Item No. 15Representative of KSRTC appeared; Heard. Regular permit on the route Payyannur-Panappuzhachal (via) Payangadi, Neruvambram, Pariyaram Medical College in respect of S/C KL-15/7705 is grantedwith the proposed time schedule.

Item No. 16Heard. Adv. Sri. P P Abdul Latheef the learned counsel represented for the applicant Sri Rajan P K for grant of regular stage carriage permit on the inter-district route Thottilpalam –Thalassery-Panoor (via) Kuttiadi, Nadapuram, Peringathur, Chokli, Manjodi, Manekkara, Koppalam . RTA Vatakara granted concurrence for the portion of the route in that jurisdiction. There was objection from enroute operators regarding proposed time schedule. The application was in respect of S/C KL-18/F-1080 or suitable vehicle. Today the applicant offered a S/C KL-18/Q-1107, which is not owned by the applicant. It is submitted that the vehicle is taken on lease by the applicant. As per section 66 of M.V Act, the owner of the vehicle shall obtain permit to ply his vehicle as transport vehicle. The Secretary RTA is directed to ascertain the genuineness of lease of the stage carriage and possession of vehicle and also the legal aspect in the reported judgment, Bhaskaran V. RTA, Alleppy, 2003(1) KLR 106. Adjourned.

Manoharan E for the grant of regular stage carriage permit on the route Thachangad – Mattannur- Sivapuram (via) Nediyanhiram, Vembady, 21st mile, Ayyallur in respect of S/C KL-13/H-9902. Fresh regular permit granted as applied for subject to settlement of timings.

Item No. 19Heard, the applicant Sri V J Thomas for the grant of regular stage carriage permit on the route Mampalam-Sreekandapuram-Kappattukunnu-Chemperi (via) Naduvil, Chempanthotty, Adoor, Malappattam, Panniyottumoola, Bhagathsign Vayanasala, Chundakunnu, Karayathumchal, Kannadipara in respect of S/C KL-13/K-1573. There was no serious objection. Hence fresh permit granted as applied for subject to settlement of timings.

Item No. 20Heard Sri. Stalin Peter Davis the learned counsel represented the applicant Smt. Vasantha, M for the grant of regular stage carriage permit on the route Payyannur-Chittarikkal-Kozhichal (via) Cherupuzha, Pulingome in respect of KL-13/L-6949. There is no objection other than timing. Hence permit granted as applied for subject to settlement of timing.

Item No. 21Heard Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Jamsheer, for the grant of regular stage carriage permit as LSOS on the route Chalode-Mattannur-Iritty-Thalassery. The Motor Vehicles Act and rules are conspicuous by the absence of the term ‘Limited Stop Ordinary Service.’ The main intention of the applicant is for the elimination of stopping on certain bus stops on the route preferably near educational institutions and at places where commuters are lesser in number and that may to perform faster/speedy service causing dangerous overtaking, which affect public safety.

Most number of trips are scheduled between Thalassery-Mattannur-Iritty where the road condition is not good at present and sufficient stage carriages are plying and only one trip to Chalod on modification for lengthy route.

Today the applicant offered a stage carriage bearing registration no. KL-58/Q- 8388 which is obtained on lease agreement. He has no ready vehicle in his name for this appliction.

The Secretary RTA is directed to conduct enquiry regarding genuineness and legal validity of lease agreement and the possession of the offered vehicle. Hence adjourned.

Item No. 22Heard Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Prakasan for the grant of LSOS permit on the route Peralassery Temple-Kuthuparamba-Thalassery-Iritty (via) Pookode, Mattannur, Uliyil. Though the total length of the route is 52.5Km., the main plying intended is between Thalassery and Iritty as per proposed time schedule where there is sufficient stage carriages are plying. The application for LSOS is only to eliminate stoppings near educational institutions and at places where commuters are lesser in number and to perform faster/speedy service causing dangerous overtaking which may affect public safety. Further, the term “LSOS” is conspicuously absent in KMV Rule, 1989.

While submitting the application, the applicant has offered a stage carriage having valid permit on the route Thaliparamba –Manikkadavu valid upto 05.01.2019. He has no other ready vehicle. The grant of permit in respect of the offered vehicles will lead to double permit of a vehicle

which could not be performed or may compel to surrender of permit on the route causing shortage of service now enjoying by the travelling public.

Hence permit is granted on the above route as ordinary moffusil (without limited stop) subject to the condition that he shall produce current records of permitless suitable vehicle before Secretary, RTA, Kannur within a period of one month and otherwise the application stands rejected.

Item No. 23Heard Sri P P Abdul Latheef the learned counsel represented the applicant Sri Prakashan for the grant of permit as LSOS on the route Iritty-Thalassery-Kuthuparamba-Chakkarakal (via) Pookode, Mattannur, Moonuperiya, and Mamba. The term Limited Stop Ordinary Service (in short LSOS) is absent in KMVRule 1989. The same application was considered in the meeting of RTA held on 07.05.15 and subsequently a modified application on a longer route is submitted. But only one trip to extended portion between Chakkarakkal-Thalassery. The other portion is well served.There was objection from operators on the sector for grant of permit as LSOS. The limiting of bus stops only results isolated islands on the route having educational institutions and lesser number of commuters. Further, there will be tendency of speedy service with dangerous overtaking and disparity of running time with existing operators. Hence “LSOS” cannot be allowed.

There is no ready vehicle even at the time of considering the application. The applicant offered a new vehicle before RTA, but the records of the vehicle not submitted. Hence regular ordinary service (without limited stop) permit granted subject to the settlement of timings and withfollowing conditions.

1. The vehicle shall ply between chakkarakkal and Iritty in all trips, ie without cut trips. 2. Current records of the vehicle shall be produced within a period of one month before Secretary RTA.The non compliance of above condition will result the grant as rejected.

