Should I list my houseover Christmas?

Tis the season to be jolly...but isit the season to sell property?One of the most sought after

house selling tips is “when is the besttime to sell my property?” and when itcomes to discussing Christmas, opinionsare divided. This is because there are bothadvantages and disadvantages to sellingyour property over the holidays.

One major practicality issue is thefact that many people choose theChristmas break to go on vacation. Anobvious consequence of this would be areduction in the number of potential buy-ers, but don’t overlook the possibility thatyour real estate agent might be takingsome time off too! It is important toensure that you have all your resourcesavailable to you if you plan to sell yourhouse during this period.

The buyers who do continue to scoutthe market over the holidays may be sus-picious of your house-selling motiva-tions, wondering why you are devotingyour time to getting rid of the propertyrather than opting to relax with your fam-ily. They might assume that you are in adesperate situation and need to sell yourhouse quickly to relieve yourself of afinancial debt or because you havealready bought another home. If theybelieve that you are impatient to sell,buyers are more likely to make offerslower than the asking price with the resultof either diminishing your profits orneedlessly dragging out negotiationsuntil you are satisfied.

However, others may argue that sell-ing your property during Christmas canactually attract a better price for yourhouse. During the holidays, the numberof houses on the market decreases, reduc-ing competition between sellers andincreasing competition between buyers.As buyers bid to secure your home forthemselves, they may end up offering farmore than you originally asked. Peoplewho seek properties during the holidaymonths are usually fairly serious about

purchasing and it is likely that you willmake a quick sale as most buyers wouldwant to have moved in and settled beforethe new year.

Christmas can also enhance theattractiveness of a property, not onlybecause the first month of summer willprovide a bright, sunny setting for yourhouse but also because the festive seasoncan make your home seem even moreinviting. You can use this to your advan-tage by using some simple staging tips toguide your Christmas decorating efforts.

Choose tasteful decorations and usethem sparingly. In preparing your homefor sale, you have probably removed a lotof clutter and you don’t want to undo allyour hard work by replacing it with anexcess of decorations. You are aiming tocapture the holiday spirit whilst givingthe illusion that your home is larger andmore spacious than it really is.

As such, try and replace your usualhuman-sized Christmas tree with some-thing smaller, perhaps a table-top treewhich can double as a centrepiece on thesideboard. If you are an avid fan of ban-ners, try opting for a more natural themeby using evergreen garlands instead.Pack away any presents which may belaying around or restrict them to one cor-ner in an attractive arrangement (tryusing groupings of 3 or 5). Try and keepreligious items to a minimum; you wantthe buyer to visualise themselves livingin your home and this can be difficult ifthey are constantly being bombarded byreminders of your beliefs. Removing reli-gious items will also serve to protect yourprivacy.

Putting your home up forsale can be a tough deci-sion, but once made and

the ball is rolling, you may not beable to change your mind. Lastweek’s column about a $3.3 millionhome sale that went wrong for theseller prompted several relatedquestions from readers. Here theyare:

Is there a buyer’s remorse period

in Ontario?

If you are buying a new condo-minium from a builder, you have 10days to change your mind. You donot need a reason. This does notapply if you buy a new house froma builder and does not apply if youare buying a resale home or condo-minium. Why condos only? Theclause is included in theCondominium Act.

Can a buyer sign an offer and

then walk away?

The Ontario real estate contractgives a buyer 24 hours to pay the

deposit, once the offer is acceptedby the seller. The buyer cannot justchange their mind or they can besued.

For example, the buyer offers$300,000 for a house which isaccepted. The buyer changes hismind and doesn’t pay the depositand walks away from the deal. Theseller resells the property for$275,000. They can still sue the firstbuyer for the difference, or $25,000.

Can buyers use conditional

clauses as escape hatches?

Most real estate contracts areconditional on the buyer being ableto get a mortgage and being satis-fied with a home inspection. Otherconditions include being satisfiedwith a condominium status certifi-cate when buying a resale condo.

Many buyers think these condi-tions give them the right to justchange their minds. It is not thateasy. The case law has demonstrat-ed that buyers must try and satisfyany condition in good faith. Thismeans that you need a legitimatereason why you found the homeinspection report or condominiumstatus certificate unsatisfactory.

