William O. Douglas Award

David ZuckermanThe Douglas Award, the highest award presented by WACDL, will be presented to David Zuckerman tonight.

David, who recently retired from the practice of law, has been a quiet warrior in Washington’s appellate and post-conviction battles. He has represented five capital defendants on appeal; none have been executed. He has represented some of the most reviled people in our prisons. He masterfully navigated the arcane minutia of habeas procedures, constantly pushing the system to apply the most basic constitutional principles to criminal defendants.

David’s work has resulted in decisions that have helped not just his clients, but defendants throughout Washington. To highlight a few cases:

� Jones v. Wood, which reversed a murder conviction because the trial lawyer failed to present evidence of another suspect.

� PRP of Morris, which established that a courtroom closure claim could be raised on post-conviction review.

� State v. Grande, holding that the smell of marijuana from a car cannot justify arresting a passenger.

David also has been an enormous resource to his defense attorney colleagues. He taught continuing legal education programs on post-conviction practice. He consistently applied his calm demeanor, professorial analysis, and great kindness to whatever issues were brought to him.

David Zuckerman has a B.A. from Brown University (1981) and a J.D. from Northeastern University School of Law (1988). After graduation, he came to Seattle to work for The Defender Association. He served as a law clerk to the Honorable William L. Dwyer United States District Court, Western District of Washington (1991-92). He maintained a private practice with a focus on appeals up until his retirement in 2017. David served as Co-President of the Washington Appellate Lawyers Association from 2012 to 2017, and was an editor and contributing author for the Washington Appellate Practice Deskbook.

David is looking forward to spending more time with his wife and law partner, Maureen Devlin, and his twin daughters, Anna and Leah..

at several state correctional centers including its neighbor, the Washington State Reformatory.

Their mission is to provide help, hope, and love to families of prisoners. More than 1,500 families are served each year. The services include prison visitors

advocacy, child care, a clothing closet, an emergency food supply, special overnight accommodations, and family transportation service — as well as counseling and

� Testified against and helped “kill” legislation that would have allowed collection of DNA upon arrest, removed the statute of limitations for felony sex offenses, and required public defenders to snitch on their clients;

� Filed amicus briefs on issues including juvenile decline, ability to pay LFOs, crack cocaine sentencing, and Batson; and

� Submitted eight court rules proposals to the Washington State Supreme Court, addressing eyewitness identification, Brady violations, video appearances, and client access to discovery.

We know there is even more we can do, and we have an ambitious agenda for the year ahead. In the legislature, we will be supporting improvements in the law on civil forfeiture reform, sealing and vacation, DUI, police use of body cameras — and abolishing the death penalty.

Meanwhile, we are continuing to add to our online brief bank and statewide Brady list, creating new quick reference guides for criminal defense practice, and working on providing the best CLE — both in person and online. Our email discussion groups continue to provide quick access to information and opportunities to come together to develop solid and creative solutions for our clients.

GENERAL1. Each guest will be given a bid card; please keep it

with you throughout the evening. By bidding in the live or silent auction each bidder agrees to these auc-tion rules.

2. A bid acknowledged by the live auctioneer is a legal contract to purchase the item. In the silent auction, designation of your bid as the top bid is a legal con-tract to purchase that item.

3. Top bidders may pay for their items at the Auction Cashier, which opens at the close of the live auc-tion. Please make full payment for all of your items tonight.

4. Auction items will be awarded to one purchaser only. The top bid amount for an auction item will not be split among bidders who may have agreed to pay a portion of the top bid amount. If you wish to split the payment for an item, you must collect the individual payments from the other bidder(s).

5. All purchases are final and there will be no exchang-es or refunds.

6. The Auctioneer reserves the right to reject any bid that is merely a fractional advance over the prior bid.

7. We will gladly accept your payment by currency, per-sonal check, Visa, MasterCard or American Express. Please make your check payable to WACDL.

8. Unless otherwise noted, all goods and services must be claimed/used by November 1, 2018.

9. WACDL reserves the right to add or withdraw, with-out notice, items to or from the auction.

10. Purchasers may claim, from the Cashier, the certificate(s) for services. If you are the winning bidder on a tangible item, please pick it up from the designated area.

11. Reservations for trips and vacation accommodations must be mutually arranged with the donor unless otherwise noted. No refunds will be allowed on travel packages for canceled tickets and/or accom-modations.

12. All items not removed from the auction premises this evening will be stored for you at WACDL and you may claim your item(s) by appointment between December 11 and 15, 2017.

13. WACDL has attempted to describe and catalog all items correctly, but all items are offered “as is, where is.” WACDL neither warrants nor represents, and in no event shall be responsible for the correctness of descriptions, genuineness, authorship, provenance or

condition of the items. No statement made in this catalog or made orally at the auction or elsewhere shall be deemed such a warranty for tax purposes or fair market value. Items have not been appraised.

14. Each person issued a bid number (bidder) assumes all risks and hazards related to the auction and items obtained at the auction. Each bidder agrees to hold harmless from any liability arising therefrom WACDL, its elected and appointed officials, mem-bers and employees, the auctioneer(s), the auction company and its agents and employees, the event organizers, sponsors, and/or volunteers connected with the auction.

15. Values set forth for items being auctioned or donors’ estimates of fair market value are not warranted by the auction for general value. Any amount you pay above the fair market value would normally be avail-able to you as a charitable contribution. Please see your tax preparer or advisor for deductibility to you. WACDL is a 501(c)(3) charitable organization.

16. The auctioneer shall have the sole and final discre-tion to determine the successful bidder in the event of and dispute between bidders.

LIVE AUCTION17. You may bid in the live auction by holding up high

your bid card with the number toward the auction-eer.

SILENT AUCTION18. Items offered in the silent auction will have silent

auction bid forms attached to them or on a table nearby. You may bid by simply writing your bid number on the form opposite the amount you want to bid.

19. You do not have to take the next available bid amount, but may skip ahead on the form to find the amount you really want to bid. The next bidder must bid a higher amount than you did to be successful.

20. If you really want an item, just write your bid number opposite the amount labeled “Guaranteed Purchase” and you own the item. Once you write your bid number on the “Guaranteed Purchase” line, the bidding on that item is concluded.

21. You may bid on any item in the silent auction until the section is closed. Bidding for items in the silent auction sections will close at the time posted. A silent auction official will circle the top bid number and amount. You can see if you are the successful purchaser by looking at the copy of the silent auc-tion bid form that is left in its place after the section is closed.

The open air market at the end of the street is in the top ten in Paris. Vibrant nightlife is just a block away on rue Roquette and other nearby streets. L-05 Little Lending Library This handcrafted cedar lending library will boost the curb appeal of any home. Local master carpenter, Ryan Desimone, made this library from 100% repurposed materials. Desimone uses reclaimed old fence boards - painstakingly milled down and sanded, and finally treated with exterior varnish to prevent leaks. This tiny home for books features a real shingle roof, complete with Tyvek underneath, and designed to resemble an open comic book. The sides are painted with chalkboard paint, and the library comes complete with chalk so the owner can personalize it with a favorite quote (or lawyer joke). Procured by Heather Straub.