Item No. 24Heard Adv. Sri. P P Bharghavan the learned counsel represented the applicant Sri Pramod N, for the grant of ordinary stage carriage permit on the route Sreekandapuram-Alakode-Chandanakampara (via) Karuvanchal, Naduvil, Chembanthotty, Nediyanga, Payyavoor. No vehicle offered by the applicant. This will not comply the provisions of Section 85 of M.V Act and Rule 143 and 144 of KMV Rule 1989. The applicant requested one month time to produce vehicle. However the permit is granted as applied for subject to settlement of timings and production of current records of suitable vehicle within a period of one month from today before the Secretary RTA. The application for grant of permit will stand as rejected if current records of the vehicle are not produced within one month.

Item No. 25Heard Adv. Sri. E K Ramakrishnan, the learned counsel represented the applicant Sri Santhosh M for the grant of regular stage carriage permit on the route Cherupuzha-Kuttiadi (via) Therthalli, Alakode, Oduvally, Naduvil, Sreekandapuram, Irikkur, Mannurpalam, Mattannur, Kuthuparamba, Panoor, Nadapuram, Mekkunnu as LSOS. The total length of the route is 120 Kms and a portion of 21.5 Km lies in the jurisdiction of Vadakara RTA. Hence Secretary RTA is directed to seek concurrence from RTA Vadakara and report the details of other Stage carriage plying on the route or portions with LSOS permit. Hence adjourned.

Item No. 26Heard Adv. Sri.E K Ramakrishnan, the learned counsel represented the applicant Sri Manoj Kumar P V, for the grant of regular stage carriage permit on the route Taliparamba-Chemberi Engg. College-Mayyil (via) Valakkai, Chembanthotty, Chepparamba, Sreekandapuram, Chenglayi, Vadakkanchery,

Parassinikadavu, Mullakody, Malapattam, Kaniyar vayal. The applicant offered a new stage carriage within one month from today.

The report of field officers is not specific. The Secretary RTA is directed to obtain a specific report containing required particulars and the daily mileage on ill served area and strength of Stage Carriage services on the sector. Hence adjourned.

Item No. 27Heard Adv. Sri. E K Ramakrishnan, the learned counsel represented the applicant Sri Hassainar S P, for the grant of regular ordinary stage carriage permit on the route Kadukkaram-Taliparamba-Cherupuzha-Therthalli-Karuvanchal (via) Perumpadavu, Chapparapadavu, Nadukani, Kakkara, Nhekli, Padichal, Eruvatty, Alakode in respect of KL-13/N-1020 or suitable vehicle. The offered vehicle is having permit on another route upto 25.11.2018. The surrender of this permit lead to inconvenience of the passengers who are enjoying that service. The applicant submitted today that he shall produce current records of a new vehicle within one month from today. Accepting this version, permit granted as applied for subject to settlement of timing with a condition that if the vehicle is not produced within one month, application for grant of permit will stand as rejected.

Item No. 28Heard, Adv. Smt. Domittilla the learned counsel represented the applicant Sri Sahil A, for the grant of regular ordinary stage carriage permit on the route Naduvil-Kannadippara-Taliparamba-Muthussery (via) Thazhe Vilakkannur, Padappengad, Someswary Temple, Chimminichootta, Nadukani, Oduvally, Karuvanchal, Karthikapuram, Udayagiri, Thaliparamba . The offered vehicle in the application KL-59/A-3488 is having another permit valid upto 24.04.2017. The route portion is having a virgin portion of 1.6 Km. The applicant offered a vehicle KL-60/6575 today which is said to be as on lease. Hence Secretary RTA is directed to; (a) ascertain the genuineness of lease agreement and possession of the vehicle; (b)obtain road fitness certificate from the concerned authority.Hence adjourned.

Item No. 29Heard Adv. Sri. P P Abdul Latheef the learned counsel represented for the applicant Sri Ahammed P for the grant of regular ordinary stage carriage permit on the route Chemperi –Puralimala-Taliparamba (via) Sreekandapuram, Chepparamba, Irikkur, Iritty, Peravoor, Muringodi, Chengalayi in respect of S/C KL 58/A 6777. Fresh regular permit granted as applied for subject to the settlement oftimings .

Item No. 30Heard Adv. Sri. P P Abdul Latheef the learned counsel represented for the applicant Sri Ligin M for the grant of regular ordinary stage carriage permit on the route Thalassery-Mamanam Ambalam (via) Irikkur, Mannurpalam, Mattannur, Anjarakandy, Chakkarakal, Moonuperiya, Peralassery, Mambaram, Parapram, Andaloorkavu, Meloor, Mammakunnu, Kadachira. The applicant offered Stage Carriage KL-13/J-7567 (on lease) today.

Severe objection from KSRTC and other operators on the sector stating that the early hour starting will not be beneficial to public and not feasible. This is only to defeat the provisions ofscheme by elongating the route in a non feasible manor. They also alleged that the findings of field officer are not correct. Hence Secretary RTA is directed to conduct enquiry regarding the genuiness of lease agreement with possession of vehicle and obtain a specific detailed report for next RTA. Hence adjourned.

Item No. 31Heard Adv. Sri. P P Bharghavan the learned counsel represented the applicant Sri Shybin Mathew for the grant of regular ordinary stage carriage permit on the route Charal- Iritty-Chedikkulam (via)

Murikkumkari, Vaniyappara, Angadikadavu, Anapanthikavala, Vallithode, Edoor, Vellarvayal, Aralamfor a period of 5 year.

The offered vehicle KL-58/B-8250 is having permit in another route, Charal-Chedikkulam. No free vehicle offered by the applicant. If permit is granted, it will result double permit or undue surrender of permit forcing difficulty for the passengers on that route. Hence regular permit is granted subject to settlement of timing on condition that the applicant shall produce current records of a later model suitable vehicle within a period of one month. Non compliance of the condition will result the grant as revoked.

