Abstract

This Option A ITT template will assist Framework Users and their technical advisers in developing the necessary documentation to undertake the Local Competition process.

Framework Users are reminded that the EFA Regional Framework was procured under the Restricted Procedure of the Public Contracts Regulations 2006 so it is important that the Framework documents are followed. In particular, Framework Users can only add to the bid requirements in exceptional and locally specific circumstances.

This Option A ITT template should be read in conjunction with the Regional Framework Handbook.

Framework Users must delete this "Document Control" front page, footnotes and all square brackets in this document prior to issuing to Framework Members in a Local Competition.

Glossary of Terms“Bidders” Those Framework Members participating in this Local

Competition Option A process;

“Building Contracts” The PCSA and JCT Contracts with standard form EFA amendments to be used for the development and / or construction of a Scheme;

“Closing Date” The closing date for the delivery of Tender Responses being [12 noon] on [ ], as specified in paragraph 1.5 of this Option A ITT;

“EFA” The Education Funding Agency, of Fourth Floor, Sanctuary Buildings, 20 Great Smith Street, London, SW1P 3BT;

“Employer’s Requirements / Output Specification” (Parts A and B)

The specification provided at Appendix F of this Option A ITT;

“Feasibility” The stage of project development that seeks to demonstrate the deliverability of the Scheme;

“Framework” The Regional Framework established by the EFA pursuant to OJEU notice reference 2013/S 230 – 398762 published on 27 November 2013;

“Framework Member(s)” The contractors who have entered into the Framework agreement with EFA on a Lot basis;

Important NoticeThis Option A ITT document is being issued for and on behalf of the Framework User in respect of a Local Competition pursuant to the Framework.

[This Local Competition is being conducted by the EFA which is an executive agency within the Department for Education (“DfE”). Any appointment made pursuant to this Option A ITT will be managed by the EFA. The legal contracting party and the “Employer” for the purposes of executing the Building Contract on behalf of the EFA is the Secretary of State for Education. References to the “EFA” in this Option A ITT (and accompanying tender documentation) shall be deemed to include the DfE and the Secretary of State for Education as the legal entity.]1

Option A ITT Structure This Option A ITT is structured in four parts:

Part Reference Content

Part 1 – Background Information

This part provides:-

Details on the structure of the Local Competition Option A documentation;

Information about the Scheme, a description of the works, educational requirements, programme, funding, and Building Contract(s).

Part 2 – Specific Information This part provides:-

Project specific information relating to the School’s requirements, surveys, specification, and risks and constraints.

Part 3 – Technical Requirements

This part comprises:-

Information about the Tender Response submission process, the timetable, communication routes, and contacts; and

Instructions on the Local Competition process setting out the core qualitative and pricing requirements to which Framework Members are required to respond and which will form the basis of the technical evaluation of the Framework Member’s response to this Option A ITT.

Part 4 – Framework Member’s Response

This part provides:-

Details of the documentation to be submitted as part of the Tender Response.

The Framework User reserves the right, at its discretion, to amend the materials in these parts as may be appropriate from time to time.

Part 1 – Background Information

1.1 Introduction

The Framework User is inviting submissions from Framework Members interested in taking part in a Local Competition for the Scheme, reference number [insert Scheme Regional Framework unique reference number] within Lot [insert Lot number], the [insert Region title] Region.

This Option A ITT is issued2 to Framework Members on [insert date] and represents the beginning of the Local Competition. The purpose of the Local Competition is to identify the Framework Member who can best deliver the Scheme. Through this Local Competition process, the Framework User will assess the Bidders team, approach and understanding of issues for this Scheme in order to identify the Selected Bidder who will be taken forward to deliver the Scheme.

The qualitative questions (refer to Part 3 and Appendix C) require concise and factual responses which clearly reflect the Bidders positions and take account of their obligations under the Framework Agreement. This provides Bidders with the opportunity to present their case for being selected to deliver the Scheme.

Bidders must obtain for themselves at their own expense all information necessary for the preparation of their Tender Response.

Educational Drivers

i) Educational Background and Context9 If more than one school is being procured within this Local Competition (i.e. a bundle), then this Part 2 – Specific Information needs to be expanded to include this information for all Schemes included in the bundle.10 Framework Users must ensure that this information does not contradict and aligns with the Output Specification/Employer Requirements provided in Appendix F of this Option A ITT.

