed through the Business License Office. However, a homeowner may obtain his/her own Electrical Permit by completing a Homeowner’s Certification and Hold Harmless Agreement Form.

d. Sprinkler Permits — All new single-family dwellings require automatic sprinkler protection. Additions to homes with existing sprinkler systems must also have sprinkler protection. Permits are issued only to individuals licensed by the State of Maryland to do sprinkler installation.

12. The Homeowner Improvement Authorization Letter — Authorizes an individual to apply for a permit on the homeowner’s behalf. This letter does not authorize the individual applying for the permit to perform the scope of work. The licensed contractor or the homeowner named on the permit as the contractor is permitted to perform the scope of work at the address specified.

Applications are reviewed promptly by the appropriate agencies. A non-refundable filing fee is required. Agency personnel will communicate directly with the applicant concerning any noncompliance with regulations or deficiencies in the plans. Each agency will require compliance within a specified time period. An application is considered abandoned if there are still noncompliance issues after a specified time period.

Permit Review Functions of Agencies

HealthDepartment,DivisionofEnvironmentalHealth(DEH) reviews plans for private/community well and septic systems, all food facilities, public swimming pools and spas, solid waste disposal methods (landfills and rubblefills) and institutional facilities (nursing homes). DEH reviews and comments to M–NCPPC on the development of new subdivisions and requires preliminary review of grading for limit of disturbance (LOD) in those subdivisions to be developed on septic systems. DEH performs demolition inspections preliminary to issuance of Raze Permits. Referrals to the Maryland Department of the Environment (MDE) are required for businesses installing sources of air pollution, such as gasoline storage tanks, printing presses, degreasing operations, asphalt plants and other major combustion sources. DEH also issues separate permits relating to these requirements. Kennels and animal hospitals are regulated by the Zoonosis Program of the Health Department at the Cheverly Clinic.

DepartmentofPublicWorksandTransportation(DPW&T) reviews plans and issues permits for construction of new streets; modification or improvements of existing roads and streets; construction of temporary entrances, haul roads and driveways entering

public roads and streets; creation or extinguishment of public rights-of-way; and site development, grading, stormwater and floodplain delineation.

9. Documentation showing approval from the local public water and sewer utility or the Health Department if it is a private well and septic system.

10. Site area, disturbed area and number of parking spaces.

11. License information. a. New Home Construction — Contractors

must be licensed with the Maryland Attorney General, Home Builder Registration Unit of the Consumer Protection Division and the Prince George’s County Business License Office, prior to the issuance of Building Permits. Allow four weeks for approval. Individuals building their own homes are required to be licensed by the Prince George’s County Business License Office and have a County Homeowner’s Waiver.

b. Home Improvement — For home improvements done by a contractor and not the homeowner, the contractor’s Home Improvement License number, issued by the Maryland Home Improvement Commission, must be included on the application. A copy of the Home Improvement License must be provided.

DPW&T also issues permits for all utility construction and paving work affecting public rights-of-way.

All building permit applications are referred toDPW&T for determination of requirements to complywith the County Road, Grading and StormwaterOrdinances. Building Permits may be withheld untilDPW&T requirements are met. Those requirementsmay include construction, extension or improvementof adjacent roads or streets; recordation of easements;construction of standard entrances; the preparation of detailed plans; payment of street construction,entrance or other permit fees; and the posting of bonds for all work in the public rights-of-way, includingcertain storm drain construction and the issuance ofthe DPW&T permit. In some cases, a Restoration Bond may be required or a letter of responsibility may be required to be signed by the owner of the property.

Maryland–NationalCapitalParkandPlanningCommission(M–NCPPC) reviews plans for zoning regulations, parking, subdivision plats, special exceptions, subdivision ordinances, departures, variances, nonconforming uses, streets and highways, Historic Site/District preservation, zoning conditions, landscaping, tree preservation, conformance with previously approved site plans, signs, private right-of-way access authorization and assignment or verification of property addresses. M–NCPPC also acts as the conduit for review of permit applications by the Maryland State Highway Administration (SHA) concerning the need for State permits for connection to or work within public rights-of-way of the State, through authority of State law, and determines the need for payment of School Impact Fees.