Item No. 32Heard. Adv. Sri. P P Abdul Latheef the learned counsel represented for the applicant Sri Shybin Mathew for the grant of regular ordinary stage carriage permit on the route Kayyappanachi-Sreekandapuram-Mudakozhi-Aralam (via) Punnad, Iritty, Irikkur, Kalliad, Alathuparamba, Kombanpara, Padiyoor, Kakkengad, Muzhakunnu, Haji road, Aralam, Edoor, Madathil, Mattannur, Uruvachal . While applying he has mentioned in the application the vehicle as KL-13/J-3132. But this vehicle is having permit on another route upto 15.06.2020. Today in the meeting , the applicant offered KL-13/W –2020, which is not owned but leased. The Secretary RTA is directed to enquire and report the genuineness of the lease agreement and possession of the vehicle. Hence adjourned.

Item No. 33Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Tomy K P for the grant of regular ordinary stage carriage permit on the route Kariyamkappu-Panniyammala-Poolakutty (via) Adakkathode, Chittiyamparamba, Kelakam, Mannanchery, Manjalampuram, Kolakkad for a distance of 3 Km is virgin for Stage Carriage permit. The Secretary RTA is directed to obtain fitness certificate of that portion from the authorities concerned and then place before RTA . Hence adjourned.

Item No. 34Heard Adv. Sri. P P Bharghavan the learned counsel represented the applicant Sri Alikunhu for the grant of regular ordinary stage carriage permit on the route Cherupuzha-Rajagiri-Kamballur-Chittarikkal-Thirumeni (via) Nallampuzha, Kadumeni, Pulingome in respect of KL-59/D-3237. A portion of the route 13 km lies within the jurisdiction of RTA, Kasaragode. Secretary RTA is directed to seek concurrence and then place the matter before this RTA. Hence adjourned.

Abdulla N P for the grant of regular ordinary stage carriage permit on the route Ettikulam –Puthiyapuzhakulangara-Cherukunnuthara (via) Palakkode, Muttam, Payangadi, Ramanthali, Kunnatheru, Kallattumkadavu, Payyannur,Edat, Kunhimangalam . No vehicle is mentioned in the application. Today applicant offered KL-13/J-7082 and requested one month time to submit current records of the vehicle. Secretary RTA is directed to verify whether the offered vehicle is having any other valid permit and place in next RTA. Hence adjourned.

He has not furnished the details of vehicle with the application. Today, the applicant offered Stage Carriage KL-18/C-1497. Ramakrishna the learned counsel represented the applicant Sri Vineesh Kumar forthe grant of regular ordinary stage carriage permit on the route Kunnathurpady-Adikadalayi (via) Irikkur, Chalode, Muthukoth, Elayavoor Colony, Kannur HQ Hosp. The applicant proposed only one trip to Kunnathupady and Adikadalayi where there are no sufficient services. The timings (4:00 am on early morning and 11:28 Halt at night) are not viable or feasible to conduct service and not for the convenience of the public. It felt that it is only to defeat the scheme violation. Secretary RTA is directed the ascertain with the applicant to modify the number of trips and suitable timing for a feasible service and place before next RTA .Hence adjourned.

Uvaib K K for the grant of regular stage carriage permit on the route Irikkur-Kannur HQ Hosp.-Iritty (via) Nayattupara, Vaduvankulam, Chekkikulam, Chappa, Kollanchira, Valiyannur, Melechovva, Mundayad, Chandroth peedika, Elayavoor colony, Chalode, Mattannur, Keezhur . As per the time schedule proposed, the main operation of service is between kollamchira-Kannur HQ Hospital-

Modukoth where there is an overlapping of 3 Km on notified route and only one trip between Irikkur and Kollamchira and between Iritty and Irikkur. The only trip from Irikkur at 8:59 pm to Iritty is not seems to be viable or beneficial to commuters in later hours with halting at 11:43 pm. The single trip on a longer portion of route is only to defeat the scheme. The applicant is directed to submit a modified application, adding more service to Iritty with viable timing. Hence adjourned.

Item No. 43Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Athul K M for the grant of regular stage carriage permit on the route Azheekkal –Kannur HQ Hosp. (via) Alavil, Munnunirath, Valapattanam, Puthiyatheru, Panamkavu, Kakkad. There was serious objections from different corners stating that the findings of field officer is not correct.

The applicant today offered a vehicle bearing registration no. KL-13/N-2700 which is not owned by him but taken on lease.

The Secretary RTA is directed to submit a specific report on the application. He is also directed to ascertain the genuineness of lease and possession of vehicle. Hence adjourned.

Item No. 44Heard Adv. Sri. P P Bharghavan the learned counsel represented the applicant Sri . Sujith P for the grant of regular stage carriage permit on the route Thalassery-Mudappathur (via) Kuthuparamba, Manantheri, Chittariparamba. The applicant furnished vehicle KL-13/M-124 with application but the vehicle has valid permit on the route Mambaram – Paravoor upto 26.07.2020.

The grant may result surrender of permit which cause difficulties on travelling facilities on that sector. The applicant offered another suitable vehicle (reg. Number not mentioned) within a period of one month from today.

Hence permit granted as applied for subject to settlement of timing on condition that the applicant shall produce current records of a suitable vehicle within a period of one month from today before the Secretary RTA, Kannur. This grant of permit will stand as revoked on the ground of non compliance of above condition.

Item No. 45Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Abdul Saleem Parakkandy for the grant of regular stage carriage permit on the route Mattannur-Kannur-Thalassery (via) Uruvachal, Kuthuparamba, Pathiriyad, Champad,Orappally, Vengad theru, Kadirur for a period of 5 years.

The route overlap on notified route for a distance of 3 km from Melechova Caltex Jn. As per proposal only one trip to Mattannur and Thalassery, only to elongate the route to escape from scheme violation. KSRTC and some other operators objected the grant stating that main plying is between Kuthuparamba and Kannur, where the route is overlapping. Hence the applicant is directed to modify the proposal so as to provide more trips to Thalassery and Mattannur. Hence adjourned. The Secretary RTA is directed to correct the mistake in proposed time schedule.

Item No. 46Heard Adv. Sri. The vehicle KL-13/J-4545, mentioned in the application has a valid permit on the same route up to 12.05.2020. The applicant today offered a leased vehicle KL-13/K-4281 which is not owned by him.

