    Application for approval of the Royal Flying Doctor Service of Australia, Central Operations Aircraft Engineers Enterprise Agreement 2015.

    [1] An application has been made for approval of an enterprise agreement known as theRoyal Flying Doctor Service of Australia, Central Operations Aircraft Engineers Enterprise Agreement 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Royal Flying Doctor Service of Australia Central Operations T/A Royal Flying Doctor Service, Central Operations. The Agreement is a single-enterprise agreement.

    [2] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met.

    [3] In so finding, I note that various leave provisions in the Agreement refer to RFDS policies. In accordance with s.55 and s.56 of the Act, these provisions will apply subject to the operation of the relevant National Employment Standards.

    [4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from25 March 2015. The nominal expiry date of the Agreement is 31 December 2017.

  • TITLE

    This Agreement shall be known as the Royal Flying Doctor Service of Australia,Central Operations Aircraft Engineers Enterprise Agreement 2015.

    DEFINITIONS2.

    For the purposes of this Agreement:

    Act means the Fair Work Act 2009 (Cth);2.1

    Accident has the same meaning as defined in Civil Aviation Act I988 (Cth),Section 300L;

    2.3 Accommodation means accommodation which is, at a minimum, quiet andfree from factors which reduce adequate rest;

    Aircraft Maintenance Engineer or AME means an unlicensed tradesman whoworks under supervision, and is engaged in the maintenance, repair, overhaul,modification, assembly and/or testing of aircraft, aircraft systems, aircraftengines and/or associated equipment;

    Agreement means the RFDS Central Operations Aircraft Engineers EnterpriseAgreement 2015;

    2.6 Award means the Airline Operations - Ground Staff Award 2010;

    2.7 ASIC means Aviation Security Identification Card;

    2.8 CAOs means the Civil Aviation Orders;

    2.9 Confidential Information includes all information, whether in tangible orintangible form, of a confidential nature regarding the RFDS' current or futurebusiness interests, methodology or affairs, or of any person or entity with whichthe RFDS may deal or be concerned including, without limitation, matters of orrelating to the RFDS' business, technical detail, engineering data, intellectualproperty, marketing procedures, financial information, computer softwareprograms, and any other information which the employee knows or ought tohave known was confidential;

    2.10 Dependant has the meaning as provided in the Income Tax Assessment Act1936 (Cth);

    2.11 Engineer means an aircraft maintenance engineer employed by the RFDS,who currently works from a base situated in Adelaide and Port Augusta inSouth Australia and A1ice Springs in the Northern Territory (and any otherbases that may be identified during the life of this Agreement);

    2.12 FWC means Fair Work Commission;

    2.13 Field Work means aircraft maintenance carried out for the RFDS at a placeother than an RFDS Engineering Base;

  • 2.14 Home Base means any base at which an Engineer is domiciled for a period inexcess of 180 days;

    Licensed Aircraft Maintenance Engineer (LAME) Airframe Grade I meansa licensed aircraft maintenance engineer holding a B, ., license rated in theairframe category and issued under CASR 1998 Part 66, with exclusions onHydraulic systems, Air conditioning systems and Pressurisation systems;

    Licensed Aircraft Maintenance Engineer (LAME) Airframe Grade 2 meansa licensed aircraft maintenance engineer holding a Bit license rated in theairframe category and issued under CASR 1998 Part 66, with exclusions onAir conditioning systems and Pressurisation systems;

    Licensed Aircraft Maintenance Engineer (LAME) Airframe Grade 3 meansa licensed aircraft maintenance engineer holding a B, .I license rated in theairframe category and issued under CASR I 998 Part 66, with no exclusionsrelating to airframe systems on the fleet operated by the RFDS;

    Licensed Aircraft Maintenance Engineer (LAME) Engine Grade 3 means alicensed aircraft maintenance engineer holding a Bl. I license rated in theengine category and issued under CASR 1998 Part 66, with no exclusionsrelating to engine systems on the fleet operated by the RFDS and holding a taxiapproval;

    Licensed Aircraft Maintenance Engineer (LAME) Mechanical Grade 3means a licensed aircraft maintenance engineer holding a Bl. I license rated inthe airframe and engine categories and issued under CASR I 998 Part 66, withno exclusions relating to Airframe or Engine systems on the fleet operated bythe RFDS and holding a taxi approval;

    Licensed Aircraft Maintenance Engineer (LAME) Instrument Grade Imeans a licensed aircraft maintenance engineer holding a B2 license rated inthe instrument category and issued under CASR 1998 Part 66, with exclusionson multi axis auto pilots, remote compass indicating systems andPressurisation systems;

    Licensed Aircraft Maintenance Engineer (LAME) Instrument Grade 2means a licensed aircraft maintenance engineer holding a B2 license rated inthe instrument category and issued under CASR 1998 Part 66, with exclusionson Pressurisation systems;

    Licensed Aircraft Maintenance Engineer (LAME) Instrument Grade 3means a licensed aircraft maintenance engineer holding a B2 license rated inthe instrument category and issued under CASR 1998 Part 66, with noexclusions relating to Instrument systems on the fleet operated by the RFDS;

    Licensed Aircraft Maintenance Engineer (LAME) Electrical Grade I meansa licensed aircraft maintenance engineer holding a B2 license rated in theElectrical category and issued under CASR 1998 Part 66, with exclusions onmulti generator systems;

    Licensed Aircraft Maintenance Engineer (LAME) Electrical Grade 2 meansa licensed aircraft maintenance engineer holding a B2 license rated in the

  • Electrical category and issued under CASR I 998 Part 66, with no exclusionsrelating to Electrical systems on the fleet operated by the RFDS;

    2.25 Licensed Aircraft Maintenance Engineer (LAME) Radio Grade I means alicensed aircraft maintenance engineer holding a B2 license rated in the Radiocategory and issued under CASR I 998 Part 66, with exclusions on thefollowing systems, Automatic Direction Finder, Very High Frequency Omnidirectional Radio, Instrument Landing System, Weather radar, Transponder,Radio Altimeter, Distance Measuring Equipment, Global Positioning Systems;