The Bidder shall design the school to facilitate the provision of education in accordance with the Employer’s Requirements / Output Specification to comply with the relevant needs of the cohort of pupils and numbers of teaching and non-teaching staff to be funded and the unique ethos of the school as set out below.

ii) Curriculum and Organisation

The Bidder shall design the school to enable the curriculum to be delivered and the school to be organised to respond to the following specific school requirements:

Any particular emphasis on an area of learning.

The proposed school day structure and length of lessons and break times (e.g. start and finish time); including any variation across groups.

Any organisational changes planned for the near future.

Whether there are any long-term arrangements for pupils to spend some of their time off site.

iv) Behaviour and Pastoral Care

The Bidder shall ensure that the school is capable of meeting the following school-specific requirements in relation to behaviour and pastoral care:

v) SEN and Disabilities

The Bidder shall ensure that the school is capable of meeting any school-specific requirements in relation to SEN and Disabilities:

Whether all support will be given within a whole-class setting or in small group or individually away from the classroom.

2.3.6 ICT

[To include information about the supply and delivery of the ICT active and passive infrastructure; whether this is being procured via a third party contractor as follows:

Active infrastructure is to be delivered by the Bidder’s supply chain and integration is required with a third party ICT contractor providing ICT equipment (e.g. servers, user devices, AV) with whom the Bidder has no contractual relationship

Active infrastructure and ICT equipment is delivered by a third party ICT contractor with whom the Bidder has no contractual relationship

The default position with the EFA Regional Framework is that ICT Infrastructure (Passive, Active and associated components) as per the Employer’s Requirements / Output Specification Part B, is delivered by the Bidder. However the Framework does provide the option for changes of responsibility at a programme or project level. This option will be used for free school projects.

In the case of free school procurements the ICT active infrastructure will be delivered by the ICT provider. Bidders are therefore not required to respond to section 4.2 ‘Active network’ of the Employer’s Requirements / Output Specification.

Bidders should note that this change only applies to free school projects, and should not be seen as a change to the default position for future projects and programmes].

2.4 Surveys

Part 3 – Technical Requirements

3.1 Instructions

3.1.1 Tender Submission

An indicative timetable for this Local Competition is set out in 1.5 (above). The Framework User reserves the right to amend this from time to time and Bidders will be notified accordingly.

The Tender Response must be received by the Framework User in accordance with the relevant instructions no later than the time and date stipulated. Subject to 3.1.3 (below) a failure to do so may result in a Bidder not being considered and being disqualified from the process.

The Framework User reserves the right to disqualify any Bidder who makes material changes to any aspect of its Tender Response (after the deadline), unless substantial justification can be provided to the satisfaction of the Framework User and such change is in accordance with procurement law.

3.1.2 Tender Response Format

3.1.2.1 Each Tender Response must comprise the documents and information set out in Appendix B. Bidders are directed to use Appendix B as a checklist of information and documents which must be included in their Tender Response.

3.1.2.2 All Tender Responses must be in English.

3.1.2.3 Written responses must be in Arial font size 11 and must not exceed the page allowances stipulated.

3.1.2.4 The Tender Response must be marked with the following details:

Scheme title;

Scheme Regional Framework unique reference number and

Bidder’s name.

3.1.2.5 One [1] electronic copy of the Tender Response shall be submitted by each Bidder.

3.1.2.6 The person signing the Tender Response must state his capacity and official position in the Bidder’s organisation and must be the person empowered and duly authorised to sign and submit Tender Responses for and on behalf of the Bidder and nominated for that purpose in the Forms contained in Part 4 of this Option A ITT (Form of Tender and Certificate of Bona Fide Tender, Non-Collusion Certificate and Non-Canvassing Certificate).

3.1.2.7 The Framework User reserves the reject (at its absolute discretion) a Tender Response which is non-compliant with the requirements of this Option A ITT. Bidders submitting any qualifications should therefore give explicit justification and reasoning for entering a qualification.

3.1.2.8 Only one Tender Response is permitted from each Bidder. In the event that more than one Tender Response is submitted by a Bidder the one with the latest time of submission (prior to the deadline given) will be evaluated and the other(s) will be disregarded.

3.1.2.9 Any signatures must be made by a person who is authorised to commit the Bidder to the Building Contract(s).

3.1.3 Tender Response Delivery

3.1.3.1 Tender Responses must be delivered by the Closing Date via [insert details of e-tendering portal, email address, or other electronic form of communication – add instructions where necessary] attaching all relevant documents (see Appendix B) required by this Option A ITT.

