Christmas will be here soon and the Grinch is still holding most of our wallets hostage. Predictions for this holiday sales season run the gamut, with the ICSC forecasting a 1.8% increase over 2008 and the National Retail Federation expecting a 1% drop from last year’s sales figures, while ShopperTrak is anticipating

a 4.2% drop in shopper traffic. These numbers don’t look so bad until you see the drop of 2008 against 2007 with an actual drop of 3.5% in sales and a 15.4% drop in shopper traffic. Aggregating two years of declines in holiday sales could be the last nail for lots of mom and pops, along with a few regional chains. While shoppers stay away from cash registers like they’re carriers of the swine flu, retailers are getting aggressive in cutting their prices and by cutting out the dead weight by closing stores and backing out of proposed locations. For example, Target is closing four stores after laying off 600 employees at its headquarters and shutting down a distribution center. The company is also nixing proposed sites and selling land back to developers even if they incur a loss. CIT filed for bankruptcy, adding yet another factor to a challenged retail climate. Thank goodness it held off to file until most of its retail borrowers had already ordered their Christmas merchandise, otherwise thousands of retailers wouldn’t have been able to buy holiday inventory. CIT’s fate is still a big unknown, as are a number of foreclosed shopping centers on its balance sheet.

In preparation for our issue that will be distributed at the ICSC’s convention in New York, I’ve been talking to developers and retailers throughout the East Coast to get a feel for their perspectives on the market. Although, many proposed second phases and empty existing spaces of shopping centers continue to sit idle in wait of better days, there has been some good news, especially on the East Coast. An investment group sold 24,700 sq.ft. of retail space at the St. Regis Hotel in New York, NY for $117 million, yep – at $4,735 psf with a 5% Cap. Massage Envy is partnering with Murad, a manufacturer of a well-known line of skincare products, to open Massage Envy Spas and rebrand some existing locations. The partnership could see as many as 150 openings to add to the franchised chain’s 44 existing Spa units. Easy Shopping Department Store signed a 10-year lease for 9,300 sq.ft. in Harlem, NY and will open the chain’s third New York location next year. Costco recently opened at the 485,000 sq.ft. East River Plaza in East Harlem, NY (projected sales for Costco are $2,000 psf) and will be joined next year with Target, Best Buy and Marshalls as co-tenants. Modani, a Miami-based wholesaler of modern furniture with one store operating, is opening a location in New York, NY this month with plans for future locations in Boston, Atlanta, Chicago and Philadelphia. The City of New York just agreed to buy seven acres in Coney Island for $95.6 million from Thor Equities. The site was intended to be a recreation/shopping destination but after years of squabbling the iconic amusement area will remain just that, while Thor plans to pursue developing about five acres that wasn’t part of the sale into retail and hospitality uses. Fairway Market plans to open a 75,000 sq.ft. supermarket at the Post Road Plaza in the Westchester,

NY market next year and continues to look for future sites within a 100-mile radius of New York, NY. On the other side of the Hudson River, Ulysses Diversified locked in $4 million in financing recently to build a 40,000 sq.ft. center, called Shoppes by Walmart, in Vineland, NJ. I know it’s not a big financing deal, but it proves that you can find funding for smaller new construction projects. The Vineland site, which sits in front of a Walmart Supercenter and is controlled by a 98-year ground lease, will see construction start next year with Planet Fitness and Gamestop as its first two tenants. A&P is in eleventh-hour negotiations on leasing a former IGA supermarket for its Food Basics concept in Atlantic City, NJ with the help of the state’s Casino Reinvestment Development Authority freezing the landlord’s payments on a $1.3 mortgage along with the possibility of a five-year tax abatement to make the deal work. The site has had two supermarkets fail within the past eight years and the area is so crime ridden that local authorities are pushing to have a police substation inside A&P. Signature Properties of New Jersey recently won planning board approvals to build a 43,000 sq.ft. Whole Foods Market in Closter, NJ at a dilapidated center, which will be renamed to Closter Town Square and undergo renovations.

REITs are starting to make acquisitions again, too. Kimco recently acquired a portfolio of 21 shopping centers, with projects in New Jersey and New York, from DRA Advisors for $175 million cash, plus $564 million in assumed non-recourse debt and $50 million in preferred stock. Equity One recently bought the 400,000 sq.ft. Westbury Plaza in Long Island, NY from Kimco/DRA for $104 million. New York-based Global Brands is in the works to qualify as a REIT and change its name to Gerrity REIT with the intent of acquiring grocery and drugstore-anchored centers in the western U.S., so they won’t be competing with buyers looking on the East Coast. Vornado raised $1.2 billion this year and is expected to be in a buying mode next year, but expectations may be just that, since it has $2.7 billion in unsecured debt that could become due in 2011. Retail Opportunity Investments Corp. plans to qualify as a REIT and go on a shopping spree of necessity-based retail centers on the East Coast. Blackstone Group, a private equity conglomerate, is making a move to buy two centers from Glimcher Realty Trust in a deal that would require $66 million in cash and assuming $124 million in debt. A few months back, Blackstone was touting that it had $12 billion to invest, so if you’ve got institutional-grade centers to sell maybe it’s worth a call. I think the next big wave of centers that will be sold in the next few years are the ones that are being foreclosed. The foreclosures may not be just little projects, since there is a lot of debt coming in 2011 and 2012 that some developers and REITs won’t be able to renegotiate with their lender or sell assets fast enough to make the payment. I think the bad times are just starting to turn, but it’s not going to be clear sailing for a few more years.