Who gets the deposit when

buyers change their mind?

In most cases, the deposit isheld by the seller’s real estate bro-kerage, in trust. Under the law,when a deal breaks down, the bro-kerage cannot pay the deposit to

anyone without either a mutualrelease or direction signed by boththe buyer and the seller, or an orderof the court. As such, when deals donot close, if there is no agreement,the deposit can be locked up for along time, and the buyer will nothave access to it to make an offer onanother property.

Is there a “legal” way for a buyer

to get out of a deal?

It depends. If for example, therewas a right on your title for the Cityto access 20 per cent of your proper-ty for any reason, known as an ease-ment, and that was not disclosed tothe buyer, they can usually cancelthe agreement without penalty.However, there have been other

cases that indicate if there is a prob-lem with a city work order or titleproblem for which the seller canobtain title insurance to protect thebuyer, then the buyer cannot refuseto close. A buyer can also cancel ifthere has been substantial damageto the property before closing, suchas a flood that was not repaired. Youcan’t refuse to close if the oven isnot working.

The better answer in all of thesesituations is to be very careful andserious before you make any deci-sion to buy a home. Changing yourmind later can be very expensive.

Amatrimonial home isrecognized as a veryspecial asset by the law

in Ontario. That means that if thehome is sold, it will usually bedivided equally between the mar-ried couple, regardless who paid forit. Even if only the husband or thewife is on title to the property, it willtake both of them to agree in writingto sell it.

In 1993, David Debora bought acottage in Oro township, near Barrieas an investment. It was a 10,000square foot cottage on 5 and a halfacres of lakefront property. Hebought it through his company ofwhich he was the only shareholder.A year later, in 1994, he marriedMiriam Debora. They had been liv-ing together for seven years and hada child together in 1989.

The couple separated in 1995and started fighting over propertyrights and support. They did notsign a marriage contract when theymarried and the cottage which wasworth $840,000 at the time of theirmarriage was worth $1 million atthe time of separation.

If the cottage was an investmentproperty, then Miriam could haveclaimed up to 50 per cent of the gainin value of the cottage during theirmarriage, or 50 per cent of$160,000, which was $80,000.However, if the cottage was a matri-monial home, then Miriam couldclaim up to 50 per cent of the entire$1 million value or $500,000.

It was clear from court docu-ments that the couple used the cot-tage year round.

In a decision dated September 5,

2006, the Ontario Court of Appealconfirmed that even though theproperty was owned by a company,since David controlled the compa-ny, he in fact owned the cottage. Asa result, Miriam was able to collect$500,000, since the property wasused as a matrimonial home at thetime they separated.

If David had wanted to protecthimself, he should have askedMiriam to sign a marriage contractbefore they married. In it, she couldhave agreed not to make a claim onthe cottage, or limit any claim to theincreased value after the marriage.

A couple can have more thanone home considered as a matrimo-nial home, as long as they use itwith their family during the year. Soif you have a home in the city, asummer home and a chalet for ski-ing, all three can be considered mat-rimonial homes and the same rulesapply to each property.

However, let’s say you bought ahome and then got married. On thedate you got married, the house wasworth $300,000. You lived in it forfive years as your matrimonialhome, but then you bought a secondhouse that you moved into together.The first house is now used as arental. It is still in your name.

While you will own the secondhome together as a matrimonialhome, the first house will no longerbe considered a matrimonial home.Therefore, if you later split, you willstill be able to get credit for the full$300,000 that your house was worthon the date of the marriage, and youwill only have to split the gain withyour spouse.

When it comes to selling ahouse after the parties have separat-ed, similar rules apply. Even if thehouse is registered in only thewife’s name, the husband will haveto give permission to the sale, evenif he moved out a long time ago, ifat the time of separation it was theirmatrimonial home and they are stillnot divorced or have not signed aseparation agreement.

These rules do not apply if youare not married. If you are living ina common-law relationship andonly one person is on title, then that

is the only person who needs to signto sell the home. You must get yourname on title to protect your interestin any property if you are not mar-ried.

If you are not sure who has tosign for the sale of your home,always get legal advice first so thatall proper parties sign your agree-ment. It will save a lot of stress later.