    2.26 Licensed Aircraft Maintenance Engineer (LAME) Radio Grade 2 means alicensed aircraft maintenance engineer holding a B2 license rated in the Radiocategory and issued under CASR I 998 Part 66, with exclusions on thefollowing systems, Weather radar, Transponder, Radio Altimeter, DistanceMeasuring Equipment, Global Positioning Systems;

    2.27 Licensed Aircraft Maintenance Engineer (LAME) Radio Grade 3 means alicensed aircraft maintenance engineer holding a B2 license rated in the Radiocategory and issued under CASR 1998 Part 66, with no exclusions relating toradio systems on the fleet operated by the RFDS;

    2.28 Licensed Aircraft Maintenance Engineer (LAME) Avionic Grade 3 means alicensed aircraft maintenance engineer holding a B2 license issued underCASR I 998 Part 66 and rated in any two of the following categories, Electrical,Instrument or Radio with no exclusions relating to those two categories, on thefleet operated by the RFDS;

    2.29 RFDS means the Royal Flying Doctor Service of Australia, Central Operations;

    2.30 Roster Relief means a period where an Engineer is required to performengineering duties at other than their Home Base for the purpose of providingspecific relief to or supplementing the Engineering staff at that Base;

    2.31 Senior Base Engineer (SBE) means a LAME appointed to that position withresponsibilities in the management of personnel, and aircraft related activitiesin accordance with the Certificate of Approval;

    2.32 Serious Incident has the same meaning as defined by the Civil Aviation ActI988 (Cth), Section 300L;

    2.33 Sensitive Information means all information concerning or relating to thisAgreement, its termination and the circumstances relating to its termination.

    PURPOSE OF THE AGREEMENT

    The purpose of this Agreement is to promote direct relationships between theRFDS and Engineers/SBEs in a manner which contributes to the productivity,flexibility, efficiency and effectiveness of the operational needs of the RFDS.

    It is the intention of the parties that the Agreement will completely replace theapplication of any applicable Modern Award and any previous agreements.

    Leave accruals earned prior to the date of this Agreement will not be affected.

  • 3.4 The expectations of both parties to this Agreement are as follows:

    3.4. I RFDS

    3.4.1.3 Improved flexibility of engineering coverage/availability.

    Engineers/SBEs

    3.4.2.1 Terms and conditions that reflect the Engineers'/SBEs'contribution to the continued success of the RFDS;

    3.4.2.2 A rate of pay that acknowledges the individual's experience,knowledge and skill; and

    3.4.2.3 Allowances that recognise the collective and individualcontribution to enhance engineering coverage/availability.

    4. ANTI-DISCRIMINATION

    It is the intention of the parties to this Agreement to achieve the principal object4.1in section 3(e) of the Act through respecting and valuing the diversity of theworkforce by helping to prevent and eliminate discrimination on the basis ofrace, colour, sex, sexual preference, age, physical or mental disability, maritalstatus, family responsibilities, pregnancy, religion, political opinion, naturalextraction or social origin.

    Accordingly, in fulfilling their obligations under Clause 37 (Dispute ResolutionProcedure), the parties must make every endeavour to ensure that neither theAgreement provisions nor their operation are directly or indirectly discriminatoryin their effects.

    Nothing in this Clause is taken to affect

    4.3. I Any different treatment (or treatment having different effects) which isspecifically exempted under the Commonwealth anti-discriminationlegislation;

    An Engineer/SBE, RFDS or registered organisation, pursuing mattersof discrimination in any State or Federal jurisdiction, including byapplication to the Australian Human Rights Commission;

    Any discriminatory conduct (or conduct having a discriminatory effect)that is based on the inherent requirements of a particular position; or

  • PARTIES BOUND

    This Agreement will be binding on the following parties:

    5.1. I The RFDS; and

    5.1.2 Engineers/SBEs.

    This Agreement does not apply to Engineers/SBEs who are appointed in therole of Engineering Manager or the Head of Aircraft Ainuorthiness andMaintenance Control.

    A copy of this Agreement will be made available to all Engineers/SBEs via theRFDS Intranet.

    5.1

    The Engineer/SBE is a member of an institution that hasconduct in accordance with the doctrines, tenets, beliefs orteachings of a particular religion or creed; and

    The conduct was in good faith to avoid injury to the religioussusceptibilities of that religion or creed.

    6. APPLICATION OF MODERN AWARD

    The terms of this Agreement prevail over the terms of any applicable Modern Awardand operate to its full exclusion. This Agreement is to be read in conjunction withRFDS policies and procedures.

    PERIOD OF OPERATION

    This Agreement shall come into operation from the date of approval by FWCand shall remain in force until31 December 2017.

    The parties agree to commence negotiations for a replacement enterpriseagreement within six months of the nominal expiration of this Agreement.

    SALARY CLASSIFICATION

    Upon engagement, each Engineer/SBE will be classified in accordance with ScheduleI of this Agreement.

    CONTRACT OF SERVICE

    Engineers/SBEs will perform their duties in accordance with this Agreement,9.1the RFDS' policies, procedures and regulations (determined internally and byexternal regulatory bodies), and their position description.

    9.2 Where changes to policy effect conditions of employment, the RFDS willconsult with the Engineers/SBEs, or their appointed representative, prior toimplementation.

  • 10. QUALIFYING PERIOD

    10.1 All new Engineers/SBEs will be required, upon commencement, to undertake aqualifying period of six months.

    10.2 At the completion of the qualifying period, confirmation of appointment isreviewed and contingent on satisfactory overall performance during thequalifying period.

    10.3 During the qualifying period, either party may terminate the Engineer'SISBE'semployment on the provision of one week's notice. The RFDS may makepayment in lieu of notice. It is not necessary for either party to provide areason for the termination if it occurs during the qualifying period.