Boutiques are as familiar to New Yorkers as taxis and tourists. The streets of SoHo, the Meatpacking District and Madison Avenue are packed with many small shops, each offering something unique and different. In the lower Westchester area of Yonkers, NY, Royal Properties, Inc. is a boutique full-service firm serving clients throughout the tri-state area.

David Landes founded Royal Properties, Inc. as a property owner/manager firm in 1993. Jeff Kintzer joined the company in the late 1990s having spent the previous five years as director of leasing with Macy’s. The two are principals and partners in the company that has grown under their guidance into a full-service brokerage firm servicing NY along with CT and NJ. They oversee a nimble team of real estate professionals that includes Scott Meshil, vice president and Craig Benson, vice president. Kintzer says, “Scott and Craig have proven integral to the business.” He also notes that many seasoned real estate professionals are looking for a different working environment as the economy continues to pummel the industry. To that end, the company recently hired Alan Mounty as senior vice president and brought on an additional leasing agent. He postulates that the company may hire an additional senior broker.

The company is a full-service brokerage firm, but it does not suffer from the rigid departmentalization that many of its competitors do. “We have a team approach to everything we do,” Kintzer says. “We trade on information, and we all need to know what everyone else is doing in the office.” He notes that this is often in direct contrast to other companies, where individuals keep things close to the vest due to fears of encroachment or poaching. This “all hands in all pots” approach is a sign of the company’s flexibility, as he says, “Some of our team may focus on one division over another, but they know that can change in a moment’s notice.”

Royal Properties, Inc. has recently begun to handle property management, something Kintzer says was a comfortable transition. “We have a wealth of knowledge within our team, in both store and center operation. We know how a center runs - from managing staff to managing deliveries,” he says, adding, “Brokers don’t have the same responsibilities

and priorities that a long-term property manager does.” The company took over the management of several properties located in Rockland County, NY during the summer, adding them to the portfolio of properties it already manages in Norwalk, CT; NJ and Westchester County, NY. He also notes that the influx of property management contracts provides a steady income; a welcome addition in the current economy.

Kintzer emphasizes the importance of a proper leasing strategy in slow times, noting the balance that many landlords can miss when times get tough. He says, “Landlords seemingly have been forced by the economy to look at short-term profitability and, by taking on too much of one type of tenant or making the wrong type of lease, hurt their center’s long-term viability.” This reinforces the importance of a long-term property manager and broker working together, a synergistic relationship aided by the company’s in-depth knowledge in both fields. He says, “We don’t have landlords coming back to us after two years wondering what happened.” He notes that the advising of, and dealing with, landlords remain a mixed bag. He says, “In nearly every interaction with a landlord, whether they are a landlord we represent or the landlord we are dealing with in a tenant representation situation, the continued line is ‘You are not going to get the same rents of a year ago.’ Credit is king, though, so if you bring a high-quality tenant with good credit, some landlords may take a haircut to land them.”

With the staff’s wealth of experience on retailer and landlord matters, Royal Properties, Inc. makes a natural tenant representation firm. Kintzer has negotiated more than 250 leases in his 11 years with the company and an additional 125 store-within-a-store leases. In every tenant representation relationship, the company will recommend markets and sites to its clients, but he says every client varies in their reaction to the advice. He says, “Verizon Wireless, which David (Landes) is working with, takes a very corporate, very researched approach and brings their own demographic and service data to the table in determining where stores should be. Subway, another of David’s clients, is much more creative when trying to cover a market. If the market is desirable to them, they have shown themselves to be extremely flexible with

space.” He notes that the majority of tenant activity that the company has seen recently is from smaller tenants, ranging from mom and pop operations to regional tenants.

In addition to property management and landlord and tenant representation, the company also handles the sale and acquisition of properties. Kintzer says, “This has been a lagging part of our business, but the influx of new brokers in the company is helping grow the sector.” He says “Distressed properties are the primary focus of what is on the market right now, and I don’t think we’ve seen the worst yet.” He notes that dropping rental rates are lowering the price that can be asked for a property, as are non-credit tenants that many landlords are installing to fill vacancies left by bankrupt national chains.

Kintzer admits that this is a trying time for any business, but insists that there are opportunities to succeed for those who are willing to work for it. Even in a market as saturated as the New York metropolitan area, he notes there are pockets where the coverage is not there. To that end, the company has done five deals within the city during the past year. He says, “It is important for us that we maintain our integrity and our honesty. We don’t ever want to reach a point where we are so stretched, coverage-wise, that we can’t conduct our business on the level our clients expect.” He reinforces the importance of integrity to the company’s business model and says, “Landlords appreciate our integrity and honesty, especially in economically-depressed times. Knowing who you can trust becomes a commodity, and keeping a client’s trust only boosts the synergy we like to maintain with each other and our clients. This is a real time for us to shine and make our mark.”