Permit Applications

Permit applications are submitted at the Permits Center located at 9400 Peppercorn Place, 6th Floor,Largo, Maryland. Permits Specialists enter the requireddata into the E-permits system as it is provided by the customer. The advantage of E-permits is that once a permit application has been created, instant recall of property identification data and permit status is available. A non-refundable filing fee is required.

The applicant must provide the following information on the application:

1. Land/tax account number, building address, town or area; or distance and direction from the nearest intersection or prominent landmark (for grading applications).

2. Lot and block number, liber and folio from a record plot plan or from the Land Records Office or Tax Assessor’s Office.

3. Subdivision name if the property is located within a subdivided tract.

4. Names, addresses and telephone numbers of the owner, occupant, applicant, architect, engineer and contractor. Complete information including zip codes and area codes must be included with the address. Post Office boxes cannot be

sediment control. An approval from SCD is required when the disturbed area exceeds 5,000 square feet. Small pond approval is required pursuant to State law. All County required stormwater management ponds

will be reviewed and processed through DPW&T. Logging Permits are issued by SCD.

WashingtonSuburbanSanitaryCommission(WSSC) authorizes the allocation ofpublic water and sewer systems with the exceptionof private or city controlledsystems; issues Plumbing,Natural Gas and Liquid Propane Permits; and inspects the installation for compliance with WSSC plumbing and gas fitting regulations and house connection authorizations.

DepartmentofEnvironmentalResources,PermitsandReviewGroup(PRG)reviews plans for compliance with fire protection, electrical, mechanical and energy codes, accessibility codes, structural design, limited stormwater requirements and grading.

PRG also issues permits for building, electrical, signs, mechanical, and Use and Occupancy Permits.

in the Chesapeake Bay Critical Area Overlay Zone or is a Historic Site, permits are also not required for the following:

1. Buildings on one-or-two family dwelling property with less than 150 square feet of floor space not designed or intended for occupation or habitation and limited to only one building per property.

2. Concrete and asphalt paving of less than 500 square feet, unless the area is to be utilized for vehicle parking.

3. Retrofit insulation.

4. Retaining walls not greater than two feet.

5. Fences not greater than four feet in height.

*DPW&T requires a permit for work on the driveway apron.

lifting devices, observation stands, oil burners, porches, power elevators, residential dwellings, retaining walls (over two feet high), roadside stands, roofing shingles and sheathing, signs, swimming pools, wood-burning stoves, TV dish antennas and satellite dishes (over three feet in diameter).

A Building Permit is not required for ordinary repairs unless it includes:

1. Cutting away of any wall, partition or bearing support;

2. Removing, changing, or rearranging any part of a structure affecting the exit ways;

3. Any standpipe or any pipe for water supply, sewer, drainage, drain leader, gas, oil, waste vent or similar usage; or

4. Electric wiring and/or mechanical or other work that could affect the general public’s health and safety.

Ordinary repairs that do not require permits include replacement in kind. Some examples are: siding, roofing shingles, gutters, downspouts, driveways,* patios, awnings, private sidewalks, slabs, handrails, cabinets, windows, window screens, residential appliances, gas stoves, storm doors and windows, and re-circulating range hoods.

Provided that the construction does not result in a violation of the Code and the property is not located

Major Environmental Approvals

Stormwater ManagementState regulations require

new developments to provide appropriate stormwater management measures to control and manage stormwater run-off associated with land development. The stormwater management measures will help to maintain water quality standards and

pre-development run-off characteristics of the site.

Additions or modifications to existing single family detached dwellings and residential developments consisting of single family dwellings on lots of twoacres or more in size are exempt from most stormwatermanagement regulations unless located within the Chesapeake Bay Critical Area. However, Stormwater Concept Approval is required. Call DPW&T, Office of Engineering (EISD), at (301) 883–5710 for additional information on obtaining a Stormwater Concept Approval. Development of property located within the City of Bowie requires stormwater approval from the City and is exempt from County stormwater management requirements. Call the City of Bowie, Department of Public Works Engineering Supervisor, at (301) 805–7975.

Chesapeake Bay Critical AreaThe Prince George’s

County Chesapeake Bay Critical Area extends 1,000 feet landward from the head of the tide or tidal wetlands of the Patuxent, Potomac and Anacostia Rivers as shown on County zoning maps. Projects in

Who Needs a Permit?