    BASIS OF EMPLOYMENT

    11.1 Engineers/SBEs will be employed in one of the following categories:

    I1.1. I Full-time;

    I I. 1.2 Part-time; or

    I I. 1.3 Casual.

    11.2 At the time of engagement, the RFDS will inform each Engineer/SBE of theterms of their engagement and, in particular, whether they are to be full-time,part-time or casual.

    CASUAL ENGINEERSISBES

    12.1 Casual Engineers/SBEs are those Engineers/SBEs engaged to performoccasional and/or irregular engineering duties.

    12.2 Casual Engineers/SBEs, working ordinary time, will be paid at an hourly rate of1140" of the weekly rate for their classification for each hour worked, plus 25%,in lieu of leave entitlements.

    12.3 Casual Engineers/SBEs will be paid a minimum of three hours for eachengagement.

    12.4 The employment of a casual Engineer/SBE may be terminated by either partygiving one day's notice to the other, or by the payment or forfeiture of one day'ssalary, as the case may be.

    PART-TIME ENGINEERS/SBES

    13.1 Part-time Engineers/SBEs are those Engineers/SBEs who work less than full-time Engineers/SBEs, have reasonably predictable hours of work and receive,on a pro-rata basis, equivalent pay and conditions of those full-timeEngineers/SBEs who do the same kind of work.

    13.2 A part-time Engineer'SISBE's hours of work will be the subject of a writtenagreement with the RFDS at the time of the Engineer'SISBE's engagement.

  • Any variation of this agreement will be by mutual agreement between theRFDS and the Engineer/SBE, and will be recorded in writing.

    13.3 Part-time Engineers/SBEs will receive the pay, entitlements, allowances andconditions due to full-time Engineers/SBEs who undertake work at the sameclassification on a pro rata basis.

    13.4 Where mutually agreed between the part-time Engineer/SBE and the RFDS,the part-time Engineer/SBE may be rostered for additional hours work over andabove their standard/core part-time hours, up to the equivalent hours of a full-time Engineer/SBE.

    13.5 In the event a part-time Engineer/SBE works additional hours, they will be paidaccordingly, with the hourly rate calculated in accordance with Clause I 9.1.4.Pro-rata leave entitlements will accrue accordingly.

    13.6 In the event that a part-time Engineer/SBE is rostered, by mutual agreement, towork on a full-time basis (eg to provide relief whilst another Engineer/SBE isabsent on leave etc), they will be paid the equivalent full-time salary for theduration of that full-time period. Leave entitlements will accrue accordingly.

    APPRENTICESHIP

    14.1 Cancellation or Suspension of Indenture

    An apprenticeship may be cancelled or suspended only in accordance with therequirements of the contract of apprenticeship or training agreement, or therequirements of State and Territory legislation.

    14.2 Period Of Apprenticeship

    The period of apprenticeship will be four years,

    14.3 Qualifying Period

    Upon commencement, apprentices will be subject to a six-month qualifyingperiod and, if apprenticed, such six months will count as part of their period ofapprenticeship.

    14.4 Tools

    14.

    14.4. I A tool kit will be purchased for the apprentice on completion of thequalifying period.

    14.4.2 The full cost of the tool kit will be recovered from the apprentice, viapayroll deductions, from the apprentice's pay throughout the period ofthe apprenticeship.

    14.4.3 The tool kit will remain the property of the RFDS until such time thatthe full cost of the tool kit has been recovered from the apprentice.

    14.4.4 Should the apprentice leave the RFDS before the full cost of the toolkit has been recovered from the apprentice, the apprentice willreimburse to the RFDS the amount outstanding, at which time the toolkit will become the apprentice's property or the RFDS will reimburse to

    the apprentice, the payments made to date, in relation to the recoveryof the cost of the tool kit, at which time the tool kit will remain theproperty of the RFDS.

    Wages

    14.5. I The minimum weekly rates of wages for apprentices will be paid inaccordance with the Junior and Adult Apprenticeship tables prescribedin Schedule I (based on an Aircraft Maintenance Engineer startingsalary).

    14.5.2 Schedule I establishes a Junior Apprentice percentage pay rate andan Adult Apprentice percentage pay rate. The Adult Apprenticepercentage pay rate applies to apprentices aged 25 and above.

    14.5.3 The Adult Apprentice percentage pay rate will apply to an apprenticeupon commencement, if that apprentice is 25 years of age or older, orto a Junior Apprentice who turns 25 during the course of theirapprenticeship with the RFDS.

    Overtime and Shift Work14.6

    No apprentice under the age of 18 years will be required to work overtime or toperform shift work at times which would prevent the apprentice's attendance attechnical school as required by any statute, award or regulation applicable.

    Payment by Results

    An apprentice will not work under any system of payment by results.

    Lost Time

    14.7

    14.8. I If an apprentice, at the end of a calendar year, has given service to theRFDS less than the ordinary working days prescribed for the trade, orhas unlawfulIy absented himself/herself without the RFDS' consent,the apprentice will, for every day short of the said number of workingdays or for every day of such absences, serve additional days in thefollowing year until the lost days have been made up.

    14.8.2 In calculating the extra time to be so served, the apprentice will becredited with time which the apprentice has worked during the relevantyear in excess of their ordinary hours,

    14.9 Attendance at Technical Schools

    Apprentices attending technical colleges or schools who present reports ofsatisfactory conduct will be reimbursed all fees paid by them.

    14.10 Operation of State and Territory Laws

    14.10. I Any statute or regulations in any State or Territory relating toapprentices will apply to apprentices under this Agreement.

    14.10.2 The provision of any statute or regulation relating to the attendance ofapprentices at technical school during ordinary working hours or to

  • disciplinary powers of apprenticeship authorities over apprentices andemployers will not be deemed to be inconsistent with this Agreement.