3.1.3.2 The Framework User may (at its absolute discretion) accept Tender Responses submitted via email or alternative means where the Bidder provides strong evidence of not being able to submit the Tender Response through the stipulated medium (for example technical issues with Framework Users e-tendering system).

3.1.3.3 The Framework User reserves the right to reject any Bid Response that arrives after the stipulated time on the Closing Date.

3.1.4 Tender Response Clarification

3.1.4.1 During Tender Response preparation, Bidders may submit questions and requests for clarification or further information. Bidders should address their questions and request for clarification or further information to the Contact Officer whose details are set out in paragraph 1.9 above.

3.1.4.2 Subject to 3.1.4.3 and 3.1.4.4 (below), all questions and requests for clarification or further information, and the corresponding responses, will be circulated to all Bidders.

3.1.4.3 Request for information or clarification which may be commercially sensitive should be marked: “confidential – not to be circulated to other Bidders” (and Bidders are expressly requested not to mark a question as confidential in this way unless this is genuinely the case). At its discretion, the Framework User will respond to that specific request privately, providing that the principle of equal availability of information to all Bidders is not breached.

3.1.4.4 If the Framework User considers that it is unable to respond to the question or request for clarification or further information on a confidential basis it will inform the Bidder, and the Bidder must as soon as practicable thereafter respond in writing requesting that either the query be withdrawn or treated as not confidential. The Framework User will deem that the question or request for clarification or further information has been withdrawn if the Framework User is not contacted in writing within three (3) working days following informing the Bidder as referred to above.

3.1.4.6 Bidders should note that all responses to requests for clarification cannot be relied upon unless the Framework User subsequently confirms that clarification or further information in writing. Bidders should therefore ensure that all requests for clarification or further information have been the subject of written correspondence.

3.1.4.7 The Framework User will at its sole discretion decide whether to respond to any requests for clarification or further information received after [insert deadline for clarification queries].

3.2 Qualitative Response

Bidders are required to provide written responses to the questions set out in Appendix C. These questions correlate to the quality sub-criteria and the Framework themes set out below (also see 3.4.1 below).

There is no design requirement or evaluation within this Local Competition. Should any designs, initial sketches etc. be received as part of a Bidder’s Tender Response, they will be destroyed prior to evaluation.

3.3 Pricing Response

Bidders must price their Tender Responses in accordance with their obligations under the Framework Agreement and the Building Contract as drafted, providing the information as set out in Appendix B attached hereto.

Bidders shall complete their Pricing Documents (“Local Competition Pricing Document” and “Local Competition Preliminaries Pricing Document”), following the Pricing Guidance at Appendix D and included in the Regional Framework Handbook. Note: Bidders may adjust their elemental works and rates to take account of location factor, indexation and project specific issues.

In addition to completing the Pricing Documents, design fees are to be shown on both the pre-construction and construction cash flows, which are to be submitted with this tender, as shown in Appendix B.

Survey costs are to be shown on the pre-construction cash flow and will be paid as part of the PCSA.

Note: All pre-construction costs form part of the overall funding envelope.

Framework Members must adhere to the overall funding envelope advised by the Framework User, as an absolute maximum (see section 1.6 above).

3.4 Evaluation

The Tender Response will be evaluated on a weighting of 70% for the Qualitative submission and 30% for the Pricing submission

3.4.2 Evaluation of the Pricing Submission

At commencement of the Framework, Framework Members were provided with their Pricing Documents to complete and return for each Local Competition they enter.

Following selection of the successful Bidder, the pricing information provided at Local Competition will form the basis for progressing from Local Competition through Feasibility to agreement of the Contract Sum and Scheme Contract Close.

With reference to the pricing information to be submitted as described at Appendix B, the price evaluation will be based on a review of the following elements of Scheme cost:

Percentage adjustment of the Elemental Pricing Section (New Build and Refurbishment);

Allocation of funding for Works following deduction of allowances for non-works related scheme costs comprising the items listed below:

Preliminaries Book; Design Fees (including “Other Design Fees” – Section 2.5 of the “Local

Competition Pricing Document); Overhead and Profit; Design and Construction Risk Allowance;

It is to be noted that the confirmation of Scheme affordability to the funding allowance (as set out in section 1.6) is evaluated as part of the Scheme proposals Qualitative sub-criteria.

3.4.2.1 Evaluation of Percentage adjustment of the Elemental Pricing Section (New Build and Refurbishment)

This represents 10% of the 30% of the score for the Pricing Response.