The owner or an authorized agent shall obtain a Building Permit to erect, construct, enlarge, alter, move, improve, remove, connect, demolish, or raze any building or structure, or to change an exit or alter/install

any equipment regulated by the Building Code. Other permits may be required as described later.

It is the responsibility of property owners or their agents to contact the municipality or homeowner’s association where the property is located for their requirements. Every municipality and homeowner’s association is different and may have separate requirements regarding property under their jurisdiction.

Additional examples for which permits are required include: antennas (over 12 feet in height), carports, chair lifts, chimneys, commercial buildings, escalators, fences (in excess of four feet in height), fire damage repairs (a fire damage inspection and report are necessary prior to filing an application), fire alarm/fire sprinkler systems, fireplaces, flag poles, flood light poles, fuel pumps, fuel tanks, industrial buildings,

the Critical Area require an approved Conservation Plan and Conservation Agreement prior to issuance of a grading/site development or Building Permit. For information on preparing the Plan and Agreement, contact M–NCPPC’s Natural Resources Division at (301) 952–3650.

Nontidal Wetland Protection ProgramAny activity in a nontidal

wetland or its 25-foot buffer will require a Nontidal Wetland Permit or a letter of authorization before a Grading or Building Permit can be issued. Contact the State of Maryland Department of the Environment, Nontidal Wetland and Waterways Division, at (410) 631–8094 for more information.

Historic Sites and DistrictsAny activity involving the land or exterior of

a building of a Historic Site or District including painting, repointing, siding, roofing, or any addition, demolition, new construction or signage requires a separate Historic Area Work Permit issued by the Historic Preservation Commission. For more information, contact M–NCPPC’s Historic Preservation Section of the Countywide Planning Division at (301) 952–3520.

Woodland Conservation ProgramIt is the policy of Prince George’s County

Government and the Prince George’s County Planning Board to conserve and protect trees, woodlands

Logging or timber harvesting operations* not exceeding 5,000 square feet of forest removal or 5,000 square feet of disturbed area lots in all zones except the Open Space (O–S) or Residential–Agricultural (R–A) Zones that have an agricultural tax assessment, unless the forest removal would violate an existing approved tree conservation plan.

11. Logging or timber harvesting operations on lots in the Open Space (O–S) or Residential– Agricultural (R–A) Zones, and the Residential Estate (R–E) and Rural Residential (R–R) Zones that have an agricultural tax assessment, resulting in the removal of not more than 20,000 square feet of forest cover or 5,000 square feet of disturbed area, unless the disturbance would violate an existing tree conservation plan.

SCD reviews and approves logging permit applications, and the DPW&T Permits Center issues the logging permit. For more information about logging permits, call (301) 574–5162.

To obtain a Grading Permit on those sites that require SCD approval, a representative of the permittee, owner, developer or responsible party who will be actively involved with the project site development and construction must meet with the DPW&T Inspector in the field. When a separate Street Grade Permit, Temporary Entrance Permit, Haul Road Permit or Restoration Bond is required, it is the landowner’s responsibility to contact the DPW&T’s Office of Engineering at (301) 883–5710 for specific requirements.

and wildlife habitat by requiring site planning techniques and construction practices that prevent adverse effects on the land, trees and forests. This policy is expressed in the Prince George’s County Woodland Conservation and Tree Preservation Policy, which is also known as the “Woodland Conservation Ordinance.”

In 1989, the County’s Woodland Conservation Ordinance was enacted, and in 1991, the Maryland State Forest Conservation Act was signed into law. The State Act was modeled after the successful County ordinance and established a statewide forest conservation requirement. By working with property owners and developers through a negotiated tree preservation plan, setting site specific woodland conservation requirements and making commitments to use proper techniques for saving trees, the irreplaceable loss of woodland habitat has been significantly reduced in the County and the State.

Compliance with the Woodland Conservation Policy is addressed during the development review and permitting processes. When a Grading/Site Development Permit is applied for, the applicant must submit either an approved Type II Tree Conservation Plan (TCP) or a Letter of Exemption from the Woodland Conservation Ordinance.