    CRIMINAL HISTORY ASSESSMENT/WORKING WITH CHILDREN CLEARANCE,ASIC AND LICENSES

    15.1 An Engineer'SISBE's employment is subject to them, upon commencement andas required thereafter, providing:

    15.1. I A current satisfactory Criminal History Assessment (SA), Working withChildren Clearance (NT) or equivalent clearance, as required byregulatory bodies and/or the RFDS;

    15.1.2 A current ASIC pass; and

    15.1.3 Evidence of a current CASA Aircraft Engineer licence(s) andassociated category endorsements, as required by the RFDS.

    MEDICAL EXAMINATION

    16.1 An offer of employment is subject to a prospective Engineer/SBE undertaking apre-employment medical examination and/or functional capacity assessment,including audiometry and drug and alcohol testing, arranged by the RFDS. Theexamination/assessment will be relevant to the risk factors of the role and thisinformation will be handled confidentially.

    16.2 From time to time, for occupational health and safety reasons, Engineers/SBEsmay be required by the RFDS to undergo medical examinations and/orfunctional capacity assessments, conducted by a registered health practitioner,appointed by the RFDS.

    16.3 The cost of medical examinations/assessments conducted under Clauses 16.

    and 16.2 will be met by the RFDS.

    PERFORMANCE REVIEW & DEVELOPMENT

    17.1 Each Engineer'SISBE's performance will be assessed regularly, with a formalperformance review conducted annually.

    17.2 The performance criteria against which the Engineer'SISBE's performance willbe measured will be determined by the RFDS in line with the RFDS'Performance and Development Review Program and policy.

    HOURS OF WORK

    18.1 The ordinary hours of work for Engineers/SBEs will be 38 hours per week,Monday to Friday inclusive, plus reasonable additional hours of up to two hoursper week.

    18.2 The ordinary hours of work are to be performed during 6.00am and6.00pm, or as otherwise agreed to by the RFDS and the Engineers/SBEs tomeet operational requirements.

  • 18.3 The Engineers/SBEs will only be required to work in excess of 40 hours perweek in the event of an aircraft on ground breakdown or to maintain minimumaircraft numbers to meet the RFDS' contractual obligations.

    18.4 Any hours worked in excess of 40 hours per week will be reinunerated asovertime at a rate of time and a half for the first three hours and double timethereafter.

    18.5 Engineers/SBEs will receive an unpaid meal break of 30 minutes, which will betaken after no more than five hours ordinary work, and two paid tea-breaks ofnot more than ten minutes duration subject to operational requirements.

    18.6 An Engineer/SBE will be entitled to the public holidays gazetted in theEngineer'SISBE's applicable Staten"erritory.

    RECALL To DUTY

    19.1 Recall to Duty

    19.1. I An Engineer/SBE, having left work at the completion of a normal workday, who is required to return to work on the same day, will be paid attime and a half for the first three hours worked and double timethereafter. All hours worked on Saturday, Sundays and public holidayswill be at the double time rate.

    19.1.2 A minimum of three hours will be paid to any Engineer/SBE who isrecalled to duty, with reference to the preceding paragraph.

    19.1.3 For the purposes of calculating the period for which an Engineer/SBEis recalled to duty, the period shall be from the time the Engineer/SBEleaves their home to the time they arrive back home, having travelledby the most direct route (for example, the travel costs associated withthe recall have been incorporated into the Recall to Duty payment).

    19.1.4 Recall To Duty Rates

    For the purposes of calculating Recall to Duty rates, the ordinary timehourly rates will be determined by dividing the appropriate weekly rateby 40.

    19.2 Time Off In Lieu (TOIL) Of Recall To Duty

    19.2. I An Engineer/SBE may be paid for a Recall to Duty or receive time offin lieu of payment subject to this Clause.

    19.2.2 TOIL may be granted by mutual agreement between the SBE and theEngineer, or in the case of an SBE, between the Engineering Managerand the SBE, and will accrue at the rate of one hour off for each hourof Recall to Duty worked (including travel time)

    19.2.3 The Engineer/SBE will specify on the TOIL Worksheet the Recall toDuty hours they wish to accrue as time off.

    19.2.4 All accrued time off will be recorded on the TOIL Worksheet.

  • 19.2.5 The Engineer/SBE can apply to take TOIL instead of being paid Recallto Duty time by submitting a standard leave application form with theassociated TOIL Worksheet, prior to any time off being taken. TOIL willbe approved at a time, subject to mutual agreement between the SBEand Engineer, or the Engineering Manager and the SBE, as the casemay be.

    19.2.6 The Engineer/SBE can accrue a maximum of 24 hours Recall to Dutyfor which they may apply for TOIL instead of payment. Extensionsbeyond this limit are to be agreed on an individual basis with theEngineer/SBE and the Engineering Manager.

    19.3 Rest and Meal Periods During Extended Work Time

    19.3. I The Engineer/SBE will be entitled to, and will ensure, in periods ofextended work time, that a paid 30-minute rest period is taken in everyfourhour period.

    19.3.2 Where an Engineer/SBE takes a rest break in accordance with sub-Clause 19.31 of this Agreement, the RFDS will provide a suitablemeal for the Engineer/SBE or, where a meal could not be provided bythe RFDS, the RFDS will reimburse to the Engineer/SBE thereasonable cost of a meal in accordance with the provisions outlined inthe RFDS Policy Manual.

    19.4 Rest Periods After Extended Work Time

    19.4. I An Engineer/SBE, who continues working after their rostered finishingtime, will ensure that they have a consecutive IO-hour rest beforereturn to work, without loss of pay.

    19.4.2 It is expected that the Engineer will communicate with the SBE, or inthe case of an SBE, the Engineering Manager, regarding the durationof extended work time, and any associated resumeal breaks, to ensurethat the Engineer/SBE is fit and able to perform their duties.

    ALLOWANCES20.

    20.1 On-call Allowance

    The on-call requirements are effective seven days a week, excluding theordinary hours of employment.