P P Abdul Latheef the learned counsel represented the applicant Sri Abdul Rasheed for the grant of regular stage carriage permit on the route Iritty – Mattannur-Kelakam (via) Kakkangad, Thillenkeri, Sivapuram, Uruvachal, Ulliyil, Peravoor, Kolakkad, Maiyalampuram . The offered vehicles KL-13/N-135 has obtained a permit recently on the route chettikulam- Iritty having validity upto 18.05.2020. Further grant of regular permit is not feasible. He has no ready vehicles for conducting service. He has not offered any ready vehicles even today. Hence adjourned.

The regular permit granted as applied for in respect of S/C KL-13-J-4143 subject to settlement of timings.

Item No. 51Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Rajesh P for the grant of regular stage carriage permit on the route Poolakutty-Ulikkal-Adakkathode (via) Nidumpoil, Peravoor, Iritty, Peruvamparamba, Kalluvayal, Nellikkampoil, Thondiyil, Manathana, Kelakam . The applicant furnished registration number of vehicle KL-58-6083, having valid permit on another route Poolakutty – Arayamkod upto 23.01.2017. He also submitted that a suitable vehicle will be produced within one month from today.

The permit is granted as applied for subject to settlement of timings with a condition that the current records of another suitable vehicle owned by him shall be produced before RTA, Kannur within a period of one month.The sanction will stand as revoked on the ground of non-compliance of above condition.

Item No. 52Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Babu K M for the grant of regular stage carriage permit on the route Thaniyulla poil-Thalassery-Kuthuparamba (via) Kumbalachola, Kaivelli, Kakkattil, Nadapuram, Peringathur, Manjodi, Kadirur, Pookode, Kayalode, Thottummal, Kolassery. A portion of route having distance of 26.5 Km lies within the jurisdiction of RTA, Vadakara. Secretary RTA is directed to seek concurrence of sister RTA. There

was objection from other operator on the report of MVI regarding frequency of services on the sector. A specific report is needed in this case from the Secretary RTA. Hence adjourned.

Item No. 53Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Sunil Kumar C for the grant of regular stage carriage permit on the route Thalassery-Kottiyoor Temple (via) Kuthuparamba, Nidumpoil, Peravoor, Thondiyil, Manathana, Kelakam The vehicle mentioned in the application is having a valid permit on the route Kottiyoor. Iritty upto 31.01.2020. The applicant today stated that he shall produce a brand new vehicle. But no records of the vehicle submitted before this authority.

The permit is sought as LSOS. The rules are conspicuously absent on the term LSOS. The non-stopping of the S/C near educational institutions, old age homes and places having lesser number of commuters is against the interest of travelling public at large. There are also chances of over speeding and dangerous overtaking. Hence adjourned with direction to submit details of offered new vehicle.

Item No. 54Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Abraham Thomas for the grant of regular stage carriage permit on the route Arayangad Snehabhavan-Kannur-Mananthavady (via) Kolayad, Kuthuparamba, Mambaram, Chala, Eachur, Chalode, Mattannur, Iritty, Peravoor, Kottiyoor, Boys town. A portion of route Chekuthan thodu to Mananthavady lies in the jurisdiction of RTA, Wayanad for a distance of 13.5 Km . The Secretary RTA is directed to seek concurrence from the sister RTA . P P Abdul Latheef the learned counsel represented the applicant Sri Dineshan A for the grant of regular stage carriage permit on the route Kayalottu thazhe-Thalassery (via) Vilakkottur, Kallikandy, Parat, Panoor, Manakkavu . The vehicle mentioned in the application is having a valid permit on the route Panoor- Thalassery- Vilakkotur upto 23.04.2016. Today applicant offered another vehicle KL-58-E-8879 which is not owned by him, but said as taken on lease.Secretary RTA is directed to ascertain the genuineness of the lease agreement and possession of the vehicle. Hence adjourned.

Item No. 56Heard Adv. Sri. P P Abdul Latheef the learned counsel represented the applicant Sri Prabhakaran K P for the grant of regular stage carriage permit on the route Peravoor – Kannur HQ Hosp (via) Iritty, Irikkur, Sreekandapuram, Adoor, Mayyil, Niranthode, Chekkikulam, Palliparamba, Kambil, Kattampally, Puthiyatheru, Vaduvankulam, Kololam, Chalode, Mattannur, Keezhur . The vehicle mentioned in the application is having valid permit on the route Panoor-Thalassery-Vilakottur upto 23.04.2016. Today he offered another vehicle KL-10/M-4970, but the same is not owned by the applicant.

The major service portion of the route is between Chekkikulam-Kannur HQ Hospital, where there is an overlapping of 5 km in notified scheme. The length of the route extended to 115 km so as to defeat the scheme. Only one trip between peravoor and chekkikulam, that too starts from Peravoor at 04:30 am, which is not feasible or beneficial to travelling public.

The Secretary RTA is directed to obtain a modified proposal from the applicant with more than one trip on the entire route. The Secretary RTA is also directed to verify the details of vehicle offered with possession of the vehicle. Hence adjourned.

Item No. 57Application for fresh regular permit was submitted by the applicant Smt. T V Sindhu on 19.07.2004 and the permit was granted by this RTA on 19.10.2004, even without a ready vehicle in possession of the applicant as per Rule 159(2) of KMV Rules. The grantee( the Appellant in MVAA No. 40/2014) failed to produce the current records of a suitable vehicle, despite specific direction to that effect. The maximum period permissible under Rule 159(2) of KMV Rules was over and off late, the grant o f permit was revoked as per the provisions of Rule 159(2) of KMV Rules for failure to produce certificate of registration of a suitable vehicle. There was no cancellation of permit u/s 86 of MV Act as there was no issue of a complete permit u/s 85.

Pursuant to the direction of Hon’ble High Court and Orders of STAT, this authority reconsidered the matter on 22.01.2014 and rejected the application on valid grounds.