With regard to the allocation of funding for works indicated in the Bidders response (see below) and in the context of the scale and nature of the scheme and the

3.4.2.2 Allocation of Funding for the works represents 20% of the 30% of the score for the Pricing Response. It will be calculated so that the Bidder demonstrating the highest value sum allocated to works following deduction of tendered costs in respect of Preliminaries, Design Fees (including “Other Design Fees” – Section 2.5 of the “Local Competition Pricing Document), Overheads and Profit, and Design and Construction Risk Allowance will be given 100 marks (which will equate to 20% for the pricing submission) and all the other Bidders will have one mark deducted for each percentage point by which the amount is less than the highest. Percentage calculations will be to one decimal point. The calculation will be undertaken by ‘reverse engineering’ using a pre-determined formula contained in the Pricing Documents as set out in Appendix D. Bidders will also be required to confirm that the proposed scope of works advised in their Tender Response can be provided within the calculated sum allocated to works within the identified programme for the works.

The Bidders will be ranked in accordance with their cumulative scores. Highest marks rank the highest. If the Framework User suspects that there has been an error or there is an anomaly in the pricing, the Framework User reserves the right to seek such clarification as it considers may be necessary.

The Framework User is not bound to accept the lowest or any Tender Response.

3.5 General Conditions

3.5.1 General

It is the Bidder’s responsibility to understand all aspects of this Option A ITT and associated tender documents.

3.5.2 Conflicts of Interest

The Framework User requires all actual or potential conflicts of interest to be notified to the Framework User at least two (2) weeks before the Closing Date. The Framework User will consider the actual or potential conflict and will require such conflict to be resolved to the Framework User’s satisfaction prior to the delivery of Tender Responses to this Option A ITT.

3.5.3 Additional Information

The Framework User reserves the right to ask for additional information by way of clarification and confirmation from Bidders at any time during the procurement of the Scheme. Such requests will include time limits for response.

The Framework User reserves the right to issue supplementary documentation at any time during the Local Competition process to clarify any issue or amend any aspect of the Option A ITT. All such further documentation that may be issued shall be deemed to form part of the Option A ITT and shall supplement and/or supersede any part of the Option A ITT to the extent indicated.

3.5.4 Collusive Proposals

The Bidder shall sign and submit the Certificate of Non-Collusion which is included at Part 4 of this Option A ITT.

Any Bidder which:

1. fixes or adjusts its Tender Response by arrangement with any other person;

2. communicates to any person other than the Framework User or its own advisers (from whom it shall have secured all necessary guarantees of confidentiality beforehand) the details of its Tender Response;

3. enters into any arrangement with any other person that it will cease to discuss its Tender Response with the Framework User; or

4. offers or agrees to pay or give or does pay or give any sum of money, other inducement or consideration, directly or indirectly, to any person in respect of its Tender Response or the Scheme,

will be disqualified, without prejudice to any other civil remedy which may be available to the Framework User, and any criminal liability that may be incurred.

3.5.5 Preparation and Proposal

Information supplied by the Framework User is supplied for general guidance in the preparation of the Tender Response. Bidders must satisfy themselves by their own investigations with regard to the accuracy of any such information and no responsibility whatsoever is accepted by the Framework User or its advisers for any inaccurate or incomplete information obtained by Bidders.

3.5.6 The Framework User Not Bound

The Framework User is not bound to accept the lowest priced or any Tender Response.

3.5.7 Costs and Expenses

The Framework User shall have no liability or obligation to pay any costs incurred by the Bidder as a result of this tendering procedure. The Bidder shall sign the statement entitled Form of Tender and Bona Fide Certificate (Part 4) declaring that it fully understands and accepts that the Framework User shall not bear any costs, in particular, in relation to:-

1. incidental work in responding to the Option A ITT;

2. any presentations, demonstrations or other arrangements;

3. submission of a Tender Response, whether or not the same is compliant or successful.

3.5.8 Publicity

Framework Members shall not undertake (or permit to be undertaken) at any time during the procurement stage, any publicity activity with any section of the media in relation to this Scheme, other than with the prior written agreement of the Framework User. After contract award the provisions of the Framework Agreement and Building Contract will govern any publicity in connection with the Scheme.

3.5.9 The Framework User’s Employees

No Framework User employee has any implied or actual power from the Framework User to give any undertaking, guarantee, warranty or representation (express or implied) in relation to this Option A ITT or any other matter relating to the Scheme.

3.5.10 Variation / Suspension / Cancellation of Procedure

The Framework User reserves the right to vary, suspend or cancel the Local Competition process at any time without explanation or liability for Bidders costs.