    20.1. I Engineers/SBEs, who are rostered for on-call duty, are entitled to oneweek (five rostered working days) of annual leave per year, in additionto the entitlement provided in Clause 25.1.

    20.1.2 Any base where a sole Engineer/SBE is required to be on-call for acontinuous four-week period, the Engineer/SBE will be entitled to onerostered day off, to be taken within a month of accrual and at anagreed time, in accordance with operational requirements.

    20.1.3 The additional leave referenced in Clause 201.1 will not start accruinguntil HR/Payroll receive written notification from the respective Home

  • Base SBE and Engineering Manager, confirming that anEngineer/SBE has commenced on the on-call roster.

    20.1.4 Engineers/SBEs, who do not hold the appropriate licences and,therefore, are not sufficiently qualified to provide on-call support, (egapprentices, AMEs etc), are riot eligible to accrue the additional annualleave detailed in Clause 20.11.

    Communication

    20.2. I To assist in the provision of the RFDS' after hours engineeringemergency on-call service, Engineers/SBEs rostered on-call will beprovided with either a mobile phone for business use, in accordancewith RFDS policy, or a mobile phone allowance of $60 per month.

    20.2.2 Where an Engineer/SBE elects to receive a mobile phone allowance, itwill be directed to a mobile phone account nominated by theEngineer/SBE.

    20.2.3 If, during the life of this Agreement the mobile phone allowance attractFringe Benefits Tax, such tax will be payable by the Engineer/SBE.

    20.2.4 In the event that an Engineer/SBE is absent from the workplace onextended leave for a period of three months or more, the mobile phoneOf provided) will be returned to the RFDS, or payment of the phoneallowance will be suspended, until the Engineer/SBE returns to workand on-call duty.

    Remote Area Housing

    Remote Area Housing Allowance will be paid in accordance with the RFDSPolicy.

    General Travelling and Accommodation Allowances

    Roster Relief will be rotated within the engineering group to ensure equity andminimum disruption to personal life. An Engineer/SBE on temporary transfer(i. e. roster relief or secondment) will be entitled to travel and accommodationallowances as per RFDS policies.

    Travelling Time Allowances

    20.5. I Where an Engineer/SBE is required to travel for duty away from HomeBase, the RFDS will provide return travel in accordance with the RFDSTravel & Accommodation Policy.

    20.5.2 If Engineers/SBEs are required to work away from their Home Base,with the exception of when the Engineer/SBE has been directed toattend training, they will be paid the following rates for all timereasonably spent travelling by them in excess of the time they usuallyspend travelling to or from their home to the Home Base:

    Private Motor Vehicle Allowance20.6

    20.6. I NO Engineer/SBE will be required to use his or her private vehicle onRFDS' business, unless the Engineer/SBE so agrees.

    20.6.2 When an Engineer/SBE agrees to use their private vehicle for RFDS'purposes, the Engineer/SBE will be paid an allowance in accordancewith the RFDS' Travel Policy.

    SBE Allowance

    SBEs will receive an additional allowance of 12.5%, in addition to their basesalary and allowances, and will be provided with a fully maintained companyvehicle.

    20.7

    20.8 Higher Duties Allowance

    If an Engineer is required by the RFDS to perform the duties of the SBE for aperiod equal to or exceeding one week, the Engineer will be entitled to anadditional 12.5% loading on their base salary and allowances. A fullymaintained vehicle will not be provided to an Engineer during periods of highduties.

    21. FIELD WORK

    21.1 Where an Engineer/SBE is required to work at locations other than an RFDSEngineering Base, the following provisions will apply:

    21.1. I Field Work will be rotated around the engineering group so as toensure equity and minimum disruption to personal life.

  • 21.1.2 The Engineer/SBE will be paid as if the Engineer'SISBE's normalHome Base roster had continued.

    21.1.3 An Engineer/SBE will be provided with travel and accommodationappropriate to the locality in accordance with the relevant RFDSpolicies.

    21.1.4 In addition to all other remuneration prescribed by this Agreement,where an Engineer/SBE is required to complete a period of Field Workthat exceeds a duration of one day, an amount of $25 per day is to bepaid.

    21.1.5 A period of Field Work will not exceed 14 days' duration. A 14-dayperiod may be extended up to seven days by mutual agreementbetween the RFDS and the Engineer/SBE.

    21.1.6 The RFDS and the Engineer/SBE may agree that the Engineer/SBEworks on Saturdays, Sundays and public holidays. Should this occur,the Engineer will be paid in accordance with Clause I9.

    21.1.7 An Engineer/SBE required to do Field Work will be entitled to one dayoff at their Home Base for each five consecutive days that theEngineer/SBE works away from their Home Base.

    REMUNERATION

    22.1 Wage Rates

    22.1. I Engineer/SBE wage rates, as set out in Schedule I, incorporate allallowances, penalties and leave loading arising from the Award, unlessotherwise provided in this Agreement. The wage rates are significantlyhigher than the minimum wages set out in the Award in recognition ofthe on-call hours arrangements set out in Clause 20.1 .

    22.1.2 The RFDS will pay the Engineers/SBEs fortnightly, via direct banking,into an account(s) nominated by each Engineer/SBE.

    22.1.3 Engineers/SBEs will have access to salary packaging options, inaccordance with RFDS policy.

    22.2 Additional Payments

    22.2. I In addition to the wage rates prescribed in Clause 22.1, additionalpayments will be made to eligible Engineers/SBEs for the functionsoutlined below.

    22.2.2 The following additional payments will be paid in accordance withSchedule 2 of this Agreement:

    Maintenance Authority - Where an Engineer/SBE holds an authorityissues by CASA under CAO 100.24 and operational Iy required by theRFDS in respect of a maintenance function to be performed andcertified on a particular aircraft, or a type, series or group of aircraft,engine, systems or installations, the Engineer/SBE shall be eligible for

  • additional payments that will be paid in accordance with Schedule 2 ofthis Agreement as if the Engineer/SBE holds the relevantcategory/type licence.