On the basis of Judgement dated 22.04.2015 in MVAA No. 40/2014, the matter is reconsidered today on merit. Heard Advocate Sri. P P Bhargavan, the learned counsel represented the appellant, Smt. T V Sindhu and the representative of KSRTC. The counsel for appellant submitted that he has a new vehicle in his possession and ownership and produced a copy of temporary registration “KL-07/BT Temp.6080 to avail the permit if granted. He also stated that the rejection of permit was set aside by the STAT. But the representative of KSRTC vehemently objected the grant stating that the route portion covers or overlap 9(Nine) kilometre on notified route and the grant is against the provision of MV Act 1988.

As per the report of field officer, the total length of the route applied is 63 Km and out of which 9 Km from Keltron Nagar to Kuppam is overlapping on notified scheme vide GO(P) NO. 42/2009/Tran dated 14.07.2009 and such overlapping is violation of the said scheme.

It is true that the scheme was not in force at the time of initial grant of permit on 19.10.2004. It was solely due to the failure on the part of grantee to offer a ready suitable vehicle with the application or to produce current records in a later date as required by Rules, that she could not avail the permit before the promulgation of notification of scheme. Even today, the appellant has no ready vehicle so as to meet the requirement of Rule 159(2) and to serve the travelling public. She has just produced a photocopy of a temporary registration issued to a chassis to which body has not been attached. The said vehicle has not been registered as a stage carriage in accordance with MV laws.

While considering the application today, afresh, this authority cannot grant a permit in violation of scheme.

Under this circumstance the sanction of application for permit on 19.10.2004 is hereby revoked under the provisions of Rule 159(2) of KMV Rules 1989.

Item No. 58This is an application for regular variation of permit in respect of S/C KL 60/C 550 operating on the route Thayeni-Taliparamba-Mazhoor (via) Pariyaram MC, Pulingome, Cherupuzha, Olayambadi. Heard Sri. P P Abdul Latheef counsel represented the permit holder and Sri. P P Bharghavan counsel represented the objector and KSRTC also in detail. The permit holder applied for the extension Mazhoor to Kalikadavu, reducing one round trip from Taliparamba to Mazhoor. On perusing the report of the enquiry officer, the proposed variation is not overlapping in NH or notified area and more over there is no virgin portion in the proposed route. It is further reported that there is no necessity for curtailing the existing route for introduction of proposed extension. Withdrawal of service is from a well served sector. Hence regular variation granted as applied for subject to the settlement of timing in accordance to the Order No. D3/875/STA/2007 dt. 8.11.2011.

Item No. 59This is an application for regular variation of permit in respect of S/C KL 18/A 97 operating on the route Puralimala-Kolithattu-Manikkadavu-Kombanpara (via) Peravoor, Iritty, Arabikulam, Nuchiyad, Vattiamthode, Padiyoor, Vallithala. Heard Sri. P P Abdul Latheef counsel representing the permit

holder and KSRTC also. Permit holder applied for regular variation of existing permit by extension from Payancherymukku to Kakkayangad (via) Meethale punnad, Kayapanachi after reducing one round trip on the route portion Iritty-Peravoor-Puralimala without curtailing the existing route portion. The enquiry officer reported that there is no virgin portion on the route applied for variation and also not overlapping in the notified route. It is further reported that withdrawal of vehicle from an ill served area and shuffling the timings will definitely affect the travelling public including students. There is no necessity under Rule 145(6) of KMV Rules 1989. Hence the application for regular variation is hereby rejected.

Item No. 60This is an application for regular variation of permit in respect of S/C KL 49/A 1515 operating on the route Kuthuparamba-Thalassery-Mudappathur-Ayithara. Heard Adv. Sri. P P Abdul Latheef counsel representing the permit holder and Sri. C Uthaman counsel representing the objectors and also KSRTC. Permit holder applied for a regular variation of permit by extension from Mudappathur to Kunderipoil (via) Pothiyottukadavu, Muthukuttypoil and to Ayithara (via)Pattari so as to provide tripsfrom Mudapathur-Kunderipoil-Ayithara. There is no virgin portion on the proposed route. There is no specific reports or notes submitted by the Secretary RTA. The effect of curtailment of trip and acceptability of extension with notified scheme not reported. The necessity U/s 80(3) is also not reported. Secretary RTA is directed to furnish a detailed report and notes before the next RTA. Hence adjourned.

Item No. 61This is an application for regular variation of permit in respect of S/C KL 58/M 1017operating on the route Kannur-Edumba (via) Kuthuparamba, chala, Mambaram. Heard Adv. Sri. P P Abdul Latheef counsel representing the permit holder and also KSRTC in detail by this authority. The proposed variation is curtailing the existing route portion Kuthuparamba-Idumba a distance of 18 kms. On perusing the report of the enquiry officer this authority is also of the opinion that the curtailment of the route portion towards Idumba will surely affect the traveling public. The route portion Idumba is an highly ill served area (tribal colony sector) where stage carriage operation is very less at present. So the withdrawal of existing service towards Idumba is not admissible one. There is no necessity under Rule 145(6) of KMV Rules 1989. Hence the application for regular variation is hereby rejected.

Item No. 62This is an application for regular variation of permit in respect of S/C KL 58/H 1748 operating on the route Adakkathode-Thalassey (via) Kelakam, Nidupoil. Heard Adv. Sri. P P Abdul Latheef counsel representing the permit holder and Sri. Bhargavan and Sri. Stalin peter Davis counsels representing the objectors and also KSRTC in detail. The proposed variation is extending the existing route Kelakam to Kottiyoor temple a distance of 8 kms. The total route length before variation is 63 kms and after variation is 71 Kms. There is no virgin portion in on the proposed variation and there is no overlapping or notified route. The enquiry officer reported that the proposed extension will be much beneficial for the travelling public. But the same time, the conversion of the existing service as LSOS is to reduce the stops and with an intension to exclude students. The conversion to LSOS will lead to unhealthy competition and dangerous overtaking of the vehicle which effect the safety of the public. The conversion is not at all beneficial for the travelling public. Hence regular variation extension to the S/C KL 58/H 1748 is granted without conversion of class of vehicle as LSOS subject to the settlement of timings in accordance to the Order No. D3/875/STA/2007 dt. 8.11.2011.