3.5.11 Subject to Contract

No offer or Tender Response is deemed accepted until the Building Contract has been signed by the Framework User and the Selected Bidder and declared unconditional. Any enquiries between the Selected Bidder and the Framework User do not imply acceptance of any offer. Only the express terms of any written Building Contract which is finally signed for and on behalf of the relevant parties and which is duly declared unconditional shall have any contractual effect.

3.5.12 Updating of Information

Any matter which comes to the attention of the Bidder at any time which may cause any information given to the Framework User (whether prior to or after this Option A ITT has been issued) to be inaccurate, incomplete or misleading shall be notified by the Bidder to the Framework User without delay, in sufficient detail to enable the Framework User fully to evaluate the impact of such information.

3.5.13 English Law

Negotiations and all subsequent contracts will be subject to English law and the exclusive jurisdiction of the English courts.

3.5.14 English Language

All negotiations will be conducted and all documents will be prepared in the English language.

3.5.15 Canvassing

The Framework User reserves the right to disqualify (without prejudice to any other civil remedies available) any Bidder who, in connection with this Option A ITT does anything which would constitute a relevant offence under the Bribery Act 2010.

3.5.16 Copyright

The copyright in this Option A ITT is vested in EFA and the Framework User. This Option A ITT may not be copied or stored in any electronic medium without the Framework User’s and EFA’s prior written consent, other than strictly for the purpose of preparing a Tender Response to this Option A ITT.

3.5.17 Failure to Comply

Failure to comply with any of the instructions set out in this Option A ITT or any other procedures required in it may result in the Tender Response not being considered by the Framework User and such Bidder being disqualified from the procurement process. The Framework User also reserves the right to reject any Bidder who is guilty of material misrepresentation in supplying any of the information requested in this Option A ITT or at any point in the procurement.

3.5.18 Amendments

The documents which accompany this Option A ITT for submission by Bidders as part of their Tender Response must not be amended or altered by the Bidder, except in so far as the same is required to complete the Tender Documents.

Any amendment to the documents which accompany this Option A ITT to Framework Members (including, but not limited to amendments made pursuant to the process referred to in paragraph 3.1.4), and/or to the scope of the Scheme, that the Framework User decides to make during the Local Competition period will be communicated in writing to the Bidder.

3.5.19 Freedom of Information, Environmental Information Statement and Transparency Agenda

The Framework User is subject to the Freedom of Information Act 2000 (“Act”), The Environmental Information Regulations 2004 (“EIR”) [and Government obligations in respect of transparency in procurement11].

As part of the Framework User’s duties under the Act or EIR, it may be required to disclose information concerning the Local Competition process or the Building Contract(s) to anyone who makes a request.

If the Bidder considers that any of the information provided in their Tender Response is commercially sensitive (meaning it could reasonably cause prejudice to the Bidder if disclosed to a third party) then it should be clearly marked as "Not for disclosure to third

parties” together with valid reasons in support of the information as being exempt from disclosure under the Act or EIR.

The Framework User will endeavour to consult with the Bidder and have regard to comments and any objections before it releases any information to a third party under the Act or EIR. However the Framework User shall be entitled to determine in its absolute discretion whether any information is exempt from the Act or EIR, or is to be disclosed in response to a request of information. The Framework User must make its decision on disclosure in accordance with the provisions of the Act or EIR and can only withhold information if it is covered by an exemption from disclosure under the Act or EIR.

The Framework User will not be held liable for any loss or prejudice caused by the disclosure of information that:

has not been clearly marked as "Not for disclosure to third parties" with supporting reasons (referring to the relevant category of exemption under the Act or EIR where possible); or

does not fall into a category of information that is exempt from disclosure under the Act or EIR (for example, a trade secret or would be likely to prejudice the commercial interests of any person); or

in cases where there is no absolute statutory duty to withhold information, then notwithstanding the previous clauses, in circumstances where it is in the public interest to disclose any such information.

The Government has set out the need for greater transparency across its operations to enable the public to hold public bodies and politicians to account. As part of the transparency agenda, the Government has made certain commitments with regard to procurement and contracting. This includes the requirement to publish all tender and contract documents for contracts over [£10,00012] from January 2011. Bidders should therefore be aware that the tender documents and the resulting Building Contract (with appropriate redactions made in accordance with the exemptions under the Act) will be published as part of the Framework Users’ obligations under the transparency agenda.