    Weight Control Authority - Payable to an Engineer/SBE inconsideration for exercising the privileges of a Weight Authority underCAO 100.28 held and required by RFDS;

    Additional Group Licence Payment - Payable for any further grouplicenses in excess of those detailed at Schedule 2 will be subject tooperational need as determined by RFDS. The rate of pay for eachgroup required will be determined by negotiation between theEngineer/SBE and RFDS.

    Tool Allowance - Payable to all Engineers/SBEs in consideration forthe upkeep and replacement of the Engineers'/SBEs' tools and toolcontrol mechanisms.

    Signatory - Payable to Engineers/SBEs who hold a companymaintenance approval.

    Taxi approval - Payable to Engineers/SBEs holding a taxi approvalapplicable to the aircraft operated by the RFDS.

    Additional Category - Payable on the second and subsequentlicense category to a maximum of four (i. e. an Engineer/SBE holding alicense in five categories is eligible for four additional categorypayments).

    23. TRAINING

    23.1 The RFDS is committed to ensuring that the Engineers/SBEs undertakemandatory and technical training, and will continue to engage with theengineering groups, through the SBEs to identify internal and external trainingneeds and opportunities.

    Engineers/SBEs will be allowed time off without loss of pay for the purposes ofattending examinations where the examinations are required to facilitate theattainment of a relevant licence/qualification and/or CASA requirements, wherethe latter is approved by the RFDS in advance.

    An Engineer/SBE will not be required to be on-call the night immediatelypreceding an examination. The Engineer/SBE undergoing examinations will berequired to make alternative arrangements for their on-call rostering to enablethis provision to be effective.

    An Engineer/SBE who is required to attend a training course (including thegaining of experience) in Australia or overseas will be paid as would haveoccurred if the Engineer/SBE worked their normal roster.

    Engineers/SBEs required to attend a training course and/or experience trainingaway from their Home Base will be provided with transport by the RFDS for thefollowing:

  • 23.5. I Travel between the Engineer'SISBE's home and departure airport, andfrom the arrival airport to the Engineer'SISBE's temporaryaccommodation, and return;

    23.5.2 Travel to and from the Engineer'SISBE's place of temporaryaccommodation and the place of training.

    23.6 An Engineer/SBE attending RFDS approved training away from their HomeBase will be entitled to:

    23.6. I Suitable furnished air-conditioned temporary accommodation withinreasonable distance from the location of training. A separate roommust be provided for each Engineer/SBE;

    23.6.2 Payment or reimbursement of all meals and all utility charges,including the cost of business telephone calls (this includes reasonabletelephone charges to home in accordance with the provisions outlinedin RFDS policy).

    23.7 Where an Engineer/SBE has been absent, outside Australia, for the purposesof training for a period of four weeks or more, the Engineer/SBE will be entitledto two days' paid resettlement leave upon returning to their Home Base.

    23.8 Engineers/SBEs will make themselves available for all training courses onaircraft operated, maintained or serviced by the RFDS.

    SUPERANNUATION

    24.1 A Engineer'SISBE's superannuation entitlement will be determined inaccordance with the RFDS Superannuation Policy and the SuperannuationGuarantee (Administratibn) Act 7992 (Cth).

    24.2 Engineers/SBEs may elect to have their superannuation contributions paid intoa fund of their choice. The RFDS National Superannuation Plan is thenominated default fund into which contributions will be made if an

    Engineer/SBE does not elect otherwise.

    ANNUAL LEAVE

    25.1 Engineers/SBEs will be granted 20 working days annual leave on full pay foreach year of service.

    25.2 Engineers/SBEs will accrue and take annual leave in accordance with theRFDS' Leave Policy.

    LONG SERVICE LEAVE

    Long service leave will be granted and taken in accordance with the appropriate Stateor Territory legislation, and the RFDS' Long Service Leave Policy.

    PERSONAL LEAVE

    Engineers/SBE will accrue and take personal leave in accordance with the RFDS'Personal Leave Policy.

  • 28. PARENTAL LEAVE

    Engineers/SBE will accrue and take parental leave in accordance with the RFDS'Parental Leave Policy.

    JURY SERVICE

    29.1 An Engineer/SBE, who is required to attend for jury service during their normalduty time, will be reimbursed by the RFDS an amount equal to the differencebetween the amount paid in respect of an Engineer'SISBE's attendance forsuch jury service and the amount of salary an Engineer/SBE would havereceived had an Engineer/SBE performed normal duty.

    29.2 The Engineer/SBE will notify the RFDS as soon as possible of the date uponwhich they are required for jury service.

    29.3 The Engineer/SBE will furnish proof to the RFDS of their attendance for juryservice, the duration of such attendance and the total remuneration theyreceive as a result of such attendance.

    UNIFORMS

    30.1 Where the RFDS requires a uniform to be worn, the RFDS will provide such inaccordance with RFDS Uniform Policy.

    30.2 The cleaning and maintenance of the uniform will be the responsibility of theEngineer/SBE.

    30.3 Disposable overalls will be made available for dirty work.

    30.4 On termination of employment, all uniforms must be returned to the RFDS.

    TEMPORARY AND PERMANENT RELOCATION

    31.1 Relocation assistance and entitlements relating to Engineers/SBEs whotransfer temporarily or permanently will be provided in accordance with RFDSRelocation policy.

    OCCUPATIONAL HEALTH AND SAFETY

    32.1 The parties agree to comply with their respective duties and responsibilitiesarising under the applicable occupational health and safety legislation.

    32.2 Engineers/SBEs will be required to engage in work behaviour that is safe toensure that they and their fellow colleagues are safe in the workplace.

    32.3 Engineers/SBEs will be required to abide by all occupational health and safetystandard, policies and directives of the RFDS.