Item No. 63This is an application for regular variation of permit in respect of S/C KL 13/AE 189 operating on the route Chandanakampara-Kannur (via) Payyavoor, Sreekandapuram, Taliparamba as LSOS. Heard Adv. Sri. P P Bharghavan counsel representing the permit holder and Adv. Sri. P P abdul Latheef

counsel representing the objector and also KSRTC in detail. This authority also considered the mass memorandum submitted by the general public from Vanjiyam. The proposed variation is the extension of one round trip from Chandanakampara to Vanjiyam (via) Onnampalam. Considering the report of the enquiry officer it is found that there is no virgin portion on the proposed variation and no overlapping on the notified route. The enquiry officer further reported that the proposed variation is through the ill served area and much beneficial for the travelling public from Vanjiyam including the students. The objection raised was only regarding the timing. Hence regular variation to S/C KL 13/AE 189 granted subject to the settlement of timings in accordance to the Order No. D3/875/STA/2007 dt. 8.11.2011.

Item No. 64This is an application for regular variation of permit in respect of S/C KL 58/D 34 operating on the route Trikkadaripoil-Thalassery (via) Thodeekkalam, Kannavam, Kuthuparamba. Heard Adv. Sri. CUthaman, counsel representing the permit holder and Adv. Sri. P P Abdul Latheef counsel representing the objector and also KSRTC in detail. The permit holder applied for the regular variation by extension from Trikkadaripoil to Vengad (via) Maloor, Sivapuram, Ayyallur, Mattannur, Keezhallur without curtailing the existing route and change of halting place from Trikkadaripoil to Vengad. As per the report of the enquiry officer there is no virgin portion on the proposed variation and also no overlapping on notified route. It is further reported that the introduction of service and halting from Vengad where stage carriage service at present is comparatively less and beneficial for the travelling public. More over there is no curtailment in the existing route. The objection raised by the other operators is only regarding timings. The proposed variation is 22 kms. Hence regular variation is granted to the S/C KL 58/D 34 as applied for subject to the settlement of timings in accordance to the Order No. D3/875/STA/2007 dt. 8.11.2011.

Item No. 65This is an application for regular variation of permit in respect of S/C KL 59/L 1215 operating on the route Thimiri-Kunnaru-Korom (via) Perumpadavu, Payyannur, Vellora, Payathampoil, Koyiprakulam.Heard Adv. Sri. P P Abdul Latheef counsel representing the permit holder and Sri. E K Ramakrishnan counsel representing the objector and also KSRTC. The permit holder applied for a regular variation by curtailing the route portion Perumpadavu to Thimiri and change of halting place from Thimiri to Vellora. Perused the report of the enquiry officer in detail by this authority. As per the report the proposed variation is 6 kms. As per the report of the enquiry officer Thimiri is an ill served area where stage carriage operation is very less at present. Representation also received from various organization against the withdrawal of service. So withdrawal of an existing stage carriage from such a highly ill served area will definitely affect the travelling public very much. This authority is of the opinion the such a practice should not be encouraged. There is no necessity under Rule 145(6) of KMV Rules 1989. Hence the application for regular variation is rejected.

Item No. 66This is an application for Temporary variation of regular permit in respect of S/C KL 13/U 225 operating on the route Muttam-Kannur-Mattool (via) Puthiyangadi, Puthiyatheru. Permit holder applied for a temporary permit on a deviated route by extension from Puthiyangadi to Choottad, curtailement cotton road to Irinav road and Payangadi to Muttam and route deviation from Pazhamchira to Kannapuram china clay road (via) Palayathuvalap, curtailment from Cotton road to Irinavu road for 3.5 Km. There is no overlapping notified route in the proposed variation and also there is no virgin portion. The proposed curtailment is on the sector where sufficient buses are conducting service at present. The proposed extension is towards Chottad which is an area where stage carriage service is not sufficient will be much beneficial for the travelling public. The proposed deviation is due to the closing of

The permit holder applied for change of halting place from Kavinmunamp to Payangadi and curtailment of route portion from Kuppam to Pariyaram MC 5 kms in NH and cotton road to Irinavu road. Strong objection was raised against the change of halting place from Kavinmunamp to Payangadi. The withdrawal of early morning trip from Kavinmunamp will adversely affect the travelling public from the route portion Kavinmunamp and Mullool to reach nearest town Taliparamba. The change of halting place is not at all beneficial for the travelling public. Hence the application for variation is rejected.

Item No. 68This is an application for regular variation of permit in respect of S/C KL 59/J 1992operating on the route Pazhassidam-Taliparamba-Chedikkulam. Heard Adv. Sri. P P Abdul Latheef counsel representing the permit holder and KSRTC in detail. The permit holder applied for a variation of extension from Padiyoor to Kalluvayal and change of halting place from Pazhassidam to Kalluvayal. Perused the report of the enquiry officer in detail by this authority. There is no overlapping in notified area on the proposed variation. As per the report of the enquiry officer 2 km of distance is virgin portion and road fitness certificate is also received from the concerned authority. The change of halting place from Pazhassidam to Kalluvayal which is highly ill served area where stage carriage service is very rare and much beneficial. Introduction of early morning and night trip towards this ill served area will much beneficial for the travelling public. There is no curtailment of existing route portion. Hence regular variation granted as applied for subject to the settlement of timings in accordance to the Order No. D3/875/STA/2007 dt. 8.11.2011.

Item No. 69This is an application for regular variation of permit in respect of S/C KL 13/S 1377 operating on the route Kannur-puthiyangadi (via) Kakkalam, Vadakkamchery, Kuttikol, Taliparamba, Ezhome and Payangadi. Heard Adv. Sri. E K Ramakrishnan counsel representing the permit holder and also KSRTC in detail by this authority. Permit holder applied for a regular variation of curtailment of one round trip from Kannur to Taliparamba, a distance of 40 kms in NH and also an extension from Dharmasala to Parassinikadavu a distance of 12 kms. The proposed curtailment is completely in notified route. More over the proposed curtailment is 40Km altogether. There is no necessity reported under Rule 145(6) of KMV Rules 1989. Hence the application for regular variation is hereby rejected.