Type II Tree Conservation Plans (TCP) and requests for Letters of Exemption are reviewed by M–NCPPC, Countywide Planning Division, Environmental Planning Section. 6. Grading as a maintenance measure, or for landscaping purposes on existing developed lots or parcels, provided that:a. The aggregate of area(s) affected, or for

earth bared at any one time does not exceed 5,000 square feet;

b. The grade change does not exceed 12 inches at any point and does not alter the drainage pattern;

c. All bared earth is promptly seeded, covered with sod, or otherwise effectively protected from erosive actions; and

d. No grading, filling, stockpiling or other earth moving operation is to be conducted within designated sewage disposal system recovery areas.

7. Grading and related earthwork, incidental to individual water wells and sewage disposal (septic) systems installed pursuant to a valid permit from the appropriate public authority (see a, b, and c from item #6).

8. Grading work related to surface mining operations* conducted in accordance with the provisions of a permit granted pursuant to the Annotated Code of Maryland, Environment, Title 15, Subtitle 8, Section 15-807-834. A Use and Occupancy Permit is required.

9. Logging or timber harvesting operations* on individually owned lots of ½ acre or less in all zones. A Use and Occupancy Permit is required.

To determine if a Letter of Exemption can be issued, the Environmental Planning Section requires a copy of a site plan that clearly shows the total area of all lots or parcels included in the permit application, the location and extent of all woodlands on the lots or parcels, and the limit of disturbance for all grading to be done. A project will qualify for a Letter of Exemption if any of the following conditions can be satisfied: 1. The total tract area of all lots or parcels included

in the permit is less than 40,000 square feet and there is not a previously approved TCP.

2. There are less than 10,000 square feet of existing woodlands on the lots or parcels and there is not a previously approved TCP.

3. Less than 5,000 square feet of woodland will be disturbed to complete the project and there is not

a previously approved TCP. This exemption is not permitted when a Preliminary Plat of Subdivision

will be needed for the subject lots or parcels. 4. The property is located in the Chesapeake Bay

Critical Area. Projects in the Critical Area have more stringent requirements that must be met.

5. The application is for logging on agriculturally assessed land when there is not a previously approved TCP.

If a project or activity cannot qualify for a Letter of Exemption based on the criteria noted above, the applicant will be required to submit a Forest Stand Delineation and Type II Tree Conservation Plan to the Environmental

Planning Section for review and approval prior to applying for a Grading Permit. The approved plan must be submitted as part of the permit application documents.

Where noted by an asterisk (*), a Haul Road Permit or a Restoration Bond may be required.

and removal of cultivated sod, shrubs and trees for transplant as part of a regular commercial activity.

2. Stockpiling, with slopes at a natural angle of repose, of raw or processed sand, stone and gravel at concrete, asphalt and material processing plants and storage yards.

3. Refuse disposal areas of sanitary landfills* operated in accordance with requirements of Prince George’s County.

4. Grading land* owned by the United States or the State of Maryland when used for purposes consistent with all applicable requirements.

5. Grading and trenching by privately or publicly owned utility companies for open channel improvements, underground utility installations and maintenance in:a. Public rights-of-way* and WSSC easements;

Requirements of County Agencies

State or local laws may require permit applications to be approved by several County or State agencies. DER distributes copies of applications to all required reviewing agencies, with the exception of the Washington Suburban Sanitary Commission (WSSC) and the SCD. These agencies should be contacted directly. Incorporated towns may require additional permits and should also be contacted directly. Some homeowner associations have covenants requiring approval by an Association Board.

If required, an applicant must submit plans directly to the Health Department, Division of Environmental Health, located at 9201 Basil Court, Suite 318, Largo, Maryland 20774. For your convenience, a Health Department representative is available at the Permits Center located at 9400 Peppercorn Place, 6th Floor, Largo, Monday through Friday from 8:00 a.m. to 12:00 noon. If the property is served by private water (well) and/or sewer (septic system), please contact the Environmental Engineering Program at (301) 883–7681.

n PlanScreening is required on submittals for all new residential and commercial buildings, additions, and townhouses prior to entering the building permit application process. Plans are screened to determine if sufficient information has been included in the package for an engineering plans review to be conducted. Submittal packages that achieve a positive screening will be approved to enter the building permit application process.