    INDEMNITY I INSURANCE

    33.1 An Engineer/SBE required to fly in any aircraft will be indemnified/insured bythe RFDS against death or totally incapacitating injury, which may arise fromthe use of that aircraft for not less than $45,000.

  • 33.2 Such indemnity/insurance need not be provided by the RFDS where theEngineer/SBE will receive a benefit of not less than $45,000 in the event ofdeath or totally incapacitating injury by way of insurance taken out by theaircraft or charter operators or by way of the RFDS sponsored superannuationscheme.

    33.3 The amount payable under this Clause will be additional to any amount anEngineer/SBE or the Engineer'SISBE's next of kin may be entitled to receiveunder any workers' compensation payments or similar provisions.

    Subject to the terms and conditions of the relevant insurance policy, the RFDSwill provide insurance cover for Engineers'/SBEs' personal toolkit, provided theEngineer/SBE has provides a replacement value schedule to the RFDS at 12monthly intervals. The insurance provided is limited to $25,000 perEngineer/SBE for personal items, subject to provision of value from eachEngineer/SBE with $100,000 maximum for whole of organisation in any oneclaim.

    33.5 Engineers/SBEs have the shared responsibility to house the item(s) undersecurity provided by the RFDS within their workplace and there exists anexcess of $500 each claim which is the Engineer'SISBE's responsibility.

    CONFIDENTIAL INFORMATION

    Engineers/SBEs must not disclose, divulge, communicate to or otherwise place at thedisposal of any third party, in any form or by any means, and must keep in the strictestconfidence, any Confidential Information and Sensitive Information of which he/shebecame aware through the performance of their employment, except as required bylaw.

    34.

    35. TERMINATION AND RESIGNATION

    35.1 Resignation

    35.1. I Upon successful completion of their qualifying period, anEngineer/SBE may terminate their employment by giving the RFDS atleast four weeks' written notice.

    35.1.2 If an Engineer/SBE does not provide the requisite notice, theEngineer/SBE forfeits to the RFDS the equivalent number of weeks'salary.

    The parties may agree upon a lesser period of notice. This will be atthe discretion of the RFDS.

    35.1.3

    35.2 Termination

    35.2. I The RFDS may terminate an Engineer'SISBE's employment, forreasons other than serious or wilful misconduct, by the giving notice tothe Engineer/SBE (or payment in lieu of notice) in accordance with thetable below:

    The RFDS may terminate an Engineer'SISBE's employment withoutthe requisite notice if the Engineer commits an act of serious or wilfulmisconduct.

    Upon resignation or termination of an Engineer'SISBE's employment, they mustdo the following :

    35.3. I Return all property belonging to the RFDS; and

    35.3.2 Repay, or cause to be repaid, any monies owed by consenting to theRFDS to deduct monies from any accrued entitlements (such as leave,but not limited to leave) that may be owing to the RFDS at the date oftermination.

    36.

    REDUNDANCY

    At least 4 weeks

    36.1 Purpose

    For the purposes of this Clause, redundancy means where the RFDS no longerwishes the job the Engineer/SBE has been doing to be done by anyone, andwhere this is riot due to the ordinary and customary turnover of labour.

    Discussions Before Terminations36.2

    36.2. I Where the RFDS has made a definite decision that lead tomaytermination of the employment of an Engineer/SBE or Engineers/SBEsfor redundancy reasons, the RFDS will hold discussions with theEngineer/SBE(s) directly affected and, if requested by theEngineer/SBE(s), their representative.

    The discussions will take place as soon as is practicable after theRFDS has made a definite decision which will invoke the provisions ofthis Clause and will cover, among other things, any reasons for theproposed changes, measures to avoid or minimise any terminationsand measures to minimise any adverse effect of any terminations.

    36.2.2

  • 36.2.3 For the purpose of such discussions, the RFDS will provide, in writing,to the Engineer/SBE(s) concerned and, if the Engineer/SBE(s) haverequested, their representative, all relevant information about theproposed changes, including the reasons for the changes, the numberand categories of Engineers/SBEs likely to be affected and the numberof Engineers/SBEs normally employed and the period over which thechanges will be implemented. The RFDS will not be required todisclose confidential information the disclosure of which would bedetrimental to its interests.

    Transfer To Lower Paid Duties

    Where an Engineer/SBE is transferred to lower paid duties for redundancyreasons, the Engineer/SBE will be entitled to the same period of notice oftransfer, as the period of notice of termination the Engineer/SBE would havebeen entitled to had the employment been terminated, and the RFDS may, atthe RFDS' option, make payment in lieu thereof of an amount equal to thedifference between the former ordinary weekly rate of wage and the new lowerordinary weekly rate of wage for the number of weeks of notice still owing.

    Severance Pay

    36.4. I In addition to the periods of notice of termination prescribed in Clause35 of this Agreement, an Engineer/SBE, whose employment isterminated for redundancy reasons, will be entitled to the followingamount of severance pay in respect of a continuous period of service,based on the Engineer'SISBE's total salary as specified in Schedule I :

    36.4.2 For the purpose of this Clause, continuity of service will not be brokenon account of:

    36.4.2.1 any interruption or termination of the employment by theRFDS if such interruption or termination has been mademerely with the intention of avoiding obligations there underin respect of leave of absence;

    36.4.2.2 any absence from work on account of illness or injury forwhich an Engineer/SBE is entitled to claim personal pay asprescribed by this Agreement on account of leave lawful Iygranted by the RFDS; or

    36.4.2.3 Any absence with reasonable cause, proof whereof will beupon the Engineer/SBE. Provided that, in the calculation of

  • continuous service under this sub-clause, any time inrespect of which an Engineer/SBE is absent from workexcept time for which an Engineer/SBE is entitled to claimannual leave, personal leave, long service leave and publicholidays as prescribed by this Agreement will riot count astime worked;

    36.4.2.4 Service by the Engineer/SBE with an enterprise which hasbeen transmitted from one RFDS organisation to another,and the Engineer's service has been deemed continuous.