Permit holder applied for a regular variation by curtailment of one round trip from Thottada ESI to Thalassery and curtailing the route portion Thottada Jn to Thottada ESI. This authority perused the report of the enquiry officer in detail. The proposed curtailment is the early morning and night trips towards Thottada ESI which is against the interest of the travelling public. So the withdrawal of service is from an ill served sector which cannot be encouraged. There is no necessity reported under Rule 145(6) of KMV Rules 1989.The

convenience offered to public as per Sec. 80(3) is not brought to our notice in a convincing manner. Hence the application for regular variation is hereby rejected.

This authority is of the opinion that the above change is a trip curtailment. As per the Govt No. G.O(P) 42/2009/Tran dated 14.07.2009 clause (19) clearly statethat –the right to operate any service additionally other than ordinary service in the State of Kerala or increase the trips shall be reserved exclusively with State Transport Undertaking. So the very purpose of the route variation itself is defeated.The necessity under R 145(6) is not reported. Hence the application for regular variation is rejected.

C Uthaman counsel for the permit holder. The validity of the permit expired on 28.04.2015 and renewal application filed on 29.04.2015. The vehicle is not conducting service presently. Delay for renewal of permit condoned subject to the remittance of Rs. 5000/- as compounding fee and renewal grantedfor a further period of 5 years from the date of expiry of permit.

Item No. 110This is an application for renewal of permit in respect of S/C KL 13/K 7799 operating on the route Vellikeel ferry-Kannur-Porakunnu valid upto 10.04.2012. Heard Adv. Sri. Abdul Latheef counsel for the permit holder. The validity of the permit expired on 10.04.2012. Renewal application was submitted on 26.03.2012. On perusing the records it is found that that the vehicle was in stoppage from 01.07.2011 to 30.09.2011 and 01.01.2012 to 31.03.2016. The tax for the stoppage period was exempted and tax arrear from 01.10.2011 to 31.12.2011 was collected on 21.07.2015. The renewal application was also filed within time. Hence renewal of permit granted subject to remittance of compounding fee of Rs. 4000/- for default of service.

Item No. 111This is an item to revoke the permit in respect of S/C KL 13/AA 4230 covered on the route Kannur-Irikkur-Sreekandapuram. Heard Adv. Sri. C Uthaman for the permit holder and Adv. Sri. P P Abdul Latheef counsel for the objector. The permit covered by S/C KL 13/AA 4230 is valid upto 31.01.2017. The permit was kept under suspended animation as per the direction of Hon’ble High Court of Kerala vide WPC No. 28396/2013. Permit holder was directed to replace with another vehicle within a period of four months. But permit holder failed to comply the order, within the stipulated period even after a notice was issued to that effect. So the application for replacement dt. 09.01.2015 was rejected by RTA stating the reason that there is no valid permit on 09.01.2015. The applicant preferred WPc No. 1527/2015 wher in this authority was directed to reconsider the replacement. But the RP filed before Hon’ble High Court of Kerala vide RP No. 220/2015 against the judgement and court ordered favorably to this authority calling back the judgement in WPc No. 1527/2015.

Now while considering this item, to revoke the permit, there was another judgement for reconsider replacement in WPc No. 12335/2015. The Secretary, RTA has filed a RP (453/2015) against the judgement of Hon’ble High Court and the same is pending before the court. Hence adjourned.

Against the impugned order of RTA the applicant preferred MVARP No. 215/2011 before STAT Ernakulam. Vide order dt. 05.07.2013 the matter was remanded back for fresh consideration with finding “ this court does not think that such conversion will adversely affect such passengers (short distance passengers) if sufficient number of service are there on the route Kottiyoor-Thalassery-Kannur (via) Peravoor, Nidumpoil, Kuthuparamba. Any way if sufficient service is there on the said route portion conversion as alleged can be allowed by RTA.

In the light of the above order, the variation application came up for fresh consideration . Heard Adv. Sri. P P Bharghavan counsel represented the applicant. The representative of KSRTC objected the conversion as LSOS. There is no detailed report of field officer as directed in the order of STAT. Supplementary Item No. 8An application for renewal of permit on the route Kayamkulam – Udayagiri as LSOS was submitted on 17.05.2012 with mentioning of wrong date of expiry of permit as 20.02.2011 and type of service as super express by somebody (whose name and address not known from the application) on behalf of Sri. Alaxander Joseph, Sanjos Bhavan, Nedumkandam, Chenganassery. The request is in respect of S/C KL 05/F 3607. This fresh application was not taken up for consideration of RTA since the same (renewal of permit of this vehicle) was settled way back in 2001 and in 2006. The petitioner preferred WPc No. 29586/2013 suppressing the fact, before the Hon’ble High Court of Kerala directed this authority to consider and dispose of the fresh application in accordance with law. In the light of Court direction, considered the application on 22.01.2014 and 11.02.2015 and happen to be adjourned. Today the same came for reconsideration.

(a) The basic application for fresh regular permit as LSOS on the route Kayamkulam-Udayagiri was received on 09.11.1994, considered by RTA on 23.02.1995 and rejected with findings “the route is very long. Finding out a time schedule is difficult. KSRTC as well as private operators having a number of similar services and introduction of this service will amount unhealthy competition. More over the timing furnished by the applicant does not accommodate facilities to driver as stipulated U/s 91 of MV Act”. The applicant preferred statutory appeal and STAT ordered on 08.06.1995 vide MVAA No. 686/95 to grant the permit to Mr. Philip Scaria as LSOS subject to counter signature from sister RTAs. This is a long distance route having jurisdiction of RTAs Alappuzha, Kottayam, Eranakulam, Trissur, Malappuram, Kozhikode. On compliance of STAT direction, permit issued on 23.02.1996 for a period of validity upto 20.02.2001, subject to counter signature of sister RTAs.

(b) In this mean time permit is transferred to Alaxander Joseph, the petitioner in WPc No. 29586/2013.