The Framework User may consult with the Bidder should it be successful, to inform its decision regarding any exemptions applicable for redacting parts of the resulting Building Contract, but the Framework User shall have the final decision in its absolute discretion.

The essence of the public procurement process is that the Framework User shall receive bona fide competitive Tender Responses from Framework Members. In recognition of this principle we hereby certify that this is a bona fide Tender Response, intended to be competitive, and that we have not fixed or adjusted the amount of the Tender Response or the rates or prices quoted by or under or in accordance with any agreement or arrangement with any other Bidder. 2. informed any other person, other than the Framework User, of the detail including (but not limited to) the amount of the Tender Response, except where the disclosure, in confidence, of the amount of the Tender Response was necessary to obtain quotations necessary for the preparation of the Tender Response for insurance, professional or consultancy advice required for the preparation of the Tender Response;

3. caused or induced any person to enter into such an agreement as is mentioned in paragraphs 1 and 2 above or to inform us of the amount or the approximate amount of any rival Tender Response for the Option A ITT or had the benefit, in the preparation of this Tender Response of any inside information about the intentions of any other Bidder;

4. committed any relevant offence under the Bribery Act 2010;

5. admitted and/or been found by a relevant regulatory authority to have participated in or undertaken behaviour which is or is apparently intended to or has the consequence of significantly restricting competition;

6. offered or agreed to pay or give any sum of money, inducement or valuable consideration directly or indirectly to any person for doing or having done or causing or having caused to be done any act or omission in relation to any other Tender Response;

7. contacted any member or officer of, or any person engaged as an adviser by the Framework User about any aspect of the Tender Response in a manner not

Appendix D – Guidance for the Completion of Pricing Documents by Bidders

For Local Competition Tender purposes, Bidders have been provided with excel based Pricing Documents (“Local Competition Pricing Document” and “Local Competition Preliminaries Pricing Document”), which automatically make the required calculations to determine the “sum allocated to works”. The process for completing the Pricing Documents is detailed below.

Unless stated otherwise, the below refers to the “Local Competition Pricing Document”;

1. Cells to be completed by Bidders (in both documents) are highlighted in yellow, or indicated by instructions highlighted in yellow.

2. Additional items must not be inserted into the Pricing Documents at this stage.

3. The “Funding Summary Elemental Cost Summary” worksheet is to contain the following, which are given in section 1.6 of this document:

the ‘TPI All-In’ pricing index number; the ‘Location Factor’ index number; the total available funding (referenced "1 – 15 Project Costs Total"); the “1 – 13 Construction Costs Total”, and; the "14 FF&E" amount; noting that none of the above are to be altered by Bidders;

.

4. Bidders are required to fully complete the separate “Local Competition Preliminaries Pricing Document” for the scheme. Bidders should then transfer the total sum for preliminaries to the “Local Competition Pricing Document” by inserting the total preliminary costs on the “Local Competition Tender Elemental Summary” worksheet at “9 Main Contractor’s Preliminaries”;

5. Bidders are required to fully complete the worksheets for “1 Substructure” through to “8A Abnormal Costs”. Bidders are required to schedule out and price required “7 Other Design Fees and Surveys” associated with the project on a lump sum fixed price basis; these figures will not be adjustable at later stages of the pre- or post-construction process. It is noted that the sums for surveys will, at this stage, be retained in the “sum allocated to works” total;

6. After completing the above the Bidder should enter a target figure for “1 – 10

Construction Costs Sub-Total” on the “Local Competition Tender Elemental Summary” worksheet;

7. Bidders should then complete the worksheets for “11 Fees”, “12 Main Contractor’s Overheads & Profit”, and “13 Design & Construction Risk Allowance” in accordance with Framework ITT tendered percentages (i.e. tendered percentages represent a maximum which can be adjusted on a project specific basis), and transfer the

percentages to the relevant cells on the “Local Competition Tender Elemental Summary”;

8. Bidders are required to achieve close to parity figures (i.e. within £5.00) for the “1 – 10 Construction Costs Sub-Total” on the “Local Competition Tender Elemental Summary” worksheet and a difference cell is provided on this worksheet for guidance;

9. At this stage the Bidder has the option to either / or adjust the “1 – 10 Construction Costs Sub-Total” value and / or the percentages / fixed sums entered in steps 3 to 6 above until they are satisfied with the result in the “1 – 10 Construction Costs Sub-Total” cell;

10. Once the Bidder has achieved a sum within the £5.00 threshold and is satisfied with the “1 – 10 Construction Costs Sub-Total” entry, this will form the basis on which their tender is scored.