    EngineerIs BE Leaving During Notice

    An Engineer/SBE, whose employment is to be terminated for redundancyreasons, may terminate employment during the period of notice and, if so, willbe entitled to same benefits and payments under this Clause had theyremained with the RFDS until the expiry of such notice. However, in thiscircumstance the Engineer/SBE will riot be entitled to payment in lieu of notice.

    Alternative Employment

    The RFDS, in a particular redundancy case, may make application to FWC tohave the general severance pay prescription varied if the RFDS obtainsacceptable alternative employment for an Engineer/SBE.

    Time Off During Notice Period Of This Clause

    36.7. I During the period of notice of termination of employment given by theRFDS, an Engineer/SBE, whose employment is to be terminated forredundancy reasons, will, for the purpose of seeking otheremployment, be entitled to be absent from work for up to a maximumof one day during each week of notice without deduction of pay.

    36.7.2 If an Engineer/SBE has been allowed paid leave for more than oneday during the notice period for the purpose of seeking otheremployment, the Engineer/SBE will, at the request of RFDS, berequired to produce proof of attendance at an interview or theEngineer/SBE will not receive payment for the time absent. For thispurpose a statutory declaration will be sufficient.

    EngineerslSBES With Less Than One Year Of Service

    Engineers/SBE with less than one year continuous service will be given noticeof the impending redundancy at the first reasonable opportunity and the RFDSwill take such steps as may be reasonable to obtain suitable alternativeemployment for such Engineers/SBEs.

    EngineerslSBES Exempted

    36.9. I This Clause will riot apply where:

    36.9.1.1 Employment is terminated as a consequence of theEngineer'SISBE's serious or wilful misconduct;

    36.9.1.2 An Engineer/SBE is engaged on a casual basis; or

  • 36.9.1.3 An Engineer/SBE is engaged for a specified period of time(eg a fixed term contract) or for a specified task or tasks.

    36.10 Dispute Settling Procedures

    Where a dispute arises about the meaning or application of these provisionsthe matter will be dealt with under Clause 37 hereof, or referred to FINC.

    37. DISPUTE RESOLUTION PROCEDURE

    In the event of a dispute or grievance arising in the workplace about matters arisingout of the Agreement or in relation to the National Employment Standards, theprocedure for resolving the dispute will be either of the following, depending on thenature of the matter.

    37.1. I The Engineer/SBE and their supervisor will meet and confer to try andresolve the matter.

    37.1.2 If the matter is not resolved at such a meeting, the parties will arrangefor further discussions between the Engineer/SBE and their nominatedrepresentative (if any) and more senior levels of RFDS management.

    37.1.3 If the matter remains unresolved, the parties may convene aconference between the Engineer/SBE, their representative Of any)and the Chief Executive Officer and their nominated representative Ofany).

    37.1.4 If the matter continues to be unresolved, either party may refer thematter to FWC or a mutually agreed third party, in the first instance, forconciliation and, thereafter, arbitration. .

    37.1.5 Without prejudice to either party, and except where a bona fide healthand safety issue is involved, work will continue as normal, whilematters in dispute are being dealt with in accordance with theseprocedures.

    37.1.6 An Engineer/SBE, who is a representative of the Engineers/SBEsgenerally and who attends meetings with management for reasonsrelated to this Clause, will be paid for the time spent at such meetings,and travelling to and from their workplace to the place of meetings, upto eight hours on any one day, if they would have otherwise lost payfor that time. The RFDS' liability under this Clause will be limited to atotal payment in any calendar year of five days.

    Part 2 (Matters Related To Civil Aviation Act 7988 (Cth), Section 300L)

    37.2. I In the event of an Accident or Serious Incident, as defined in thisAgreement, Engineers/SBEs involved are to make a statement,without prejudice, as soon as practicable. Such statement may bemade in the presence of a friend or representative.

  • 37.2.2 After receiving the statement from the Engineer/SBE, the RFDS isentitled to stand the person down with pay whilst the statement isconsidered.

    37.2.3 Should the RFDS be satisfied with the statement and no further actionis required, the Engineer/SBE so cleared will be advised to resumenormal work without prejudice.

    37.2.4 Where the RFDS proposes to further interview an Engineer/SBE inconnection with the Engineer'SISBE's alleged involvement in anAccident or Serious Incident, which may lead to disciplinary actionbeing taken against the Engineer/SBE, the Engineer/SBE will beinformed by the RFDS:

    37.2.4.1 Of the purpose for the interview;

    37.2.4.2 Of the allegation against him/her and the reasons therefore;

    37.2.4.3 That disciplinary action may result; and

    37.2.4.4 That the Engineer/SBE has the right to be accompanied,and represented, by a representative of their choice.

    37.2.5 The Engineer/SBE may request reasonable time (not more than 24hours) to become familiar with matters set out in Clause 37.24.

    37.2.6 If the RFDS elects to be accompanied and/or represented by arepresentative, the Engineer/SBE may require that the advice given inClause 37.24 be repeated in the presence of their representative.

    37.2.7 If, following such interview, the RFDS proposes to dismiss, suspendwithout pay, or remove the Engineer/SBE from a supervisory position,the Engineer/SBE will be informed of that proposed disciplinary actionin the presence of their representative.

    37.2.8 In the event that an Engineer/SBE is dissatisfied with the decision, thematter may be referred to FWC for resolution

    37.3 In addition to other provisions of this Clause, in the prevention or settling ofdisputes, the duly appointed Engineer/SBE representative is entitled, uponrequest made by an Engineer/SBE or group of Engineers/SBEs, to such paidtime during working hours as is necessary to meet with the RFDS or itsrepresentative to discuss matters affecting the Engineers/SBEs

    MODEL TERMS

    38.1 The provisions of Schedule 2.2 of the Fair Work Regulations 2009 (Cth) areincorporated into this Agreement.

    39.1 The parties undertake that, for the duration of this Agreement, they will riotpursue any extra claims.