(c) In this contest no concurrence of sister RTAs received or sister RTAs counter signed the permit. Without obtaining counter signature, submitted application for renewal of permit on the entire route. There was also commission of offence for plying without counter signature. The Renewal of permit application was rejected by the RTA on 16.08.2001. The applicant filed appeal as MVAA No. 738/2001 and in the appeal STAT on 02.02.2002 ordered to reconsider the renewal application vide MP No. 1723/2001 on 16.8.2002. RTA adjourned this renewal application. Again in MP No. 2941/2003 in MVAA No. 827/2003 ordered U/s 214(2) as the permit will valid beyond the expiry date 20.02.2001 and temporary permit issued in this direction till 1/2005. The direction of STAT in MVAA No 738/2001 to renew the permit was set aside by the Hon’ble High Court of Kerala in OP No 14683/2002 with finding “when permit is sought to be renewed, there should be valid permit for operation throughout the route. If counter signature for the authority of a particular region is not obtained it cannot be said that the permit is valid over that region and thereby it is not a valid permit on the entire route”. The court upheld the decision of RTA of rejecting the renewal of permit in OP No. 14683/2002 and petitioner not challenged this judgement so far.

(d) But again renewal application was filed on 03.02.2006 obtaining a direction from Hon’ble High Court in WPc No. 11905/2006 to consider the renewal application. The renewal application considered on 22.07.2006 and rejected.

(e) In this time the vehicle S/C KL 05/F 3607 attained the expiry of eligibility period of stage carriage (15 years). No vehicle Tax at S/C rate is paid from 01.02.2005 for this vehicle. The present where abouts of the vehicle is also not known. No records of permit submitted along with the application. The vehicle is also having HP agreement and no NOC from the HP company produced, this is mandatory along with the renewal application.

Hence so called renewal application dated 17.05.2015 is liable to be dismissed at lemine due to the following reasons also:

(1) Identical application for renewal of said permit was rejected by this authority. Therefore he is not entitled to made an application of fresh in the same matter and that the rejection order was upheld by Hon’ble High Court of Kerala.

(2) The permit was expired long ago on 20.02.2001 and there does not exist any permit so as to consider any application for renewal of said permit.

(3) In fact there is no vehicle offered by the applicant. (4) Tax in respect of the vehicle mentioned in the application (KL 05/F 3607) has not paid at

S/C rate wef 01.02.2005 and the NOC from the financier has not enclosed.(5) The vehicle is not plying for the last 10 years on the route.(6) The route is objectionably overlapping with the notified route.(7) The sister RTAs have not concurred the permit. (8) The division bench of Hon’ble High Court of Kerala in Judgement dated 26.10.2015 inWA

No. 2175/2013 held that “an application for renewal of permit without being a vehicle with the application is not contemplated by Rule 172 of KMV Rules”.

Under the aforesaid reasons the application for renewal of permit is rejected.

Suppplementary Item No. 9Heard Adv. Sri. P P Abdul Latheef counsel representing for the permit holder. This is an application for renewal of permit in respect of S/C KL 58/K 6100 (pervious KL 58/C 9979). The permit was replace with later model vehicle S/C KL 58/K 6100 in compliance of the decision of Hon’ble HighCourt of Kerala vide WPc No. 11558/2015 dt. 17.04.2015. The validity of the basic permit expired on 07.08.2012 and renewal application received on 23.06.2012. Renewal of permit in respect of S/C KL 58/K 6100 granted for a period of further five years from the date of expiry of the permit subject to the remittance of Rs. 5000/- as compounding fee

Supplementary Item No. 10Heard Adv. Sri. P P Abdul Latheef, the learned counsel represented the applicant Sri Nishanth babu for the grant of regular stage carriage permit on the route Thalassery-Vadakkumbad HS (via) Kuthuparamba, Mambaram, Anjarakandy, Chakkarakal, Moonuperiya, Peralassery, Kadachira, Parapram, Meloor, Andaloor kavu, Chirakuni, Ambedkar colony, Kolassery. KSRTC and other objectors from the same route objected the grant of fresh permit stating that there is objectionable overlapping in notified route. More over applicant did not comply the decision of RTA held on 22.01.2014 to offer more trips towards ill served areas. Secretary RTA is directed to consider all these fact and furnish a detailed report and place in the next RTA. Hence adjourned.

Supplementary Item No. 11This is an application for conversion of nature of permit and replacement of S/C KL 13/Y 4094covered by the permit on the route Kasaragod-Mananthavady as Super Fast (via) Kanhangad, Payyannur, Taliparamba, Kannur, Kuthuparamba and Nedumpoil. Heard learned counsel represented the applicant. This is an application for conversion(variation) of nature of service as LSOS and replacement of vehicle KL-13/Y 4094 with another vehicle offered by the applicant on the route Kasaragode-Mananthavady. The details of offered vehicle not submitted before this RTA.

Consequent upon a judgement date 07.04.2015 in WPC 11426/2015 of Hon’ble High Court of Kerala, the outgoing vehicle (KL-13/Y 4094) was issued with a clearance certificate, without insisting surrender/cancellation of permits, with a condition that if the current records of a suitable vehicle are not produced within 06.08.2015, the permit shall stand cancelled.

The applicant hearing fail to comply the condition of the judgement and in result the permit stands cancelled. Hence it is not possible to consider the application for conversion and replacement on a cancelled permit. Hence the requests stand rejected.

Supplementary Item No. 12This is an application for regular variation of permit in respect of S/C KL 59/F 4600 operating on the route Kanhangad-Trissur (via) Kannur, Kozhikode, Edappal as Super Fast. Heard the applicant and KSRTC. Permit holder applied for the conversion of nature of permit from Super Fast to LSOS. Permit of the vehicle expired on 06.02.2013 and renewal application is under consideration due to the want of concurrence from the sister RTAs. Vehicle is now conducting service U/s 87(1)d of MV Act which is valid upto 21.03.2016. Secretary RTA is directed to obtain concurrence from sister RTAs and place both renewal and conversion application before next RTA. Hence adjourned.

Supplementary Item No. 13There is no need for consideration of this item in this RTA. However on calling it is found that the applicant is absent. Hence Rejected.
